Senate ‐ Elected Committee

Senators

Keep informed on important issues and developments relating to academic freedom and faculty rights in higher education; remains alert for potential problems involving academic freedom and faculty rights at the University; investigates academic freedom complaints and considers faculty grievances and alleged violations of academic freedom and, when necessary, forwards such complaints to the Consolidated Hearing Committee (CHC) for formal hearings; oversees  the Code of Faculty Rights and Responsibilities and makes recommendations to the Academic Senate; oversee the application and updating of Policy 6‐316; reports to the Academic Senate.

The Academic Senate shall elect twelve members chosen from the voting members of the faculty other than the ex officio members of the Senate.  The committee members shall be elected for a term of three years on a rotating basis so that the Senate shall annually elect four committee members to fill vacancies caused by the expiration of terms of office.

Appointed by the President of the Academic Senate upon approval of the Academic Senate Executive Committee, and confirmation of the Academic Freedom and Faculty Rights Committee

Non‐voting members shall include the President of the Academic Senate or its designee.

Terms shall end each year on June 15, and the terms of newly elected committee members shall begin on June 16.

Considers any matter relating to academic policy which may be suggested by members of the committee, members of the faculty, administrative officers, or students; submits reports and recommendations to the Academic Senate.

Acts for the university faculty in all matters of educational policy, including requirements for admission, degrees, diplomas, certificates, and curricular matters involving relations between schools and colleges or departments; receives, considers, and takes action on reports from faculty committees, councils, divisions, departments, schools, colleges, and administrative officers; makes recommendations on matters of professional interest and faculty welfare; proposes to the Board of Trustees amendments to University Regulations for the government of the University.

Not more than eighty‐one regular faculty members apportioned among sixteen areas of representation in the Academic Senate and elected by their respective faculty constituencies for three‐year terms, with one‐third of the terms expiring each year; two deans elected by the Council of Academic Deans to serve two‐year terms, with one term expiring each year; the ASUU President, the ASUU Academic Affairs Board Chairperson, and the members of the Student Senate.An annual orientation shall be provided for newly elected Senators. Beyond service in the Senate, faculty members of the Senate should expect that they may be called upon to serve on standing and ad hoc committees. Senate faculty members shall be ineligible for nomination for another term until at least one year has elapsed following the expiration of their terms of office or date of resignation therefrom. The secretary of the faculty shall be ex officio the secretary of the Academic Senate, but the presiding officer may appoint an assistant secretary at any time.

The President of the Academic Senate shall be elected annually by the Academic Senate from the faculty at large.  The person elected shall serve one year as President‐elect and his/her second year as the President, and then the following year as Past President

Senate faculty members shall be ineligible for nomination for another term until at least one year has elapsed following the expiration of their terms of office or date of resignation therefrom.

(Non‐voting) The President of the University, the Vice President for Academic Affairs, the Vice President for Health Sciences, the non‐elected deans or their designated representatives.

Senate ‐ Elected Committee

Senators

Prepares the agenda for the Academic Senate; reviews actions of college councils; initiates studies and legislation for Senate action on matters not assigned to other university committees; acts for the Senate during vacation periods and the summer quarter, or at other times when urgent matters require immediate attention; reports to the Academic Senate.

Ten persons elected annually to represent the Senate's faculty and voting dean members; the ASUU President, the student chairperson of the ASUU Student Senate, and one other Student Senator (one of the three students must be a graduate student).  Not more than two of the ten faculty may be from the same area of representation.

The President of the Academic Senate chairs the Executive Committee.

The University President, the Senior Vice President for Academic Affairs (or designee) and the Senior Vice President for Health Sciences (or designee).

Functions in a research and advisory capacity on matters relating to sabbatical leaves, salary schedules, salaries and cost of living, faculty retirement plans, annuities, health and life insurance options, and other benefits without exercising budgetary or administrative powers; advises the administration on matters pertaining to annuities and salaries and reports information to the next Academic Senate meeting.

