which, it will be treated as refusal of promotion by

the promote officer and he shall be debarred for

The records indicate that the Administration has

taken appropriate steps in respect of some of the

grievances including rehabilitation of the tribals/

victims at Nirankal.

The Learned Adv. Shri Sonak submitted that still

some more grievances have remained to be

redressed.

Shri Satish Sonak submits that basic

necessity of toilet facilities has not been provided

and also an adequate compensation has not been

paid.

He submitted that interim compensation has

been given which is not adequate.

It is further submitted that Police have not filed

charge-sheet against the offenders so far.

Smt. Sawant Dy. S.P. stated before us that the

investigation of this case is in progress and the

Police shall be able to file charge-sheet/report u/s

173 of Cr.P.C. within 3 months.

In view of the above, we make the following

recommendations:

The State Government shall take appropriate

steps to provide basic necessity of toilet facility for

males and females as expeditiously as possible.

The Collector and District Magistrate, South Goa

shall move the Government for payment of adequate

and final compensation to the victims.

The Ponda Police shall take appropriate

steps to expedite the investigation and shall file

report u/s 173 of Cr.P.C. preferably within three

Accordingly, the proceeding is disposed off.

1) That Office of the District Magistrate, South

Goa, Margao has submitted compliance report

dated 16-11-2016 before this Hon’ble

Commission.

2) That as per the said report the following things

have been done in the interest of “Wanarmare”.

a) Provided benefits under Food Security Act

and has issued Ration Cards as per the list

annexed.

b) Opened Saving Accounts and delivered to

them on February, 2016.

c) Provided Aadhar Cards to all including

children.

d) The names of all the adults have been

enrolled as electors.

e) Solar lights were also provided to their

families.

f) That Police protections was given to ensure

safety to them.

g) That further Sub-Divisional Police Officer,

Ponda and SDM, Ponda were directed to

conduct inquiry of the incident.

h) That Ponda Police Station had registered

Cr. No. 292/16 U/s. 147, 452, 427, r/w. 149

IPC and Sec. 3(1)(V) of the Scheduled

Castes and Scheduled Tribes (Prevention of

Atrocities Act), 1989 against 15 local

people including 5 ladies on 16-10-2016.

i) As per the Goa Calamity Relief Fund, the

proposal was accepted by the Government

and the compensation of Rs. 2,50,660/-

will be paid to 17 Wanarmare families

subject to availability of funds for the

repairs of their huts and sheds [As per

the letter issued by Under Secretary

(Revenue-I) to the Collector, South Goa

dated 17-07-2017].

j) Families who were under darkness are

provided with full fledged electrical

supply by general area lightening since

15-11-2016.

k) Steps have been initiated to provide new

solar lanterns to the families/households.

l) That the Civil Supply Department has made

arrangements to supply food items and

distributed 5 kgs. of rice and ½ kg. of sugar

per person on 2-11-2016.

3) That Respondent No. 2 also has submitted his

comments in the above matter on 08-02-2017,

in which he has given the details of the action

taken in the whole incidents and the help and

the protection which has been extended to

Wanarmare Community.

4) That Respondent No. 1 adopts the contents of

the Compliance Report filed by Office of the

District Magistrate, South Goa, Margao, and the

comments filed by Respondent No. 2 before this

facility level. It will also review compliance

to standards & protocols, and reports of the

financial proposals that are beyond the

powers of the Executive Committee, i.e. over

Rs. 10.00 lakhs at the level of the District

Hospital.

7. The Governing Body shall have powers to

engage chartered accountant for audit

purposes for a period not exceeding three

years.

8. The Governing Body shall meet at least once

in quarter.
