In 2005-2006 this was changed. Basic exception for other citizens was raised to Rs 100000/- & that for Sr Citizens it was made 185000/- This resulted in actual Tax relief of Rs 12000/- instead of Rs 20000/ -. Thereafter it has been progressively reduced & today it stands at just Rs 5000/- Right from its inception, the basic Income Tax exemption is related to cost of living. For & up to F.Y.2004-2005 Sr. Citizen weregetting concession in income tax payable(under Section 80CC) to the tune of Rs. 20000/-, as compared to other citizens with similartaxable income. In 2005-2006 this waschanged. Basic exception for other citizenswas raised to Rs 100000/- & that for Sr Citizensit was made 185000/- This resulted in actualTax relief of Rs 12000/- instead of Rs 20000/-. Thereafter it has been progressively reduced& today it stands at just Rs 5000/-

Right from its inception, the basic Income Taxexemption is related to cost of living. Whereasin comparison to the year 2004-05 cost of food

In 21st century population of older persons isincreasing faster than any other age group. InIndia during last decade population growth ratehas gone down by 3.09% population of 0-6 agegroup has gone down by 3.08% due to sharpdecline of 19% infertility, but the population ofSr. Citizens has gone up by 2.8% because ofrise in average life expectancy (69.89yrs).Withthe present trend we may surpass the 17%estimated Sr citizen population figure in 2050 .This may well touch 20%.

90% of Indian elderly are suffering from oneor the other ailment/disability. If India is not tobe a Nation of cripple. The Society & the Govt.will have to take care of them.

For happier or say healthier ageing Govt.support, Laws & Acts though are a necessity,are the second part of the story. The first partrests with older persons themselves, Employers,NGOs, Associations & the Labour organizations.

Every person right from the age of 45yearsneed to prepared for the old age. Governmentalone can not do it .NGOs, Associations,Employers & labor organizations can be apowerful tool & should voluntarily come forwardto train would be oldies, to save for the rainy days,to improve life style & eating habits to keep fit.

Financial security , Health care & abuseare the three major concerns of elderly:

Finance & health have to go side by side. Intoday’s scenario for continued financial securityhealth care is very important. Health is wealth is moretrue in case of Sr citizens, as one hospitalizationmay push the entire family below poverty line.

Health care :  Adequate quality & Patientfriendly Heath care within easy reach. May bedivided under two major categories

(i) Preventive care, which in fact is self care

which need training & education –Healthy eatinghabits, Exercise, yoga, acupressure, sanitation,knowledge about diseases, symptoms & regularcheckups. NGOs, Associations, Employers,labour organizations be encouraged to take upthis task by introducing distt., State & Nationallevel award by the govt.

Monetary assistance to these organizationsby the govt. should be restricted to providingbasic infrastructure & transport.

(II) Curative or Managed care i.e. OPDs &Hospitalization for which Sr citizen population canbe split in two categories

(i) Over 17% superannuated persons inorganized sector are covered by Govt. Healthschemes like CGHS, RELHS & ECHS etc. Forthis category, to extend coverage area, all theseschemes be pooled together. OPD care beoutsourced, those who opt out may be providedFixed medical allowance of Rs 1200 linked toinflation or equal to the amount M/O H & FWspends on per card holder per month in CGHSdispensaries(whichever is more).

Hospital care: more number of Hospitals &Diagnostic centers be brought on govt. panel sothat beneficiaries do not have to travel more than15 KMs. For those who still remain uncovered &for the persons in unorganized sector adequateaffordable Health insurance cover including preexisting diseases at subsidized rate of premiumbe provided. For poor elderly Govt. should bearthe burden of adequate insurance cover.

Financial security :

1.In unorganized sector universal Pension atthe rate 50% of minimum wage of Central Govt .based on15th ILC Norms plus Dearness relief@ applicable to govt. employees, to all Sr citizenshaving income below this range be granted.

2. In organized sector:

(i) To ensure that value of Sr citizen’s moneyin Banks & P.O. does not go on reducing yearafter year, rate of interest should be at least twopercent higher than the normal rate of interest &

OBITUARY

Sub: Implementation of Sixth CPC Reportregarding Disparities in %age rise ofPension of certain categories of Pre-2006 Pensioners retired from S 4 to S23 & S 29 vis-a-vis  S 24 to S 34

Reference:- i) DOP & PW OM No F.No. 38/37/08-P&PW (A), dated 1st September,2008 - regarding revision of pension ofpre-2006 pensioners and FamilyPensioners

ii) BPS Memorandum dated 11-10-2012(Point 7)– submitted to the Hon PrimeMinister reg: Long Pending issues &grievances Central Govt. Pensioners

Dear Sir,

In continuation of Memorandum submitted byBPS on 11-10-2012 to you, Bharat PensionersSamaj draw your kind attention towards PointNo 7 thereof – reg: the grave injustice done tocertain categories of the Pre-2006 Pensioners(i.e. those who had retired from S-4 to S-23) - inrespect of discriminatory Fixation of their RevisedPensions (vis-a-vis those who retired from S-24

to S-28 & S-30 to S-34) after Sixth PayCommission, in total disregard of the laws ofnatural justice and in violation of the Articles 14

& 16 of the Constitution of India.

