Being convinced of the urgent need to enhance international cooperation between States in devising and adopting effective and practical measures for the prevention of such acts of terrorism and for the prosecution and punishment of their perpetrators,

Noting that the activities of military forces of States are governed by rules of international law outside of the framework of this Convention and that the exclusion of certain actions from the coverage of this Convention does not condone or make lawful otherwise unlawful acts, or preclude prosecution under other laws,

Have agreed as follows:

Article 1

For the purposes of this Convention:

1. "Radioactive material" means nuclear material and other radioactive substances which contain nuclides which undergo spontaneous disintegration (a process accompanied by emission of one or more types of ionizing radiation, such as alpha-, beta-, neutron particles and gamma rays) and which may, owing to their radiological or fissile properties, cause death, serious bodily injury or substantial damage to property or to the environment.

2. 4. Each State Party shall likewise take such measures as may be necessary to establish its jurisdiction over the offences set forth in article 2 in cases where the alleged offender is present in its territory and it does not extradite that person to any of the States Parties which have established their jurisdiction in accordance with paragraph 1 or 2 ofthe present article.

5. This Convention does not exclude the exercise of any criminal jurisdiction established by a State Party in accordance with its national law.

Article 10

1. Upon recelvmg information that an offence set forth in article 2 has been committed or is being commi tted in the terri tory of a State Party or that a person who has committed or who is alleged to have committed such an offence may be present in its tenitory, the State Party concerned shall take such measures as may be necessary under its national law to investigate the facts contained in the information.

2. Upon being satisfied that the circumstances so warrant, the State Party in whose territory the offender or alleged offender is present shall take the appropriate measures under its national law so as to ensure that person's presence for the purpose of prosecution or extradition.

3. Any person regarding whom the measures referred to in paragraph 2 of the present article are being taken shall be enti tIed:

(a) To communicate without delay with the nearest appropriate representative of the State of which that person is a national or which is otherwise entitled to protect that person's rights Of, if that person is a stateless person, the State in the territory of which that person habitually resides;

The State which makes the investigation contemplated in paragraph l~f the present article shall promptly inform the said States Parties of its findings and shall indicate whether 'it intends to exercise jurisdiction.

Article 11

1. The State Party in the territory of which the alleged offender is present shall, in cases to which article 9 applies, iif it does not extradite that person, be obliged, without exception whatsoever!and, whether or not the offence was committed in its territory, to submit ~he case without undue delay to its competent authorities for the purpose of prosecution, through proceedings in accordance with the laws of that State. Those authorities shall take their decision in the same manner as in the pase of any other offence of a grave nature under the law of that State.

Article 13

1. The offences set forth in' article 2 shall be deemed to be included as extraditable offences in any extradition treaty existing between any of the States Parties before the entry into force of this Conventiolh" State~ ,Parties undertake to include such offences as extraditable offences in every extradition treaty to be subsequently concluded between them.

2. When a State Party which makes extradition condi,tional on the existence of a treaty receives a request for extradition from another, State Party with which it has no extradition treaty, the' requested State ,P~rty may, at, its option, consider this Convention as a legal basis for extradition' In respect of the offences set forth in article 2. 3. States Parties which do not make extradition conditional on the existence of a treaty shall recognize the offences set forth in article 2 as extraditable offences between themselves, subject to the conditions provided by the law of the requested State.

If necessary, the offences set forth in article 2 shall be treated, for the purposes of extradition between States Parties, as if they had been committed not only in the place in which they occurred but 'also in the territory, of the States that have established jurisdiction in accordance with article 9, paragraphs 1 and 2.

5. The provisions of all extradition treaties and arrangements between States Parties with regard to offences set forth in article 2 shall be deemed to be modified as between States Parties to the extent that they are incompatible with this Convention.

Article 14

1. States Parties shall afford one another the greatest meaSure of assistance in connection with investigations or criminal or extradition proceedings brought in respect of the offences set forth in article 2, including assistance in obtaining evidence at their disposal necessary for the proceedings.

