Burnett is a retired Terrell P.D. Officer and also
retired as the Sheriff of Van Zandt County and has
over 38 years of Law Enforcement experience.
Dog calls for Police Officers can create problems for
all parties involved. Police Officers in the normal
course of their duty will encounter a dog in
approximately 1/3 of all their calls. Use of Force in
dog calls is a serious problem and Police Officers
must be trained in the basic knowledge of how to
approach dogs in general.

Justice for Candy
• As we continue to fight for Justice for Candy by pursuing animal cruelty charges as well as illegal search and seizure (opening the doors to our house without permission). I think that Jayna and I have decided to use ANY money leftover, after all the legal ramifications, to bring attention to making police officers go through animal interaction training (especially with that of dogs). We also feel that dogs that are wrongfully killed by police officers should be treated as dependents and not property! This must be a crime!!!

The case of Santa Clara vs. Hells Angels ruled on in 2006 should be used as a reference tool, as the U.S. Supreme Court has set a standard individual jurisdictions need to go by.
Back in 2006, Santa Clara County Board of Supervisors approved a $990,000 settlement to pay motorcycle group Hells Angels for the death of three family dogs.

The methods used in the raids with the shooting of three family guard dogs, could be used as a case reference in dogs shot by Police in our time. The Police had planned the raids for over a week and didn’t take into consideration how they would handle any dogs on the property. This is very similar (lack of a plan) to what’s taking place today.

Texas Health and Safety Code 822.041. DEFINITIONS. In this chapter:
(2) “Dangerous dog” means a dog that: (A) makes an unprovoked attack on a person that causes
bodily injury and occurs in a place other than an enclosure in which the dog was being kept and that was reasonably certain to prevent the dog from leaving the enclosure on its own; or
(B) commits unprovoked acts in a place other than an enclosure in which the dog was being kept and that was reasonably certain to prevent the dog from leaving the enclosure on its own and those acts cause a person to reasonably believe that the dog will attack and cause bodily injury to that person.

(4) “Secure enclosure” means a fenced area or structure that is:
(A) locked;
(B) capable of preventing the entry of the general public, including children;

(e) It is a defense to prosecution under Subsection (b) (2) or (6) that:
(2) The person killed or injured the animal within the SCOPE of the person’s employment as a public servant or in furtherance of activities or operations associated with electricity transmission or distribution, electricity generation or operation associated with the generation of electricity, or natural gas delivery.
(g) This section does not create a civil cause of action for damages or enforcement of the section.

Sec. 822.0421 DETERMINATION THAT DOG IS DANGEROUS
(a) If a person reports an incident described by Section 822.041 (2), the animal control authority / Police Officer may investigate the incident. If, after receiving the sworn statements of any witnesses, the animal control authority determines the dog is a dangerous dog, the animal control authority shall notify the owner in writing of the determination.

Texas Health and Safety Code
(b) Notwithstanding any other law, including a municipal ordinance, an owner, not later than the 15th day after the date the owner is notified that a dog owned by the owner is a dangerous dog, may appeal the determination of the animal control authority to a justice, county, or municipal court of competent jurisdiction.
(c) To file an appeal under Subsection (b), the owner must:
(1) file a notice of appeal of the animal control authority’s

Section 3. Section 822.0423, Health and Safety Code, is amended by adding Subsection (c-1) and amending Subsection (d) to read as follows: (c-1) The court shall determine the estimated costs to house and care for the impounded dog during the appeal process and shall set the amount of bond for an appeal adequate to cover those estimated costs.
(d) An owner or person filing the action may appeal the decision of the municipal or justice court in the manner described by Section 822.0424.

Sec. 822.0424. Appeal. (a) a party to an appeal under Section 822.0421(d) or a hearing under Section 822.0423 may appeal the decision to a county court or county court at law in the county in which the justice or municipal court is located and is entitled to a jury trial on request.

(b) As a condition of perfecting an appeal, not later than the 10th calendar day after the date the decision is issued, the appellant must file a notice of appeal and, if applicable, an appeal bond in the amount determined by the court from which the appeal is taken.
(C) Notwithstanding Section 30.00014, Government Code, or any other law, a person filing an appeal from a municipal court under Subsection (a) is not required to file a motion for a new trial to perfect an appeal.

Section 5. The change in law made by this Act applies only to a determination, decision, or hearing under Section 822.0421 or 822.0423, Health and Safety Code, as amended by this Act, or Section 822.0424, Health and Safety Code, as added by this Act, that occurs on or after the effective date of the Act. A determination, decision, or hearing that occurs before the effective date of this Act is governed by the law in effect on the date the determination, decision, or hearing occurred, and the former law is continued in effect for that purpose.
Section 6. This Act takes effect September 1, 2015.

