We write to request a modification to Stipulation 1 of the Approved Zoning Ordinance G-6623. Background: The previous approval was to rezone 1.12 gross acres from R-3 (Multifamily Residence District) to A-1 (Light Industrial District) to allow for manufacturing, office, an off-premise sign and warehouse uses. Staff supported the rezoning based on the following findings:
1. The proposed development will be compatible with the surrounding residential uses.
2. The proposed zoning is consistent with several goals and policies of the General Plan.
3. The proposed development, as stipulated, is compatible with development in the area considering the site’s proximity to the freeway.
On September 4, 2019, the City of Phoenix approved Zoning Ordinance G-6623. The approved conceptual site plan depicted the construction of an office/ light manufacturing facility and an off-premise sign (billboard) adjacent to the freeway. The building was oriented towards the street with the internal circulation being along the freeway. The building elevations depicted a stucco building with corrugated architectural embellishments. The proposed building height was proposed at 48 feet to the roof deck. Staff recommended general conformance to these elevations. Revised Scheme: Given the economic uncertainty due the pandemic and the potential ripple effect across the commercial real estate sector, our client is seeking to make some alterations to the conceptual scheme in order to accommodate an incoming tenant who is interested in utilizing the property for storage. The proposal is fundamentally staying the same with the overall layout of the site and massing broadly in line with the previous scheme. The billboard is still an important component to the project and will be screened by the new mass as previously required. Whereas before the conceptual plans depicted an office/warehouse building, the new scheme proposes the use of shipping containers to create the mass stacked around a central courtyard which will be used for storage. The height will increase from 48’-0” to 52’-6” with areas of metal perforated screen or tensile fabric adding articulation to the roofline at a height of 55’-6”.

An important aspect of the scheme is the recycling and reuse of shipping containers which adds and important element of sustainability into the scheme. When used sympathetically and appropriately, shipping containers can create unique and interesting massing as is evident is other areas of the City.
With the introduction of the C-2 streetscape landscaping standards, areas of metal perforated screen or tensile fabric and up lighting, the proposed scheme sits comfortably at the intersection between the Freeway and adjacent residential uses. (See sheet A8.00 for conceptual renders of the scheme.)
Stipulation Modification:
The above-mentioned changes to the scheme, specifically the elevations, would require a modification to Stipulation 1 of Ordinance G-6623.
Existing:
1. The development shall be in general conformance with the elevations date stamped April 10, 2019 as modifiedby the following stipulations and approved by the Planning and Development Department.
The requested modification would utilize the exact same wording but would reference the new proposed elevations which are the subject of this Planning Hearing Officer Application.
Proposed:
1. The development shall be in general conformance with the elevations date stamped April 10, 2019 [DATE] as modified by the following stipulations and approved by the Planning and Development Department.
Conclusion
The proposed amendments to the scheme respond to a build-to-suit request from an incoming tenant which given the economic situation is extremely positive.
The overall massing and layout are very similar to the approved concept with only some minor modifications to the elevations all of which are in compliance with the A-1 Zoning.

AN ORDINANCE AMENDING THE ZONING DISTRICT MAP ADOPTED PURSUANT TO SECTION 601 OF THE CITY OF PHOENIX ORDINANCE BY CHANGING THE ZONING DISTRICT CLASSIFICATION FOR THE PARCEL DESCRIBED HEREIN (CASE Z-19-19-6) FROM R-3 (MULTIFAMILY RESIDENCE DISTRICT) TO A-1 (LIGHT INDUSTRIAL DISTRICT).
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PHOENIX, as
SECTION 1. The zoning of a 1.12 acre property located at the northeast
corner of 51st Street and Taylor Street in a portion of Section 5, Township 1 North,
Range 4 East, as described more specifically in Exhibit "A," is hereby changed from "R-
3" (Multifamily Residence District) to "A-1" (Light Industrial District).
SECTION 2. The Planning and Development Director is instructed to
modify the Zoning Map of the City of Phoenix to reflect this use district classification
change as shown in Exhibit "B."
SECTION 3. Due to the site's specific physical conditions and the use
district applied for by the applicant, this rezoning is subject to the following stipulations,
violation of which shall be treated in the same manner as a violation of the City of
Phoenix Zoning Ordinance:
1. The development shall be in general conformance with the elevations date stamped April10, 2019, as modified by the following stipulations and approved by the Planning and Development Department.
2. All parking shall be located behind the building, as approved by the Planning and Development Department.
3. Any outdoor storage shall be located behind the building and be screened by a minimum 8-foot high decorative masonry wall, as approved by the Planning and Development Department.
4. One framing inspection for the primary building must be approved prior to the issuance of a permit for any off-premise signage.
5. The development shall utilize the C-2 streetscape landscape standards for planting type, size and quantity along the 51st Street and Taylor Street frontages, as approved by the Planning and Development Department.
6. If determined necessary by the Phoenix Archaeology Office, the applicant shall conduct Phase I data testing and submit an archaeological survey report of the development area for review and approval by the City Archaeologist prior to clearing and grubbing, landscape salvage, and/or grading approval.
7. If Phase I data testing is required, and if, upon review of the results from the Phase I data testing, the City Archaeologist, in consultation with a qualified archaeologist, determines such data recovery excavations are necessary, the applicant shall conduct Phase II archaeological data recovery excavations.
8 In the event archaeological materials are encountered during construction, the developer shall immediately cease all ground-disturbing activities within a 33-foot radius of the discovery, notify the City Archaeologist, and allow time for the Archaeology Office to properly assess the materials.
9. Recycling services shall be provided on site.
SECTION 4. If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held to be invalid or unconstitutional by the

decision of any court of competent jurisdiction, such decision shall not affect the validity
of the remaining portions hereof.

3) Z-19-19-6: Presentation, discussion and possible recommendation regarding a request to rezone 1.12 acres located at the northeast corner of 51st Street and Taylor Street from R-3 to A-1 to allow manufacturing, office and warehouse.

At this point in the meeting Ms. Hayleigh Crawford arrived bringing the quorum to 14 members.
Ms. Maja Brkovic provided an overview of the request noting the projects location, surrounding uses, surrounding zoning, general plan designation, staff findings and recommendation.

Mr. Adam Baugh, Withey Morris, PLC, representing the applicant, Blue Box Holding, LLC, presented an overview of the request. He explained that the development would include a warehouse building and a billboard sign. He provided an overview of the site plan and explained that the proposed zoning and use was most practical on the site because the site was adjacent to the freeway for much of the property.
Ms. Hayleigh Crawford asked for clarification regarding recycling on the site. Mr. Baugh noted that private waste services would be provided on the site and that there would be a dedicated recycle bin on site for recyclable scrap material.
Ms. Dawn Augusta asked if the site might be used to store or be affiliated to medical marijuana uses. Mr. Baugh note the building could not be used for medical marijuana as the property would not be able to meet ordinance requirements.
Ms. Barry Paceley asked if the billboard sign would be electronic. Mr. Baugh noted that an electronic sign would require a use permit.
Ms. Andrea Hardy asked how the applicant was going to meet the planting requirement in the PUE. Ms. Jessi Thornton, Withey Morris, PLC, noted that the applicant would be abandoning a portion of the PUE and indicated that there were specific plant species that would get planted in the PUE.

Mr. Hayleigh Crawford made a motion to approve Z-19-19-6 per staff stipulations with an additional stipulation to require recycling services be provided on site.
