Declaration by the Presidency on behalf of the European Unionon the Coup d'Etat in Guinea-Bissau

Brussels, 18 September 2003

The EU is strongly opposed to unconstitutional seizure of power and therefore condemns the military coupoccurred in Guinea-Bissau on the 14th of September.

The EU reiterates its attachment to democratic principles and to free and fair elections, which are the onlymeans for a change of government.

The EU takes note of the announcement by the Military Committee of its intention to ensure a prompt returnto constitutional order and civilian rule in the country.

The EU is committed to work together with the international community, including the UN, theAU, the ECOWAS – whose constructive attitude has been commendable - and the CPLP, tosupport a quick restoration of constitutional legality, of democratic principles, especially theorganisation of early and credible elections, and national reconciliation in Guinea Bissau.

These essential elements remain the basis for the continued EU Guinea-Bissau partnership, which could helpinter alia overcoming the economic and social crisis that the country has been facing recently.

The use of armed police toenforce the closure and confiscation of equipment from daily news offices indicate an attempt to silencedemocratic voices and curb the pluralism of information in Zimbabwe.

Declaration by the Presidency on behalf of the European Unionon recent developments in Côte d’Ivoire

Brussels, 22 September 2003

The EU resolutely condemns any attempt to make direct or indirect use of violence in the political process inCôte d'Ivoire, as well as any threats to law and order and stability in the country. The EU confirms its fullconfidence in and support for the national reconciliation process, based on the implementation of the Linas-Marcoussis Agreements.

The EU welcomes the fact that the government of national reconciliation is now complete and encouragesthat Government to continue down the path to the reunification of Côte d'Ivoire without delay. As a matterof urgency, the opposing armed forces must be confined, disarmament must take place and theadministration must be re-established throughout national territory. The implementation of the reformsenvisaged by the Marcoussis Agreements must lead a unified and cohesive Côte d'Ivoire to credible,transparent and open elections in 2005.

The EU encourages the President of the Republic to continue on the path of reconciliation and thestrengthening of democracy, with a view to the organisation of the elections in 2005.

The EU encourages the Prime Minister in his practical steps to make governmental action for thereconciliation and rehabilitation of the country more effective.

The EU urges all parties, and especially the new forces, to overcome any distrust and to commit themselvesin a constructive manner to pursuing the major objectives of the construction of democracy and the recoveryof the country's economy.

The EU invites the constitutional parties, and all the political and social forces in the country, to committhemselves without reservation to constructive action to re-establish confidence and strengthen the nationalreconciliation process.

The European Union welcomes the reopening of the border with Burkina Faso as a prelude to the re-establishment of rail traffic between the two countries.

Declaration by the Presidency on behalf of the European Union and the Acceding Countries on thedecision by the National Assembly of Armenia to abolish the death penalty and to ratify the protocol

no.6 to the European Convention on Human RightsBrussels, 23 September 2003

The EU wishes to congratulate the National Assembly of Armenia on its decisions to abolish the deathpenalty and to ratify Protocol No. 6 to the European Convention on Human Rights. These acts will not onlyabolish de jure the death penalty from Armenia's juridical system but will also allow Armenia to honour oneof the commitments undertaken when it became a member of the Council of Europe in 2001.

The European Union is opposed to the death penalty in all circumstances. Promoting universal abolition ofthe death penalty is a key component of the EU's human rights policy. The EU therefore considers theArmenian Parliament's decision a significant step in the implementation of Armenia's commitment to thevalues and principles which are at the core of the community of European states.

The EU calls on Armenia to now also sign and ratify Protocol No. 13 to the Convention for the Protection ofHuman Rights and Fundamental Freedoms, concerning the abolition of the death penalty in allcircumstances.

Declaration by the Presidency on behalf of the European Unionon the peace process between Ethiopia and Eritrea

Brussels, 23 September 2003

The European Union reaffirms its full support for the peace process between Ethiopia and Eritrea, nowarrived at the crucial phase of border demarcation. Expressing concern at delays in the demarcation process,the European Union emphasises the importance of attaining an expeditious implementation of the boundarycommission’s decision.

The European Union calls upon the parties to abide by the peace agreements as well as the rulings of theboundary commission and to fully comply with the UN Security Council Resolution 1507 (2003) so toensure that the border demarcation begins as scheduled and that the necessary conditions are provided for thedemarcation to proceed.

