    counterfeit products from the building/shop of the defendant. It is

    contendedthatifpriornoticeofsuitisgiventothedefendant,hewill

    in all probability remove the infringed material and equipment in

    order to frustrate thecase. Request seems genuinein viewof the

    documents and purported counterfeit products emanating from

    defendantshown.

    Plaintiff claims to be the largest manufacturer of

    Sportswearapparels, shoes and accessories in Europe and second

    largestintheworld.Itistheowneroftrademarks'adidas',withlogo

    ofthreestrips,'trefoil'anditsproductsunderthesemarksareTM09/2015 Page1of5

  • available in 160 countries worldwide including India. Although, it

    formallyentered India in 1989yet adidasand relatedbrandswere

    alreadywellknownhere.Theplaintiffhassponsoredmanyeventsin

    the Olympics and FIFA world cup. The plaintiff carries out

    advertisementsinIndiaandotherpartsoftheworld throughprint,

    televisionandothermediaforpromotionofitsbrandandproductsand

    incurshugeexpensesonaccountofadvertisement.Theplaintiffhas

    hugeturnoverandintheyear2012itsworldwidenetsaleswere14883

    millionEuro.Theplaintiffhasgotitsvarioustrademarks,logosand

    devices registered from 1989 onwards. Its products under the

    registeredtrademarkhave extensivelybeenacceptedasquality and

    standard products. The excellent reputation and goodwill has thus

    been acquired by the plaintiff amongst the user/consumers of its

    productsduetostrictqualitycontrol.

    DuringmarketsurveyinthelastweekofMarch,2015,

    the defendants has been found to have engaged in manufacturing,

    selling, stocking, anddistributing of counterfeit footwear including

    Shoes and accessories under the trademark and logo 'adidas', 3

    stripes''threebars'and'Trefoil'anddeceptivelysimilartrademarks

    whicharemuchinferiorinquality.ThelabelattachedandtrademarksTM09/2015 Page2of5

  • embossedontheimpugnedproductsofdefendantaresimilarindesign

    andappearanceandsufficienttoconfusethepotential purchaserof

    the products of the plaintiff. The defendant has infringed the

    registeredtrademarksandlogosofplaintiffwithmalafideintention.

    I have perused the sample of Shoes purportedly

    belongingtothedefendantandonecoming outoftheplaintiff.The

    wordmarkandlogo'adidas'and'3stripes'oftheplaintiffareusedin

    the impugned product prominently as that of the plaintiff. By

    adopting exactlytheidenticaltrademarkofplaintiff, thedefendant

    hasapparentlytriedtoconfusethepotentialcustomersofplaintiffand

    alsodenttheirrevenues.Theunwarycustomerofplaintiffneedstobe

    protected fromsecondary products of unscrupulous persons like

    defendantwhomaybeouttomakequickbuckwhilepayingforthe

    highendproducts of plaintiff. Theplaintiff thushasbeen able to

    makeouttheprimafaciecaseforgrantofexparteinjunction.

    In order to seize the infringing goods, material and

    equipmentsfromtheshopofdefendant,Sh.AbhishekVerma(Mob.

    No.9891899809) isappointedasLocalCommissionerwithdirection

    tovisitthepremises/godownofdefendantlocatedat ShopNo.29,

    Ground Floor, Gaffar Market, Karol Bagh, New Delhi110005

    and also at Building No. 2342/2343, Ajmal KhanRoad, Karol

    Bagh, Beodanpura, New Delhi110005 and seize the infringing

    materiali.e.Shoesandotheraccessoriesunderthetrademark'adidas',

    '3 stripes' 'three bars' and 'Trefoil' and deceptively similar

    trademarks. He shall prepare an inventory of goods and material

    seizedfromtheaboveaddressesandreleasethemtodefendantortheir

    officialonsuperdariaftersealingtheseizedarticlesinbags.Heshall

    alsoputhisinitialsonthebagsandsomeoftheincriminatingmaterial

    withindelibleink.