States Parties shall carry out their· obligations under paragraph 1 of the present article in conformity with any treaties or other arrangements on mutual legal assistance that may exist between them. Article 18

I. Upon selzmg or otherwise taking control of radioactive material, devices or nuclear facilities, fo !lowing the commission of a.n offence set forth in article 2, the State Party in possession of such items shall:

(a) Take steps to render harmless the radioactive material, device or nuclear facility;

(b) Ensure that any nuclear material is held in accordance with applicable International Atomic Energy Agency safeguards; and

(c) Have regard to physical protection recommendations and health and safety standards published by the International Atomic Energy Agency.

2. Upon the completion of any proceedings connected with an offence set forth in article 2, or sooner if required by international law, any radioactive rna teria I, device or nuclear facility sha II be returned, after consul ta tions (in particular, regarding modalities of return and storage) with the States Parties concerned to the State Party to which it belongs, to the State Party of which the natural or legal person owning such radioactive material, device or facility is a national or resident, or to the State Party from whose territory it was stolen or otherwise unlawfully obtained.

3. Article 2

Article 5

Chaque Etat Partie prend les mesures qui peuvent etre necessaires pour:

a) Eriger en infraction penale au regard de sa legislation nationale les infractions visees a I' article 2 de la presente Convention;

b) Reprimer lesdites infractions par des peines tenant dilment compte de leur gravite.

Article 6

Chaque Etat Partie adopte les mesures qui peuvent etre necessaires, y compris, s'd y a lieu, une legislation nationale pour faire en sorte que les actes crimi nels relevant de 1a presente Convention, en particuJier ceux qui sont convus ou calcules pour provoquer la terreur dans la population, un groupe de personnes ou chez des individus, ne puissent en aucune cir­constance etre justifies par des considerations politiques, philosophiques, ideologiques, raciales, ethniques, religieuses Oll autres de nature analo­gue, et qu'ils soient punis de peines a la mesure de leur gravite.

Article 7

I. Les Etats Parties collaborent :

b) En echangeant des renseignements exacts et verifies en confor­mite avec les dispositions de leur legislation nationale et selon les moda­lites et les conditions eooncees dans les presentes dispositions et en coor­donnant les mesures administratives et autres prises, Ie cas echeant, afin de d6tecter, prevenir et combattre les infractions enumerees a I' article 2 de 1a presente Convention, et d'enqueter sur elles et d'engager des pour­suites contre les auteurs presumes de ces crimes. En particulier, tout Etat Partie fait Ie necessaire pour informer sans deIai les autres Etats vises a I' article 9 de toute infraction visee a 1 'article 2 et de taus preparatifs de telles infractions dont iI aurait eu connaissance, ainsi que pour en infor­mer, Ie cas echeant, les organisations internationales.

2. Les Etats Parties prennent les mesures voulues en accord avec leur legislation nationale pour preserver Ie caractere confidentie I de toute information rc((ue a titre confidentiel d' un autre Etat Partie en application des dispositions de la presente Convention, ou obtenue du fait de leur participation a des actlvites menees en appl ication de la presente Conven­tion. Si les Etats Parties communiquent a titre confidentiel des infonna­tions a des organisations internationales, i1s font Ie necessaire pour que Ie caractere confidentiel en soit preserve.

3. Les dispositions de la presente Convention n' irnposent pas a un Etat Partie l'obligation de communiquer des informations qu'i1 n'aurait pas Ie droit de divulguer en vertu de sa legislation nationale, ou qui (isqueraient de mettre en peril sa securite ou 1a protection physique de matieres nu­c1eaires.