The European Union acknowledges that a lasting peace requires a relationship between the parties thatenables them to address bilaterally any problems arising between them. It therefore calls on both

The agreement reached and the personal engagement ofthe two leaders augur well for the continuation of negotiations on the remaining outstanding issues.

The European Union encourages the parties to seize the momentum and to spare no effort to reach a final andcomprehensive agreement.

The European Union reiterates its readiness to assist the parties in the implementation of the peaceagreement and to accompany Sudan on a path of peace building, respect for human rights, democracy anddevelopment.

Declaration by the Presidency on behalf of the European Unionregarding the elections in Chechnya

Brussels, 26 September 2003

The EU supports all genuine efforts to bring about a lasting peace in Chechnya. It recognises the territorialintegrity of Russia and condemns terrorism in all its forms.

The EU is following preparations for presidential elections in Chechnya on 5 October closely. The EU wouldlike to be convinced that the process will be conducive to ending the conflict, restoring the rule of law,promoting the respect of human rights in the north Caucasus and launching the basis for a genuinereconciliation process in Chechnya.

In this respect, the EU underlines the paramount importance of ensuring that the population of Chechnya -including those temporarily displaced - recognises the legitimacy of elections. The EU views with concernthe indications of intimidation of candidates and of allegations of the manipulations of the electoral process.The EU recalls the importance of independent media as a pre- condition to any free and fair election.

After the referendum on 23 march the EU expressed its hope that the new Chechen constitution will providea platform for dialogue, genuine reconciliation, restoration of the rule of law and effective protection ofhuman rights. The EU underlined that the referendum can only be assessed as successful if living conditionsin Chechnya improve significantly, which has not materialised so far.

The EU confirms its view that there is a need to do more to ensure respect for human rights in Chechnya andto prosecute human rights offenders. It refers to the EU presidency statement of 17 September at the councilof Europe, in which the Russian authorities are invited to address as efficiently and promptly as possible theserious concerns regarding human rights violations and continuing instability in Chechnya.

As the largest provider of humanitarian aid to the North Caucasus, with over €110m committed since 1999by the European community humanitarian office and with further large scale contributions by individualmember states, the EU looks upon the Russian authorities to facilitate quick and efficient delivery ofhumanitarian aid to those in need. The EU further calls on Russia to provide assurances that internallydisplaced persons in Ingushetia and throughout the North Caucasus can return on a strictly voluntary basis.

Declaration by the Presidency, on behalf of the European Union,on the terrorist bombing in Florencia, Colombia

The EU strongly condemns the terrorist bombing of Sunday 28 September in Florencia which resulted in thedeath of at least 12 persons and various wounded as well as significant material damage.

The EU expresses its condolences to the families of the victims and its full solidarity to the people andGovernment of Colombia for this latest attack.

The EU reaffirms its support for the Government of President Uribe in its efforts to address threats todemocracy, terrorism, illegal drugs, human rights and international humanitarian law violations and theserious humanitarian crisis as outlined in the London declaration of 10 July 2003.

Declaration by the presidencyon behalf of the Europoean Union

to mark the first World Day against the death penaltyon 10 October 2003

Brussels, 10 October 2003

The European Union welcomes the Civil Society initiative of organising World Day against the DeathPenalty each year on 10 October, as of 2003.

On this occasion, the European Union would like to reiterate its longstanding and firm opposition to use ofthe death penalty under any circumstances. The European Union believes as a matter of policy that the deathpenalty is a contravention of the right to life and calls for its abolition.

The European Union’s aspiration is to see the death penalty abolished in law and in practice in every countryin the world, in times of peace and war. The EU calls upon countries that have not yet abolished the deathpenalty to at least introduce a moratorium as a first step towards complete abolition. The EU welcomes theglobal trend towards abolition of the death penalty. In this context, it is important to note that theinternational community has excluded the use of the death penalty when establishing international criminalcourts and tribunals competent to try the most heinous crimes such as genocide and crimes against humanityand war crimes.

In countries which retain the death penalty, the EU aim is a progressive restriction of its scope and respectfor the strict conditions set forth in several international human rights instruments under which capital

The European Union supports the objectives of the World Coalition against the Death Penalty (WCADP),organisers of World Day against the Death Penalty, namely: to encourage public discussion of the deathpenalty; to strengthen public opposition to the death penalty; and to put pressure on retentionist countries tostop executions and abolish the death penalty. The political commitment of the EU to work towards theabolition of the death penalty is supported by community funding through the European Initiative forDemocracy and Human Rights (EIDHR).