Bharat Pensioners Samaj, therefore, seekyour benign intervention and submit the followingfacts for your favourable consideration to givejustice to the thousands of Pre-2006 Pensioners:

1. Pre-2006 Pensioners are ahomogeneous class as a whole and as such, asper settled law, they required equal treatment forrevision of their Pension. But the implementationof Sixth Pay Commission Report has created aclass within a class resulting in wide disparity inrespect of the percentage rise in the pension ofthose Pensioners who retired from lower Pay

Scales S 4 to S 23 vis-a-vis those who retiredfrom scales S 24 & above- (as per details

submitted below).

2. Glaring incoherence and partiality infixation of Pensions of Pre-2006 Pensioners atlower & middle levels were highlighted to theGovt. by one of the constituents of BPS - RSCWS(Railway Senior Citizens Welfare Society,Chandigarh) vide their Memorandum dated 24-4-2008 followed by other Memorandums dated8-5-2008 and the last one being dated: 28-5-2012. The facts were duly supported by relevantdata based on the details in the Report of SixthCPC.

3. We had a fervent hope that correctiveaction would be taken to ensure equality amongstthe past pensioners in respect of the %age rise- irrespective of the pre-revised scale from whichthey retired. Our hopes, however, had beenbelied – thus perpetrating the injustice - as wouldbe seen from the following facts.

(i ). Based on Para 4.1 of OM dated 1-9-2008 for arriving at consolidated pension and theminimum pension as per operative OM of 3-10-2008, a table is appended as Annexure-I*. Thisshows the ground reality in respect of thecomparative percentage increase in pension aswell as rise of pension in real terms as on 1-1-2006 for all the scales from S 4 to S 34 at theminimum level of pension. The following factsemerge from the table;

a) Percentage increase of Basic Pension ason 1-1-2006 was about 21.5% for scales S 4 toS 23 in Pay Bands PB 1 to PB 3, whereas thesame in Pay Band (PB) 4 and above was over50% (except for S 29) and even beyond 70 % in3 other scales - (as per details indicated in col. 7

of the Table Annexed herewith*).

b) Consequential rise in pension (Ratiobetween revised pension and Basic pension inpre-revised scale given in col.8 indicates a wideand unjustified variation between scales S 4 toS 23 in Pay Bands 1 to 3 and scales in pay band4 and above.

Sub: Deprivation of all the Central PayCommission benefits in terms of payrevisions and pensionary benefits,suffered by Pensioners born on1.1.1946/1938/1928 owing to theirretirements on 31.12.2005/1995/1985 asa result of modification of FR 56 by theMinistry of Finance

Respected Sir, This representation issubmitted by ‘Bharat Pensioners Samaj’ onbehalf of Pensioners born on 1/1/1946, 1/1/1938 and on 1/1/1928 to seek restoration of

c) Rise of Basic Pension was 2.26 times for PB1 to PB 3 whereas for higher scales, it was 3 to 3.4times - except for S 29 where it was 2.6 times.

(ii ). All Pre-2006 Pensioners are ahomogeneous class as a whole. As such theyrequire an equal treatment and consideration forrevision of their pension. It is totally unjust thatrevision of pension to be as discriminatory asmentioned above to put the retirees from lowerscales to substantial loss of pension with as lowrise as 2.26 times of Basic Pension as comparedto a rise of more than 3 times of Basic Pensionfor the higher scales of Pre-2006 Pensioners.

( iii) It is, therefore, requested that a uniformrise of at least 3 times of Basic Pension (as on1-1-2006) be given for fixation of revised pensionof all Pre–2006 Pensioners who had retired fromS–4 to S-23 & S-29 – at par with the minimumrise of Basic Pension of Pre-2006 Pensionerswho retired from PB 4 and above - as they allform the same homogeneous group of Pre–2006pensioners.

2. While modifying the then existing provisionof FR 56(a) that every government servantshall retire from service on the afternoon ofthe last day of the month in which he attainsthe age of fifty eight years, it was provided onthe 7th February, 1975 in Rule 56 (a) that agovernment servant whose date of birth is thefirst of a month shall retire from service onthe afternoon of the last day of the precedingmonth on attaining the age of sixty years.