4. Les Etats Parties communiquent au Secretaire general de l'Organisation des Nations Vnies Ie nom de leurs organes et centres de liaison competents charges de communiquer et de recevoir les infonna­tions visees dans Ie present article. Le Secreta ire general de l'Organisation des Nations Unies communique les informations relatives aux organes et centres de liaison competents a tous les Etats Parties et a l' Agence internationale de I' energie atomique. L' acces aces organes et a ces centres doit etre ouvert en permanence.

ArticJe 8

Aux fins de prevenir les infractions visees dans 13 presente Conven­tion, les Etats Parties s' efforcent d' adopter des mesures appropriees pour assurer 1a protection des matieres radioactives, en tenant compte des re­commandations et fonctions de I' Agence internationale de l'energie ato­mique appJicables en la matiere.

Article 9

1. Chaque Etat Partie adopte les mesures qui peuvent etre necessaires pour etablir sa competence en ce qui conceme les infractions visees a l' artie Ie 2 lorsq ue :

a) L'infnction est commise sur son territoire; ou

b) L'infraction est commise a bard d'un navire bartant son pavilion au d'un aeronef jmmatricuh~ conformement a sa legislation au moment ou I'infraction a ete commise; ou

c) L'infraction est commise par l' un de ses ressortissants.

2. Chaque Etat Partie peut egalement etablir sa competence a I'egard de telles infractions lorsque :

a) L'infraction est com mise con tre I' un de ses ressortissants ; ou

b) L'infraction est commise contre une installation publique dudit Etat simee en dehors de son territoire, y compris une ambassade au des locaux diplomatiques ou consulaires dudit Etat; ou

c) L'infraction est commise par un apatTide qui a sa residence habi­melle sur son territolre ; ou

d) L'infraction commise a pour objectif de contraindre ledit Etat a accomplir un acte quelconque ou as' en abstenir ; au

e) L'infraction est commise a bord d'un aeronef exploite par Ie gouvernement dudit Etat.

3. Lors de la ratification, de I' acceptation ou de \' approbation de 1a pre­sente Convention ou de l' adhesion a celle-ci, chaque Etat Partie infonne Ie Secretaire general de l'Organisation des Nations Vnies de la compe­tence qu' il a etablie en vertu de sa h!gislation nationale conformement au paragraphe 2 du present article. En cas de modiftcation, l'Etat Partie concerne en informe immediatement Ie Secretaire general.

4. Chaque Etat Partie adopte egalement les mesures qui peuvent etre necessaires pour etablir sa competence en ce qui concerne les infractions visees a I' article 2 dans les cas ou t' auteur presume de I' infraction se trouve sur son territaire et au il ne I' extrade pas vers I'un quelconque des Etats Parties qui ant etabli leur competence confonnement aux paragra­phes 1 et 2 du present article.

Article 11

I. Dans les cas ou les dispositions de I' article 9 sont applicables, I' Etat Partie sur Ie territoire duqueJ se trouve l' auteur presume de l'infraction est tenu, s'il ne \'extrade pas, de soumettre I'affaire, sans retard excessif et sans aucune exception, que I'infraction ait ete ou non commise sur son territoire, a ses autoriH~s competentes pour I' exercice de l' action penale selon une procedure conforme a la It!gislation de cet Etat. Ces autorites prennent leur decision dans les memes conditions que pour toute autre infraction ayant un caractere grave au regard des lois de cet Etat.

Article 12

Article 13

1. Les infractions prevues a I'article 2 sont de plein droit considerees comme cas d'extradition dans lout traite d'extradition canclu entre Etats Parties avant l'entree en vigueur de la presente Convention. Les Etats Parties s'engagent a considerer ces infractions comme cas d'extradition dans tout traite d'extradition a conclure par la suite entre eux.

2. Lorsqu' un Etat Partie qui subordonne l' extraditi on a I' ex istence d' un traite est saisi d'une demande d'extradition par un autre Btat Partie avec lequel il n'est pas lie par un traite d'extradition, l'Etat Partie requis a la latitude de considerer la prt::sente Convention comme constituant la base juridique de l' extradition en ce qui concerne les infractions prevues a I' article 2. L' extradition est subordonnee aux autres conditions prevues par la legislation de I 'Etat requis.