Declaration by the Presidency on behalf of the European Unionon the launching of direct dialogue between Belgrade and Pristina

Brussels, 8 October 2003

The EU recalls the Council Conclusions of 29 September and reaffirms its full support to the launching ofdirect dialogue between Belgrade and Pristina on practical issues of mutual interest. The EU also fullyendorses Special Representative of the UN Secretary General Harri Holkeri’s proposal to have the firstmeeting in Vienna on 14 October. The Italian Presidency, High Representative Javier Solana and EuropeanCommissioner Chris Patten have already expressed their commitment to be present in Vienna.

The EU therefore calls upon all parties involved to demonstrate unconditional support for the dialogue in allappropriate forms and to fully cooperate with the SRSG in this regard, also on the basis of the commitmentmade at Thessaloniki before the EU.

Direct dialogue is an indispensable element of the IC strategy of “standards before status” on the basis of UNSecurity Council Resolution 1244. It is also an essential step towards normalization of Kosovo. Declaration by the Presidency on behalf of the European Unionon the presidential elections in Chechnya

Brussels, 8 October 2003

I. The EU has taken note of the holding of presidential elections in Chechnya on October 5 2003 andof its preliminary results.

II. The EU and Russia in their Joint Statement at the Summit in St. Petersburg on 31 May 2003expressed the hope that the recently started political process as well as the economic and socialreconstruction would lead to the restoration of the rule of law, thus promoting the protection of human rightsand a genuine reconciliation. They condemned any kind of violence, in particular terrorist acts, which couldendanger the prospects for a political solution. The EU reiterates its recognition of the territorial integrity ofthe Russian Federation.

III. Against this background the EU followed the electoral process in Chechnya with great attention. TheEU had already noted negative developments as, inter alia, the lack of real pluralism of candidatures to thepresidency and the absence of independent media. Considering these developments, the EU expresses seriousconcerns regarding the conditions in which these elections were held.

IV. Nevertheless, the EU expresses the hope that the political settlement process in Chechnya continues.In this context, the EU appreciated the Russian Government's commitments before the referendumconcerning the improvement of living conditions, an amnesty, autonomy provisions, compensation fordestroyed property and the restoration of the rule of law. Reports about ongoing human rights violationscontinue to be an issue of concern to the EU. The EU calls on Russian authorities to investigate andprosecute those responsible.

V. The EU once again would like to express its hope that commitments will be followed by theirimplementation and that an immediate, significant improvement of the human rights situation in Chechnyawill bridge the divide between the authorities and the population. The EU urges the Russian authorities to dotheir utmost to advance a genuine political process and to intensify its cooperation with internationalorganisations, and in particular with OSCE, as agreed in the EU-Russia Joint Statement at St. Petersburg.

VI. The EU appreciated the opportunity given by the Russian Government to the Special Representativeof the Secretary General of the United Nations for displaced people, Mr Francis Deng, for visiting camps ofrefugees in Ingushetia. The EU views with concern the situation of refugees in the North Caucasus andreiterates its strict rejection of all attempts to make them return to Chechnya on a coercive or involuntarybasis. The EU calls on the Russian authorities to redouble their efforts to facilitate the delivery ofhumanitarian aid to those in need.

Declaration by the Presidency on behalf of the European Unionin response to the political agreement signed in Pretoria on 8 October 2003

between the Burundian government and the FDD movementBrussels, 13 October 2003

The European Union congratulates the transitional government and Mr Pierre Nkurunziza's CNDD-FDDmovement following the signing on 8 October of the Pretoria Protocol on political, defence and securitypower sharing in Burundi. It fervently hopes that the call issued by both warring parties for an end tohostilities will be followed by immediate action in the interests of the Burundian population.

The European Union calls on the parties to move swiftly to implement the agreement's political and militaryclauses and confirms its willingness to assist in Burundi's peace and reconstruction process. The EUreaffirms its support for the MDRP (Multi-Country Demobilisation and Reintegration Programme), to whichthe Commission and the Member States are the main contributors.

The European Union calls on Mr Agathon Rwasa's FNL movement to pursue the path of dialogue and asksthe Burundian authorities to do their utmost to foster negotiations with that movement.