3. The proviso added by the Ministry of Financesingled out the 1.1.1946/1938/1928-bornpensioners, which deprived them of the fullPay Commission benefits, which weregranted to the rest of the pensioners, thusthe application of the rule becoming bereft ofthe universality and uniformity maintained sofar in keeping with upholding of a fundamentalrule. It is a general principle that framing oramending of any statutory rule should becommon to all retirees without exception andthere should not be any discrimination.

4. It will be seen that the basic rule already standsrelaxed by the Government itself consequenton its acceptance of the Third Central PayCommission’s recommendation, by which allthe government servants including those bornon 1st of every month other than January,benefited, by way of extensions in theirservices besides the Sixth CPC Pay & Pensionrevision benefits, barring the 1st January-borngovernment servants. While this initialrelaxation has benefited the employees bornon 2nd of January and onwards and even 1stof every month other than January (whichvirtually means all the remaining 364 days ofthe year), as in their case their retirement asper the basic rule on the preceding dayhappened in the same year (post-2005), therelaxation was not applied in the case of the1st January-born employees probably on

Paragraph 7and second is suitableamendment to the Government Resolutiondated 29/8/2008, the third is to retire the 1stJanuary pensioners also on the 31st of thesame month and the fourth is to grant 1stJanuary born pensioners also to avail likethe rest of the pensioners all the PayCommission benefits, extension of servicesetc. by following the same principle as appliedto Senior pensioners for grant of enhancedpension on attainment of 80 years, 85 years,etc. The best recourse will always be theremoval altogether of the first proviso underthis amended FR.

9. It will also be noticed that there is noproportionate reduction in enhanced pensionfor the particular month in which a pensionerattains the 81st/85th birthday irrespective ofthe date, ie. 1st day of the month or any otherday of the month, he is paid full enhancedpension. In other words, there is noproportionate reduction for the part of themonth during which the pensioner is below80 years since the benefit has been madeavailable for the whole month.

10.It is time to think of appropriate Administrativereforms to remove all such anomaloussituation by the Govt. so that things can beput straight. They shall not view like yetanother representation or grievance, but theyneed to take it as an improvement over thesystem that is prevailing. Such a right spiritwill facilitate added repute to the HR basedAdministration of date. I think still manycapable and positive oriented functionariesexist at top layer and hence the system keepson and on in spite of all odd factors.

11.May I, therefore, request for a deep examinationof the several issues raised hereinabove, witha view to finding a satisfactory and just solutionto the hardship being faced by the pensionersreferred to above?

5. Actually, the relaxation of FR 56 should havebeen made in an equitable manner by treatingthe application of the basic rule, which standsamended, inconsequential for the 1st Januaryborn employees also.

6. In response to a representation from asimilarly affected 1/1/46-born pensioner, theDepartment of Expenditure seems to havemade a stock observation that for any suchrevision, a line has to be drawn and whereverthe line is drawn, there will be persons whoretired on a previous day and would lose thebenefits of pay revision, We strongly feel thatthis analogy may not hold good in matters ofpay & pension revisions consequent on therecommendation of Pay Commissions, sincethis happens not routinely but once in tenyears as a measure of updating the pay &pensions, etc according to new economicconditions in the country and theserecommendations encompass allgovernment servants and there cannot be anyexception by application of any extant rules,which are meant for only routine purposes.

7. Further, in regard to 1/1/46-born retirees itmay be stated that they retired on theafternoon of the last day of the precedingmonth, i.e. 31/12/2005 consequent on adecision taken based on the Third CPCrecommendation. This clubbed them with theother retirees who retired notionally on 31/12/2005. There is absolute need to provide anenabling provision, by adding another suitableprovision under FR.56 (a), so that this categoryof pensioners, who have been left out for nofault of theirs – in fact it sounds as if they havebeen penalised for wrong-doing – can alsoavail the said benefits.

8. Thus there are several alternatives to removethe hardship being faced by the above-referred pensioners. First, addition of secondProviso to FR.56 as prayed for in the

Committee of Voluntary Agencies

(SCOVA) held on 27.9.2012 under the

Chairmanship of Minister of State (PP) at

Civil Services Officers Institute (CSOI),

Kasturba Gandhi Marg, New Delhi.

Secretary (P&PW) at the outset welcomedHon’ble MOS(PP) as well as allrepresentatives of Pensioners’ Associationsand the participating members of variousMinistries/Departments. Thereafter, heenumerated the changes in the pension rulesand mentioned the fact that SCOVA has beenable to achieve the objective for which it wasstarted in 1986. Secretary (P&PW) furtheradded that today’s serving officers willeventually become pensioners tomorrow. Hepraised the contributions made by thePensioners as officers during their tenure inthe Government and also applauded for theirpresent contributions as Senior Citizens.Secretary expressed the hope that the

Department would continue to get supportfrom the pensioners’ Associations in future.

