ABC Boards — United States, Canada, and Puerto Rico

Following national Prohibition, the 21st Amendment to the Constitution provides states with broad powers and authority to regulate the sale and distribution of alcohol within their borders. (This is in addition to Federal requirements.) Each state created its own unique system of alcohol beverage control. There are two general classifications. “Control” states, 18 in number, are the sole wholesalers of distilled spirits, as well as the retailers in various ways in some of these States.

“License” states, of which there are 32, do not participate in the sale of alcohol beverages and regulate through the issuance of licenses to industry members that do business within their states.

(Control states also license those activities outside of the state’s direct involvement in the sale of alcohol beverages.)

In addition to meeting Federal regulations, individuals and businesses must meet each state’s individual laws and regulations. These state laws and regulations, which vary widely from state to state, may be more restrictive than Federal regulations and must be met in addition to Federal requirements unless the Federal law pre-empts the State law wherein they desire to do business.

For example regarding pre-emption, the Government Warning label on alcohol beverages pre-empts the states from imposing a similar requirement. (See 27 U.S.C. section 216.) Likewise, the state may not authorize a bottle size for distilled spirits that is not also authorized at the Federal level.

When people are moving back to the U.S., they often want to include alcohol in their shipments. Small quantities, under a case, are unlikely to be a problem, but if you own a wine collection, there can be special challenges. For this reason, Customs and Border Protection (CBP) recommends you ship the wine separately so that if there is a problem, the rest of your household effects will not be held up while it is being resolved.Keep in mind, it is illegal to send alcoholic products through the International Postal System.Personal wine collections are not considered by CBP to be either household goods or personal effects, consequently they are not eligible for duty-free treatment on entry to the United States. Because imports of alcohol are subject tostate regulations, it is very important that you do some homework before you ship your wine collection to the U.S.*Military and Government Personnel are exempt from duty on liquor and cigarettes, but not IRS tax.Many states - but not all - will allow you to enter with up to 1 case of wine without requiring you to get a license from that state's alcohol control authority. Some states make a distinction between personal and commercial importations,and will grant a license for one-time importations, while others will not. The fee for such a license can vary from state to state. Some states simply will not permit the importation of more than a specified amount, and any quantity of wine above that will be destroyed.CBP determines the admissability of wine according to the regulations of the state where the shipment enters the U.S.For instance, if your wine enters the U.S. in New York, CBP will enforce New York's regulations, if it enters the U.S. in North Carolina, CBP will enforce North Carolina's regulations.The term "enters" is very important, because it does not necessarily mean the same thing as "arrives" for CBP purposes. The distinction comes into play when goods are shipped to the U.S, as opposed to carried by, or accompanying, an individual coming to the U.S. When goods accompany you, they are "entered" through CBP at the same place where they arrive.If they are shipped, their "entry" can either take place at the port of entry where they first arrive, or, using a procedure called "in bond transit," their "entry" can take place in the state here your goods are ultimately shipped to. If you specify to your shipper that you want your goods sent "in bond" through the port of arrival to a port in your state of residence (assuming these are two different states) then CBP will enforce the rules of the state to which your goods have been sent "in bond" rather then the rules of the state where they first arrived. If you do not specify an "in bond" entry, your shipper may enter the goods in the state where they first arrive in the U.S., and that state's rules are the ones that CBP will enforce.

If your final destination state has strong barriers to the importation of alcohol, you may need to reconsider sending your wine collection to the U.S., If it does not, your wine shipment might still encounter difficulties clearing the first port of entry if that port is located in a state with barriers and your shipper makes arrangements to enter it there, rather then sending it "in bond" to your destination state. It is in your best interest to be educated about state regulations so thatyou can tell your shipper where you want your wine collection entered. As a general rule, the carrier handling your shipment will make arrangements for a Customs broker to handle all the paperwork, and if your collection is large enough that you do need a license to import it, that broker will need a copy of it, preferably before your wine arrives at the port of entry.Alternatively, some shippers have a relationship with a licensed alcohol distributor who will import your wine on your behalf, eliminating the need for you to obtain a license.While there are no federal regulations governing the importation of alcohol for personal use (other than requiring the importer to be 21 or older), a federal permit is needed to import alcohol for commercial - or resale- purposes. If your wine collection is really large, a CBP officer might suspect that you are importing it for resale and require you to get a permit from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). If you think this could be a concern, call the port where your goods will be entered into the U.S., and ask what proof they will need that the shipment is for your own personal consumption.Duty rates for alcohol are based on alcoholic content, not the value of the beverage itself. A general rule of thumb is $1-2/liter for wine and beer, considerably more for cognac, vodka, etc. Specific duty rates can be found in Chapter 22 of the Harmonized Tariff Schedule (HTS).Wines that were in your collection that were shipped abroad will be subject to duty when they return to the US. and ask what proof they will need that the shipment is for your own personal consumption.although American-made wines may be entered duty-free as "American Goods Returned." We caution that the inspection process to verify this claim might be hard on fine wines.
