AnyfacultymemberhastheauthoritytorestrictastudentfromaclassroomorotherinstructionalareaforthedurationofthescheduledinstructionalperiodinwhichaviolationoftheStudentCodeofConducthasoccurred.Facultychairpersonshavetheauthoritytorestrictstudentsfromspecificclasses,otherinstructionalactivities,andfacultyoffices,pendingresolutionofaspecificdisciplinarycomplaintofferedinwritingtotheVicePresidentforStudentAffairsandDeanofStudentsortheVicePresidentforAcademicAffairsandDeanoftheCollege.Shouldastudent’spresenceoncampuscreateathreattothesafetyorwell‐beingofothermembersofDaemenCollegecommunity,theCollegereservestherighttoimmediatelysuspendthatstudentfromcampusuntilthetimeofahearing.Additionally,theCollegereservestherighttoresolveacaseandsanctionastudent,includingsuspension,withoutahearingwheresuchactionisdeemednecessaryorappropriatebythePresidentoftheCollege.NothinginthisCodeofConductprecludesafacultymemberfrompromptlyremovingadisruptivestudentfromhis/herclassroomfortheperiodoftimeneededtoeffectivelyresolvetheissueandensureasafeclassroomenvironmentthatisconducivetotheacademicstandardsoftheCollege.JurisdictionoftheCollegeConductSystemTheCollegeConductSystemwillhearcomplaintsconcerningviolationsofCollegepolicyorregulationswhenevertheconductinquestionoccursinanyofthefollowingcircumstances:
1. IfitoccursonthecampusorinanyCollegefacility;
2. IfitoccurswhilethestudentwhoischargedwasattendingorparticipatinginanyCollege‐relatedactivity,includingbutnotnecessarilylimitedto,studyabroad,fieldtrip,experientiallearningofanykind(includinginternships,clinicalplacements,andservicelearning),socialevent,activitysponsoredbyarecognizedstudentorganization;or
3. Iftheconduct,wheneverandwhereveritoccurs,includingviaonlinemedia,callsintoquestionthestudent’ssuitabilityasamemberoftheCollegecommunity.Unlawfulactsofviolence,violationsofanother’scivilrights,hazing,theunlawfulsaleorpossessionofdrugs,theunlawfuluseofalcoholicbeveragesandcrimesagainstpersonsorproperty,and/orallegedviolentfelonyoffenses,areexamplesofconductthatwillsubjectastudenttotheconductreviewsystemregardlessofwheretheconductoccurs.Incasesinvolvingstudentbehavioralproblemsthatoccuroffcampus,theCollegereservestherighttoinitiatedisciplinaryactionintheinterestofpreservingitsreputationandorderlyfunctioning.Thefactthatastudent’sconductmayalsoconstituteacrimeinviolationoflocal,state,orfederallawdoesnotlimittheabilityoftheCollegetodisciplinethestudentforthatconduct.TheCollege,therefore,reservestherighttosubmitacomplainttotheconductreviewsystemevenifthesameconductisormaybecomethesubjectofacriminalcase.
StudentCodeofConductInadditiontothepolicieslistedinvarioussectionsofthestudenthandbook,DaemenCollegeStudentCodeofConductoutlinesbehaviorsthatareprohibitedattheCollege.Thespecificitemsarenotmeanttoserveasanexhaustivelist,butasageneralguidelineforaddressingstudentbehavior.TheCollegereservestherighttoaddressotherbehaviorsthatoccurthatareconsidereddetrimentaltothelearningenvironmentand/orhealthandsafetyoftheCollegecommunity.Tothatend,prohibitedbehavioratDaemenCollegeincludesthefollowing:
1. Non‐academicdishonesty,including,butnotlimitedto,theft,attemptedtheft,possessionofstolenproperty,forgery,andfalsificationofinformationprovidedtoanyCollegeofficial;
a. Lying:anystatement,action,orbehaviorwiththeintenttodeceive.b. PossessionoruseofafakeID.c. Stealing:knowinglytakinganitemoritemswithouttheowner’sexpressedpermission.d. Eludingorevading:anystatement,action,orbehaviorwiththeintentofhidingthetruth,including
runningorhidingfromCollegepersonnel.e. Aidingandabetting:knowinglyencouraging,assistingandorbeinganaccessorytoanyactprohibited
bytheStudentCodeofConduct.
2. Conductwhichthreatensthephysicalorpsychologicalhealthand/orsafetyofanyperson(includingthepersoncommittingtheact)orthesanctityofthecampus,including,butnotlimitedtophysicalorsexualassault;
a. DatingViolence:violence,whetherphysical,sexual,orthethreatthereof,committedbyapersonwhoisorhasbeeninasocialrelationshipofaromanticorintimatenaturewiththevictim.
b. DomesticViolence:afelonyormisdemeanorcrimeofviolencecommittedbyacurrentorformerspouseorintimatepartner,acohabitatingpartner,oranotherpersonwithwhomthevictimsharesachild;

object,fondling,incest,orstatutoryrapeasusedintheFBI’sUCRprogram;e. Stalking:anyact,whetherviaphone,internet,orphysicalproximity,that,throughunwantedand/or
unsolicitedviewingorcommunicating,threatensanindividual’sphysicaloremotionalsafety.f. PhysicalAttack.g. Hazing.h. Harassment:anyact,whetherwrittenorverbal,viaonlineorinperson,thatabuses,intimidates,or
threatensthesafetyofamemberoftheDaemenCollegecommunity.i. Failuretomaintainpersonalhealth,whetherphysical,mentaloremotional,insuchawaythatit
threatensthesafetyandsecurityoftheindividualortheCollegecommunity.j. Useorpossessionoffirearms,fireworks,orotherweaponsthatcouldbeconsideredlethal,including
thoseweaponsforwhichthepersonhasapermit.
3. Damagetoormisuseofpublic,private,personalorCollegeproperty;a. PropertyDamage,eithertoanindividual’sortheCollege’sproperty.b. Removingapprovedpostingsand/orOfficeofResidenceLifenoticesorbulletinboards.c. Littering,applyinggraffiti,and/orotherbehaviorwhichthreatenthecleanlinessandappearanceofthe
College.d. Useoffireequipment,includingsprinklers,extinguishers,and/orhoses,inanymannerforwhichit
wasnotintended.e. Defenestration:throwingobjectsoutsideofwindoworfrombalconyorroof.
4. ViolationofpoliciesasdescribedintheStudentHandbook,theCourseCatalog,theHousingAgreementandall
otherrulesgoverningCollegefacilities,programsandservicesincluding,butnotlimitedtothefollowing;a. ViolationofResidenceLifepolicies(seeResidentialLivingpoliciessection)b. Purchase,possession,use,saleordistributionofalcohol,exceptbyconsumersoflegalageandin
compliancewiththeCollege’salcoholpolicyc. Possessionoruseofalcoholparaphernalia.d. Distributionorattempteddistributionofalcoholtoanypersonunderthelegaldrinkingagee. Distributionorattempteddistributionofadrug,includingprescriptionmedication.f. Illegaluseorpossessionofadrug,includingprescriptionandover‐the‐counterdrugs.g. Manufacturingofanydrug,includinggrowingmarijuanaforanypurpose.h. Possessionoruseofillegalorsomeoneelse’sdrugsand/ordrugparaphernalia.i. Accessingprohibitedareasintheresidencehalls,includingbutnotlimitedto,fireescapes,balconies,
andbasements,exceptinanemergency.
5. Intentionalobstructionordisruptionofteaching,research,administration,disciplinaryprocedures,otherCollegeactivitiesoractivitiesauthorizedtotakeplaceonCollegeproperty.
6. Disorderlyconductincludingactswhichbreachthepeace;a. Disruptivebehavior.b. Unauthorizedentry,whetherpeacefullyorbyforce,intoaprohibitedareaorresidencehallapartment
inwhichthereisnodocumentedreasonforbeingpresent.c. Urinatinginpublic.
7. Non‐compliancewiththedirectionsofCollegeorcivilauthoritiesperformingofficialduties,includingfailureto
giveproperidentificationwhenrequested.
8. Violationofastudent’srightsorprivilegesandverbalorwrittenharassment,discrimination,abuseand/ordisrespectofanyperson;
a. Harassment:anyact,whetherwrittenorverbal,viaonlineorinperson,thatabuses,intimidates,orthreatensthesafetyofamemberoftheDaemenCollegecommunity.
b. Actsorabusivelanguage,eitherinpublicorviaonlinesources.
9. Violationofstatutes,laws,ordinancesand/orregulationsoftheTownofAmherst,StateofNY(orotherstates,whenapplicable)andtheUnitedStatesofAmerica.