2. Hon’ble MOS (PP) in his welcome addressto the participants stated that representationsrelating to pensionary matters are increasingas different Ministries/Departments areinterpreting pension rules in different ways.Thus, he stressed the need for uniforminterpretation of pension rules so that thegrievances of the pensioners relating topensionary matters are reduced and settledwithout delay. In order to have bettercooperation between the Department and thepensioners association he agreed to theoutstanding demand of holding the SCOVAmeeting twice in a year.

4. Thereafter, the Action Taken Repot (ATR) of20th SCOVA meeting (Annexure-I ) andAgenda items of 21st SCOVA meeting(Annexure-II) were taken up for discussion.

5. Action Taken Report (ATR) on the pointsraised in the 20th meeting of SCOVA( Annexure-I)

Sl. No. 1 and 19 of ATR

(1)- Issue of Corrigendum PPO for Pre-2006 retirees and also to communicate theamount of pension as well as FamilyPension to be revised consequent to the6th Central Pay Commission to Pre1.1.2006 pensioners.

(19)- Issue of Revised PPOs for pre andpost 2006 retirees- Status thereof

i) Central Pension Accounting Office hasindicated that out of 6.67 lakhs cases ofpre-2006 pensioners/family pensionersrevised PPOs in respect of 3.06 lakhscases have been issued. CPAO informedthat they are sending e-scrolls ofPensioners to all Ministries/Departments,which will solve the problem of non receiptof Annexure-III.

ii) As final figures were not available,Department of Telecommunications andDepartment of Posts were asked tocompile data for the cases of pensioners/family pensioners of pre-2006 and takenecessary action for their revision by 31stMarch, 2013.

iii) Ministry of Railways informed that theyhave requested pensioners to apply forrevision of PPO by making all the dataavailable to them. They informed that theyhave revised 4.7 lakhs PPOs on receiptof these applications and 6.00 lakhs arepending. The Ministry has been asked tocomplete the task of issuing revised PPOsby March, 2013 where applications havebeen received. Simultaneously theyshould ascertain a mechanism of gettingdata of the remaining cases and revisingPPOs of those who have not applied forrevision of PPOs.

iv) Ministry of Defence informed that theyhave to cater to the requirement of morethan 11 lakh pre-2006 Pensioners. Theyhave revised PPOs of about 5.7 lakh outof them. They also informed that inapproximately 8.0 lakh cases, the revisionhas to be done manually and they have totake additional action for capturing all thedata which is available only in physicalform. The Ministry was asked to deployadditional manpower for capturing ofdata and complete the revisionexercise by 30th September, 2013.

Secretary (P&PW) requested all theorganizations/Departments/ Ministries toexpedite the same without further delay andupdate the latest status with the Departmentof Pension & Pensioners’ Welfare.

Sl. No. 2 of ATR :

Expediting cases of sanction of secondaryfamily pension with monitoringmechanism at various levels.

The necessary clarifications as decided in thelast SCOVA meeting had been circulated toall ministries/departments and associationson 8.12.2011 and the same has beenreiterated in September, 2012.

Hence the item is treated as closed.

Sl. No. 3 & 12 of ATR :

(3)- Same fitment benefit to Pre-2006pensioners as recommended andimplemented in respect of servingemployees by the VI CPC.

Parity between Past and FuturePensioners.

Stepping up of Pension and FamilyPension to 50% and 30% respectively.Extension of new benefits granted to thepast pensioner.

(12)- The implementation of orders dated01.09.2008 read with the orders dated14.10.08 is not correct for fixation ofpension.

With regard to the issue of same benefit topre-2006 pensioners as given to servingemployees by 6th CPC and parity betweenpast and future pensioners, the memberswere informed that CAT in its judgement on

1.11.2011 had dismissed the issue. Withregard to issue of stepping up of pension andfamily pension to 50% and 30% respectivelyof the minimum of pay in the payscale, themembers were informed that appropriateaction in this regard is being taken taken bythe government. In view of the above, it hasbeen treated as closed.

Sl. No. 4 of ATR :

A suitable alternative to merger of DR afterit reaches 50% in view of VI CPCrecommendation against 50% DA/DRmerger benefit to ensure revision atreasonable intervals.

(d) Ex- gratia to those who voluntarilyretired after 20 years of service.

(e) Ex-gratia should not be less thanminimum pension and the sameshould be effective from 01/01/06.

(a), (b) and (e) : It was informed that the proposalfor increasing the ex-gratia for CPFpensioners so as to bring them at par withSRPF beneficiaries is under consideration.

(c) : Since they are the CPF beneficiaries whoare not eligible for CGHS benefits, hence,they are not eligible for FMA as well.