3. Les Etats Parties qui ne subordonnent pas J' extradition a l' existence d'un traite reconnaissent les infractions prevues a l'article 2 comme cas

Article 14

1. En I'absence d'un tel traite ou accord, les Etats Parties s'accordent cette entraide confor­mement a leur legislation nationale.

Article 15

Aux fins de I'extradition ou de I'entraide judicia ire entre Etats Par­ties, aucune des infractions visees it I'article 2 n'est consideree comme une infraction po Iitique, au connexe a une infraction politique, ou inspi­ree par des mobiles politiques. En consequence, une demande d'extraditioo ou d'entraide judiciaire fondee sur une telle infraction ne peut etre refusee pour la seule raison qu' elle concerne une infraction poli­tique, une infraction connexe a une infraction politique, au une infraction inspiree par des mobiles politiques.

Article 16

Aucune disposition de la presente Convention ne doit etre interpretee comme impliquant une obligation d'extradition ou d'entraide judiciaire si 1 'Etat Partie requis a des raisons serieuses de croire que la demande d'extradition pour 1es infractions visees a I 'article 2 ou 1a demande d'entraide concernant de telles infractions a ete presentee aux fins de poursuivre au de punir une personne pour des considerations de race, de religion, de nationalite, d'origine ethnique ou d'opinions politiques, ou

Article 25

1. La presente Convention enn-era en vigueur le trentieme jour qui sui~ vra 1a date de depot aupres du Secretaire general de I' Organisation des Nations Unies du vingt-deuxieme instrument de ratification, d'acceptation, d'approbation au d'adhesion.

2. POUf chacun des Etats qUI ratifieront, accepteront ou approuveront la Convention au y adhereront apres Ie depot du vingt-deuxieme instrument de ratification, d' acceptation, d' approbation ou d' adhesion, la Conven­tion entrera en vigueur Ie trentieme jour suivant Ie depot par cet Etat de son instrument de ratification, d) acceptation, d' approbation ou d'adhesion.

Article 26

L Un Etat Partie peut proposer un amendement a 1a presente Conven­tion. L'amendement propose est adresse au depositaire, qui Ie communi­que immediatement a taus les Etats Parties.

2. Si la majorite des Etats Parties demande au depositaire la convoca­tion d'une conference pour l'examen de l'amendement propose, Ie depo­sitaire invite tous les Etats Parties a une conference, qui ne s' ouvrirn au plus tot que trois m01s apres I 'envoi des convocations.

3. La conference ne neglige aucun effort pour que les amendements soient adoptes par consensus. Au cas ou elle ne peut y parvenir, les amen­dements sont adoptes a la majorite des deux tiers de tous les Etats Parties. Tout amendement adopte a la Conference est immediatement communique par Ie deposita ire a tous les Etats Parties.

4. L'amendement adopte conformement au paragraphe 3 du present ar­ticle entrera en vigueur, pour chaque Etat Partie qui depose son instru­ment de ratification, d'acceptation ou d'approbation de l'amendement, au d'adhesl0n a I'amendement, Ie trentieme jour suivant 1a date a laqueHe les deux tiers des Etats Parties auront depose leur instrument pertinent. Par la suite, l' amendement entrera en vigueur pour tout Etat Partie Ie trentieme jour suivant la date a Jaquelle il aura depose son instrument pertinent.

ArticJe 27

1. Tout Etat Partie peut denoncer la presente Convention par voie de notificatjon ecrite adressee au Secretaire general de l'Organisation des Nations Unies.

2. La de:nonciation prendra effet un an apres 1a date a laquelle la notifi­cation aura ete revue par Ie Secretaire general de l'Organisation des Na­tions Unies.