CRIMEREPORTINGPROCEDURES/POLICYDaemenCollegestrivestomaintainasafecampusandreliesonallmembersofthecampuscommunitytodotheirparttokeepthecampussafe.Anymemberofthecampuscommunity—faculty,student,staff,trustee—whoobservescriminalactivityontheDaemenCollegemaincampus,oratanyoff‐campusinstructionalsite,isexpectedtoreportsuchconductpromptlytothepoliceandtoCampusSafetyorbuildingsecurity.Additionally,theCollegehasdesignatedcertainemployeeswhohavesignificantresponsibilityforstudentandcampusactivities,and/ortheauthority/dutytoactorrespondtoaparticularissueonbehalfoftheinstitutionasCampusSecurityAuthorities(CSAs)andResponsiblePersonsuponTitleIXoftheEducationalAmendments(1972).Criminalactivityincludes,butisnotnecessarilylimitedto:physicalassault,includingsexualassaultandabuse,burglary,robbery,arson,unauthorizeddisplayoruseofadangerousweapon,andtheillegaldistributionormanufactureofcontrolledsubstances.Ifcommunitymembersobserveacrime,theyareinstructedtophone911immediatelyandfollowtheinstructionsofthepolice.Immediatelyafternotifyinglocalauthorities,itisexpectedthatnotificationswilloccurtotheOfficeofCampusSafetyat716‐839‐8246(MainCampus),716‐831‐6000(CollegiateVillage),or716‐835‐3366day/716‐860‐4114after5:00pm(Tri‐MainCenterCampusemergencymonitoringservice).Incaseofanemergencyduringoff‐siteathleticpracticesorgames,studentsaretoreporttotheattendingcoach,assistantcoach,orathletictrainer.Incaseofanemergencyduringoff‐siteacademicfunction,studentsaretoreporttotheinstructor.Anycrimedirectlyinvolvingamemberofthecampuscommunity,whetherasvictimorallegedperpetrator,shouldalsobebroughttothepromptattentionoftheOfficeofCampusSafety.Additionally,thereareoccasionswhenminors(personsunder18yearsofage)areontheDaemenCollegecampusorinvolvedinCollegeevents.Anypersonwhoobservesthesexualabuseofaminor,orhasareasonablesuspicionofsuchabuse,areexpectedtoimmediatelynotifyCampusSafetyandthelocalpoliceauthorities(call911).AcallmayalsobemadetotheNYSChildAbuseHotlineat1‐800‐342‐3720.AnysuchconductinvolvingaDaemenstudentoremployeeshouldalsobebroughttotheattentionoftheOfficeofCampusSafetyand/ortheOfficeofHumanResources.Thepromptreportingofcriminalactivityisessentialtosecuringasafecampusenvironmentforallpersons,includingguestsandmembersofthepublic.Nooneisexemptfromtheexpectationoflaw‐abidingbehavior.ThereshallbenoformofretaliationwithintheDaemenCollegecommunityagainstanypersonmakingagoodfaithreportofsuspectedcriminalactivity.Individualstowhomstudentsandemployeesshouldreportcriminaloffensesdescribedinthelawforthepurposeofmakingtimelywarningreportsandannualstatisticaldisclosureare:

MemorandumofUnderstandingsDaemenCollegemaintainsaclose,professionalrelationshipwiththeAmherstPoliceDepartment,aswellasotherlocalagencies,aswellaslocaladvocateagenciessuchasCrisisServicesofBuffalo.AformalMemorandumofUnderstandingisindevelopment,buthasnotcurrentlybeenfinalized.CRIMEPREVENTIONANDSECURITYAWARENESSPROGRAMSEducationDaemenCollegehasaTaskForcethatmeetsoncepermonthduringtheyeartodiscussandplanwellnesseducationprogrammingandawarenessthroughouttheyear.Thefocusofthiscrosscampuscollaborationcomprisedoffaculty,staff,students,andoutsideagencies,andchairedbytheVicePresidentforStudentAffairs,istoexaminehealthywaystoaddresssubstanceabuse,dating/domesticviolence,andotherwellnessissuesinaconcertedandintentionalmanner.Allnew,incomingstudents,includingfirst‐yearstudents,transfers,andgraduates,arerequiredtocompletetheThinkAboutItprogrambyCampusClarity.ThinkAboutItcombinessexualassaultandsubstanceabusepreventioninacomprehensiveonlinetrainingprogram.Studentsandtheirfamiliesareprovideddetailedinformationaboutthisprogramduringsummerorientationprogramsandaresentnumerousremindersthroughoutthesummerinpreparationforthestartofthesemester.Studentswhofailtocompletetheprogramaresubjecttoafine.Additionally,theCollege

