BOND ORDINANCE AMENDING BOND ORDINANCE NUMBER 13-2016 FINALLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, IN THE COUNTY OF BERGEN, STATE OF NEW JERSEY ON APRIL 4, 2016 TO INCREASE THE APPROPRIATION THEREIN FOR ITEMS OR EXPENSES LISTED IN AND PERMITTED UNDER N.J.S.A. 40A:2-20 BY AN AMOUNT EQUAL TO $500,000

BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY

OF HACKENSACK, IN THE COUNTY OF BERGEN, STATE OF NEW JERSEY (not less

than two-thirds of all the members thereof affirmatively concurring), AS FOLLOWS:

SECTION 1. Bond Ordinance Number 13-2016 finally adopted on April 4,

2016 by the City Council of the City of Hackensack, in the County of Bergen, State of New

Jersey (the "City"), entitled, "BOND ORDINANCE PROVIDING FOR THE MAIN

STREET/STATE STREET TWO-WAY CONVERSION BY AND IN THE CITY OF

HACKENSACK, IN THE COUNTY OF BERGEN, STATE OF NEW JERSEY;

APPROPRIATING $6,200,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF

$3,800,000 BONDS OR NOTES OF THE CITY TO FINANCE PART OF THE COST

THEREOF," (the "Original Ordinance"), is hereby amended and supplemented to the extent

and with the effect as follows:

SECTION 2. The total costs of items of expense listed in and permitted under

section 20 of the Local Bond Law, N.J.S.A. 40A:2-1 et seq. set forth in the Original

Ordinance is hereby increased by $500,000, from $600,000 to $1, 100,000.

SECTION 3. The City covenants to maintain the exclusion from gross

income under section 103(a) of the Code of the interest on all bonds and notes issued

under this ordinance.

CITY OF HACKENSACK ORDINANCE NO. 44-2017

AN ORDINANCE TO AMEND CHAPTER 170 OF THE CODE OF THE CITY OF HACKENSACK, "VEIDCLES AND TRAFFIC," TO

MODIFY THE STREETS LISTED IN SECTION 56, "ONE-WAY STREETS."

WHEREAS, pursuant to N.J.S.A. 40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and,

WHEREAS, the City Council of the City of Hackensack wishes to amend Chapter 170 of the Code of the City of Hackensack, entitled "Vehicles and Traffic," to modify the streets listed in Section 56, entitled "One-Way Streets;" and,

WHEREAS, the City of Hackensack has investigated the matter and has determined that amending this section will improve traffic flow in the City; and,

WHEREAS, the City Council finds it is in the City's best interest to take this action.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows:

Section 1: Chapter 170, Section 56 of the Code of the City of Hackensack is hereby amended as follows [additions by underline, deletions by strikethreugh]:

§170-56 Schedule Vil: One-Way Streets. In accordance with the provisions of § 170-14, the following described streets or parts of streets are hereby designated as one way streets in the direction indicated:

Section 2: All other provisions of Chapter 170, Section 56 of the Code of the City of Hackensack shall remain unchanged.

Section 3: Repeal of Inconsistent Provisions. All ordinances or parts thereof in conflict or inconsistent with this Ordinance are hereby repealed, but only however, to the extent of such conflict or inconsistency, it being the

Section 4: Severability. The provisions of this Ordinance are declared to be severable and if any section, subsection, sentence, clause or phrase thereof for any reason is held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining sections, subsections, sentences, clauses and phrases of this Ordinance, but shall remain in effect; it being the legislative intent this Ordinance shall stand notwithstanding the invalidity of any part.

Section 5: Codification. This Ordinance shall be a part of the Code of the City of Hackensack as though codified and fully set forth therein. The City Clerk shall have this ordinance codified and incorporated in the official copies of the Code. The City Clerk and the City Attorney are authorized and directed to change any Chapter, Article and/or Section number of the Code of the City of Hackensack in the event that the codification of this Ordinance reveals that there is a conflict between the numbers and the existing Code, and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be repealed.