The European Union commends the facilitation job done by South Africa, which hosted the recent meetingsbetween the government and the FDD, and appreciates the continued commitment of the regional mediators.It also expresses its political and financial support for the AMIB (African Mission in Burundi) at this crucialstage in the peace process and invites all the warring parties to play an active and constructive part in thework of the CMC (Joint Ceasefire Commission).

Declaration by the Presidency on behalf of the European Unionconcerning the parliamentary elections in Rwanda

Brussels, 13 October 2003

On the occasion of the parliamentary elections in Rwanda, the European Union wishes to highlight theimportance of the completion of the country's electoral process, which represents a very important steptowards national reconciliation and the consolidation of viable democratic institutions. Like the presidentialpoll on 25 August 2003, the parliamentary elections were conducted in a calm, orderly manner and with anorganisational effort reflecting the care taken by the Rwandan authorities with Rwanda's political transition.

At the same time, the European Union has noted the comments made by its election observer mission in itspreliminary statement on 3 October 2003 as regards the obstacles to opposition activities, the intimidation,the threats and the arrests that marked the election campaign, as well as the irregularities discovered at a

The European Unionreaffirms its willingness to assist the reconciliation process in the Great Lakes region, which may emerge thestronger after the latest developments.

Declaration by the Presidency on behalf of the European Unionon the massacres in the province of Ituri in the Democratic Republic of the Congo

Brussels, 13 October 2003

The European Union firmly condemns the renewed massacres in Ituri on Monday 6 October 2003, in thevillage of Katchele. These events, which add to the enormous suffering already sustained by the localpopulations, demonstrate the persistence of elements opposing the peace process in the Democratic Republicof the Congo, despite the progress made in recent months.

The European Union confirms its very strong support for the peace process and its determination to ensurethat the perpetrators of these massacres do not go unpunished. In this connection, the EU notes the decisionof the International Criminal Court to examine the investigations into the events in Ituri.

The European Union calls on the States in the region to cooperate fully with the transitional government ofthe Democratic Republic of the Congo in its task of restoring order and the authority of the State throughoutthe territory, and in its eastern provinces in particular. The EU attaches great importance to the strictobservance of Security Council Resolution 1493 (2003) which, inter alia, invites all States to take thenecessary measures to prevent the direct or indirect supply of arms to armed groups operating in the easternprovinces of the Democratic Republic of the Congo which are not party to the Global and All-inclusiveagreement.

The European Union encourages MONUC to continue its peace-keeping efforts in Ituri, in the wake ofOperation Artemis, and notes with satisfaction the full deployment of the Ituri Brigade.

However, bearing in mind the debates which will be held at European and national level, the EESCrecommends that those taking part in the IGC supplement, detail and clarify certain points in such a way asto increase the trust and involvement of the general public and civil society organisations. This includes:

• introducing stronger provisions for implementing the Union's economic and social policies andimproving governance in the Euro zone;

2. REGIONAL AND STRUCTURAL POLICY AND ECONOMIC AND SOCIAL COHESION

• Partnership for implementing the Structural Funds – Rapporteur: Mr Barros Vale (Employers - PT)

– Reference: Exploratory opinion – CESE 1166/2003

– Key points:

The Committee considers that it would be very helpful to set a minimum threshold for involvement of thesocio-economic partners, laid down by a Community regulation but leaving the Member States to establishdetailed participation levels in their own national law or provisions.

The role of the socio-economic partners, the content of the proposals and the participation proceduresnecessarily differ at the preparatory, financing, monitoring and evaluation stages of Community structuralmeasures. It is therefore necessary to clarify what is expected of the partners, what the partners need to do toensure that the programmes are as successful as possible, at what levels the partnership is conducted, and thepolitical and technical bodies in which the partners should be involved.

The Committee stresses that the partnership is of crucial importance at two stages:

– at the "political" stage of Fund programming and when general decisions are taken, at both Communityand national level;

– at the monitoring and evaluation stage.

The Committee considers that Article 8 of Regulation 1260/99 should be expanded so as to establish a clearframework for each group involved in each stage of a programme, from planning to evaluation, and thusallow real involvement of the socio-economic players.

The management authorities should retain responsibility for the operational management of the measures, toavoid any confusion or overlapping of roles.