SummaryofEducationProgramsInadditiontotheaforementionedtrainingandeducation,theCollegecompletesyearroundtrainingthroughpassivecampaignsaroundtopicssuchasknowingthecodeofconduct,cyber‐bullying,reportingsuspiciouspersons,andreportingstudentconcerns.TheCollegealsoconductsregulareventsthroughclubsandorganizationsthatfocusonawareness,acceptance,andcreatinganenvironmentthatisfreeofhostility.Additionally,theCollegeconductssemi‐annualfiredrillsandtabletopexercisesfortheEmergencyResponseTeam,aswellasregulartestsofthetextalertsystem.SEXUALVIOLENCEANDASSAULT(INCLUDINGSEXUALHARASSMENT)Afterresponsibilityhasbeenassignedthroughinvestigationandhearing,asoutlinedintheConductReviewprocedures(Section7)oftheStudentHandbook(www.daemen.edu/studenthandbook),allperpetratorsofsexualassaultwillbeaggressivelysanctioned,inaccordancewiththestandardsoutlinedbytheStudentCodeofConduct.TheCollegewillworkinclosecooperationwithlocallawenforcementagenciestoaddressthisseriouscriminalactivity.DaemenCollegewillthoroughlyinvestigatethisviolationofindividuals'rightsandsafetywhenreported.Inaddition,theCollegemayterminatetheenrollmentand/oremploymentofanyperpetratorofsexualassault,includingsummarilysuspendingtheviolatortoprotecttheCollegecommunity.Theinstitutionwillchangeavictim’sacademicandlivingsituationsafteranallegedsexoffenseifthesechangesarerequestedbythevictimandarereasonablyfeasible.Studentsareprovidedwitheducationalprogrammingtopromotetheawarenessofsexualviolencepreventionasindicatedpreviouslyinthisreport.Informationisprovidedtothecampuscommunitythroughnewstudentorientation,residentassistanttraining,residentstudenteducationprogramming,aswellasthroughapplicablehandbooks(faculty,staff,administration,andstudent).PossibleSanctions/AppealsIncidentsofsexualviolence,datingviolence,domesticviolence,stalkingand/orsexualassaultaretakenveryseriouslybyDaemenCollege.Uponcompletionofathoroughinvestigationandhearing,asoutlinedintheStudentCodeofConduct,astudentwhoisfoundresponsibleforsuchacrimecouldfacesuspensionorexpulsion.Investigationsthatarehandledinformallymayresultintheuseof“educationalsanctions”asdeemedappropriatebythematterandinconsultationwiththeTitleIXCoordinator.Astudentmaynotbefoundresponsibleforoneofthecrimesmentionedabove,butmaybefoundresponsibleforotherviolationsoftheCodeofConductwhichcouldincuradditionalsanctionsandfines,asoutlinedinthestudenthandbook.TheCollegewillimposeinterimsanctionssuchasOrderofNoContact,PersonaNonGrataOrders,roomassignmentchanges,etcetera,inordertoensurethesafetyofthecommunityandtheindividualreporting,without“punishing”thestudentwhocameforward.Inmattersthatarebeingaddressedconcurrentlythroughthecriminaljusticesystem,wherearespondentisadvisedtonotparticipateinthecampusprocess,orwhereitseemsappropriatebythecircumstancesoftheincidentasdeterminedbytheVicePresidentforStudentAffairsand/orhis/herdesignee,theCollegemayplaceastudentoninterimsuspensionpendingtheopportunitytocompletetheinvestigationandconductprocess.Boththecomplainantandrespondenthavetheabilitytoappealsanctionsbasedonthecriteriaoutlinedinthestudenthandbook.InaccordancewithNewYorkStateLaw,appealsofincidentsofsexualviolence,datingviolence,domesticviolence,stalkingand/orsexualassaultwillbeheardbyapanelascoordinatedbytheOfficeoftheVicePresidentforStudentAffairsinconjunctionwiththeTitleIXCoordinator.Theinstitutionwill,uponwrittenrequest,disclosetotheallegedvictimofacrimeofviolenceoranon‐forciblesexoffense,thereportontheresultsofanydisciplinaryproceedingconductedbytheinstitutionagainstastudentwhoistheallegedperpetratorofsuchcrimeoroffense.Iftheallegedvictimisdeceasedasaresultofsuchcrimeoroffense,thenextofkinofsuchvictimshallbetreatedastheallegedvictimforpurposesofthisparagraph.ConsentDaemenCollegedefinesconsentas“affirmativeconsent”(yesmeansyes),inaccordancewiththeNewYorkStateEnoughisEnoughlegislation.Affirmativeconsentisaknowing,voluntary,andmutualdecisionamongallparticipantstoengageinsexualactivity.Consentcanbegivenbywordsoractions,aslongasthosewordsoractionscreateclearpermissionregardingwillingnesstoengageinthesexualactivity.Silenceorlackofresistance,inandofitself,doesnotdemonstrateconsent.Thedefinitionofconsentdoesnotvarybaseduponaparticipant'ssex,sexualorientation,genderidentity,orgenderexpression.Consentmaybeinitiallygivenbutwithdrawnatanytime.Whenconsentiswithdrawnorcannotbegiven,sexualactivitymuststop.Consentcannotbegivenwhenapersonisincapacitated.Incapacitationoccurswhenanindividuallackstheabilitytofully,knowinglychoosetoparticipateinsexualactivity.Incapacitationincludesimpairmentduetodrugsoralcohol(whethersuchuseisvoluntaryorinvoluntary),thelackofconsciousnessorbeingasleep,beinginvoluntarilyrestrained,ifanyofthepartiesareundertheageof17,orifanindividualotherwisecannotconsent.Consentcannotbegivenwhenitistheresultofanycoercion,intimidation,force,orthreatofharm.

CampusSexualAssaultVictims’BillofRightsInaccordancewiththeCampusSexualAssaultVictim’sBillofRights(1992)andsection485oftheHigherEducationActof1965(revised2010),aswellasguidelinesprovidedbyNewYorkState,DaemenCollegehasimplementedthefollowingbillofrightsthatshallbeaffordedtoallvictimsofreportedcampus‐relatedsexualassaults.TheserightshavebeenadaptedforDaemenCollegefromthelanguageusedintheHigherEducationActandaredescribedinmoredetailthroughoutthissection.
1. Therighttohaveanyandalldisclosuresofdomesticviolence,datingviolence,stalking,andsexualassaultagainstthemtreatedwithseriousnessandreceive,fromtheinstitution,courteous,fair,andrespectfulhealthcareandcounselingservices,whereavailable.
2. Therighttohavesexualassaultscommittedagainsttheminvestigatedandadjudicatedbythedulyconstitutedcriminalandcivilauthoritiesofthegovernmentalentityinwhichthecrimesoccurred,ifthevictimsochooses,includingmakeareporttolocallawenforcementand/orthestatepolice;andtherighttothefullandpromptcooperationandassistanceofCollegestaffinnotifyingtheproperauthorities.Theforegoingshallbeinadditiontoanycampusdisciplinaryproceedings.
3. TherighttobefreefromanykindofpressurefromCollegestaffthatvictims:a. notreportcrimescommittedagainstthemtocivilandcriminalauthoritiesortocampussafetyand
residencelifestaff;orb. reportcrimesaslesseroffensesthanthevictimsperceivethemtobe.
4. Therighttobefreefromanykindofsuggestionthatsexualassaultvictimsnotreport,orunder‐report,crimesbecause:
a. victimsaresomehow‘responsible’forthecommissionofcrimesagainstthem;b. victimswerenegligentorassumedtheriskofbeingassaulted;orc. byreportingcrimestheywouldincurunwantedpersonalpublicity.
5. Therighttoparticipateinaprocessthatisfair,impartial,andprovidesadequatenoticeandameaningfulopportunitytobeheardandinsodoing,todescribetheincidenttoasfewinstitutionrepresentativesaspracticableandnotberequiredtounnecessarilyrepeatadescriptionoftheincident;
6. Thesamerighttolegalassistance,orabilitytohaveotherspresent,includinganadvisoroftheirchoice,inanycampusdisciplinaryproceedingthattheinstitutionpermitstotheaccused;andtherighttobenotifiedoftheoutcomeofsuchproceeding.
7. Therighttocounselingservicesfromanymentalhealthservicespreviouslyestablishedbytheinstitution,orbyothervictim‐serviceentities,orbyvictimsthemselves.
8. Aftercampussexualassaultshavebeenreported,thevictimsofsuchcrimesshallhavetherighttorequirethatappropriateCollegestafftakethenecessarystepsoractionsreasonablyfeasibletopreventanyunnecessaryorunwantedcontactorproximitywithallegedassailants,includingimmediaterelocationofthevictimtosafeandsecurealternativehousing,andtransferofclassesifrequestedbythevictims.
9. Accesstoatleastonelevelofappealofadetermination;10. Therighttoreportanyinappropriateaction,orlackthereof,inthehandlingofareportedsexualassaultonthe
partoftheCollegeasaTitleIXcomplaint.11. Beprotectedfromretaliationbytheinstitution,anystudent,theaccusedand/ortherespondent,and/ortheir
friends,familyandacquaintanceswithinthejurisdictionoftheinstitution;12. Exercisecivilrightsandpracticeofreligionwithoutinterferencebytheinvestigative,criminaljustice,or

