INTERLOCAL AGREEMENT

This agreement is made and entered into by and between LAKEWOOD RANCH COMMUNITY DEVELOPMENT DISTRICT 2 (hereinafter "CDD2"), LAKEWOOD RANCH COMMUNITY DEVELOPMENT DISTRICT 5 (hereinafter "CDDS") and LAKEWOOD RANCH COMMUNITY DEVELOPMENT DISTRICT 6 (hereinafter "CDD6"), community development districts organized under the laws of the State of Florida.

WHEREAS, CDD2 owns the Lakewood Ranch Legacy Gatehouse (hereinafter "Legacy Gatehouse") and other infrastructure and improvements throughout CDD2; and·.

If Exhibit "B" is modified and amended, by written agreement of all parties, to include additional shared expenses, apportiomnent of costs shall also be calculated according to this paragraph.

4. EXHIBIT "A". Exhibit "A" to this Agreement shall be the document originating from the Interlocal Agreement for the Inter-District Authority whereby all shared expenses between any and all parties of the Interlocal Agreement for the Inter-District Authority are enumerated and appropriation calculations are set forth. Exhibit "A" may be modified with the written agreement of all parties to this agreement with regard to any expenditure indicated on Exhibit "B" to this Agreement.

No custom or practice of the parties at variance with the tenns hereof shall constitute a waiver, nor shall any delay or omission of a party to exercise any rights arising from a default impair the party's rights as to such default or any subsequent default.

g. CAPTIONS. Titles or captions of articles and paragraphs contained in this Agreement are inserted only as a matter of convenience and reference, and in no way define, limit, extend, or describe the scope of this Agreement or the intent of any provisions hereunder.

h. COUNTERPARTS. This Agreement may be executed in counterparts, each of which when taken together shall constitute the entire whole agreement.

i. COOPERATION. By signature below, the parties agree to cooperate to achieve the most efficient and cost-effective operation of the Legacy Gatehouse and the Balmoral Gatehouse.

A RESOLUTION ADOPTING THE LAKEWOOD RANCH COMMUNI'l'f DEVELOPMENT DISTRICT

PUBLIC ACCESS PROTOCOL

WHEREAS, the District's Board of Supervisors requested and obtained a special power for security, including, but not limited to, guard gates, guard houses, fences and gates, electronic intrusion-detections systems and patrol cars, as .more fu!ly set forth in Manatee County Ordinance 04-49; and

WHEREAS, consistent with the objectives of Ordinance 04-49, the District's Board of Supervisors desire to adopt the attached Lakewood Ranch Community Development District Public Access Protocol, attached hereto as Bxbibit "A" and incorporated herein.

NOW THEREFORE BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE LAKEWOOD RANCH COMMUNITY DEVELOPJYIENT DISTRICT;

1. The Lakewood Ranch Co=unity Development District PUblic Access Protocol, attached hereto as Exhibit "A" is hereby approved and adopted.

2. The District agrees to comply with Manatee County Ordinance 04-49.

uakewood Ranch Community Development District 6 Public Access Protocol

The Lakewood Ranch Community DevelopmentDistrict 6 ("CDD 6"), a local unit of special purpose govemment, intends to aoqulretitlebydedication to certain roads and roadways located within the boundaries ofCDD 6. This public access protocol applies to all security control devices, guard gates, and other such items to be located within the CDD 6. 'l'hls public access protocol applies to all subdivisions located within tha CDD 6. The public access protocol includes the following:

1. Objective. The CDD 6's objective is to implement security control procedures in accordance with Section 190,012 (2) (d), Florida Statutes, and pursuant to Chapter 120, Florida Statutes. The CDD 6 Board of Supervisors requested and obtained a special power for security, including, but not limited to, guard houses, fences and gates, electronic intrusion-detection systems and patrol cars, as more fully set forth in Ordinance #04-49, dated May 4, 2004.

2. Public Access. Public access will be provided to all individuals and vehicles which desire access over the streets and roadways owned and controlled by the CDD 6. Public access will not be denied by CDD 6 policy or personnel. Public access shall be permanently available on a continuous, twenty-four (24) hour and seven (7) day a week basis.

3. Secnrity Control Procedures. Personnel employed by the CDD 6 may man the guard house(s) as identified on the approved final site plan for the property within the boundaries ofCDD 6 and intend to employ the following security control procedures, including:

A. Stopping all incoming vehicles, except for those containing a CDD 6 issued bar code scanner or other electronic device approved by the CDD 6.

B. For all vehicles stopped by CDD 6 personnel at the guard house, CDD 6 personnel may request infonnation, on an optional basis, as to the intended destination of the individual and/or vehicle. The requested stop will be professional, brief and non-in1rusive.

C. Electronic imaging systems may photograph the vehicle and the vehicle's license plate.

Inspection Carry-over Items: 3 Replacement Items: Performance Evaluation: The inspection of CDD 2 this month found the property to in good condition. The plant material overall is healthy and growing vigorously. The new Indian Hawthorn bushes along Lakewood Ranch Boulevard in the center median has been delayed due to a change in plant material and will get installed in December. The turf has been fertilized and is showing good color and had received a blanket weed control application. The weed control products used take a few weeks to show the desired results we will monitor them to see if we get the desired results. The annuals have been installed and are doing well. The weather has changed from the rainy season to cool and dry. The result has caused the grassy weeds to die off giving the turf in some areas a yellowing look. This will fill in some areas and other larger areas will need to be replaced with new turf. The bed weeds are under control in most areas. The berm along University has been cleaned up and the remaining dying Juniper will be removed. These areas will need to get new plant material installed to give the desired presentation. The perennial peanut along Eagle Watch Way was installed and looks good. The existing peanut plants will be given additional nutrients to help fill in voids. The vine growth has been addressed and exotics are under control. With the season change the contractor will be addressing the detail along the back side of berms to reestablish edges and treat weeds. The district will receive a passing grade.