Section 6: This Ordinance shall take effect upon passage, adoption, and publication in the manner prescribed by law.

AN ORDINANCE TO AMEND CHAPTER 170 OF THE CODE OF THE CITY OF HACKENSACK, "VEHICLES AND TRAFFIC," TO ADD AND REMOVE CERTAIN BUS STOPS WITHIN THE CITY OF HACKENSACK

WHEREAS, pursuant to N.J.S.A. 39:4-8(e), the governing body of a municipality may, without the approval of the Commissioner of Transportation, and consistent with the current standards prescribed by the Manual on Uniform Traffic Control Devices for Streets and Highways, by ordinance designate stops, stations, or stands for omnibuses on any street under its jurisdiction, subject to guidelines issued by the Commissioner of Transportation;

WHEREAS, pursuant to the above-noted authority, the City Council of the City of Hackensack has established locations for bus stops on certain streets within the City, as enumerated in Section 170-62 of the Code of the City of Hackensack; and,

WHEREAS, the City Council has determined that for safety and the expedition of traffic on the streets within the City, certain bus stops should be added and others removed, as set forth herein.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows:

Section 1: Chapter 170, Section 62 of the Code of th~ City of Hackensack is hereby amended to ADD the following bus stops:

Section 5: Severability. The provisions of this Ordinance are declared to be severable and if any section, subsection, sentence, clause or phrase thereof for any reason is held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining sections, subsections, sentences, clauses and phrases of this Ordinance, but shall remain in effect; it being the legislative intent this Ordinance shall stand notwithstanding the invalidity of any part.

Section 6: Codification. This Ordinance shall be a part of the Code of the City of Hackensack as though codified and fully set forth therein. The City Clerk shall have this ordinance codified and incorporated in the official copies of the Code. The City Clerk and the City Attorney are authorized and directed to change any Chapter, Article and/or Section number of the Code of the City of Hackensack in the event that the codification of this Ordinance reveals that there is a conflict between the numbers and the existing Code, and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be repealed.

Section 7: This Ordinance shall take effect upon passage, adoption, and publication in the manner prescribed by law.

RESOLUTION AWARDING EXTRAORDINARY UNSPECIFIABLE SERVICES CONTRACT TO LKS ASSOCIATES TO

SERVE AS CONSULTANT FOR THE NEW HACKENSACK PERFORMING ARTS CENTER

WHEREAS, it is necessary for the City of Hackensack ("City") to engage the services of a consultant to develop the potential of the new Hackensack Performing Arts Center ("HACPAC"); and,

WHEREAS, the desired consultant must have expertise, extensive training and proven reputation in the field of non-profit arts management; and,

WHEREAS, the services are of such a qualitative nature that their performance cannot reasonably be described by written specifications; and,

WHEREAS, the City has sought quotations from qualified non­profit arts management firms, and has determined that LKS Associates of Lebanon, NJ is most qualified for this important assignment; and,

WHEREAS, this contract will not exceed the bid threshold established by N.J.S.A. 40A:ll-6.l(a) and thus may be awarded without further delay;

WHEREAS, the Chief Financial Officer certifies that there are sufficient and legally appropriated funds available in furtherance of this resolution in account number 8-01-28371-371-204.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack that LKS Associates be and is hereby appointed as consultant to the City for HACPAC for the period January 1

WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program ("State"), provides loans and/ or grants to municipal and county governments and grants to nonprofit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and,

WHEREAS, the City of Hackensack desires to further the public interest by obtaining a loan of $200,000 zero percent interest (payable over twenty years) and a grant of $600,000 from the State to fund the following project:

NOW THEREFORE BE IT RESOLVED, that the Mayor and Council of the City of Hackensack resolves that Mr. Ted Ehrenburg or the successor to the office of City Manager is hereby authorized to

documents as may be required; (c) Act as the authorized correspondent of the above-named applicant;