Six faculty members of the regular faculty, elected by the Academic Senate to serve for three‐year rotating terms.  Members shall represent the University faculty as a whole and not any particular area or college

Functions as a policy recommendation and review body for intercollegiate athletics; reviews the annual intercollegiate athletics budget; reviews requirements for intercollegiate athletics honors and awards; considers the demonstration of equality and diversity in the appropriate treatment of student‐athletes as well as staff and coaches; reviews the report on the status of all compliance, eligibility, academic, and other appropriate matters related to the athletics program and as requested by the President, reviews the qualifications of applicants for major positions in the Intercollegiate Athletic Program; submits a written annual report to the President, the Academic Senate, and the Athletics Director annually; reports to the Vice President for University Relations and to the President.

Sixteen voting members consisting of nine faculty members as follows: two faculty members appointed by the President; six faculty members named by the Personnel and Elections Committee for appointment by the President, for three‐year rotating terms with the possibility of reappointment, and three students,  recommended by the ASUU President and the Athletics Directory for appointment by the President. At least one, but not more than two of the three students shall be a student‐athlete. Student members shall be appointed for two‐year rotating terms with the possibility of reappointment. University Faculty Athletics Representative:   Appointed by the President. Two representatives of the University Alumni Association:    Appointed by the UUAA Executive Director with the approval of the Alumni Board of Directors for two‐year rotating terms with the possibility of reappointment. Two representatives of the University Board of Trustees: Appointed by the Chair of the Board of Trustees, for two‐year rotating terms with the possibility of reappointment.

Two of the faculty members shall be appointed chair and vice chair respectively by the President with advice from the Vice President for University Relations and the Athletics Director for two‐year rotating terms with the possibility of reappointment

Background Review Committee (BRC) shall have continuing members, ad hoc members, and faculty representative members.The continuing members will consist of University personnel representing the Senior Vice Presidents for Academic Affairs and Health Sciences, the Associate Vice President for Diversity, Human Resources and General Counsel. In each case considered by the BRC, the continuing members will invite one or more representatives of the applicant or employee’s division or program (if applicable), department, and college to participate as ad hoc members of the BRC. Faculty representative members of the BRC shall be elected by the Academic Senate Executive Committee upon the recommendation of the President of the Academic Senate. They shall be selected on the basis of qualifications consistent with those applicable for members of the Consolidated Hearing Committee (Policy 6‐002‐III‐Section 10), and may be selected from the current or past roster of the CHC. They shall serve for terms determined by the Executive Committee, within the range of one to five years, staggered. At least two and no more than three shall serve in any given period. The President of the Academic Senate or designee may substitute for any faculty representative absent for a particular BRC proceeding. No BRC proceeding involving investigation of an existing faculty employee shall be completed without the direct participation of at least one of the faculty representatives. In addition, the department chairperson will have the option, following notice to the applicant or employee, to consult with the faculty of the department on any BRC matter regarding an existing faculty member or final applicant for a faculty position in that department. Background check information shall be divulged only to the extent necessary for purposes of such consultation, or as further agreed by the applicant or employee. All members of the BRC and all other persons consulting or otherwise participating in BRC proceedings are governed by the provisions of Policy 5‐130 regarding privacy, confidentiality, and limitations on the use of background check information.

Serves as an advisory committee to the University administration regarding campus health and safety issues; provides advice and recommendations regarding needs, priorities and strategies to promote health and safety on campus; provides advice and recommendations regarding the adequate and effectiveness of University‐wide policies that relate to health and safety matters; fosters cooperation among campus units at the University that have operational responsibility for health, safety and security; reports to the Vice President for Administrative Services.

The Consolidated Hearing Committee (“CHC”) is the hearing body for grievances and complaints brought against faculty members (as defined in PPM 6‐002 at the University of Utah or by faculty members asserting rights including appeals from retention, promotion and tenure decisions. Reports to the Academic Senate.

Consist of at least 30 faculty members nominated by the Personnel and Elections Committee of the Academic Senate. The Senate will select members by vote to fill staggered terms of 6 years. There may be expedited elections if necessary to fill vacancies in the pool or to provide sufficient members for a particular panel. At least 5 members of the pool shall be faculty with extensive experience as researchers and as recipients of sponsored research grants.

