Sub:- Guidelines for OTS Scheme for Credit
Societies, 2020.
On scrutiny of functioning of the PAC’s/Multi-
-purpose/Urban Coop. Credit Societies in this State,
it is observed that, due to mounting overdue of
loan advanced by these Coop. Societies they are
constrained to make provision towards principal
and interest receivable from the members. This has
resulted into mounting of N.P.A’s of the said societies
against which the appropriate provisioning needs
to be done in the balance sheet to avoid further
erosion of owned funds.
In view of this in order to speed up recovery and
also to give relief to the affected borrowers, it is
necessary that all the Credit Co-operative Societies
(other than Banks) shall devise a One Time
Settlement (OTS) Scheme for their borrowers. To
facilitate proper drafting of the OTS Scheme the
Government is pleased to lay down guidelines as
enclosed which shall be the guiding principles
within which each Credit Co-operatives shall frame
their schemes and obtain approval from their
respective Board and General body.
Society having any Government Share Capital
Contribution or aid in any other form shall
compulsorily obtain prior permission of the Asstt.
Registrar concerned before implementation of the
OTS Scheme.

GOVERNMENT GUIDELINES ON LOAN
REPAYMENT COMPROMISE SCHEME/OTS
SCHEME FOR CREDIT CO-OPERATIVE SOCIETIES
IN THE STATE OF GOA – 2020
Features
1. The OTS scheme shall be applicable to all the
Primary Agricultural Credit/Multi-purpose/
/Urban Coop. Credit Societies registered in the
State of Goa who are doing the credit and
deposit business.
2. This scheme shall adhere to all the provisions
of the Goa State Coop. Societies Act, 2001 &
the rules made there under and shall also
comply with the various Circulars Notification,
Orders issued by the Government and
Registrar of Co-operative Societies from time
to time.
3. After adopting the scheme, it shall be made
applicable to all the members of the society
equally without any discrimination except
sitting members on the Board of Directors, Ex-
Directors and their family as defined under
the Act.
4. Since at any point of time the Doubtful-1 type
of loan and interest therein would not be
exempted/waived, Rule 40 of the Goa Coop.
Societies Rule, 2003 shall not be applicable to
this compromise scheme.
5. The Societies shall be bound to place all the
information in relation to the loans covered

under this OTS scheme in the Board of
Director’s Meeting. Therefore, all the cases
considered for OTS scheme shall be included
in the Agenda of the Board of Director’s
meeting. The particulars of which will be
placed before the Board of Director’s in the
proforma enclosed herewith as “Annexure-A”.
6. Since the exemption is not allowed in the
outstanding balance of principle and interest
as appearing in the loan ledger of the loanee
members there is no necessity to make
provision in the balance sheet of the society
in respect of the exemption waiver is allowed
to the loanee member.
EXPLANATION
a) Incase any society has shown the accrued
interest receivable in the balance sheet
after Doubtful-I stage, then such interest
shall not be exempted. It will be the
responsibility of management to recover
such interest in TOTO and then they can
apply OTS to such cases.
b) The society shall prepare statement as
prescribed under clause 6 and shall obtain
approval from the board meeting before
practically implementing the scheme.
1. Eligibility
The cut off date of this scheme for eligibility
shall be 31st March, 2015 and shall remain in
force till 30th September, 2020. The loans which
are doubtful and classified as NPA’s only upto
31st March, 2015 shall be considered for this
scheme to be eligible.
2. The scheme will not be applicable to the
following cases:
A. The loans availed by the sitting directors/
/members of the managing committee,
ex-directors and their family as defined
under the Act.
B. The loans obtained by suppressing the
facts and mis-representation about the
loanee, the purpose of loans, the particulars
of mortgage property etc., similarly this
scheme will not be made applicable to the
loans availed with the intention of
cheating the society and also the loans
which has been made to be overdue
knowingly wilful defaulters and also with
intention of duping the society.
C. If the loans have been utilized for the
purpose other then the purpose for which
it has been sanctioned (diversification of
funds)
D. The loans in respect of which the
reconciliation or compromise agreement
has been concluded (consent decree has
been finalized) and thereafter the said loans
have been overdue.
E. The loans that have been sanctioned by
the society beyond the loan limit that has
been specified in its bye laws and or loan
Rules.
F. The loans sanctioned to the employees of
the said particular society.
G. The loans sanctioned on the hypotheca-
tion of gold, fixed deposit, national saving
certificate, Kisan Vikas Patra, Indira Vikas
Patra and any such gilt edged security.
H. Any other reasons if, BOD finds genuine.
3. Obligation to be adhered by the priniciple
loanee and sureties after availing OTS
Scheme
A. The loanee members who has availed the
OTS facility shall not be entitled for any
type of facilities/exemption in relation to
loan repayment for future 6 years from the
date of availing this facility.
B. The loanee members and surety members
who has availed this facilities shall not
stand surety to any type of loan advanced
by the society for next 6 years from the
date of availing this OTS.
4. The following items/heads can be waived/
exempted under this scheme:
a) Recovery expenses of the Society.
b) Penal Interest.
c) Postage expenses and the expenses other
then the actual interest.
5. The Waiver could be allowed under this
scheme in following heads of accounts:
a. The loans which has been classified as
doubtful/N.P.A. under Doubtful-I category
shall be treated as the loan receivable
amount i.e. the principle amount and
interest shown as receivable as on cut off
date shall be treated as the amount
receivable from the loanee members.
b. The expenditure for publishing the
Advertisement may also be exempted.

