Description
AHabitual Traffic Offender is a person who has accumulated:
Fifteen Moving Violations (in five years) Fifteen convictions for moving traffic offenses for which
poin t s may be assessed will result in an HTO Revocation
-OR-
Three Major Violations (in five years) Three or more convictions of any one or more of the
following offenses arising ou t of separate acts will result in an HTO revocation.
Manslaughter (motor vehicle involved)
DUI, DWI or other alcohol re la ted convictions
Driving while suspended or revoked
Failure to s top and rende r aid in the event of a motor vehicle crash
Any felony in th e commission where a motor vehicle is used
Driving a commercial motor vehicle while disqualified
HTO revocations are calculated by conviction dates. The earl iest connector conviction date and
the latest connector conviction date must be no more than five years apart . The term of HTO
revocation is 5 years.
Departmental Policy
Habitual Traffic Offender Amnesty Period
Effective October 1, 2010 House Bill 795 established an amnesty period for Habitual Traffic
Offenders. The amnesty period begins October 1, 2010 and ends June 30, 2011.
When customer calls in requesting information about th e HTO amnesty program, review the
record and verify that there is an HTO, with all 3 connectors being:
1) Driving While License Suspended Revoked criminal an d non-criminal (DWLSR) And
2) All Offenses occurred before 7/1/2010
Once verified send the HTOAmnesty Work Request. Advised the cus tomer tha t they will receive
a call back once th e review is completed (whether approved or den ied) . The turnaround time is
about 10 - 15 business days. If determined that th e customer is eligible to be considered for th e
amnesty program; a letter will be mai led to th e customer instructing them to go to the clerk of
th e courts. This will be notated on the r eco rd in th e correspondence section HTO Amnesty
Approved. The clerk of court determines IF they will grant amnesty by changing th e disposition
of th e DWLSR, and therefore removing th e HTO.
If determined t hat t he customer is NOT eligible to be considered for Amnesty, then they will
receive a call advising they ar e no t eligible. The correspondence section o n th e record will be
nota ted Amnes ty Review.
