PROVIDING FOR THE ACQUISITION OF EASEMENTS FOR PUBLIC USE, TO WIT:WAIANAE COAST EMERGENCY ACCESS ROAD, SITUATE AT LUALUALE!,WAIANAE, OAHU, HAWAII, AND DETERMINING AND DECLARING THE NECESSITYOF THE ACQUISITION THEREOF BY EMINENT DOMAIN.

BE IT RESOLVED by the Council of the City and County of Honolulu:

That for public use and purpose, to wit: Waianae Coast Emergency AccessRoad, Parcels S-i, 5-2, and B-i (TMK: 8-7-019-054), Parcel S-3 (TMK: 8-7-019-001),Parcels S-4, S-5, and 6-3 (TMK: 8-7-021-035), and Parcels 5-6, S-7, and B-2(TMK: 8-7-021-001), situate at Lualualei, Waianae, Oahu, Hawaii, proceedings ineminent domain as provided by law be instituted for the acquisition of slope easementsover, under, through, and across Parcels S-I, S-2, S-3, S-4, S-5, 5-6, and S-7, andbridge maintenance easements over, under, through, and across Parcels B-I, 6-2, andB-S. the descriptions of which parcels of land are attached hereto and made a parthereof, and that the Corporation Counsel of the City and County of Honolulu be and sheis hereby authorized and empowered to institute the said proceedings.

That this acquisition by eminent domain is necessary for the aforesaid public useand purpose.

II.

That in the process of said proceedings in eminent domain, the CorporationCounsel be and she is hereby authorized and empowered to negotiate terms of

settlement, subject to the approval of this Council and/or of the Court before which suchproceedings are commenced.
