PUBLIC NOTICE DECLARATION OF BOATING ACTIVITY EXEMPTION Marine Safety Act 2010 (Vic) Section 203(3) Peter CORCORAN, Director Maritime Safety and delegate of the Director, Transport Safety, under the Marine Safety Act 2010 (Act), makes the following declaration under Section 203(3) of the Act. For the purposes of the boating activity by Life Saving Victoria, at the waters specified in Table 1, (attached), all competing vessels and persons competing in the IRB Carnival are exempt from: 1. Five knots within 50 metres of a person in the water (Clause 2a); 2. Five knots within 50 metres of another vessel (Clause 2c); 3. Five knots within 200 metres of the water’s edge (Clause 4a); 4. Requirement to carry a hand-held orange smoke signal, hand-held red distress flares, anchor with chain or line or both, bailer, torch, bucket with lanyard and paddles (regulation 96(1)). 5. Requirement to carry approved PFD1 on a vessel 4.8 metres or less (regulation 96(2)); and 6. Requirement to wear approved PFD1 on vessel 4.8m or less (regulation 100(1)). The above mentioned exemptions are subject to the conditions detailed below. EXEMPTION CONDITIONS Exemptions 1-3 will be automatically suspended for any periods when swimmers or other vessels not associated with the event approach within 100 metres. The above exemptions will apply only to operators and vessels associated with the event which are noted on a list maintained by LSV. The masters of rescue vessels and course vessels are exempt from 1 and 2, only when undertaking a rescue operation to retrieve persons in distress and provide for their initial medical or other needs and deliver them to a place of safety. The masters and crew of all vessels must wear the approved type of PFD as specified by Life Saving Victoria. The exemptions apply for the time, date and location as specified in Table 1, attached.
