Foreword

Kivells are delighted to have received instructions on behalf of Mr JW Harris-Jarvis

of Rowden Farm, Longbredy, Dorchester to disperse his entire Dairy herd which is

being removed to Exeter Livestock Centre for convenience of sale.

We started farming in 2002 on a Devon County Council farm in South Devon

(Buckridge Farm, Denbury). In 2007 we moved to Dorset to another County

Council farm (Rowden farm). In 2011 we sold all of our Holsteins and restarted in

2012 with a small herd of Jerseys, progressing into cross breeding. More recently

Fleckvieh has been used extensively across the herd and the majority of the

Youngstock are Fleckvieh X and the Cows and Heifers are all In-Calf to Fleckvieh.

The Cows are grazed at grass in the summer months and fed grass silage with

concentrates in the parlour and grass & maize silage in the winter months. This

winter, a blend has been added into the wagon as our forage stock has been short.

It has been our aim to produce high quality milk to maximise our milk price and in

the last year between April ‘18 to March ‘19 we were 10th out of 150 producers on

the Barbers Annual Milk Results. The Herd is averaging approx. 6000kgs however

the cows could produce a lot more if they were pushed more intensively.

Rowden Farm needs considerable investment to update the buildings to run as an

efficient Dairy Farm and with there being no access for the cows to go down the

farm lane and cross the road to grazing ground it has become very difficult to farm

how we want to. As a result we have made the difficult decision to disperse the

Dairy herd which will allow us to explore other options for the future.

The Sale comprises 141 In Milk &/or In Calf Cows & Heifers, 52 In Calf Heifers, 62

Bulling & Yearling Heifers, 10 Heifer Calves & 1 Pedigree Fleckvieh Bull.

NMR Herd Average 6075kgs 4.42%BF 3.84%P cc158

Our milk sold averages are 5.02BF, 3.84P, SCC 154 and Bactoscan 34. (NMR

result is always lower than our sold as cannot agitate milk when milk recording

because of flushback system).

Herd Age

This is a young herd with 46 milking Heifers, 36 second, 17 third, 12 fouth, 13 fifth

& 9 sixth plus calvers.

Calving Pattern

The herd Calves predominantely in a spring and Autumn block period: February-

April (20), May-June (44 inc 25 Heifers), July-August (41), September-October (56

inc 28 Heifers) & November-December (24).

Herd Health

The herd is not vaccinated but is regularly screened with bulk milk sample

for BVD, Lepto & IBR bulk and results have always been negative.

Dry Cow Threapy – Ubro Red

Bulling & In Calf Heifers were drenched with Ovidrench 10% on 8th May

Close Calving Heifers & Dry Cows were drenched with Ovidrench on 30th

April.

Six month to Yearling Heifers were wormed with Closamectin on 30th

April.

We have never had a TB reactor on this farm or Buckridge

We are on a 12 monthly testing and had our latest Annual Test on 2nd April

2019.

Auctioneers comments

This is an excellent herd of grazing type cows which have huge potential to go on

and perform well. They have excellent udders and as well as a large number of cows

and heifers being fresh or close to profit there is a great number due in the Summer

and Autumn period. The Youngstock are nearly all Fleckvieh bred and look very well

along with the Fleckvieh bull that they are In-Calf to who will sell in the sale! With

something for everyone this sale should not be missed!

and disinfection legislation. All vendors, purchasers, agents and hauliers must comply with all

current legislation governing the welfare of livestock whilst at Kivells livestock market premises or

in transport to or from the livestock market premises. Any concerns over Biosecurity and Animal

Welfare should be reported to Kivells Biosecurity and Animal Welfare officers, whose details are

located in the Kivells market office.

Registration - In order to bid, all new Buyers are required to register before the auction, at the

Kivells market office or as otherwise advised by the Auctioneers. All such Buyers will be asked for

two forms of identification and a credit reference will be required. Acceptable identification

includes Driving Licence/Passport together with a Utility Bill/Proof of Address/Business Letter

Heading/Business Card. The Auctioneers reserve the right to request a deposit ahead of any

purchase or during sale proceedings and to refuse registration or any bid or bidder without giving

reason. New Buyers are strongly advised to contact the Auctioneers well in advance of the sale.

Payment - All Lots must be paid for on the day of the Sale by the Buyer prior to any removal or

consolidation, unless alternative arrangements have been agreed with the Auctioneers. At the fall

of the hammer the highest bidder will be deemed to be the Buyer and transfers of purchases will

only be permitted with prior approval from the Auctioneers. Any payment is to be by a means

approved by the Auctioneers. Our preferred payment terms are debit card or cash and Kivells

reserve the right to stipulate payment by these methods. Kivells may also accept bank transfers

and cheques with prior approval. Our Bank Account details are: Sort Code 56-00-49 Account

Number 32376359.

Payment in Cash - In order to comply with money laundering regulations we cannot accept Cash

payments above the maximum permitted at the time of sale. The maximum varies according to

exchange rates and currently it is circa £9,000. Buyers are advised to check with the Auctioneers

ahead of the sale.