Sexdiscriminationintheformofharassmentonthebasisofsexincludesunwelcomesexualadvances,requestsforsexualfavors,andotherverbalorphysicalcontactofasexualnaturewhen:a)submissiontosuchconductismadeeitherexplicitlyorimplicitlyatermorconditionofanindividual’semploymentoreducationstatus;orb)submissiontoorrejectionofsuchconductbyanindividualisusedasthebasisforeducationaloremploymentdecisionsaffectingsuchindividuals;orc)suchconducthasthepurposeoreffectofunreasonablyinterferingwithanindividual’sperformanceorcreatinganintimidating,hostile,oroffensiveworkingoreducationalenvironment.DaemenCollegewilltakeallstepsnecessarytopreventsuchdiscriminationandeffectivelyaddressincidentsofunlawfulharassment,includingtheimpositionofappropriatesanctions.Asexamples,thefollowingkindsofconduct,orotherswithasimilarharassingeffect,areabsolutelyprohibitedifsuchconductfallswithinthedefinitionstatedabove:
1. Abusinganemployeeorstudentthroughinsultingordegradingsexualremarks,jokes,innuendoes,orothersexuallyorientedconduct(including,amongotherthings,graphicordescriptivecommentsrelatingtoanindividual’sbodyorphysicalappearance,sexuallyorientedteasingorpranks,impropersuggestions,objectsorpictures,orunwantedphysicalcontact);or
2. Threats,demandsorsuggestionsthatanemployee’sorstudent’sstatusdependsinanywayupontoleratingoracceptingsexualadvancesorsexuallyorientedconduct.
3. Sexualviolence,definedasphysicalsexualactsperpetratedagainstaperson’swillorwhereapersonisincapableofgivingconsentduetothevictim’sage,useofdrugsoralcohol,orintellectualorotherdisability.
AnyharassmentofDaemenCollegeemployees,students,orapplicants,orthirdparties(suchasparticipantsinCollegesponsoredevents)inviolationoftheserulesisabsolutelyprohibitedandwillnotbetolerated.Interimprotectivemeasuresmaybemadewhileacomplaintisinvestigated.Bothcomplainantandrespondentshallbetreatedequitablythroughouttheinvestigation.Conductthatoccursoffcampus,includingbutnotlimitedtothatperpetratedelectronically,bysocialnetworkingoremail,isalsosubjecttoinvestigationandanappropriateresponseunderthePolicytotheextentthatsuchconductcontributestoasexuallyhostileenvironmentoncampus.Sexualharassmentisillegalunderbothstateandfederallaw.InquiriesregardingcompliancewithTitleIXandallotherstateandfederaldiscriminationlawsmaybedirectedtotheAssociateVicePresidentforAcademicAffairs(DS102,716.839.8301),whoistheCollege’sEqualOpportunityandAffirmativeActionOfficerandTitleIXCoordinator.
D. OtherUnlawfulHarassment.Unlawfulharassmentisdefinedasverbalorphysicalconductwhichdenigratesorshowshostilityoraversiontoanindividualbecauseofhisorhersex,sexualorientation,gender,race,color,creed,religion,veteranormilitarystatus,nationalorigin,age,disability,maritalstatus,domesticviolencevictimstatus,statusasanex‐offender,arrestrecord,predisposinggeneticcharacteristicsorgeneticinformation,oranyothercharacteristicprotectedbyfederalorNewYorkStatelaw,orthatofhisorherrelatives,friends,orassociates,andwhich:1. Hasthepurposeoreffectofcreatinganintimidating,hostile,oroffensiveworkingoreducational
environment;or2. Hasthepurposeoreffectofunreasonablyinterferingwithanindividual’sperformance;or3. Otherwiseadverselyaffectsanindividual’semploymentoreducationalopportunities.
Asexamples,thefollowingkindsofconduct,orotherswithsimilarharassingeffect,areabsolutelyprohibitedifsuchconductfallswithinthedefinitionstatedabove:

E. Retaliation.Retaliationagainstemployees,students,thirdparties(suchasparticipantsinCollegesponsored
events)orapplicantsforexercisingtheirrightsunderthispolicyisalsostrictlyprohibitedandwillnotbetolerated.Thisincludesretaliationagainstemployees,students,thirdparties(suchasparticipantsinCollegesponsoredevents)orapplicantsforinquiringabouttheirrights,orformakinganhonestcomplaintofaviolationorpossibleviolation,orfortruthfullyassistinginacomplaintinvestigation.ClaimsofretaliationshouldbereportedtotheAssociateVicePresidentforAcademicAffairs(DS102,716.839.8301),whoistheCollege’sEqualOpportunityandAffirmativeActionOfficerandTitleIXCoordinator.
F. NoOneHasAuthorityToViolateThisPolicy.Undernocircumstancesdoesanyfacultymember,administrator,trustee,otheremployee,orstudentoftheCollegeoranyotherperson,includingvendorsandsub‐contractors,haveanyauthoritywhatsoevertoengageindiscriminatory,harassing,orretaliatingconductinviolationofthispolicy.Ifanyoneclaimstohavesuchauthority,orifanemployee,student,thirdparty(suchasparticipantsinCollegesponsoredevents)orapplicanthasaquestionaboutwhetherobjectionableconductisauthorizedbytheCollege,theCollege’sEqualOpportunityandAffirmativeActionOfficerandTitleIXCoordinator(DS102,716.839.8301),shouldbecontacted.
G. AcademicFreedom.Asaninstitutionofhighereducation,DaemenCollege,itsemployeesandstudentsalsomustbeawareoftheneedforfreedomofinquiryandopennessofdiscussioninitseducationalandresearchprograms,andmuststrivetocreateandmaintainanatmosphereofintellectualseriousnessandmutualtoleranceinwhichtheseessentialfeaturesofacademiclifecanthrive.Nocollegecanorshouldguaranteethateveryideaexpressedinitsclassroomsorlaboratorieswillbeinoffensivetoall;pursuedseriously,educationandscholarshipnecessarilyentailraisingquestionsaboutreceivedopinionsandconventionalinterpretations.DaemenCollegedoesguarantee,however,thatcredibleaccusationsofinappropriateremarksorconductthatmayviolatetheCollegepolicyprohibitingdiscriminationandharassmentwillbeinvestigatedpromptly,thoroughly,andfairly.
H. Procedures.Employees,students,andapplicantsareencouragedtopromptlyreportanyconductthattheybelieveviolatesthispolicy.IftheCollegedoesnotknowabouttheconduct,itcannotact.ComplaintsorinquiriesshouldbemadeconfidentiallytotheAssociateVicePresidentforAcademicAffairswhoistheCollege’sEqualOpportunityandAffirmativeActionOfficerandTitleIXCoordinator.Inthecaseofstudent‐on‐studentconduct,complaintsorinquiriesshouldbemadeconfidentiallytotheVicePresidentforStudentAffairsandDeanofStudents(WickCenter,716.839.8519)forinvestigationandadjudicationundertheStudentConduct(Disciplinary)ProceduresoutlinedintheStudentHandbook.TheVicePresidentforStudentAffairsandDeanofStudentswillreportanyallegationsofTitleIXviolationtotheAssociateVicePresidentofAcademicAffairs.Alternatively,anindividualmayinitiallydiscussthematterwithanyotheremployeeoftheCollege,orinvolveanyotherpersontohelpinbringingthecomplaintforward,providedthecomplaintispromptlybroughttotheattentionoftheAssociateVicePresidentforAcademicAffairsorDeanofStudents,toensureconsistencyandcentralizeddecision‐makingintheapplicationofthispolicy.ComplaintsmayalsobemadeanonymouslythroughU.S.orcampusmailtotheTitleIXCoordinator,DaemenCollege,4380MainStreet,Amherst,NY14226.