(d) : As regards ex-gratia to those who tookvoluntary retirement, it was agreed to re-examine the matter in the light of various courtjudgements

The performance and facilities availableunder the Web based “Pensioner Portal” wasappreciated by the SCOVA members. TheSecretary (P&PW) suggested that Ministries/Departments should adhere to the timelinesin the redressal of grievances and they shouldalso sensitize the subordinate functionariesto adhere to these timelines. (16)- (i) The existing Pensioners ofDepartment of Posts and Telecomcovered by P& T Dispensaries are neitherconsidered for treatment ofhospitalization facilities nor for FixedMedical Allowance.

It was informed that the issue was taken upwith the concerned ministries and the decisionto merge 19 dispensaries in 12 cities havebeen taken in principle. The concernedministries will inform the exact timelines. Inthis regard Hon’ble MOS(PP) will take up theissue with the Health Minister. He will alsotake up the matter with the Health Ministerregarding opening of one new CGHSdispensary at Mohali/Panchkula/Chandigarh.

Ministry of Railways explained that the 2.5Km. limit is laid down by the decision of courts.The members thereafter raised specific issueof RELHS. It was decided that the Ministry ofRailways may discuss the issue with themembers.

Anomaly in fixation of pension to DoTemployees absorbed in BSNL, who retiredbetween 1.10.2000 and 31.7.2001.

6. Agenda Items for 21st SCOVA meeting (Annexure-II)

6.1 Time bound grievance redressal & realtime dissemination of information are thetwo main ingredients of this novel venturefor the welfare of pensioners

The Department of Pensioners andPensioners Welfare informed that all theMinistries have been issued instructions toredress the grievance as per the timelineprescribed by Department of AdministrativeReforms (ARPG). In cases it was not possibleto give immediate reply, an interim replyshould be given to the applicant. DOP&PWwill reiterate these instructions to all Ministries/Departments.

The Railway association pointed out thatdirect cases which goes to Ministry ofRailways should give acknowledgement onthe same lines as in respect of cases comingthrough DoP&PW. This facility is available inthe software CPENGRAMS which can bemade use by all Ministries/Departments.

6.2 Dissemination of information in real time:

All the Ministries were requested to updatethe information available in the website andprovide necessary linkage to the websites ofDepartment of Pensioners and Pensioners’Welfare. Ministry of Railway have been askedto regularly update all the instructions forinformation of Pensioners association.

Representative of the Posts & TelcomPensioner Association stated that when thecircular about enhancement of Dearnessrelief (DR) for pensioners/family pensionersis issued by Department of Pension &Pensioners’ Welfare (DoP&PW) andsubsequently pasted on the Pensioner portalWebsite, the post offices don’t takecognizance of it, until a separate circular isissued by the Department of Post on the basisof DoP&PW Dearness Relief circular. Thisdouble exercise tantamounts to delay ingetting the dearness relief by the pensioners/family pensioners through post offices. Duringthe discussions, Hon’ble MOS(PP)mentioned that, circular on enhancement ofDearness Relief (DR) issued by DoP&PWshould be applicable to all offices of theGovernment of India. In this regard Secretary(P&PW) will take up the issue withDepartment of Post and Department ofTelecommunication

6.3 Simplification of submission of LifeCertificate

The issue of submission of life certificate inany branch of Banks other than the Bank inwhich the pensioners had their accounts hasnot been found feasible. However, CPAO wasasked to look into the feasibility of submissionof life certificate in any of the branches of thesame Bank.

6.4 Simplification for payment of FamilyPension in case of illiterate Family Pension.

In view of the number of documents availableto the pensioners and also in view of the

financial/legal implications of the proposal, thesame was not agreed to. The item is closed.

6.5 Nomination facility for Family Pensionersdrawing Life Time Arrears:

The Department of Pension and PensionersWelfare agreed to further examine theproposal.

6.6 Review of DCRG-Limit.

The matter has not been agreed to by theGovernment, hence the item is treated asclosed.

6.7 Medical Insurance coverage toPensioners

The Representatives of Ministry of Health &Family Welfare informed that the proposalhas been sent to Planning Commission in12th Plan and the scheme will be started forobtaining the requisite information.

6.8 a) Grievances Committees at the AdditionalDirector (CGHS) Level at Delhi :

Advisory Committees have been constitutedat Wellness Centre level which meetsregularly to settle the issues at local levelitself. Claim day once in a month and ClaimAdalat from time to time are held in each zoneto settle outstanding reimbursement claims.Detailed instructions to streamline andexpedite disposal of Medical ReimbursementClaims have also been issued and theposition is being monitored at all levelsregularly. As a result of the initiatives takenby the Ministry in this regard, the pendencyhas been brought down drastically. MOHFWintends to further bring it down throughcomputerization and administrative actions.It was decided that a fix date and time may

b) A similar grievance committee at nationallevel may also be constituted

e) Opening of three more CGHSDispensaries, one at Mohali, second atPanchkula and “one more at Chandigarh.