6. "Por fuerzas militares de un Estado" se entienden las fuerzas armadas de un Estado que esten organizadas, entrenadas y equipadas con arregJo a la legislaci6n nacional primordialmente a los efectos de la defensa y la seguridad nacionales y las personas que acruen en apoyo de esas fuerzas armadas que esten bajo su mando, conITol y responsabilidad oficiales.

Articulo 2

Articulo 8

A los efectos de impedir que se cometan los delitos de que trata el presente Convenio, los Estados Partes haran todo 10 posible por adoptar rnedidas que permitan asegurar la proteccion del material radiactivo, teniendo en cuenta las recomendaciooes y fuociones del Organismo Internacional de Energia At6mica en la materia.

Articulo 9

1. Cada Estado Parte adoptara las medidas que sean necesarias para establecer su jurisdicci6n respecto de los delitos enunciados en el articulo 2 cuando estos sean cometidos:

a) En el territono de ese Estado; 0

b) A bordo de un buque que enarbole el pabeH6n de ese Estado 0 de una aeronave matriculada de conformidad con la legislacion de ese Estado en el momento de la comisi6n del delito; 0

c) Por un nacional de ese Estado.

2. Un Estado Parte podra tambien establecer su jurisdicci6n respecto de cualquiera de tales delitos cuando:

a) Sea cometido contra un nacional de ese Estada; a

b) Sea cometido contra una instalaci6n publica 0 gubernamental en el extranjero, incluso una embajada u otro local diplomatico 0 consular de ese Estado; 0

c) Sea cometido por un apatrida que tenga residencia habitual en el territorio de ese Estado; 0

d) Sea cometido con el prop6sito de obligar a ese Estado a realizar o abstenerse de realizar un determinado acto; 0

e) Sea cometido a bordo de una aeronave que sea operada por el gobierno de ese Estado.

3. Cada Estado Parte, al ratificar, aceptar 0 aprobar el Convenio 0

adherjrse a ei, notificara al Secretario General de las Naciones Unidas que ha establecido su jurisdicci6n de conformidad con su legislaci6n nacional con arreglo al parrafo 2 del presente articulo y notificara inmediatamente at Secretario General los cambios que se produzcan.

En el caso de que el material radiactivo, los dispositivos 0 las instalaciones nucleares a que se haee referencia en los parrafos 1 y 2 del presente articulo no pertenezcan a ninguno de los Estados Partes ni a ninglin nacional 0 residente de un Estado Parte 0 no hayan sido robados ni obtenidos por ninglin otto medio ilicito en el territorio de un Estado Parte, o en el caso de que ninglin Estado este dispuesto a recibir el material, los dispositivos 0 las instalaciones de conformidad· con el parrafo 3 del presente articulo, se decidira por separado acerca del destino que se les dara, con sujeci6n a 10 dispuesto en el apartado b) del parrafo 3 del presente articulo, tras 1a celebraci6n de consultas entre los Estados interesados y cualesquiera organizaciones internacionales pertinentes.

5. Para los efectos de los parrafos 1, 2, 3 Y 4 del presente articulo, el Estado Parte que tenga en su poder el material radiactivo, los dispositivos o las instalaciones nucleares podra solicitar 1a asistencia y la cooperacion de los demas Estados Partes, en particular los Estados Partes interesados, y de cualesquiera organizaciones internacionales pertinentes, en especial el Organismo Internacional de Energfa Atomica. Se insta a los Estados Partes y a las organizaciones internacionales pertinentes a que proporcionen asistencia de conformidad con este parrafo en la maxima medida posible.

6. Los Estados Partes que participen en 1a disposici6n 0 retencion del material radiacti vo, los dispositivos 0 las instalaclones nucleares de confonnidad can el presente articulo informaran a1 Director General del Organismo Internacional de Energia At6mica aeerca del destino que dieron al material; los dispositivos 0 las instalaciones 0 de como los retuvieron. E1 Director General del Organismo Internacional de Energia Atomica transmitini la informacion a los demas Estados Partes.