Conditions of Sale - It is strongly recommended that Bidders and Buyers visit Kivells.com and read

the full Conditions of Sale produced by the Livestock Auctioneers Association (LAA) ahead of the

sale. Unless advised otherwise you will be bidding and buying under these Conditions and you will

be obligated to abide by these Conditions and these Notice to Purchasers. The LAA Conditions of

Sale are also displayed in Kivells market office. Clauses 12 to 19 inclusive relate mainly to the

Purchaser. This catalogue may also contain reference to Warranties as defined by the LAA

Conditions of Sale. Warranty issues will not be considered if payment in full has not been received.

Risk - All livestock are at the risk of the Vendor before they are sold and at the risk of the Buyer

when they are sold (fall of the hammer). It is strongly advised that Vendors and Buyers ensure

that their insurance policies cover livestock at market premises and that Buyers have immediate

cover for animals purchased.

Removal of Lots - Lots can only be removed once payment has been made in full and/or a pass

issued by the Auctioneers. All Lots need to be cleared from the sale premises by 5pm on the day

of sale unless otherwise agreed with the Auctioneers.

Descriptions of Lots - Buyers should satisfy themselves prior to making bids as to the condition of

any Lot and should rely on their own judgement as to whether the Lot accords with its description.

All Lots are sold under the Livestock Auctioneers Association Conditions of Sale as referred to

above to include the following two clauses:

Statements of Fact - Unless otherwise announced all statements of fact made in any sale

catalogue or at the time of sale regarding the breeding of any animal, its health status or other

tests carried out on any animal are statements of fact made by the Vendor and not the Auctioneer

and the Auctioneer accepts no responsibility for any misstatement nor does he nor the Vendor

accept any responsibility for any subsequent reaction by an animal sold to any relevant test

administered after the sale.

Liability of The Auctioneer - The Auctioneer acts in all respects only as agent for the Vendor and

no warranty is given by the Auctioneer or his employees or contractors, and none shall be implied,

as to title, description or the quality of any Lot. Neither the Auctioneer nor his employees or

contractors shall be liable to the Purchaser in any respect for any defect of title, error of

description or imperfection or for any announcement or statement concerning any Lot offered for

sale whether made orally or in writing (whether in a sale catalogue, order of sale, advertisement

for the sale or otherwise) and whether given before, during or after the sale, nor shall he incur

any liability in relation to any dispute between a Vendor and Purchaser.

Bidding Form - The Auctioneers will bid on your behalf if written instructions are received on the

form supplied, or an email or text has been received confirming instructions and acceptance of

the terms set out in the form and adequate time is available to enter such bids. The Auctioneers

reserve the right to request a deposit as part of the instruction process. It is entirely at the

discretion of the Auctioneers whether other forms of bids are acceptable however in every case

there is no liability on the auctioneers.

Refreshments and Facilities - Canteen and toilets are on site.

Auction Sale Rules

(All cattle sold by Kivells are sold under the Livestock Auctioneers Association Conditions of Sale)

*In Milk / In Calf dairy cattle sold through the dairy ring at £500

or less per head DO NOT carry the usual National Sales

Conditions warranty*

Maiden heifers stated to be sold for breeding purposes.

The vendor warrants a maiden heifer stated in the catalogue or at the time of sale to be sold for breeding purposes to be free from any malformation which would render the animal incapable of breeding. The warranty is a 5 day warranty if the malformation is patent or a 6 month + 5 day warranty if the malformation is

latent.

If the purchaser proves a breach of warranty the purchaser may return the animal to the vendor. Notice of

claim must be supported by a veterinary surgeon’s certificate.

Cows or heifers sold as being in milk and/or in calf. The vendor warrants a dairy cow or heifer in calf

and/or in milk: (a) To be correct in the udder and teats; (b) Not to be infected with clinical mastitis;

(c) Not to suck any other animal or herself; and (d) To be quiet to milk.

The warranties in conditions (a) & (b) is an after sale warranty which shall run from the close of the day’s sale

or until the animal is removed from the sale premises, whichever is sooner. The warranty in conditions (c) & (d) is a 5+5 day warranty.

Cleansing The vendor warrants that all newly calved cows and heifers have cleansed satisfactorily before the

sale. This warranty is a 3 day warranty in which any claim made by the purchaser must be supported by a veterinary surgeon’s certificate. The vendor is obliged to pay for the cost of one wash out.

Cows or heifers sold as served or guaranteed in calf.

When an animal stated to have been served less than 10 weeks prior to the sale and is pregnancy diagnosed positive, this is given as guidance only and carries no warranty. If a cow or heifer has been positively diagnosed as 10 weeks or more in calf at the time of sale and thereafter is proved to be not in-calf, and a Veterinary Surgeon’s certificate to that effect is produced there is a 38 + 5 day warranty.

Where a cow or heifer is sold as ‘having run with a bull’ no warranty as to the animal being in calf at the time of sale is given.

Breeding Stock bulls The vendor warrants that any bull 10 months or over sold as a stock bull is capable of

and effective at natural service. This warranty is a 16 week warranty.

Please note Milk yields are given as a guide but carry no warranty.

The descriptions are supplied by the vendor and whilst they are believed to be correct this catalogue in no way

shall guarantee their accuracy.

Antibiotics – Please would all vendors inform the Auctioneers if any animal has been treated with any antibiotics. There are serious penalties incurred to milk producers for antibiotic contamination.