6. The mode of application:
a. The last date for application to avail theOTS shall be decided by the Boardhowever the same shall not be extendedbeyond six months from the date of issueof this guidelines.
b. The applicant shall deposit 10% of the loanamount as it stands on cut off date ofclassifying his loan and interest asDoubtful-I.
c. The Board of Directors shall scrutinize theapplication received from the loanee
members and take the decision thereafter.
Nevertheless, the decisions taken by the Boardof Directors under this OTS scheme shall becommunicated to the concerned applicant within30 days from the date of such decisions. In case thesociety refuses any such applications the refusalsshall be communicated to the concerned applicantwith the reasons of non acceptance of hisapplication and 10% amount of loans receivedalongwith application from the concerned loaneemembers shall be credited to the principle loan ofthat loanee. In no case, amount shall be adjustedtowards the interest.
7. Applicability of the Scheme:
A. This scheme is applicable to all types ofloans.
B. This scheme is applicable to doubtful loansin respect of which the process ofArbitration is being continued and or thedecree have been passed in respect of suchloans by any judicial and quasi-judicialauthority.
C. When more then one loan accounts havebeen turned into N.P.A’s because of onedoubtful loan of any loanee member, thisloanee member shall be entitled for theOne Time Settlement scheme in respect ofthe loan account which has been treatedas doubtful one only and not to the otherloan accounts.
8. Compromise Formula:
A. The date i.e. cut off date, on which theloan has been classified as Doubtful-1, onthat day the balance of principle andinterest appearing in the loan ledger shallbe taken as the base and the simpleinterest not more than @ 10% shall becalculated on the total of the aboveprinciple and interest, this rate of interestshall be applicable commonly to all the
loanee members.
B. In case any loanee members has paid
certain amount after cut off date the date
of classifying the loan as doubtful one, such
amount shall be deducted at the end.
However, in no circumstances the amount
outstanding on the date of classification
of loan as Doubtful-1 shall be reduced and
allowed to be closed by recovering less
amount then the formula adopted by the
society as at “A” above.
C. The loanee member shall deposit 25% of
above compromised amount within 30 days
from the date of the letter of the society.
(this 25% proportion may include the
amount deposited at the time of
application for OTS)
D. Remaining 75% of the amount arrived after
compromise shall be paid within 30 days
from the date of expiry of 30 days allowed
(under “C’ above)
E. Precisely, the total amount that has been
compromised under this scheme shall be
paid within 60 days from the date of
communication under para 6 from the
society to loanee member.
F. Incase the loanee member fails to pay the
entire amount within 60 days as specified
under clause ‘E” above and if the balance
remains after 60 days, the loanee members
shall be liable to pay for 15% rate of interest
compounded at an interval of one month
till the date of final payment.
G. The mode applicable in clause ‘F’ above
shall be limited only upto 12 month from
the date arrived under clause E. Beyond
this period, the loanee member will be
liable for the penal interest @ 2% over and
above the rate specified under clause ‘F’
above.
H. The society can allow this relaxation only
to the extent of 24 months from the expiry
of 60 days that has been allowed under
compromise formula in clause E.
I. In case the entire amount arrived after
compromise has not been deposited within
24 months from the date of expiry of 60
days as calculated in clause ‘E’ of this para
the society will have right to revoke the
facility of One Time Settlement scheme
extended to the loanee members and in
such circumstances the loanee shall be
liable to pay all the amount along with the