Lastly, the Committee thinks that deeper and more responsible involvement of the socio-economic partners,with the requisite technical and financial capacity, is highly desirable in the management of measures thatuse Community funds. It therefore proposes the setting of a substantial minimum threshold – e.g. 15% of thetotal CSF funding – to be applied under the global grants procedure, which has regrettably been used verylittle hitherto. – Contact: Mr Roberto Pietrasanta

• Economic and social cohesion: regional competitiveness, governance and cooperation – Rapporteur: Mr Malosse (Employers – FR) – Reference: Exploratory opinion – CESE 1178/2003

– Key points: In this exploratory opinion requested by the Italian presidency, the Committee stresses that the lack ofcohesion within the European Union is a source of weakness at a time when the Union should be able to findits way back to strong growth. As requested, the Committee goes on to put forward recommendations for thefuture of cohesion policy, focusing on the topics of competitiveness, governance and cooperation.

In the light of past experience, the Committee calls for an active policy to help the least developed countriesand regions (Objective 1 of cohesion policy) become more competitive. This policy should be provided withsignificant resources, which should be targeted on education and training, infrastructure, sustainabledevelopment, enterprise and SMEs, and the capacity of civil society organisations to mobilise local players.

The Committee calls for EU aid to be given further to EU regions which cease to qualify for Objective 1because of the statistical effect of enlargement, with the focus on measures for promoting entrepreneurshipand job creation.

The Union and its Member States must continue to show solidarity towards regions with serious structuralproblems (the outermost regions, islands, upland areas, landlocked regions, sparsely populated regions, etc.)which need specific support for the provision of services of general interest.

In essence, the Community's regional cohesion policy should undergo radical reform and aim to increase thecompetitiveness of EU regions that under-use their own resources, rather than using public aid to compensatefor development disparities. EU intervention should provide real added value and should draw on successfulexperiences and cooperation between regions. This added value will help the least developed regions to playtheir part in the major Community policies.

Better governance of cohesion policy is vital: the added value of Community cohesion policy depends on it.An effective cohesion policy must be clear and transparent and must enjoy the support of its beneficiaries,who should also play an active part. Above all, it must encompass all the various factors that can generateeconomic, social, cultural, environmental and human development. These factors appear increasinglyinterlinked.

The Committee therefore thinks that a better distribution of roles between the EU, the Member States and theregions is vital in order to avoid overlapping and excessive delays. The Union should set the main priorities –based on the Lisbon objectives – and the regions should be responsible for implementing them. The role ofthe Member States should be to check that this is done properly.

Socio-economic organisations should be directly involved in the establishment of priorities, on the basis ofEU priorities and in partnership with the local authorities. They should also be involved in the monitoringand evaluation exercises conducted by local and regional steering committees. A genuine partnership thatinvolves all the socio-economic partners at all stages of the programming is vital. Any move to downgradethe role of the partnership in cohesion measures is bound to limit their usefulness and scope.

Given the effects of enlargement and globalisation, cohesion policy must promote a more polycentricdevelopment within the EU. This approach requires not only shared objectives, but also a recognition ofEurope's diversity. Despite implementation difficulties, cross-border, transnational and interregionalcooperation within the EU are recognised as essential instruments for the integration of regions which foryears have lived "back to back". In view of the forthcoming enlargement, the Committee thinks that theInterreg programme must be continued and extended, albeit with new priorities and significant streamliningof its governance: procedures must be radically simplified. − Contact: Mr Roberto Pietrasanta

The Committee analyses the concept of cohesion and the combined approach to economic and socialcohesion referred to in the Treaty, while reserving the right to examine the subject further at a later date. Itcould then consider which Community policies contribute to cohesion and how it might be possible to securea maximum level of economic and social cohesion within the European Union. An initial general assessmentof the repercussions of common policies on economic and social cohesion leads the EESC to draw thefollowing conclusions:

– if economic and social cohesion policy is to be effective, European regional policy must be a horizontalpolicy so that all EU policies take into account their impact on the regions and their development;

– without underestimating the role of the remaining Community policies, transport policy and competitionpolicy rules on state aids aimed at regional development must be reviewed;

– as there is not yet a common policy on taxation, national fiscal policies should take serious account ofthe regional dimension with a view to strengthening cohesion, with due regard for competition policy.