2. The applicant has its matching share of the project in the amount of $200,000.

3. In the event the State's funds are less than the total project cost specified above, the applicant has the balance of funding necessary to complete the project, and;

4. The applicant agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project .

OPEN SPACE, RECREATION, FLOODPLAIN PROTECTION, FARMLAND & HISTORIC PRESERVATION TRUST FUND- MUNICIPAL PARK

IMPROVEMENT PROGRAM (CARVER PARK)

WHEREAS, the Mayor and Council of the City of Hackensack wish to enter into a Bergen County Trust Fund Project Contract ("Contract") with the County of Bergen for the purpose of using a $42,000 matching grant award from the 2016 Funding Round of the Bergen County Open Space, Recreation, Floodplain Protection, Farmland & Historic Preservation Trust Fund ("Trust Fund") for the municipal park project entitled Carver Park Recreation Improvements located in Block 334 Lot 4 on the tax maps of the City of Hackensack.

NOW THEREFORE BE IT RESOLVED, that the Mayor and Council of the City of Hackensack authorize the City to enter into said agreement with the County of Bergen.

BE IT FURTHER RESOLVED, that the Mayor and Council hereby authorize Mayor John Labrosse to be a signatory to the aforesaid Contract.

BE IT FURTHER RESOLVED, that the Mayor and Council hereby acknowledge that, in general, the use of this Trust Fund grant towards this approved park project must be completed by or about August 9, 2019.

RESOLUTION AUTHORIZING APPROVAL OF PETTY CASH FUND

WHEREAS, N.J.S.A. 40A:5-21 authorizes a local unit to establish a petty cash fund upon approval from the Director of the Division of Local Government Services; and

WHEREAS, such approval was granted on December 8, 2015; and

WHEREAS, in order to establish a uniform method of accounting for petty cash funds, which purpose is to pay for small incidental costs not associated with the normal processes for the acquisition of materials and services; and

WHEREAS, petty cash funds are not provided for the purpose of circumventing the regular acquisition process; and

WHEREAS, purchase order procedures can be utilized with most vendors when making frequent purchases.

NOW, THEREFORE BE IT RESOLVED, by the Mayor and Council of the City of Hackensack, County of Bergen a petty cash fund in the amount of $600 is approved for year 2018; and

BE IT FURTHER RESOLVED, that no single payment from the petty cash find shall exceed $50.00. Each disbursement shall be evidenced by an appropriate receipt. The petty cash fund shall be subject to approved accounting procedures and shall be closed out at the end of the year for audit.

RESOLUTION FOR AUTHORIZATION OF THE ADOPTION OF A CASH MANAGEMENT PLAN INCLUDING DESIGNATION OF APPROVED

DEPOPSITORIES

BE IT RESOLVED, by the Mayor and Council of the City of Hackensack, County of Bergen for the year 2018, the following shall serve as the Cash Management Plan of the City of Hackensack.

The Chief Financial Officer is directed to use this cash management plan as the guide in depositing and investing the City of Hackensack's funds.

The following Government Unit Deposit Protection Act (GUDPA) approved banks are authorized depositories for the deposit of funds:

The Chief Financial Officer is empowered to invest cash funds as bank balances will allow from time to time in order to maximize realized revenue.

In accordance with N.J.S.A. 40A;5-15.l, the following instruments are authorized as suitable investments for the City of Hackensack:

• Interest-bearing bank accounts in banks as authorized above for deposit of local unit funds (GUDPA approved);

• Certificates of Deposit in GUDPA approved banking institutions;

• Bonds or other obligations of the United States of America or obligations guaranteed by the United States of America. This includes instruments such as Treasury Bills, Notes, and Bonds;

• Government money market mutual funds that comply with the requirements ofN.J.S.A. 40A:5-15.l(e);

• Any federal agency or instrumentality obligation authorized by Congress that matures within 397 days from the date of purchase, and has a fixed rate of interest not dependent on any index or external factors;

• Bonds or other obligations of the local unit or school district of which the City is a part;

• Local government investment pools, including municipal note issuances, which comply with N.J.S.A. 40A:5-15. l(e) and conditions as set by the Division of Local Government Services;

• New Jersey Cash Management Fund;

• Repurchase agreements of fully collateralized securities which comply with N.J.S.A. 40A:5-15. l(e);

• New Jersey Asset and Rebate Management Program.