A. Policy.ItisthepolicyofDaemenCollege,inaccordancewithfederalandstatelawsincluding,butnotlimitedto,TitleIXoftheEducationAmendmentsof1972,theCivilRightsActof1964,theRehabilitationActof1973,theAgeDiscriminationinEmploymentAct,theAmericanswithDisabilitiesActandtheNewYorkStateHumanRightsLaw,nottodiscriminateonthebasisofsex,sexualorientation,gender,race,color,creed,religion,veteranormilitarystatus,nationalorigin,age,disability,maritalstatus,domesticviolencevictimstatus,statusasanex‐offender,arrestrecord,predisposinggeneticcharacteristicsorgeneticinformation,oranyothercharacteristicprotectedbyfederalorNewYorkStatelawagainstanypersonwithrespecttoemployment,admissiontotheCollege,orinparticipationinanyCollegeprogramoractivity.Alsoinaccordancewiththeselaws,itisthepolicyoftheCollegetoprohibitharassmentofanystudent,employeeorapplicantonthebasisofthestatusesoutlinedabove.Allcomplaintsallegingaviolationofthispolicywillbeinvestigatedandappropriateremedieswillbeinstituted.
B. Responsibility.EverypersonintheCollegecommunityisresponsibleforcompliancewiththispolicy.TheAssociateVicePresidentforAcademicAffairsastheEqualOpportunityandAffirmativeActionOfficerhasbeengivenday‐to‐dayresponsibilityforimplementingthispolicy.
C. Grievances.AllgrievancesorcomplaintsallegingaviolationoftheCollege’snondiscriminationpolicyand
policyprohibitingunlawfulharassmentshouldbesubmittedtotheAssociateVicePresidentforAcademicAffairswhoistheEqualOpportunityandAffirmativeAction(EOAA)OfficerandTitleIXCoordinator(RoomDS102,716.839.8301).GrievanceformsareavailableintheofficeoftheEOAAOfficer,butanyformorformatmaybeusedprovideditisidentifiedasagrievance.Agrievanceshouldcontainastatementofthefactsidentifyingtheviolationandasmuchsupportingdocumentationaspossible.Uponrequest,assistanceinpreparingthegrievancewillbesuppliedbytheEOAAOfficer/TitleIXCoordinator.Thosefilingagrievanceshouldalsoexpresstheirviewofapossibleresolutiontotheproblem.Agrievanceshouldbefiledassoonaspossibleaftertheallegeddiscriminationhasoccurred(usuallywithin30days).AdelayinfilingagrievancemayimpacttheabilityoftheCollegetoinvestigateandresolvethegrievance.
D. GrievanceProcessing1. Step1.TheEOAAOfficer/TitleIXCoordinatorwillattempttoresolvethematterassimplyandasquicklyas
possiblebyinformallymeetingwiththerelevantpersonsinanefforttoreachanacceptableagreement.Ifthecomplaintinvolvesanallegedsexualassault,thematterwillimmediatelyproceedtoStep2below;noinformalmediationwillbeundertaken.CasesofallegedsexualassaultinwhichboththecomplainantandrespondentarestudentswillfollowtheproceduresoutlinedintheStudentCodeofConduct
2. Step2.UnlessanacceptableresolutionisreachedinStep1,thegrievantmayrequestthatthematterbereferredtotheappropriateCabinetmember(VicePresidentforAcademicAffairs[VPAA]inthecaseofafacultygrievant)foramoreformalinvestigation.Suchrequestmaybemadeatanytime,butnotlaterthanten(10)daysafternotificationthattheStep1procedureiscompleted.Withinthirty(30)daysthereafter,theCabinetmemberorVPAAorhis/herdesignatedrepresentative(GrievanceOfficer)willconductaninvestigationwithrespecttothegrievance.(ShouldthegrievancebeagainsteithertheEOAAOfficer/TitleIXCoordinatorortheCabinetmember,thegrievantshouldnotifytheDirectorofHumanResourceswhowillarrangeforanotherGrievanceOfficertobeappointed.)Effortswillbemadetocompletetheinvestigationwithin45daysafterStep2isinitiated.