7. En caso de que se haya producido ernisi6n de material radiactivo en relaci6n con alg(!n delito cnunciado en el articulo 2, nada de 10 dispuesto en el presente articulo afectara en forma alguna a las Donnas de derecho intemacional que rigen la responsabilidad p~r danos nucleares, nl a otras normas de derecho internacionaL

Artkulo

2. El presente Convenio esta sujeto a ratificacion, aceptacion 0

aprobacion. Los instrumentos de ratificaci6n, aceptaci6n 0 aprobacion sen in depositados en poder del Secretario General de las Naciones Unidas.

3. El presente Convenio estara abierto a la adhesion de cualquier Estado. Los instrumentos de adhesion seran depositados en poder del Secretario General de las Naciones Unidas.

Articulo 25

1 . El presente Convenio enrrara en vigor el trigesimo dia a partir de la fecha en que se deposite en poder del Secretario General de las Naciones Unidas el vigesimo segundo instrumento de ratificaci6n, aceptaci6n, aprobacion 0 adhesion.

2. Respecto de cada uno de los Estados que ratifiquen. acepten 0

aprueben el Convenio 0 se adhieran a 61 despues de que sea depositado el vigesimo segundo instrumento de ratificaci6n, aceptaci6n, aprobaci6n 0

adhesion, el Convenio entrara en vigor e] trigesimo dfa a partir de 1a fecha en que dicho Estado haya depositado su instrumento de ratificaci6n, aceptacion, aprobaci6n 0 adhesi6n.

Articulo 26

1. Cualquier Estado Parte podra proponer enmiendas al presente Convenio. Las eruniendas propuestas se presentanin al depositario, quien las comuoicara iomediatamente a todos los Estados Partes.

2. Si una mayoria de Estados Partes pide a1 depositario que coovoque una conferencia para examinar las enmiendas propuestas, el depositario invitara a todos los Estados Partes a aSlstir a dicha conferencia, 1a eual comenzara no antes de que hayan transcurrido tres meses desde 1a fecha en que se hayan cursado las invitaciones.

3. En 1a conferenda se hara todo 10 posible por que Jas enmiendas se adopten por consenso. Si ello no fuere posible, las enmiendas se adoptaran por mayoria de dos tercios de todos los Estados Partes. Toda enmienda que haya side aprobada en 1a conferencia sera comunicada inmediatamente pOT eI depositario a todos los Estados Partes.

4. La enmienda adoptada de conformidad con 10 dispuesto en el panafo.3 del presente artkulo entrara en vigor para cada Estado Parte que deposite su instrumento de ratificaci6n, aceptaci6n 0 aprobaci6n de la enmienda, 0 adhesion a ella el trigesimo dia a partir de la fecha en que dos tercios de los Estados Partes hayan depositado sus instrumentos pertinentes. De alH en adelante, la enrnienda entrara en vigor para cualquier Estado Parte el trigesimo dia a partir de la fecha en que dicho Estado deposite el instrumento pertinente.

Articulo 27

1. Todo Estado Parte podra denunciar el presente Convenio mediante Dotificaci6n por escrito dirigida a1 Secretario General de las Naciones Unidas.

2. La denuncia surtinl efecto un ano despues de la fecha en que el Secretario General de las Naciones Unidas reciba 1a notificaci6n.

Articulo 28

El original del presente Convenio, cuyos textos en arabe, chino, espanol, frances, lngles y ruso son igualmente autenticos, sera depositado en poder del Secretario General de las Naciones Unidas, que enviara capias certificadas de 61 a todos los Estados.

EN TESTIMONIO DE LO CUAL, los infrascritos, debidamente autorizados par sus respectivos Gobiernos, han finnado el presente Canvenio, abierto a 1a firma en 1a Sede de las Naciones Unidas en Nueva York el 14 de septiembre de 2005.
