Emotionalabusecanbeasdamagingasphysicalabuse indestroying thechild’s self‐confidenceandself‐esteem.Being in thepresenceofoffensiveandabusivebehaviorisnotinthebestinterestofthechild.Researchshowsthatchildrenwhohavebeensubjectedorexposedtoviolenceintheirhomeshaveabetterchanceofminimizingtheharmsustainedtothemifallsystemsintervene,maximizing theirexposure tosupportive roleswithcaringadults,especially thenon‐violentparent,andminimizingtheexposuretotheviolenceanditsaccompanyingbehaviors.NAT’LCOUNCILOFJUVENILE&FAMILYCT.JUDGES,AJUDICIALGUIDETOCHILDSAFETYINCUSTODYCASES,BENCHCARD1(2008).

Counseling:Unliketheformerlaw,whichrequiredconvictedoffenderstoundergocounseling,thenewlawprovidesthatcounselingisdiscretionarywiththecourt,afteranevaluationismade.Also,thenewlawnolongerrequirescounselingpriortoanyawardofcustody.Afteranevaluation,anoffendermaybegrantedaccesstoachildbeforereceivinganyrelevantcounseling.Liketheformerlaw,thenewlawrequiresthecourttoappointa“qualifiedprofessionalspecializingintreatmentrelatingtotheparticularoffense.”Butunliketheformerlaw,thenewlawprovidesdiscretionforwhatthecounselingwilladdress,including,butnotlimitedto,physicalandsexualabuse,domesticviolence,thepsychologyoftheoffender,anditseffectonthevictim.HouseholdMembers:Thenewlawaddshouseholdmembersaspersonswhosecriminalconvictionhistorymustbeconsidered.