willbemadetotheExecutiveCommitteeoftheBoardofTrustees,whichwillreviewandruleupontheGrievanceOfficer’sdecision.EMERGENCYRESPONSEPLAN–MAINCAMPUSTheDaemenCollegeEmergencyResponsePlanisintendedtoprovideneededdirectionandguidancetothecampuscommunityintheeventofanysituationwhichaffectsthenormaloperationofthecampus.ConsistentwiththeNationalIncidentManagementSystem(NIMS),DaemenCollegeutilizestheIncidentCommandSystem(ICS)toeffectivelyrespondtocrisesandconcerns.ChairedbytheVicePresidentforStudentAffairs(VPSA),thecampusEmergencyResponseTeam(ERT)meetsregularlyinordertoreviewandbecomefamiliarwiththeplan,conducttrainingexercisesforthecommunity,andensurethattheplaniscontinuallyupdatedandrevised.Regulartraininganddrillsareconductedon‐campuswithconsultationfromAmherstemergencyresponseservicepersonnel.Additionally,theCollegehasimplementedanAdministratorOn‐Call(AOC)systemtoensurethataseniorleveladministratorisinformedwheneverasignificantincidentoccursthataffectsthesafetyofindividualsorthecampusproperty.Thissystemisinplaceatalltimesregardlessofwhetherclassesareinsessionornot.GeneralEmergencyProceduresItisnotfeasibleorpracticaltodevelopanemergencyplanbasedoneveryincidentthatmayoccur.Eachsituationandcrisisisdifferent.Eventwosituationsofthesamenaturearedifferentincircumstance.Therefore,theDaemenCollegeEmergencyResponsePlanisbasedontheNationalIncidentManagementSystem(NIMS)andIncidentCommandSystem(ICS)asusedbyfederal,state,andlocallawenforcementandemergencyresponseagencies.ThepurposebehindICSistoallowforintegratedcommandofmultipleresponseagencies—toallowforeaseofcommunication,sharingofresources,andgreaterflexibilityinresponsebasedonthepersonnelatthesceneatthattime.TherearefivemajormanagementfunctionsthatarethefoundationuponwhichtheICSisbuilt.Thesefunctionsapplywhethertheteamisrespondingtoaroutineemergency,organizingforamajornon‐emergencyevent,ormanagingaresponsetoamajordisaster.Thefivemajormanagementfunctionsare:
IncidentCommand:Setstheincidentobjectives,strategies,andprioritiesandhasoverallresponsibilityattheincidentorevent.
Operations:Conductstacticaloperationstocarryouttheplan.Developsthetacticalobjectivesandorganization,anddirectsalltacticalresources.
Planning:PreparesanddocumentstheIncidentActionPlantoaccomplishtheobjectives,collectsandevaluatesinformation,maintainsresourcestatus,andmaintainsdocumentationforincidentrecords.
Logistics:Providessupport,resources,andallotherservicesneededtomeettheoperationalobjectives. Finance/Administration:Monitorscostsrelatedtotheincident.Providesaccounting,procurement,time
recording,andcostanalyses.
ICSfollowsthesefivemajormanagementfunctionsforanysituation,regardlessofthesizeoftheincident,WhentheICSisdeployed,thestaffmemberwiththemostexperiencetohandlethesituationatthattime,regardlessoftitle,rank,etcetera,isdeemedtheIncidentCommander.Inmostcases,thiswillbetheCampusSafetySupervisorforthatevening.Whenitisappropriatetoswitchcommand,theIncidentCommanderwillbriefthenextpersonandtransitioncommand.Asincidentsexpandorcontract,changeinjurisdictionordiscipline,orbecomemoreorlesscomplex,commandmaychangetomeettheneedsoftheincident.Rank,grade,andseniorityarenotthefactorsusedtoselecttheIncidentCommander.TheIncidentCommanderisalwaysahighlyqualifiedindividualtrainedtoleadtheincidentresponse.The

EachtenantoftheTri‐MainCenterisresponsiblefortheaccountingofallemployees.TenantEvacuationProceduresATENANTEVACUATIONPROCEDUREispostedintheTri‐MainCenterrooms.Theseproceduresidentifyeachtenant’sresponsibilityduringafireoremergencythatrequiresevacuationofthebuildingandanyemergencythatdoesnotrequireevacuation.IncludedintheseproceduresarethedefinedprogramissuescoveredinthiswrittenEmergencyAction/Evacuationprogram.AlsoincludedisafloorplanindicatingthenearestExitRoutefromtheTenant’spremisesandthenearestalternateroute(s).
Thetenantevacuationprocedureandnearestexitroutearetobemadeknowntoallemployeesandregularvisitorsandaretobepostedinaconspicuousplacewithinthesuite.
Eachtenantmustkeepanaccurateheadcountofallemployeesandvisitorsthatarepresentintheirworkplaceatthatparticulartime.AdesignatedemployeeofthetenantmustbeabletoprovideTri‐MainCenterstafforthefiredepartmentwithanaccuratecountofthenumberofemployeesandvisitorsattheRefugeareaandthenumberofunaccountedforemployeesandvisitors.Thiswillassistthefiredepartmentintheirendeavorstofacilitatetheemergencyaction.
Shouldanevacuationoccur,eachtenantanditsemployeesandvisitorsmustexitthebuildingandcongregateintheirsecureDesignatedRefugeArea.Oncethe“AllClear”signalisgivenbyamemberoftheTri‐Mainstaff,thetenants,theiremployeesandvisitorsmayreturntotheirrespectivesuites.
CommunityMembersWhoRequireAssistancetoExittheBuilding
Alltenantswithanystaff,clientsorvisitorsthatmayrequireassistancetoevacuatethebuildinginanemergencymustnotifytheManagementOfficeinwriting.Tri‐MainmanagementwillkeeparecordofalltenantsuiteswhereassistancemayberequiredandthislistwillbeavailabletotheFireDepartmentupontheirarrivalatthebuilding.
Whenanalarmsounds—thoserequiringassistance,adesignatedemergencymonitor,andaminimumnumberofassistants—aretoremainintheirsuite(RemaininPlace)andclosethedoor.Allothersaretoevacuatethebuilding.
Inanemergencyduringnormalbusinesshours,thedesignatedemergencymonitoristocalltheTri‐Mainofficeandreporttheirlocation,totalnumberofpeopleinthesuiteandthenumberofpeopleneedingassistance.
Afternormalbusinesshoursalltenants,employees,andvisitorsenteringthebuildingaretosigninatthesecuritydesk.Emergencyresponderswillusethislogtoensureallpersonsarevacatedfromthebuilding.
PeoplewhomayneedassistanceforanemergencyevacuationareinstructedtoinformtheManagementOfficeinadvanceinwriting.AnEvacuationAssistanceRequestformshouldbefilledoutandreturnedtothemanagementoffice.ExitRoutes:Maintenance,SafeguardsandOperationalFeaturesEachfloorinTri‐MainCenterhasbeendesignedtoprovidemultipleroutestoexitthebuilding.Incaseofanemergency,tenants,visitorsandemployeeswillnothavetotraveltowardahighhazardarea.AllExitRouteswill:

Whentheemergencyalarmsounds,Tri‐Mainengineers,maintenanceandadministrativestaffwillremaininthefacilitytoascertaintheextentoftheemergencyandcoordinatetheemergencyresponse.
Adesignatedemployeewillpositionthemselvesinthemainfloorlobbytoassistintheevacuationofthefacilityandtoguidethelocalfiredepartment,upontheirarrival,totheidentifiedlocationoftheproblem.Ifafireisdeterminedtobetheproblem,theFireChiefisinchargeoftheincidentuntilthefirehazardiseliminated.
OtheradministrativestaffwillremainintheTri‐Mainofficetobeabletonotifytenantswithdisabledvisitorswhentheyshouldevacuate.Thispersonwillalsohandleallincomingcallsregardingtheemergency.
Thedockoperatorswillreturnandremaininplaceattheloadingdocklevel,todirectemergencyresponders.TheelevatorsshouldnotbeoperatedunlessdirectedbyamemberoftheManagementStafforFireDepartment.Shouldtheybeneededinothercriticalareas,theseniormanagementofficialonsitewillnotifythem.
OtherTri‐Mainstaffwillbedirectedtovariousplacesinoroutsidethebuildingtoassistinorderlyevacuation.
Evaluation ThiswrittenEmergencyAction/Evacuationprogramwillbereviewedandupdatedonanas‐neededbasis.

NotificationProceduresforMissingResidentStudents
Itisunderstoodthatresidentstudentswillhaveopportunitiesduringtheacademicyeartotakeweekendsawaytovisitfamilyorfriends.Whenstudentswillbeawayfromtheiron‐campusresidence,studentsshouldinformtheirroommateorResidentAssistantoftheirplansandexpecteddateofreturnforemergencycontactpurposes.Forpurposesofthispolicy,astudentmaybeconsideredtobea“missingstudent”iftheperson’sabsenceiscontrarytohis/herusualpatternofbehaviorandunusualcircumstancesmayhavecausedtheabsence.Suchcircumstancescouldincludeareasonable/reliablereportorsuspicionthatthemissingstudentmaybeendangered.Examplesinclude,butarenotlimitedto,possiblevictimfoulplay,expressionofsuicidalthoughts,possiblealcoholordrugabuse,alife‐threateningsituation,orrecentcontactwithpersonswhomayendangerthestudent’swelfare.

