Upon approval of your credit application, we will notify you of the initial Index Rate, margin and APR for your account. The initial Index Rate will be determined as of the date your credit application is approved. An adjustment in the periodic rate and corresponding APR will apply both to outstanding balances of the account and to new purchases, cash advances and/or other charges. After you open a credit line, rate information will be provided on periodic statements that we will send you. CHANGES TO TERMS: We may change the terms and conditions of this Agreement by providing you at least 90 days’ prior written notice as permitted by Section 422.415 of the Wisconsin Statutes. MONTHLY PAYMENT: A statement will be mailed to you every month. You must pay the minimum payment within 25 days of the statement date. You can reduce your finance charge by paying more than the minimum payment. Any additional amount paid will reduce the balance, but will not prepay any future monthly payments. You can eliminate the finance charge by paying the new balance in full. A payment is applied to the finance charge first and then to the balance. If you exceed your credit limit, the minimum payment will be your monthly payment plus the total amount above your credit limit. Purchases and cash advances will be paid off in the order that they were added to your regular balance. If two or more transactions are added on the same day, your payment will be applied to the smaller first. DEFAULT: You will be in default if (1) you fail to make the minimum payment on time 2 times during any 12 month period or (2) your ability to repay us or the value to us of our security interest is materially reduced by a change in your employment, an increase in your obligations, bankruptcy or insolvency proceedings involving you, your death, or your failure to abide by these regulations. If you default 3 times within 12 months and we notified you of the prior 2, and you do not cure your default within 15 days after we sent you a written default notice, we have the right to demand immediate payment of your full account balance. SECURITY INTEREST: Each purchase and cash advance through your account constitutes a loan made by WCCU to you in the State of Wisconsin. You agree that the Wisconsin Consumer Act applies to all these loans (except for the rate of finance charge which may be governed by federal law) even though you are a person not otherwise covered by the Act. To secure each purchase loan, you grant us a security interest under the Uniform Commercial Code in any goods you purchase with it. If you default, we still have the right to recover any of these goods which have not been fully paid for through our application of your payments in the manner described in the monthly payment section. You also agree to grant us a security interest in all funds now or hereafter in the WCCU deposit accounts that you have listed on the application (except any IRA), and if you default under the terms of this Agreement you authorize us to apply such funds to the payment of your credit card indebtedness. To the extent not prohibited by Wis. Stat. 422.417 or other provision of the Wisconsin Consumer Act, this Agreement is also secured by all existing and future security agreements between the Credit Union and any Borrower or any other person providing security for Borrower’s obligations. However, this Agreement is not secured by a Borrower’s dwelling. CREDITS: If those who honor your card give you credit for returns or adjustments, they will send us a credit slip which we will apply to your account. The credit will first be applied to your current purchases, and then to your previous balance. If the credit is for more than what you owe, we will hold it and apply it toward any future purchases and cash advances, or refund it with your written request if the credit amount is $1 or more. We will make an attempt to return any credit that remains in your account for more than 6 months. FOREIGN TRANSACTIONS: Purchases and cash advances you make in foreign currencies will be billed to you in U.S. dollars. The conversion to dollars will be made by the foreign plan member’s bank in accordance with the applicable MasterCard/VISA operating regulations for international transactions. An International Transaction Fee of up to 1% of the transaction amount will be assessed and will be shown independently of the transaction on your billing statement. PLAN MEMBER DISPUTES: We are not responsible for those who refuse to honor your card. You must resolve directly with the plan member any disputes regarding goods or services you purchase with the card, unless (a) your purchase was made in response to an advertisement WCCU sent or participated in sending you; or (b) your purchase amount was more than $50 and was made from a plan member in your state or within 100 miles of your home. UNAUTHORIZED USE: You may be liable for unauthorized use of the card. However, you will not be liable for unauthorized use which occurs after you notify us (see information below), orally or in writing of the loss, theft or possible unauthorized use of your card. In any case, your liability will not exceed $50.00, unless you are a business or other organization to which we have issued ten or more cards for use by your employees. Your consumer liability may be $0 for fraud, theft or loss of a MasterCard if you meet the following three rules as a condition of $0 liability: the activity involves a MasterCard, you have exercised reasonable care in safeguarding the MasterCard from risk or loss or theft, you have not reported two or more incidents of unauthorized use of the MasterCard within the preceding twelve months, the MasterCard account is in good standing, you are a natural person, and the MasterCard is not used primarily for business, commercial, or agricultural purposes. Your liability may be $0 for fraud, theft, or loss of consumer Visa card, unless you have been grossly negligent or have engaged in fraud. This $0 liability limit does not apply to commercial cards. Unauthorized use does not include use by a person to whom you have given authority to use the Account. ILLEGAL USE OF CARD: You, the cardholder, agree that you will not use your Card for any transaction that is illegal under applicable federal, state or local law. Cardholder agrees that illegal use of the card will be deemed an action of default and/or breach of contract and the cardholder’s account may be terminated at the Credit Union’s discretion. Cardholder further agrees, should illegal use occur, to waive any right to sue the Credit Union for such illegal use or any activity or indirectly related to it and additionally agrees to indemnify and hold the Credit Union harmless from any suits or other legal action or liability, resulting from such illegal use. The Credit Union reserves the right to decline to authorize any transaction that may possess an undue risk of illegal activity. EFFECT OF REGULATIONS: These regulations are the contract which applies to all transactions on your account even though the sales, cash advances or credit slips you sign may contain different terms.