The Senate President in consultation with the Senate Executive Committee and the administration shall identify at least 5 chairs from the elected pool. The chairs shall be individuals who will agree to undergo significant training in preparation for chairing the CHC panels. Panel member for each hearing will be selected by the Office of the Senate for an impartial panel

Acts as an oversight committee to the University Technology Commercialization Office; oversight functions include, but are not limited to, reviewing the functioning of the TCO, policy interpretation, and policy recommendations on intellectual property, protection of inventions, and licensing of University‐owned technology; may also recommend changes in University intellectual property policies and may provide technical advice to the Research Foundation on the foregoing matters; approves exceptions to standard University intellectual property procedures, proposed royalty distributions and related matters; reports to the Vice President for Technology Venture Development. (Committee currently inactive.)

Provides representation from the University community in reviewing policies, practices, and programs of the A. Ray Olpin University Union; reports to the President.Oversees the staffing and programming of all Union Board committees; promotes the utilization of Union programming, services, and the Union; establishes policies and procedures for the use of the Union, including oversight of the Policies and Procedures Document; advises University Dining Services with regard to dining service in the Union; consults with the Union staff as to all services and operations in the Union; and reviews and endorses the Union’s annual operating budget and periodic financial statements before it takes affect.

Vo ng members:15 matriculated students consisting of ASUU Vice President and Chief of Staff, or their designees, 1 representative from RHA, 7 representatives from UPC (Executive Director, Director of Marketing, Director of Crimson Nights, Director of Community Service, Director of Arts & Special Events, Director of Publications, Director of Development); 1 student House and Operation Representative and 4 other students from agencies housed within the Union. (Student terms are for one year); 4 staff members consisting of Union Director, 1 representative form VP of Student Affairs: Dean of Students, 1 representative from Alumni Association:  Executive Director of the Alumni Association, Director of U‐ card Services; 2 Faculty members appointed by Personnel and Elections Committee, approved by the President.

Staff and faculty terms are for three years and can be renewed.

    The Committee will be composed of nine members drawn from University faculty. Seven of those shall be regular (tenured/ tenure‐eligible) faculty members drawn from the faculty of the academic colleges which offer undergraduate degrees, with no more than one of the seven from any one college. The eighth and ninth members shall be regular faculty members who are in some capacity affiliated with one of the QIDT programs. These two members may have their regular appointments in any college (including the same as one of the other seven members). The eighth and ninth members and any others who are affiliated with one of the QIDT programs are prohibited from voting on (but may participate in discussions regarding) internal rules and individual appointments from the QIDT program with which they are affiliated.

The Senior Vice President for Academic Affairs shall appoint the non‐voting chairperson (ordinarily the Associate Vice President of Interdisciplinary Studies). The Associate Vice President for Faculty, or designee, shall serve as a non‐voting, ex officio member of the committee.

Reviews and makes recommendations in individual cases relating to retention, promotion, or tenure of regular faculty; when there are differing recommendations from any of the prior levels of review, when the cases originate in colleges/schools that are organized and function as single departments, or when recommendations are made for appointments with tenure; reports to the cognizant vice president.

One tenured faculty member from each college or school and four students (including at least one graduate student).  Faculty members are elected for three‐year terms by their respective faculty constituencies; one‐third of the faculty terms expire each year.  Student members are selected for one‐year terms according to established ASUU procedures.

The President or the Vice President for Academic Affairs, as designated by the President.

Tenured Faculty

Reviews and approves or disapproves department and/or college retention/promotion/tenure criteria; considers any timely appeal authorized by Faculty Regulations for review of the cognizant vice president's recommendations to the President at the conclusion of a formal retention/promotion/tenure review; reports to the Academic Senate and to the President.

Ten tenured faculty members elected at large for three‐year terms by the Academic Senate.  No more than one person at a time from a college may be a voting member.  Membership shall rotate in a manner which assures that a member is elected from each college at least once every six years.  The first election of the committee will establish the rotation.

Appointed by the President of the Academic Senate upon approval of the Academic Senate Executive Committee and confirmation by the University RPT Standards and Appeals Committee.

The chairs of the Academic Freedom and Tenure Committee and the Faculty Hearing Committee shall be ex officio nonvoting members.