The Committee suggests establishing a procedure for measuring the impact of the Article 159 policies oneconomic and social cohesion, and more specifically on the profile of GDP per capita per region,employment per region, unemployment per region and poverty per region. This should be carried out bymeans of a special study to establish the package of ex ante and ex post indicators for measuring theeffectiveness of the non-structural policies.

Lastly, in the EESC's view, a procedure should be established for the three-yearly review and evaluation ofthe impact of the Stability Pact, both for the EU as a whole and for the individual European regions. − Contact: Mr Roberto Pietrasanta

The Committee believes that, in future supranational legislative projects, consideration should be given toother aspects which, as a side effect, assume importance in company mergers, such as those relating toemployment and industrial policy.

4. INDUSTRIAL CHANGE • Industrial change: current situation and prospects – Rapporteur: Mr van Iersel (Employers - NL) – Co-rapporteur: Mr Varea Nieto (ES delegate) – Reference: Own-initiative opinion – CESE 1180/2003 – Key points: The goal of this opinion, which is the first of a series, is to highlight the role of the CCIC to further a directdialogue with all concerned stakeholders affected by industrial change and where lessons learnt from boththe coal and steel and from other sectors will be used. The EESC experience and that of the former ECSCConsultative Committee demonstrated that establishment of a continuous sector-based dialogue at Europeanlevel in which representatives of the producers, workers and other groups representing organised civil society(consumers, dealers, etc.) helps to establish a useful basis for a renewed industrial policy.

Change in the European industrial sector has often been approached from the restructuring angle. But in factit is a much more dynamic concept. It embraces the on-going development of the company as well as itspolitical and social environment. Today it is important to dwell on a proactive concept of change in order tobetter anticipate and manage the economic, social, organisational and environmental repercussions ofindustrial change.

In order to create further conditions for industrial change based on social cohesion and competitiveness, theEESC also reiterates its demands for efficient policies to achieve:

– human resources development,– more and better jobs within an inclusive labour market,– specific attention towards the ageing of the active population, and towards measures promoting women's

access to the labour market,

which all require lifelong-learning at all levels, and improvement of education and training. Analyses of bestpractice in each of these subjects are highly desirable.

For the EESC it is essential that innovation and research promote European leadership both in terms ofcompetitiveness and of social welfare.

An effective impact assessment of European legislation is desirable. To that end, the EESC supports theproposal to establish an independent advisory group for business impact assessment of EU regulations, inorder to improve the quality of EU legislation. More attention should be paid to the possible repercussions ofcertain Community provisions and rules on SMEs.

The EESC considers that social dialogue in companies and, where appropriate, involving local players andpublic authorities, is an important and decisive tool to develop competitiveness, social conditions andemployment as well as environmental protection in a productive balance.

The EESC is in favour of a horizontal industrial policy which at the same time allows the development ofsectoral approaches directly related to industrial change.

A sectoral approach must be accompanied by procedures for consultation, participation of all players andsocial negotiation in the framework of industrial restructuring, particularly in the candidate countries. TheEESC considers that the establishment of sectoral observatories would make it easier to anticipate andimplement industrial change, identify viable alternatives and minimise their negative consequences.

The EESC stresses the importance of ensuring that relocation of industries must not be purely inspired byincreasing differences in legislation between Member States, e.g. in environmental and fiscal areas. Inregions particularly affected by relocation specific flanking measures may be needed for a limited period.

Specific measures can be foreseen on a temporary basis in mono-industrial regions. The EESC recommendsthat the positive experiences with sectoral programmes such as Rechar, Resider and Retext be taken intoaccount in modernising such regions in the future and existing Member States and that new forms of socialdialogue be promoted in these countries.

The future work of the CCIC, as a body within the EESC, will concentrate on sectors and/or regionsparticularly affected by industrial change and will be related to the following:

• seeking common approaches to promoting sustainable development and improving social and territorialcohesion, in order to give an impetus to the Lisbon Strategy, and promoting a framework and conditionsallowing industrial change to take place in a way compatible both with firms' need for competitivenessand with economic, social and territorial cohesion.

Agreed EU-level procedures could lead to more efficiencyand lower costs for participating Member States.

It recognises that the key element in this will be the necessary political will, notably in the area of increasedfunding.

It is in both the political and the economic interests of the EU to have a defence industry that is capable ofcompeting globally and the Committee notes that restructuring is already happening, largely because ofmarket pressures.