StudentActivitiesDaemenCollegeallowsstudentswhocomplywiththeNewYorkStateminimumdrinkingageof21yearsofagetoconsumealcoholasaprivilege,butnotasaright,andwithinspecifiedguidelinesandlimitations,atcertainCollegeevents,asdeterminedbytheDirectorofStudentActivities.Theseeventsaregenerallylimitedtothosewhereasignificantnumberofstudentsovertheageof21areanticipatedtoattend.TheCollegeexpectsthatstudentswhochoosetoconsumealcoholwilldosoresponsibly.Individualsorgroupswhoconductthemselvesinadisorderlymanner,destroyproperty,orinfringeupontherightsofothersareaccountablefortheirbehaviorandwillbesubjecttocampusdisciplinaryactionand/orappropriatecivilorcriminalactions.Inotherwords,drunkennessisaproblem,notanexcuseforone.ThesepoliciesandregulationsapplytoallmembersoftheCollegecommunityandtheirinvitedguests.
1. AllalcoholicbeveragesaretobeprovidedbyDaemenCollegeDiningServiceatalleventsapprovedforalcoholservice.
2. AllstudentsocialfunctionsinvolvingalcoholareusuallylimitedtomembersoftheDaemenCollegecommunityandtheirescortedguests.Studentsareliablefortheactionsoftheirguests.TheDirectorofStudentActivitieswillgenerallyrefusealcoholrequestsforeventswhereunescortedvisitorsmaybeexpected.TheDirectormayrefuseentryofanypersontoanyCollegeevent.
3. Alcoholabusewillnotbetolerated.Alcoholmaynotbeofferedasaprizeorreward,orconsumedincontests.Socialparticipantsareallowedtopurchasenomorethanonealcoholicdrinkatatime(oratthediscretionoftheDirectorofStudentActivities).
4. FoodServicebartenders,securityofficers,groupmoderators,theDirectorofStudentActivities,andtheVicePresidentforStudentAffairsandDeanofStudentshaveauthoritytorefusethepurchaseofalcoholbyanypersonwhoappearstobeintoxicatedortroublesomeandthatpersonmayberequiredtoleaveasocialevent.
5. Asidefromthespecificationspermittingalcoholatcertainstudentactivities,andtheguidelinesforalcoholpermittedintheresidencehallslistedinthisStudentHandbook,alcoholcannotbeconsumedoncampusgroundsorinprivateautomobileswhileoncampusgrounds.
DaemenCollegerecognizedstudentorganizationsarenotpermittedtohosteventsoncampusoroffcampuswheretheprimaryfocusistheconsumptionofalcohol.Thistypicallyreferstobarpartiesorfundraiserswherepersonspayacoverchargeandalcoholicbeveragesareprovidedfreeoratareducedfee.Theintentofthispolicyispreventanddiscourageeventsthatpromotealcoholabuse(bingedrinking,underagedrinking,DWI)andtoreducetheriskofliabilityfacedbystudentorganizationsandtheirofficerswhenholdingthesetypesofevents.ResidenceHallsTheuseofalcoholintheresidencehallswillbesubjecttostateandfederallawsandDaemenCollegePolicy.Responsibleuseofalcoholbystudents21yearsofageandolderispermittedonlyaccordingtocollegeregulations.InaccordancewithNewYorkStatelawstudentsundertheageof21maynotpossess,sell,orconsumealcoholicbeverages.Thecollegefollowsazero‐tolerancepolicyinthesematters.Thismeansthateveryreportedincidentwillbeformallyaddressedthroughtheconductreviewsystem.(Pleasenote:GeneralpolicyinformationregardingdrugsandalcoholarecoveredinSection5,CampusPolicies)Thefollowingguidelinespertaintostudentswhoareoflegaldrinkingage.TheCollegealsoexpectsallvisitorsandgueststocomplywiththeregulationslistedbelow:

G. Underagestudentsmaynotbeinthepresenceofalcoholicbeverages.Theonlyexceptionisanunderageresident
wholiveswithstudentsoflegaldrinkingage,maybeinthepresenceofalcoholinhis/herassignedapartment.Theunderagepersonmaynotconsumeorpossessalcohol.Onceguests(anyonenotresidinginsaidapartment)overtheageof21enteranapartmentwherealcoholispresent,NOstudentsundertheageof21(includingresidentsofthatapartment)maybepresent.
H. Theamountofalcoholpermittedbyeachresidentovertheageof21inanapartmentis1literofspiritsorwine,or
a6packofbeer.Visitors/Guestsofresidentsarenotpermittedtobringalcoholontocampus.I. Alcoholiccontainersmaynotbeusedasdecorations.Emptycansorbottleswillbedeemedasproofof

anypeople,facilities,community,and/orselfwillbedealtwiththroughtheappropriateauthorities.DaemenCollegeDrugandAlcoholAbusePreventionPolicyPursuanttotheU.S.DepartmentofEducationRegulationsimplementingtheDrug‐FreeSchoolsandCommunitiesActAmendmentsof1989,DaemenCollegeestablishesthefollowingpolicyandregulations:PolicyStatement:DaemenCollegeendeavorstoestablishforitsstudents,facultyandstaffanenvironmentinwhichthemisuseofalcoholanddrugsisminimized,whichencouragesmoderation,safetyandpersonalaccountability,andwhichprovidesanatmospherefreeofcoercionandpeerpressuretoabusealcoholoruseillegaldrugs.TheCollegestronglybelievesandencouragestheuseoftreatmentandeducationalprogramsasthemosteffectivemeanstoreduceandpreventsubstanceabuseofanykind.AllmembersoftheDaemencommunityshouldexercisesoundjudgmentandbemindfuloftheirpersonalhealth,safetyandwellbeing,aswellasthatoftheirfriendsandguests,byobservingalllawsregulatingdrugandalcoholandtheCollegerulesexpressedinthisPolicyandelsewhereinthisHandbook.StandardsofConduct:Theunlawfulpossession,useordistributionofalcoholandillegaldrugsbystudentsandemployeesoncollegepropertyorwhileengagedinCollegeactivitiesofftheCollegecampusisprohibited.WhiletheCollegepermitsthelawfuluseofalcoholbystudentsandguestsoncampusinaccordancewiththeCollegealcoholpolicy(seefollowingsection),anyabuseofthisprivilegewillbesubjecttoCollegedisciplinaryactionand/orappropriatecriminalsanctions.LegalSanctionsRegardingAlcohol:UnderNewYorkStatelawitisillegal:
Toprovidealcoholtopersonsundertheageof21ortopersonswhoarevisiblyintoxicated.Providingalcoholtopersonsundertheageof21isaClassAmisdemeanorwhichispunishablebyimprisonmentforuptooneyear,afineofnotmorethan$1,000and/or3yearsprobation;
Tomisrepresenttheageofapersonundertheageof21forthepurposeofinducingasaleofalcohol.Thosefoundguiltyofviolatingthislawshallbepunishedbyafineofnotmorethan$200,orbyimprisonmentfornotmorethanfivedays,orbybothfineandimprisonment;