There are no approved security broker/ dealers. In the event that a security broker/ dealer shall be approved during the year, the registered principle of said brokerage firm so approved shall be provided with and sign an acknowledgement that have seen and reviewed this cash management plan.

Each month the Chief Financial Officer shall prepare a report for the City Manager that consists of the following:

• A summary of all investments made or redeemed for the month.

• A listing of any and all financial institutions holding local unit funds.

• The class or type of securities purchased or funds deposited.

• Income earned on deposits and investments.

• Market value of investments and disclosure as to how the value was determined, if applicable.

• A listing of accounts or deposits that do not earn interest.

This document shall constitute the cash management policy of the City of Hackensack.

Any official involved with the selection of depositories, investments, broker/ dealers, shall disclose any material business or personal relationship to the City Manager and to the Local Finance Board or Local Ethics Board as applicable.

Any official who, in the course of his or her duties, deposits or invests in accordance with this plan shall be relieved of any liability for loss.

RESOLUTION AUTHORIZING 2018 TEMPORARY BUDGET

WHEREAS, N.J.S.A. 40A:4-19 provides that where any contract, commitment or payments are to be made prior to the final adoption of the 2018 Budget, temporary appropriations should be made for the purpose and amounts required in the manner and time therein provided; and

WHEREAS, the date of this resolution is within the first thirty days of January 2018; and

WHEREAS, the total appropriations for 201 7, exclusive of any appropriations made for interest and debt redemption charges, capital improvement fund and public assistance in said budget is the sum of $92,303,087.00; and

WHEREAS, 26.25% of the total appropriations in the 2016 Budget, exclusive of any appropriations made for interest and debt redemption charges, capital improvement fund and public assistance, in said budget is the sum of $24,229,560.34.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Hackensack that the following appropriations be made and that a certified copy of this resolution be transmitted to the Chief Financial Officer for his records.

RESOLUTION AUTHORIZING CHANGE ORDERS -DMR ARCHITECTURE FOR M&M BUILDING RENOVATION PROJECT

WHEREAS, the City of Hackensack was in need of architectural services for the M&M Building Renovation Project; and

WHEREAS, the Mayor and Council of the City of Hackensack awarded a contract to DMR Architecture in the amount of $490,000 on September 27, 2016 as per Resolution #367-16; and

WHEREAS, the City Manager now recommends the approval of Change Order # 1 which is an increase of $1 7 ,500.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack, County of Bergen, as follows:

1. DMR Architecture of 777 Terrace Ave., Hasbrouck Heights, NJ 07604 is hereby awarded Change Order #1 in the amount of 17,500 bringing the total amount of the contract not to exceed $507,500.

2. A Certification of Funds has been prepared and authorized by the Chief Financial Officer for the said contract assuring that there is a sufficient appropriation to fund the purchases authorized in this resolution as an express and mandatory condition of this contract.

3. The budget account to be charged is C-04-16-015-000-100.

4. The Mayor and Clerk are hereby authorized to sign the contract documents necessary to effectuate the award of this contract. The City Attorney shall review any and all contractual documents prepared in furtherance of this award.