Establishing and monitoring relevant data on the industries will best be done by Member States; the datashould include employment figures related to skills.

A coherent EU advanced security research effort is vital to future progress, and defining the "EU strategictechnologies" required for closing the capabilities gap is a key element in this.

The Committee looks forward to commenting in detail on the EU Agency in the field of defence capabilitiesonce its role and other details have been agreed.

Security of supply must remain the responsibility of Member States for the foreseeable future, although the Agency could play a useful role.

– Key points: The Committee welcomes the Commission's Green Paper and the added urgency it has given to reflectionson European enterprise policy among officials, politicians and stakeholders. In order for this process now tohave a lasting value, it is essential that an ambitious, yet carefully targeted, Action Plan is deliveredefficiently.

It is clear that an improvement of the risk-reward balance for entrepreneurs is central to any increase inentrepreneurial activity and must be a theme running through the Action Plan.

The Committee stresses that public policy needs to be targeted and should seek to tackle the most urgentmatters first if ultimately all objectives are to be realised. Within the broad range of policy areas covered bythe Green Paper, it is therefore imperative that the Action Plan prioritises specific policy areas.

The Committee highlights several key areas for action that the Action Plan should prioritise:

• improving SMEs’ access to public contracts;• a review of the fiscal regimes in which SMEs operate across Europe, assessing taxation levels,

administration and collection;• a clearer understanding of the process of business closure and society’s response to owner-managers’

involved in closures;• action to promote the spirit of entrepreneurship and to encourage people of all ages and backgrounds

who demonstrate the appropriate mindset to become entrepreneurs;• the development of more systematic benchmarking data on SMEs in order to facilitate measurement and

– ratification and implementation of the international conventions already concluded; the current andfuture Member States should adopt all needed measures to prevent fragmentation of the law in variousareas of IWT;

– to study, in view of a Danube Commission as IWT coordination institution between East and West, anew Danube Treaty following the Rhine's Central Commission-EU rules as a positive step towardsharmonisation;

– to introduce a Community basis for the law relating to crews in the EU, in order to create a level playingfield for IWT.

The various reports and studies on agreements and practices confirm that the experience gained to date issufficient for conclusions to be drawn on how to organise a simple, democratic and effective negotiationprocess on the establishment of a European Works Council or a procedure for the purpose of informing and

consulting employees. There is also a wealth of experience on the extent to which the basic aim of thedirective, i.e. to improve the right of workers to information and consultation, has been achieved.

By virtue of its composition, the EESC has certainly been able to shed special light on the dynamic processof social dialogue under way in companies and groups of companies. The EWC is still a very new body butone which is constantly evolving. The proportion of agreements that are renegotiated each year bears witnessto this.

Information and consultation through EWCs and the dynamic nature of their role and practices wouldcertainly benefit all the parties concerned, including citizens. The responses made in the context of theglobalisation of companies and restructuring affect not only living and working conditions but also the socialclimate beyond company gates.

Drawing on various findings – which it shares – on the practical application of the directive and theoperation of the EWCs, the EESC has been able to identify the contribution of EWCs to European socialdialogue and European development. However, a number of fundamental questions remain open. Theymainly concern the following aspects:

• the concepts of "useful effect" and "timeliness" with regard to informing and consulting employees;

• the scope of Directive 94/45/EC with regard to, for example, joint ventures, the possible exclusion ofmerchant navy crews and the concept of "undertaking", owing to the many different forms of businessorganisation. This diversity will increase further at European level with the inclusion of communityenterprises, cooperatives and mutual enterprises, whose economic activities are becoming increasinglyimportant and increasingly transnational in scope. Public sector enterprises are nevertheless mentionedexplicitly in the national transposing legislation of two states, Sweden and Spain;

• the question of representation and proportionality of representation on EWCs, which is not covered bytransnational rules;

• the question of the impact of EWCs on social dialogue in the company at national level;

• the question of the possibility of EWC representatives visiting the establishments whose workers theyrepresent and communicating with these workers;

• the question of the relation between EWCs and the regulatory authorities in the competition field.

EESC members are divided on the significance of the findings and views put forward on the application ofthe directive and the operation of EWCs. Some feel that the present exploratory opinion must simply providea corpus of information, without any intention of influencing possible future discussion by the social partnerson the revision of Directive 94/45/EC; the Commission has indicated in its work programme that it intends toconsult the social partners starting in the autumn of 2003. Others consider that it should be possible to use

• Programme to promote NGOs active in the field of youth

The European Economic and Social Committee welcomes this measure, which ensures continuity ofessential funding to bodies active at European level in the field of youth.