    TheLd.LocalCommissionermaytakehelpofthelocal

    policeincaseofneed.SHOPSKarolBaghisdirectedtoprovideall

    possiblehelptotheLocalCommissionerinsmoothlycarryingoutthe

    hadgotsentareplytoitthroughcounsel.

    Itiscorrecttosuggestthattheentryforusisthesamewhichis

    theentryforthechurchandtheschoolrunbychurchandguardposted

    attheentrygateisofthechurch.

    I am not aware so I cannot admit or deny whether 1889,

    ChandniChowk,Delhi06ispropertyofMr.AmarNathMehra,prop.

    ofKumarCinema.

    Itisincorrecttosuggestthatwehavewronglyvaluedthesuit

    propertyasitisnotsupportbyanyreportofapprovedvaluer.Itis

    ofmyofficialworkIhaveneveropenedtheaccountsindefendant's

    bank.

    Inpara3ofmyaffidavitIhavementionedaboutcompletionof

    allformalitiesinopeningoftheaccountinquestion.IsaythatIam

    not aware what all formalities were completed before opening the

    accountinquestion.Vol.IamawarethatKYCdocumentsaretaken.

    KYC is KnowYour Customer. I amnot aware whether KYC

    norms were in operation in year 2001. Identity proof and address

    proof are those documents whichare required as per KYCnorms.

    Originalsofthecopiesofabovesaiddocumentsarealsoseenatthe

    timeofopeningoftheaccount.Iamnotawarewhethertheaccount

    openingformistobefilledinthebankbytheaccountholderatthe

    time of opening of account. It is correct to suggest that original

    partofMarkDX1(colly.)wasfilledupandsignedoutsidethebank

    premises and given to Mr. Sachin Pandirkar, bank official, who

    openedtheaccount.Itiscorrecttosuggestthatthereisnoimpression

    ofanyphotographinthecopyofaccountopeningform,partofMark

    DX1 (colly.). I do not know whether in year 2001 there was

    requirementofaffixingphotographonaccountopeningform.Ihad

    not opened my account before 2001. There is no need for any

    introducerforopeningaccountbutKYCnormsaremandatory.Ido

    notknowsoIcannotadmitordenythatin2001,therewasmandatory

    requirementofintroducerforopeningtheaccountinquestion.It is

    correcttosuggestthattherewasnointroducerforopeningtheaccount

    inquestion. I donotknowsoI cannotadmitordenythataccount

    opening form, part of MarkDX1(colly.) was filled by Mr. Sachin

    Pandirkarinhisownhandwriting.IdonotknowsoIcannotadmitor

    denythatnopersonofnameVijayJainexisted.Addressofaccount

    holdermustbementionedintheaccountopeningform.Itiscorrectto

    suggestthatintheaccountopeningform,copyMarkDX1(Colly.)no

    registered against Mr. Sachin Pandirkar and other employee of

    SachinPandirkarbankemployeeandgotopenedaccountinquestion.

    Inmypresence,thetransactionofopeningofaccountinquestionhad

    nottakenplaceandIamnotawarewhatalltranspiredintheprocess

    of openingof account in question or whoopened it andat whose

    instanceitwassoopened. Icannotadmitordenywhetheroriginal

    rationcardwasnotseenatthetimeofopeningofaccountinquestion.

    It is correct to suggest that in the event of deposit and immediate

    withdrawaloflargesuminnewopenedaccount,bankofficialsareto

    bevigilantasperRBIguidelines.Icannotadmitordenythatcheque

    book was delivered to Mahavir Impex in respect of account in

    questionwithoutcompletingnecessaryformalitiesofbeingdelivered

    toauthorisedperson.

    It is incorrect to suggest that defendant bank is guilty of

    negligence inopening theaccountinquestionand negligenceand

    lachesbyhonouringandpassingthechequeindisputebearingno.