WHEREAS, N.J.A.C. 5:30-15 established rules that govern how local government units manage and finance compensation for accumulated absence time for their respective employees, and

WHEREAS, accumulated absence includes any sick days, vacation days, personal days, compensatory time or any other absence time authorized as part of an employer agreement, which is not used by the employee during the allowed period and which is permitted to accumulate over time to the benefit of the employee, and

WHEREAS, the Chief Financial Officer has certified that the funds and authority exists to pay Anthony Sedita owed vacation days and sick days; and

WHEREAS, City Manager Ted Ehrenburg has authorized the payment of $100,311.13 to Anthony Sedita for said days.

NOW THEREFORE, BE IT RESOLVED that the Mayor and Council of the City of Hackensack hereby approves payment to Anthony Sedita in the amount of $100,311.13 for an accrued time payout in accordance with the rules and regulations established by the Local Finance Board for such payments.

WHEREAS, the City of Hackensack requires engineering design services related to the Main St. North Streetscape Project; and

WHEREAS, the City solicited Requests for Proposals regarding said services; and

WHEREAS, a proposal was received from Boswell McClave Engineering; and

WHEREAS, it was determined that the proposal from Boswell McClave Engineering was most advantageous to the City based on cost, experience and specific knowledge of this particular project.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack, County of Bergen, as follows:

I. Boswell McClave Engineering of 330 Phillips Ave. South Hackensack, NJ 07606 is hereby awarded a contract in the amount not to exceed $15,000 for engineering design services related to the Main St. North Streetscape Project, in accordance with the proposal attached thereof.

RESOLUTION AUTHORIZING THE ESTABLISHMENT OF A RESERVE FOR PRELIMINARY EXPENSES FOR THE MAIN STREET SOUTH

STREETSCAPE PROJECT

WHEREAS, the City of Hackensack hereby acknowledges the requirement of preliminary costs to determine the scope and cost of the project to provide for the beautification and enhancement of the south side of Main Street through a Streetscape project. The purpose of these preliminary costs are for the engineering and related studies to establish the scope and cost of the Main Street South Streetscape Project. The amount to be charged is for the purpose for which bonds may be issued under Chapter 2 of Title 40A.

NOW THEREFORE, BE IT RESOLVED that the amount appropriated for preliminary costs shall not exceed $140,000 and the Chief Financial Officer is authorized to set up a "Reserve for Preliminary Expenses - Main Street Streetscape Project" out of the Capital Improvement Fund of the General Capital Fund.

RESOLUTION AUTHOIUZING MUNICIPAL TAX COLLECTOR TO CANCEL ALL SMALL BALANCE OF LESS THAN TEN DOLLARS IN THE 2018

CALENDAR YEAR

WHEREAS, the Governing Body of the City of Hackensack finds and declares that N.J.S.A. 40A:5-l 7-l empowers authorized municipal employees to process the cancellation of tax refands and/or delinquencies of less than Ten ($10.00) Dollars, and

WHEREAS, the Governing Body farther finds and declares that the Municipal Tax Collector is qualified to process the cancellation of tax refunds and/or delinquencies ofless than Ten ($10.00) Dollars, and

WHEREAS, the Governing Body farther finds and declares that it is in the hest interest of the citizens of the City of Hackensack for the Municipal Tax Collector to be authorized to process the cancellation of tax refunds and/or delinquencies of less than Ten ($10.00) Dollars in accordance with N.J.S.A. 40A:5-l 7-l;

NOW, THEREFORE BE IT RESOLVED, by the Governing Body of the City of Hackensack that Municipal Tax Collector Elisa Coccia is hereby authorized to process the cancellation of tax refunds or delinquencies of less than Ten ($10.00) Dollms during the calendar year 2018 in accordance with N.J.S.A. 40A:5-l 7-l.

RESOLUTION NO. 18-18

RESOLUTION AUTHORIZING THE TAX COLLECTOR TO FIX THE RATE OF INTEREST TO BE CHARGED FOR NONPAYMENT OF

TAXES, ASSESSMENTS AND OTHER MUNICIPAL CHARGES

WHEREAS, N.J.S.A. 54:4-67 permits the Governing Body of the City of Hackensack to fix the rate of interest to be charges for the nonpayment of taxes, assessments, or any other municipal charges.