Hon’ble MOS (PP) directed Ministry of Health& Family Welfare to take appropriate actionand he will take the matter with Minister ofHealth & Family Welfare also forempanelment of hospitals to be made better.

6.9 Two family pension to widows ofreemployed ex servicemen:

The representatives of the Ministry of Defenceinformed that the same has been approvedby the government. Thus, the item is treatedas closed.

6.10 Refusal to sanction Family pension todependent daughters

In view of the fact that legal heir certificateissued by court has been accepted by Ministryof Defence, the item may be dropped.

6.11 Widen scope of pension Adalat toinclude all payment cases & to allowSCOVA members/representative as wellas representative of identifiedAssociations to actively participate

It was stated that as the guidelines on PensionAdalats are very clear with clear provisionsfor participation by SCOVA members, as suchthe item may be treated as closed.

6.12, 6.13 and 6.14 : 6.12 - RELHS facilities tofamily pensioners, other than spouse, and

to the kids of Divorced & widoweddependent daughters.:

i) RELHS facilities to dependent parents ;

Sub: Provision of carrying of ID proof duringjourney on reserved tickets

Please refer to this office letter no.2011/TG-I/20/P/Tatkal dated 16.01.2012 (CommercialCircular No.4 of 2012) on the subject quotedabove wherein it was advised that with effect from15.02.2012, any passenger travelling on areserved ticket (non-Tatkal) issued through PRSfor undertaking journey in any air conditionedclass (except 3E) will have to produce any oneof the nine prescribed proofs of identity (inoriginal) during journey failing which all thepassengers will be treated as without ticket andcharged accordingly. This provision has helpedin keeping a check on the cases of travelling ontransferred ticket in AC classes to a great extent.

2. With a view to ensure availability ofreserved tickets to bona fide passengers in allclasses, it has been decided as under:

(i) One more proof of identity has been addedin the list of 9 prescribed proofs of identity forundertaking journey on e-ticket, Tatkal ticket andfor undertaking journey on a reserved ticketissued through PRS and these 10 prescribedproofs of identity are as under:

1. •Voter Photo identity card issued by ElectionCommission of India.

2. •Passport.

3. •PAN Card issued by Income TaxDepartment.

4. •Driving Licence issued by RTO.

5. •Photo identity card having serial numberissued by Central/State Government.

6. •Student identity Card with photograph issuedby recognized School/College for theirstudents.

7. •Nationalized Bank Passbook withphotographs.

8. •Credit Cards issued by Banks with laminatedphotograph.

9. •Unique identification Card “Aadhaar”

10.•Photo identity cards having serial numberissued by Public Sector Undertakings ofState/Central Government, DistrictAdministrations, Municipal bodies andPanchayat Administrations.

(ii) The above provision shall come into effectfrom 01.12.2012.

(iii) With effect from 01.12.2012, any one ofthe passengers booked on a PNR for undertakingjourney in any reserved class will have to produceany one of the 10 prescribed proofs of identity(in original) during the journey failing which allthe passengers booked on that ticket will betreated as travelling without ticket and chargedaccordingly. This provision shall, however, notaffect the existing provision of Tatkal schemewhere the passenger is required to show thesame original proof of identity as indicated onthe ticket.

3. Wide publicity may be given by ZonalRailways through all possible means on thisaccount for the information of general public.

4. Necessary instructions may be issued toall concerned particularly Ticket Checking Staffso as to educate them about the revisedprovisions.

G.S.R. - In exercise of the powers conferredby the proviso to article 309 of the Constitution,the President hereby makes the following rulesfurther to amend the Ex-servicemen (Re-employment in Central Civil Services and Posts)Rules, 1979, namely:-

1. (1) These rules may be called the Ex-

(iv) Personnel, who were on deputation inArmy Postal Service for more than six monthsprior to the 14th April, 1987; or

(v) Gallantry award winners of the Armedforces including personnel of Territorial Army; or

(vi) Ex-recruits boarded out or relieved onmedical ground and granted medical disabilitypension.

(2) for rule 3, the following rule shall besubstituted, namely:-

“3. Application - These rules shall apply to allthe Central Civil Services and Posts and theposts upto the level of Assistant Commandantin all paramilitary forces.”

(3) in rule 4,-

(a) for sub-rule(I), the following sub-rule shall besubstituted, namely:-

“(i) Reservation of vacancies: — Ten percent of the vacancies in the posts upto ofthe level of the Assistant Commandant inall para-military forces, ten per cent of thevacancies in Group ‘C’ posts; and twentyper cent of the vacancies in Group ‘D’ posts,including permanent vacancies filled initiallyon a temporary basis and temporaryvacancies which are likely to be madepermanent or are likely to continue for threemonths and more, to be filled by directrecruitment in any year shall be reservedfor being filled by ex-servicemen.”

