Trader Notice MPD 02/2016
To: All Food Business Operators approved or seeking approval to export milk or milk products to the at Russian Federation/Customs Union (RF/CU).
Subject: Reference List of Russian Federation/Customs Union legislation for dairy FBOs and
associated pre-certification criteria and plant inspection format.
Background This Trader Notice updates previous Trader Notices issued by DAFM concerning the export of dairy products to the Russian Federation/Customs Union (TN No. 3/2012 and 001/2014). FBOs listed/approved or considering listing/approval to produce/store/export milk products to
the Russian Federation/Customs Union, either directly or via other EU Member States, must
have a working knowledge of relevant RF/CU national legislation on the sanitary and veterinary
standards applicable to products exported to the RF/CU.
Although the Customs Union of the Russian Federation, Belarus and Kazakhstan came into
existence in 2010 and has developed a considerable amount of trans-CU legislation, this is not
complete. Therefore some older RF sanitary and veterinary standards still apply.
At present there is a Russian prohibition on the export of most dairy products to the Russian
Federation, which has been extended to the end of 2017. However some dairy products are not
subject to this ban. (See Point 2 below).
Purpose of Trader Notice
This trader notice has a number of purposes, primarily emanating from the findings of a RF/CU
audit of Irish Dairy plants in 2014 and the findings thereof (please see also Trader Notice
03/2016 in this respect). Key issues this notice aims to address are as follows:
1. Appraise FBO’s of the relevant RF/CU Legislation and their responsibility in respect of being
cognisant of same
2. Provide a background context in terms of the ongoing Russian Ban
3. Elaborate on the practical implications greater adherence to RF/CU legislation will have in
terms of issues such as sampling criteria, plant approvals and inspections.

1. RF/CU Regulations: RF/CU regulations is laid out along sanitary and veterinary lines as outlined below. The principle Regulations that apply are:
Customs Union Technical Regulation No. TR TS 033/2013 on the Safety of Milk and Milk Products.
Customs Union Technical Regulation No. TR TS 021/2011 on the Safety of Food Products.
Customs Union Decision No. 299 on laboratory test requirements.
Russian Federation Milk Regulation No. 88 as amended by RF No. 163. Sanitary (Hygiene) Requirements
These are the regulations setting out the hygiene and sampling/testing requirements for food
products being exported to the RF/CU:
1. San Pin
This is the principle statement of RF sanitary (hygiene) requirements for all foods imported
into the Russian Federation.
The specific application of SanPin to dairy products is contained in a 1996 regulation:

These are a detailed set of technical regulations for the production and export of dairy
products into the Russian Federation

3. Customs Union Sanitary Regulations
a. Customs Union Decision 299
This piece of legislation details the entire microbiological, chemical and residue testing
required to be carried out on all foods exported into the Customs Union.
It is currently being applied in the EU for meat and dairy products.

These came into force on July 1st 2013 and include regulations on:

This regulation should be read in conjunction with CU Regulation No. 021/2011 on General Food

Veterinary Requirements
Most of the current veterinary requirements emanate from the Customs Union and relate to:
The single list of goods subject to veterinary control (supervision);
The standard forms of veterinary certificates;
The regulations for the standard procedure of joint field inspections and selection of
samples of goods (products) subject to veterinary control (supervision) in the territory of
member states of the Custom Union and third countries:

This Decision lists the goods subject to veterinary control and details the veterinary (animal
health and veterinary public health) requirements applicable to animals/foods of animal
origin imported into the Customs Union

2. Russian ban on the import of certain dairy products and derogations (Annex 1)
The Russian ban on a list of products for human consumption has been extended to end
2017.
The list of banned products and commodity codes (CN codes) are listed below in Annex 1
and include butter, cheese and processed cheese.
The list of CN codes does not apply to goods destined for use in baby food.
Derogations from the ban includes: specialised lactose free milk and specialised lactose free
dairy products intended as a dietary health food or for protective dietary nutrition purposes.
The ban also does not include the following CN codes:
CN code 3501 : Casein, caseinates and other casein derivatives, and
CN code 3502 : Albumin, including two or more whey proteins containing more than 80% whey protein dry matter, albuminates and other derivatives of albumin.
These dairy products may continue to be certified and exported from RF/CU approved
plants.
N.B. The ban is a Russian ban and does not apply to exports to Kazakhstan and Belarus.
Dairy product may be exported from an RF/CU non-restricted approved plant to another EU Member State when it is intended for use as an ingredient in another product which itself is not subject to the Russian ban and which therefore may be onward certified by that EU Member State.

NB. The RF/CU require that the test results relate to the consignment exported. In order
to provide such traceability and for certification purposes, the FBO should ensure that
sampling is done during RF/CU production runs, unless the FBO operates a continuous
RF/CU production system. In either case, linkage with the consignment or consignment
equivalent product must be demonstrable. Where possible, RF/CU samples should be
taken from and test results relate to specific RF/CU consignments.

4. Dairy plant approvals
To gain RF/CU approval, a dairy establishment must apply to DAFM, have an RF/CU system in place that ensures that the systems and product intended for the RF/CU market meets compliance with RF/CU regulations. RF/CU approval will not be considered by the RF/CU Authorities until the applicant plant has been inspected by an audit team from the RF/CU. RF/CU audit inspections will first require the lifting of the Russian ban for related products.