THEREFORE, BE IT RESOLVED, by the Governing Body of the City of Hackensack that the rate of interest on unpaid taxes shall be eight (8) percent per anmnn on the first One Thousand Five Hundred ($1,500.00) Dollars of delinquency and eighteen (18) percent per annum on any amount in excess of One Thousand Five Hundred ($1,500.00) Dollars to be calculated from the date the tax was payable lmtil the date of actual payment, provided that no interest shall be charged if payment of any installment is made on or before the tenth calendar day following the date upon which the same became payable; and,

BE IT FURTHER RESOLVED, that the rate of interest on unpaid sewer bills shall be eight (8) percent per ammm on the first One Thousand Five Hundred ($1,500.00) Dollars of delinquency and eighteen (18) percent per annum on any amount in excess of One Thousand Five Hundred ($1,500.00) Dollars to be calculated from the date the charge was billed until the date of actual payment, provided that no interest shall be charged if payment of any bill is made within thirty (30) calendar days following the billing date; and,

BE IT FURTHER RESOLVED, that when the 10th day of grace period for taxes, or the 30th day for sewer billing, falls on a Saturday or Sunday, it is due on the following Monday, and if the following Monday is a legal holiday, it will be due and payable on the following Tuesday, and,

BE IT FURTHER RESOLVED, that in addition to the interest provided above, on all delinquencies in excess of Ten thousand ($10,000.00) Dollars and which are not paid prior to the end of the calendar year, the tax collector shall also collect a penalty of six (6) percent of the amount of the delinquency in excess of Ten Thousand ($10,000.00) Dollars.

BE IT FURTHER RESOLVED, that the Municipal Clerk provide a certified copy of this resolution to the Tax Collector.

RESOLUTION NO. 19-18

RESOLUTION AUTHORIZING AN ACCELERATED TAX LIEN SALE FOR CALENDAR YEAR 2018

WHEREAS, the Governing Body of the City of Hackensack finds and declares that N.J.S.A. 54:5-19 requires that the City of Hackensack conduct a public tax sale to enforce delinquent municipal liens by selling said liens in accordance with the Tax Sale Law; and

WHEREAS, "delinquency" means the sum of all taxes and municipal charges due on a given parcel of property covering any number of quarters or years per N.J.S.A. 54:4-67, and

WHEREAS, the Governing Body further finds and declares that the Municipal Tax Collector is qualified to hold said Tax Sale in the calendar year 2018 for municipal delinquent charges; and

WHEREAS, the Governing Body further finds and declares that the Accelerated Tax Lien Sale may be at the discretion of the Municipal Tax Collector;

NOW, THEREFORE BE IT RESOLVED, by the Governing Body of the City of Hackensack that the Municipal Tax Collector, Elisa Coccia, is hereby authorized to conduct an Accelerated Tax Lien Sale during the calendar year of 2018 in accordance with N.J.S.A. 54:5-19.

BE IT FURTHER RESOLVED, that the Municipal Clerk provide a certified copy of this resolution to the Tax Collector.

RESOLUTION NO. 21-18

RESOLUTION AUTHORIZING THE REJECTION OF ALL BIDS FOR ELEVATOR ADDITION AT THE EMERGENCY OPERATIONS CENTER

WHEREAS, the City of Hackensack solicited bid proposals for the installation of an elevator in the Emergency Operations Center in the City of Hackensack; and

WHEREAS, two (2) bids were opened and read on November 21, 2017; and

WHEREAS, upon reviewing the bid submissions it was determined that the lowest bid proposal substantially exceeds the appropriation for this project.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the City of Hackensack, County of Bergen that all bids be rejected for the elevator installation at the Emerg3ency Operations Center, pursuant to N.J.S.A. 40A:l l-13.2.b.