822.042. Requirements for Owner of Dangerous Dog
(a) Not later than the 30th day after a person learns that the person is the owner of a dangerous dog, the person shall:
(1) register the dangerous dog with the animal control authority for the area in which the dog is kept;
(2) restrain the dangerous dog at all times on a leash in the immediate control of a person or in a secure enclosure;
(3) obtain liability insurance coverage or show financial responsibility in an amount of at least $100,000.00 to cover damages resulting from an attack by the dangerous dog causing bodily injury to a person and provide proof of the required liability insurance coverage or financial responsibility to the animal control authority in which the dog is kept; and

Texas Health and Safety Code
(4) comply with an applicable municipal or county regulation, requirement, or restriction on dangerous dogs. (b) The owner of a dangerous dog who does not comply with Subsection (a) shall deliver the dog to the animal control authority no later than the 30th day after the owner learns that the dog is a dangerous dog. (c) If, on application of any person, a justice court, county court, or municipal court finds, after notice and hearing as provided by Section 822.0423, that the owner of a dangerous dog has failed to comply with Subsection (a) or (b), the court shall order the animal control authority to seize the dog and shall issue a warrant authorizing the seizure. The authority shall seize the dog or order its seizure and shall provide for the impoundment of the dog in secure and humane conditions.

(d) The owner shall pay any cost or fee assessed by the municipality or county related to the seizure, acceptance, impoundment, or destruction of the dog. The governing body of the municipality or county may prescribe the amount of the fees. (e) The court shall order the animal control authority to humanely destroy the dog if the owner has not complied with Subsection (a) before the 11th day after the date on which the dog is seized or delivered to the authority, except that, notwithstanding any other law or local regulation, the court may not order the destruction of a dog during pendency of an appeal under Section 822.0424. The court shall order the authority to return the dog to the owner if the owner complies with Subsection (a) before the 11th day after the date on which the dog is seized or delivered to the authority.

• St. Louis Metropolitan Police Department, Missouri
• End of Watch: Thursday, December 27, 1888
• Patrolman Fahle died after contracting rabies as a result of a rabid dog bite while walking his beat on September 24, 1888. The wound to his leg initially did not cause any pain, however, on December 25, 1888, his leg began to swell and caused great pain. He was admitted to a local hospital where he died two days later.
• Patrolman Fahle had served with the St. Louis Police Department for 14 years and was assigned to the 4th District.
• He was survived by his wife and four children.

• Sandusky Police Department, Ohio
• End of Watch: Saturday, April 21, 1906
• Officer Clevens died after contracting rabies following a dog bite the previous summer. A rabid dog had been brought to the police department where it broke loose. When Officer Clevens attempted to capture the dog, he was bitten. The wound was tended to approximately seven hours later but by that time the disease had already set in.
• Officer Clevens had been with the agency for 11 years and was survived by his wife.

• Officer John Phipps succumbed to rabies as a result of being bitten by a rabid dog. The dog had bitten a young girl and, as Officer Phipps attempted to kill it, the dog also bit the officer. After showing symptoms of the disease, he was taken to St. Joseph’s Hospital where he later died.

month earlier when he was bitten by a rabid dog. He had been called to a home on Cuyler Avenue to kill the dog, but was bitten as he attempted to do so. After the bite he underwent treatment for hydrophobia. He died as a result of a side effect from the rabies treatment.

Justice for Bullet, the audacious story of Bullet being shot by Round Rock Police in his own house, have had an official crime scene recreation done by former officer, forensics expert, and canine aggression expert Jim Crosby.
There were holes on the family's futon where Bullet was laying as well as in the hallway.
The incident was "internally investigated" and deemed justified. Hopefully, now the Round Rock PD will properly investigate the incident and look at the FACTS.

• Leptospirosis (Lepto) - Quickly becoming an important pathogen in the
U.S.
• Two notable outbreaks:
• 2007 Texas Air Force base - working dogs were infected resulting in several dog deaths and 3 handlers becoming ill.
• 2008 Colorado - several dog deaths in the Denver area where Lepto had not been diagnosed before.
• Infects the liver and kidneys of dogs and humans.
• Dogs, cattle, and rodents spread the infection in the urine.
• Infected urine can contaminate water, food or soil. Contamination can last weeks.

Man diagnosed with rare pneumonic plague in Colorado
• DENVER (Reuters) - A Colorado man diagnosed with pneumonic plague, a rare form of the disease that is also the most life-threatening, is the state's first confirmed human case of the illness in a decade, officials said on Wednesday. (07-09-2014)
• The man was found to have the disease after the family dog died unexpectedly, and a necropsy concluded the animal was afflicted with pneumonic plague, the Colorado Department of Public Health and Environment said in a statement.
• The unidentified man and his dog were believed to have contracted the disease in an eastern Colorado county. There was no word on the man's condition.
• The bacteria that causes plague occurs naturally in the western United States, particularly in Colorado, New Mexico, Arizona and California, according to the U.S. Centers for Disease Control and Prevention.
• The plague is transmitted by fleas to rodents, usually prairie dogs. When an infected animal dies, the disease is spread when the fleas find another host.