However the EESC is critical of the proposal to reduce funding by 2.5% each year after the third year.

The EESC welcomes the stability of funding this measure will give to the European Youth Forum, ensuringthat it can continue to grow and strengthen.

The EESC notes with concern the trend over the past years, which has seen a gradual reduction of funding tosome international youth organisations. The EESC calls on the European Parliament, the Council and theEuropean Commission to actively work to increase this budget line. The growth and development ofinternational youth organisations is essential to the development and future of Europe, this needs to berecognised.

The EESC notes that this proposal covers the period 2004-2006. We urge the Commission to commence andconsult as wide as possible on how funding post-2006 will be handled.

The EESC urges the immediate implementation of the outstanding recommendations contained in theEvaluation Report on support for International Non-Governmental Youth Organisations, produced by theCommission.

The EESC notes that this proposal is one of several referred by the Commission concerning Communityaction programmes and measures across a diverse range of fields. The EESC strongly advocates that theCommission takes a coherent approach across these fields, particularly to the eligibility for funding criteria.

11. EURO-MED POLICY

• Greater involvement of civil society in the Euro-Mediterranean partnership

The annual Euro-Mediterranean summits of ESCs and similar institutions, which have been held since 1995,seek to improve understanding of the major topics of interest to the Euro-Mediterranean partners and toexchange information on their respective economic and social situations.

At the last Euro-Mediterranean summit in Athens, it was decided that the next summit would be held inMalta in 2003.

Apart from the European Economic and Social Committee, the preparatory group for the summit includesthe Economic and Social Council of Greece (OKE) and the Malta Council for Economic and SocialDevelopment (MCESD). The EESC is a permanent member of the preparatory group for Euro-Mediterranean summits and contributes, inter alia, by drafting a paper in the form of an informationreport.

This year the EESC's information report is on: Greater involvement of civil society organisations in theEuro-Mediterranean partnership at national and regional level, drafted in conjunction with the Tunisian andPortuguese Economic and Social Councils and the Moroccan National Council for Youth and the Future. The Economic and Social Council of France, in conjunction with the Algerian National Economic and SocialCouncil, the Italian CNEL and the Spanish, Greek and Tunisian Economic and Social Councils will present apaper on New knowledge, new jobs (the impact of new technologies).

The EESC report analyses the ways of involving organised civil society (information, consultation,implementation) in the Euro-Mediterranean partnership at national and regional level and makesrecommendations to further develop involvement.

The EESC believes that the notion of democracy in the Mediterranean countries cannot and should not beexamined on the basis of Western criteria, though such examination should not lose sight of the fundamentaldemocratic principles which pertain worldwide, have been established as the result of major social strugglesand have been recognised by international institutions and agreements.

Civil society organisations in the Mediterranean Partner Countries (MPCs) are currently under-informed andunder-involved with respect to the Euro-Mediterranean partnership by both their governments and by the EUitself.

The EESC believes that:

• it is necessary to facilitate the means by which civil society groups can benefit from the programmes;• improving the flow of information is a matter of crucial importance;• a Euro-Mediterranean network of Economic and Social Councils on the Internet, including national civil

society organisations should be set up;• intensified efforts should focus on establishing a framework for cooperation and systematic dialogue

between the representatives of organised civil society and governments of the MPCs, rather than onsetting up new bodies;

• President Prodi was right to say that the threat of terrorism cannot be used as a justification forcurtailing political and social rights;

• civil society cooperation must seek to create common networks between the various communities;• the number of small-scale activities must be stepped up;• civil society could act as a key factor in promoting dialogue between the MPCs;• particular attention must be paid to migration;• the International Monetary Fund and the World Bank have a useful role to play in the economic and

social development of the region.

The EESC believes that cooperation at regional and subregional level should be stepped up. The EESCbelieves that the Euromed partnership can play a key role in regional integration between the MPCs, and thatthe EU can compensate for the lack of trust and confidence between them. Through the Barcelona Processthe EU can and must act as a guarantor of ties between the regional partners and protect the integrationprocess from the potential inability of partners to honour their commitments.
