NDHFA is providing the Down Payment Assistance in its governmental capacity in the State of North Dakota, the state in which the Property is located, pursuant to and consistent with its FirstHome Program or ND Roots Program. The Down Payment Assistance is not contingent upon a future transfer of the first mortgage loan to any entity other than the Agency. NDHFA has, at or before the closing of the first mortgage loan, incurred a legally enforceable obligation to provide the Down Payment Assistance. NDHFA will satisfy this obligation by wiring funds from the Agency’s Trustee Account directly to the above referenced lender’s specified account as evidenced in the applicable funding report.