(b) for sub-rule(2), the following sub-rule shallbe substituted, namely:-

“(2) The Scheduled Castes, the ScheduledTribes and the Other Backward Class candidatesselected against the vacancies reserved for ex-servicemen shall be adjusted against vacanciesreserved for Scheduled Castes, ScheduledTribes and Other Backward Classes,respectively:

Provided that if a the Scheduled Caste or theScheduled Tribe or the Other Backward Classex-servicemen is selected against the vacancy

servicemen (Re-employment in Central CivilServices and Posts) Amendment Rules,2012.

(2) They shall come into force from the dateof their publication in the Official Gazette.

2. In the Ex-servicemen (Re-employment inCentral Civil Services and Posts) Rules, 1979

(I) in rule 2, for clause (c), the following clauseshall be substituted, namely:-

(c) An ‘ex-serviceman’ means a person -

(i) who ‘has served in any rank whether as acombatant or noncombatant in the Regular Army,Navy and Air Force of the Indian Union, and

(a) who either has been retired or relievedor discharged from such service whether athis own request or being relieved by theemployer after earning his or her pension;or

(b) who has been relieved from such serviceon medical grounds attributable to militaryservice or circumstances beyond his controland awarded medical or other disabilitypension; or

(c) who has been released from suchservice as a result of reduction inestablishment; or

(ii) who has been released from such serviceafter completing the specific period ofengagement, otherwise than at his own request,or by way of dismissal, or discharge on accountof misconduct or inefficiency and has been givena gratuity; and includes personnel of theTerritorial Army, namely, pension holders forcontinuous embodied service or broken spellsof qualifying service; or

(iii) personnel of the Army Postal Service whoare part of Regular Army and retired from theArmy Postal Service without reversion to theirparent service with pension, or are released fromthe Army Postal service on medical groundsattributable to or aggravated by military serviceor circumstance beyond their control andawarded medical or other disability pension; or

reserved for ex-servicemen and vacancyreserved for the Scheduled Castes or theScheduled Tribes or the Other BackwardClasses, as the case may be, is not available toadjust such exserviceman, he shall be adjustedin future against the next available vacancyreserved for the Scheduled Castes or theScheduled Tribes or the Other BackwardClasses, as the case may be.”

(c) after sub-rule (3), the following provisoshall be substituted, namely:-

“Provided that in case of recruitment to thevacancy reserved for Ex-servicemen in theCentral Para Military Forces, the reservedvacancy remained unfilled due to non-availability of eligible or qualified candidates,the same shall be filled by candidates fromnon-ex-servicemen category”.

(4) for rule 5, the following rule shall besubstituted, namely:-

“(5) (a) For appointment to vacancies in GroupB(Non-Gazetted), Group C or Group D postsin Central Government, an exservicemanshall be allowed to deduct the period of actualmilitary service from his actual age and if theresultant age does not exceed the maximumage fimit prescribed for the post for which heis seeking appointment by more than threeyears, he shall be deemed to satisfy thecondition regarding age limit.

(b) For appointment to any vacancy in GroupA and Group B services -or posts filled bydirect recruitment otherwise than on theresults of an Open All India CompetitiveExamination, the upper age limit shall berelaxed by the length of military serviceincreased by three years in the case ofexservicemen and commissioned officersincluding Emergency Commissioned Officersor Short Service Commissioned Officers.

(c) For appointment to any vacancy in GroupA and Group B services or posts filled bydirect recruitment on the results of an All India

Competitive Examination, the exservicemenand Commissioned Officers includingEmergency commissioned Officers or ShortService Commissioned Officers who haverendered atleast five years military servicesand have been released -,

(i) on completion of assignment (includingthose whose assignment is due to becompleted within one year) otherwise thanby way of dismissal or discharge on accountof misconduct or inefficiency; or

(ii) on account of physical disabilityattributable to military service or oninvalidment, shall be allowed maximumrelaxation of five years in the upper agelimit. [File No.36034/(IAM-Estt(SCT)]

Sub : Clarification regarding payment of family pension to physically handicapped/mentallydisabled children

A reference has been received from one of the Zonal Railways seeking clarification on certainissues relating to grant of family pension to a son/daughter of a deceased Railway servant, sufferingfrom any disorder/disability of mind/mentally retarded or physically crippled/disabled and is renderedincapable of earning a living even after attaining the age of 25 years of age, in terms of provisionscontained in Rule 75(6) of the Railway Services (Pension) Rules, 1993. The matter has been examinedin consultation with the Department of Pension & Pensioners’ Welfare (DOP&PW), and the issuesraised are clarified as under :-

Clarification given

(a) The past cases as indicated in letter ofeven number dated 15.01.2010 will also becovered under the said instructions. Thefinancial benefits will accrue from the date thefamily pensioner becomes entitled to the familypension irrespective of whether the injury/handicap occurred/manifested and whetherthe same was certified by the competentmedical authorities before or after attaining theage of 25 years.