regular interest, service charge, recovery
charge & other incidental expenses. The
society will also have the right to recover
the amount from the loanee as it is being
done under normal practise.
J. In case any loan of a society is overdue for
more than 10 years and that the said loan
is not secured by tangible security of the
principal loanee, such loan could be
compromised under OTS with due approval
of the general body, provided that in no
case the amount recovered shall be less
than double of the principal loan availed.
9. The obligations to be observed by the society:
A. Public notice shall be published in any
two local newspapers, one in Marathi and
in English language to give wide publicity.
B. All the eligible loanee member under this
scheme shall be entitled for the scheme
and the society shall not discriminate to
any member.
C. The amount compromised shall bedeposited by the loanee himself. In nocircumstances, the loan compromised
under this scheme shall be paid by gettingsanctioned loans in the name of othermembers or through and on behalf of othermembers. In case any director or officebearer or responsible officer as the casemay be is found to be misutilising the
scheme by borrowing in the name of anyone person and repaying the loan of theother person with the sole intention to takethe benefit of One Time Settlement schemethe person responsible shall be liable forthe action under the relevant law in force.
D. The society shall constitute anindependent sub-committee under thenomenclature “One Time Settlement subcommittee” in which the chairman of thesociety, three directors, will be the membersand the Chief Executive Officer/Secretary//Manager will be the Member Secretary ofthe said committee.
E. The list of eligible OTS cases shall beforwarded to the respective zonal officesfor verification.
F. The society who has availed any loan,financial assistance, Government Shareholding, Guarantees, etc. from theGovernment shall invariably seek approvalfrom the Government before implementing
the OTS Scheme.

Bardez is directed to publish this notification
through the Director of Information and Publicity
in local newspapers and P.W.D. (Engineering Cell)
to make necessary arrangements to construct the
speed breakers and to erect the signboards at the
places indicated above as per the specification laid
down by the Ministry of Road Transport and
Highways and as published in the Official Gazette
Series I No. 15 dated 15-07-2005 by the Government
of Goa and report compliance within fifteen days
time.

dent of Police, Traffic, South Goa, Margao.
Whereas, the Deputy Superintendent of Police,
Traffic, South Goa, Margao vide letter dated
14-01-2020 has submitted that the Police Inspector,
Traffic Cell, Vasco has reported that due to the
ongoing construction works of the new Zuari
Bridge, several Bottlenecks are being formed on
the stretch of NH66 from Verna near Sharayu Toyota
Showroom to Agassaim Bypass road. Besides narrow
carriage way of the road, it is also due to the uneven
surface of the road at various places such as near
Santrant slope and Bony Deck below railway bridge,
vehicular traffic moves at snail pace, forming long
queues of vehicles, resulting in frequent traffic
congestion along the National Highway;
And whereas, it is further submitted that the
problem is further compounded as heavy vehicles
including Trucks, Tankers, Trailers and centers
contentiously converge from Borim side towards
Thana-Cortalim road via Loutolim to proceed to IDC,
Railway Station Verna, MPT Vasco and also from
Vasco towards Borim from Cortalim Junction via
Cortalim Ferry - Thana. Due to movement of these
heavy vehicles which intersect Thana - Cortalim
road, frequent traffic congestion is caused at the
Thana Cortalim junction which caters to continuous
and heavy volume of vehicular traffic plying from
Panaji to Margao and vice versa;
And whereas, to streamline vehicular movementalong NH66 and prevent frequent traffic jam, it isalso submitted that it is necessary to restrict the
movement to heavy vehicles which are continuouslyusing this route from Borim towards Cortalimjunction and vice versa to proceed to theirdestinations like MPT, Vasco Zuari Industrial Estate,Verna Industrial Estate and also for heavy vehiclescoming from Vasco side to proceed toward Borim
from Cortalim Junction via Cortalim Ferry - Thanaand therefore requested to notify the road leadingfrom Borim to Loutolim Ferry-Cortalim junction andvice versa and also the road coming from Vascoside to proceed towards Borim from Cortalimjunction via Cortalim ferry - Thana as “No Entry for
all types of heavy vehicles” till the completion ofthe construction work of new Zuari Bridge;
And whereas, I am satisfied that “No Entry” forheavy vehicles from Borim to Thana CortalimJunction and from Cortalim Junction - Cortalim Ferry- Thana to Borim is essential to reduce traffic

The alternate routefor these heavy vehicles is available via Verna -Arlem Bypass from where these vehicles can plywithout any inconvenience.

1. Proper signages of “Road Closed”, “No Entry”,“Take Diversion/Work in Progress” etc. shallbe erected on both the sides of road, flashlight for guidance of the motorists, pedestriansand other road users.
2. Necessary signbaords shall be erected by the
concerned roads division, PWD.

Mrs. Rosalia Otilia Melinda Pinto D’Abreu, married
with pre-nuptial agreement dated 9-5-1944, however
by executing a Will dated 1-4-1978, executed before
the Notary Public Ex-Officio of Ilhas at Panaji at
page 22 of the Register Number 46 of Wills, in favour
of his said wife; Mrs. Rosalia Otilia Melinda Pinto
