INTRODUCTION

•The Indian Postal Service, with 1,55,333 post office, is the most widely distributed post office system in the world (China is next, with 57,000).The large numbers are a result of a long tradition of many disparate postal systems which were unified in the Indian Union post-Independence. Owing to this far-flung reach and its presence in remote areas, the Indian postal service is also involved in other services such as small savings banking and financial services.

HISTORY OF POSTAL SERVICES

•The British East India Company established post offices in Mumbai, Chennai and Kolkata from 1764-1766, each serving the Bombay, Madras and Calcutta presidencies. During Warren Hastings' governorship, postal service was made available to the general public. A letter would cost 2 annas (one-eighth of a Rupee) for distances up to 100 miles (160 km). Payments would be done through copper tokens; a letter was hand stamped "post paid" if paid for, otherwise it was stamped "post unpaid" or "bearing".

GOVERNANCE & ORGANIZATION CONNECTED TO POSTAL SERVICES

• The postal service comes under the Department of Posts which is a part of the Ministry of Communications and Information Technology under the Government of India. The apex body of the department is the Postal Service Board. The board consists of a chairman and three members. The three members hold the portfolios of Operations & Marketing, Infrastructure & Financial Services, and Personnel. The Joint Secretary and Financial Advisor to the Board is also a permanent invitee to the Board.

SERIOUS CONSEQUENCES

• The EICI (Express Industry Council of India) believes that, if enacted, the provisions of The Bill would drive the Indian economy

• Backwards and effectively wipe out the Express and Courier Industries.

• The EICI welcomes the opportunity to modernize The Act, but it believes that it should be done on the basis of:- 

• - qualitative improvements to India's postal services;

• - recognition of modern communication and shipment needs and practices and-a competitive market operating on a level playing field.

POSTAL SERVICES IN INDIA

•India possesses the largest postal network in the world with 1,55,000 post offices spread all over the country as on March 31, 2001, of which 89 per cent are in the rural sector. Post offices in India play a vital role in the rural areas. They connect these rural areas with the rest of the country and also provide banking facilities in the absence of banks in the rural areas.

CASE STUDY:Union of India VS Bhojraj Singh

• An appeal was filed by the appellants Postal Department, Union of India against the order dated 21.5.09 passed by the District Forum , Sirohi in complaint no.48/08,by which the complaint of the complainant respondent was allowed against the appellants in the manner that the appellants were directed to pay a sum of Rs.5000/- as amount of compensation for mental agony and Rs.1000/- as amount of cost and if the above amount was not paid within two months ,the appellants would further pay interest @ 9% p.a.

• Since in this case, deficiency in service on the part of the appellants is well established and protection u/s 6 of the Act, 1898 is not made available to the appellants and so far as the amount of compensation is concerned, the District Forum had awarded a very marginal amount and from that point of view also, this Commission does not want to interfere with the findings recorded by the District Forum even on point of compensation.

For reasons as stated above the findings recorded by the District Forum, by which the complaint was allowed are liable to be confirmed one and this appeal deserves to be dismissed and the same is dismissed.
