Subject: Estt: Promotion from the grade of Inspector to thegrade of Superintendent Group "B" in the combinedcadre of Gujarat State — reg.
Shri Bist Tanujkumar B., Inspector, Customs Ahmedabad, is hereby
promoted to the grade of Superintendent Group "B" in the Pay Band of Rs.9300-34800
with Grade Pay of Rs.4800/-, w.e.f. 01.03.2012, i.e. the date from which his immediate
Junior Inspector, Shri Ojha Manoj Kumar, was promoted to the grade of
Superintendent. The promotion of Shri Bist Tanujkumar B is on notional basis with
benefit of fixation of pay in the said grade and consequential benefits as admissible
under the rules/orders. However, no arrears of salary will be admissible.
Consequent on promotion, Shri Bist Tanujkumar B is posted to Customs
Ahmedabad Zone.
Accordingly, the seniority of Shri Bist Tanujkumar B is hereby fixed
above Shri Ojha Manoj Kumar, who was promoted vide CCO's Estt. Order
No.11/2012 dated 28.02.2012 under F.No.11/03-02/CC0/2012.
The above promotion is being made in terms of Ministry's letter F.No.C-
18012/6/2009—Ad.11—B dtd.16.09.2010, in pursuance to Hon'ble Kolkata High Court's
interim order dated 27.08.2010, vacating its earlier interim stay order dated 02.03.2010
in WPCT No.261 of 2008 filed by Samiran Roy & Others V/s U01 & Others.
The above promotion is subject to final outcome of the said WPCT No.261
of 2008 before Hon'ble Kolkata High Court and final decision of the Government of
India, on the issue regarding treatment of SC & ST candidates promoted on their own
merit, as conveyed vide Ministry of Finance, CBEC, New Delhi's letter F.No.C-
18012/23/2010—Ad.IIB dtd.15.02.2012.

The above officer will be on probation for a period of two years from the
date of assumption of charge in the grade of Superintendent Group "B".
The said officer, if he has not been given financial benefit under Assured
Career Progression (ACP) Scheme, should note that he should exercise the option for
fixation of pay in accordance with the instructions contained in Ministry of Home Affairs,
Department of Personnel and Administrative Reforms, New Delhi's O.M. No.13/2/97—
Estt.Pt.1 dated 12.12.97 as amended from time to time.
Further, if he has been grated the financial benefit under the ACP Scheme
in the Pay Scale of Rs.7500-250-12000 prior to this, no pay fixation benefit shall
accrue to him on account of this promotion, in terms of the provisions contained in ACP
Scheme introduced by Government of India, Department of Personnel & Training's
O.M.No.35034/1/97—Estt.(D) dtd.09.08.99 as amended.
The above officer should note that he is liable to be transferred from his
present place of posting to anywhere in India.
If the officer so promoted to officiate as Superintendent Group "B" does
not accept the promotion by joining at the new place of posting on or before 21 st May,
2012, it will be presumed that he has refused the promotion and accordingly his
promotion order would be liable to be cancelled.
The date of relieving/joining at the old/new place of posting should be
reported to this office forthwith.