Forapersonundertheageof21topossessalcoholwiththeintenttoconsumeit.Thosefoundguiltyofviolatingthislawshallbepunishedbyafineofnotmorethan$50and/orrequiredtocompleteanalcoholawarenessprogramand/orrequiredtoprovideupto30hoursofcommunityservice;
Foranypersonundertheageof21topresentorofferanywrittenevidenceofagewhichisfalse,fraudulentornotactuallyhisown,forthepurposeofpurchasingorattemptingtopurchasealcohol.Thosefoundguiltyofviolatingthislawshallbepunishedbyafineofnotmorethan$100,and/orrequiredtocompleteanalcoholawarenessprogramand/orrequiredtoprovideupto30hoursofcommunityservice.Additionally,ifitisfoundthataNewYorkStatedriver'slicensewasthewrittenevidenceofageusedforthepurposeofthepurchaseorattemptedpurchase,theperson'slicensetodriveamotorvehiclemaybesuspendedfor90days.Lastly,alterationoftherequiredformsofidentification(driver'slicense,passportorarmedforcesIDcard)mayconstitute"possessionofaforgedinstrument…withintenttodefraud,"whichisaClassDfelonyunderNewYorkStatepenallaw.
LegalConsequencesofOperatingaVehicleWhileUndertheInfluenceofAlcoholorDrugs
OperatingaMotorVehicleAfterConsumingAlcoholWhileUnderAge21.Anypersonunderage21whooperatesamotorvehicleafterhavingconsumedalcohol,asdeterminedbyablood‐alcoholcontentofatleast.02%,maybereferredtotheDepartmentofMotorVehiclesforlicensesuspensionorrevocation,anda$125charge.VandTLaw§1192‐a.
DrivingWhileAbilityImpaired(DWAI)(morethan.05%butlessthan.08%BloodAlcoholContent(B.A.C.)Firstviolation(TrafficInfraction):Mandatory$300‐$500fine;and/orimprisonmentupto15days;mandatory90daylicenserevocation.Subsequentviolationsincreasethefine,possibleimprisonmentandlengthofrevocation.
DrivingWhileIntoxicated(DWI)(.08%B.A.C.orhigherorwhileimpairedbytheuseofadrug)1stViolation(Misdemeanor):Mandatory$500‐$1,000fineand/or1yearimprisonment;Mandatory6‐monthminimumlicenserevocation.Twoviolationswithin10yearscanresultinjailforupto4yearsanda1yearrevocationofyourlicensetodrive.Ifthereispersonalinjury,apossiblelifetimerevocationcanresult.
Ifyouareundertheageof21andchargedwithDWAI,orDWI,andyouareconvictedofsuchcharges,yourlicensewillberevokedforaminimumofoneyear.Ifyoudrivewhileyourlicenseissuspendedorrevoked,orifyourefuseachemicaltest,youfaceamandatoryjailtermof7‐180daysandamandatoryfineof$500‐$1,000.
DrugsThereareseveralNewYorkStateandFederallawsprohibitingtheuseand/orsaleofcontrolledsubstances(drugssuchasmarijuana,heroin,cocaine,PCP,LSD,methamphetamineandfentanyl).Misuseandsaleofprescriptionmedicationsisalsoprohibited.Prescriptionsaremeanttobeusedonlybythepersonforwhomtheprescriptioniswrittenand/orasprescribed.Aconvictioncanresultinasubstantialfineand/oralengthyimprisonment.Rememberthattheconvictionofacrimewillremainonyourrecordandcanimpactyourabilitytofindsuitableemploymentorgetaprofessionallicenseandcanimpairyourabilitytotravel. DaemenCollegeSanctionsMembersoftheCollegecommunitywhoviolatethesepolicieswillbesubjecttodisciplineviatheStudentCodeofConduct.Takingintoaccountthecircumstancesofeachcase,sanctionsforstudentsmayrangefromwarningstoexpulsionfromtheCollege,andsanctionsforfacultyandstaffmembersmayrangefromwarningstotermination.AtthediscretionoftheCollege,asanalternativeto,orinadditiontoanydisciplinaryactiontaken,studentsoremployeesmayberequiredtoparticipateinandtocompletesatisfactorilyanappropriatecounselingorrehabilitationprogram.Recordsofsuchdisciplinemaybemaintainedinastudent’srecordoranemployee’spersonnelfile.EnforcementofthesesanctionswillbethroughtheCollege’sexistingdisciplinaryproceduresforstudents,faculty,andstaff,asappropriate.HealthRisksAbusingdrugsand/oralcoholamongotherthingscanmakeyousick,loweryourjobperformance,putyouinprison,causedependency,beexpensiveandcostyouyourlife.Alcoholusewilldullyoursenses,impaircoordination,sluryourspeech,causemoodchanges,depressbrainfunctions,leadtoirreversiblebraindamage,damageliver,heart,andpancreas,irritateyourstomach,andpossiblycausephysicaldamagetoyourunbornbaby.Drugusemayincreaseyourheartrateandbloodpressure,causetremorsandconvulsions,produceheart,liver,andkidneydamage,causepersonalitychanges,confusion,anddepression,leadtoparanoiaandhallucinations,injureyourunbornbaby,andloweryourresistancetodisease—includingSTDsandAIDS.AmnestyPolicyThehealthandsafetyofeverystudentattheInstitutionisofutmostimportance.Institutionrecognizesthatstudentswho

7. Stalkingmeansacourseofconductdirectedataspecificpersonthatwouldcauseareasonablepersontofearforher,his,orothers'safety,ortosuffersubstantialemotionaldistress.
8. Robberyisthetakingorattemptingtotakeanythingofvaluefromthecare,custody,orcontrolofapersonorpersonsbyforceorthreatofforceorviolenceand/orbyputtingthevictiminfear.
9. AggravatedAssaultisanunlawfulattackbyonepersonuponanotherforthepurposeofinflictingsevereoraggravatedbodilyinjury.Thistypeofassaultusuallyisaccompaniedbytheuseofaweaponorbymeanslikelytoproducedeathorgreatbodilyharm.
10. Burglaryistheunlawfulentryofastructuretocommitafelonyoratheft.TheFederalBureauofInvestigation’sUniformCrimeReportingHandbook(UCR)classifiesoffenseslocallyknownasBurglary(anydegree);unlawfulentrywithintenttocommitalarcenyorfelony;breakingandenteringwithintenttocommitalarceny;housebreaking;safecracking;andallattemptsattheseoffensesasBurglary.

Penaltiesforcommissionofbias‐relatedcrimes;NewYorkStatePenalLaw485.10sentencing:
1. Whenapersonisconvictedofahatecrimepursuanttothisarticle,andthespecifiedoffenseisaviolentfelonyoffense,asdefinedinsection70.02oftheNYPL,thehatecrimeshallbedeemedaviolentfelonyoffense.
2. WhenapersonisconvictedofahatecrimepursuanttothisarticleandthespecifiedoffenseisamisdemeanororaclassC,DorEfelony,thehatecrimeshallbedeemedtobeonecategoryhigherthanthespecifiedoffensethedefendantcommitted,oronecategoryhigherthantheoffenselevelapplicabletothedefendant’sconvictionforanattemptorconspiracytocommitaspecifiedoffense,whicheverisapplicable.
