    STATEMENT OF CITY COUNCIL CANDIDATE DENNIS SAFFRANCONDEMNING COURT DECISION STRIKING DOWN STOP & FRISK

    - - - Judge Scheindlin may feel very progressive in her secure upper

    middle class home tonight. But she has just made life a lot moredifficult and dangerous for immigrant and minority bodega owners

    and struggling single mothers and their kids

    City Council candidate Dennis Saffran (R-C, 19th District) condemned this morningsfederal court decision by Judge Shira Scheindlin holding the Citys Stop, Question andFrisk policy unconstitutional and appointing a monitorto rewrite the policy.

    Saffran, an appellate lawyer and former head of a national public interest anti-crime

    group, stated:

    Judge Scheindlins decision today is a threat to our city, a threat to ourpolice, and, most importantly, a threat to the lives of the very peoplewhose rights she claims to be protecting. Stop, Question and Frisk hasbeen an essential element in our citys incredible success in drasticallyreducing violent crime during the Giuliani and Bloomberg years. Ofcourse we must assure that these stops are as courteous, civil andrespectful as possible. But the bottom line is that they get guns offthe street and save lives typically the lives of poor and minoritychildren. As Mayor Bloomberg noted today, the murder rate in New York

    City has been reduced from more than six per day during the DinkinsAdministration to less than one per day now. And we know that, given thesad reality of where crime occurs, most of the lives saved have beenthose of young black and Hispanic men. According to some estimates, ifNew Yorks crime rate had remained what it was when Mayor Giuliani waselected in 1993, more than 10,000 black and Hispanic males who are alivetoday would have had their lives cut short in senseless street violence.Indeed, in Chicago, where a liberal city government refuses to implement

    a policy like New Yorks, the teen homicide rate is four times what it ishere.

    Judge Scheindlin, whose bias against the city has been evidentthroughout this litigation, and who blithely declared at the outset of her

    opinion that she did not care about the effectiveness of stop and frisk indeterring or combatting crime, may feel very smug and superior andprogressive in her secure upper middle class home tonight. But she has

    just made life a lot more difficult, and dangerous, for the immigrant andminority bodega owners and the single mothers and their kids struggling tosurvive and succeed in our citys roughest neighborhoods. Her decision iswrong on the law as well as the policy, and the city must fight it all the wayto the Supreme Court if necessary.