(b) The clarification contained in this letter andletter of even number dated 15.01.2010 willequally apply in the case of similarly placedchildren of CPF/SRPF{C) beneficiaries

Clarification regarding admissible /non-admissible items under CGHS

Sub: Clarification regarding admissible / non-admissible items under CGHS.

The undersigned is directed to refer to thedirections given by Hon’ble High Court of Delhi inthe case of Sh. Kanhiya Singh Vs UOI and others[W.P.(C)9044/2011], regarding admissibility andnon-admissibility of certain items under CGHS, thefollowing clarifications are issued:-

2. “CGHS Package Rate” means and includeslump sum cost of inpatient treatment / day care /diagnostic procedures for which a CGHS beneficiaryhas been permitted by the competent authority orfor treatment under emergency from the time ofadmission to the time of discharge including (butnot limited to ) – (i) registration charges, (ii) Admissioncharges, (iii) Accommodation charges includingpatients diet, (iv) Operation charges, (v) Injectioncharges, (vi) Dressing charges, (vii) Doctor /consultant visit charges, (viii) ICU /ICCU Charges,(ix) Monitoring charges, (x) Transfusion charges, (xi)Anesthesia charges, (xii) Operation theatre charges,(xiii) Procedural charges / surgeon’s fee, (xiv) Costof surgical disposables and all sundries used duringhospitalization, (xv) Cost of surgical disposables andall sundries used during hospitalization, (xv) Cost of

medicines, (xvi) Related routine and essentialinvestigations, (xvii) Physiotherapy charges etc. (xviii)Nursing care and charges for its services.

3. Cost of Implants / Stents / Grants isreimbursable in addition to package rates as perCGHS ceiling rates for Implants / Stents / Grafts oras per actual, in case there is no CGHS prescribedceiling rate.

4. During In-patient treatment of the CGHSbeneficiary, the hospital will not ask the beneficiaryor his / her attendant to purchase separately themedicines / sundries / equipments or accessoriesfrom outside and will provide the treatment within

the package rate, fixed by the CGHS, which includesthe cost of all the items.

5. In cases of conservative treatment, wherethere is no CGHS package rate, the abovementioned items are admissible – items wise atCGHS rates or as per AIIMS rates (if there is noCGHS rate) or as per actual (if there is no CGHS /AIIMS rate) for any item.

6. Package rates envisage up to a maximumduration of indoor treatment as follows:

•12 days for Specialized (Super Specialties)treatment:

•7 days for other Major Surgeries;

•3 days for Laparoscopic surgeries / normaldeliveries;

•1day for day care / Minor (OPD) surgeries.

7. However, if the beneficiary is required to stayin the hospital for his / her recovery for a period morethan the period covered in the prescribed packagerate, in exceptional cases, supported by relevantmedical records and certified as such by the hospital,the additional reimbursement shall be limited toaccommodation charges s per entitlement,investigations charges at approved rates, anddoctors visit charges (not more than 2 visits per dayper visit by specialists / consultants) and cost ofmedicines for additional stay). No additional chargeon account of extended period of stay shall beallowed if that extension is due to infection on theconsequences of surgical procedure or due to anyimproper proceed.

8. The above list is however not exhaustive. Somepatients may require additional facilities/ procedures,which are admissible depending upon the medicalrequirements as advised by the treating doctors/specialists, with proper justification. Therefore, it isnot possible to indicate a comprehensive list of items,which are not admissible. However, the following itemsare not admissible for the purpose of reimbursementunder CGHS:

Sub: Eligibility of children from a void orvoidable marriage for family pension -clarification regarding.

The undersigned is directed to refer to thisDepartment’s a.M. No.1/16/96-P&PW(E), dt2.12.1996 whereby it was clarified thatPensionary benefits will be granted to childrenof a deceased Government servant/pensionerfrom void or voidable marriages when their turncomes in accordance with Rule 54(8). It ismentioned in Para 4 of the a.M. that “It may benoted that they will have no claim whatsoeverto receive family pension as long as the legallywedded wife is the recipient of the same.”

2. The matter has been re-examined inconsultation with the Ministry of Law and Justice(Deptt of Legal Affairs) and Ministry of Finance(Deptt of Expenditure). It has been decided thatin supersession of Para 4 of the a.M., ibid, dt2.12.1996, the share of children from illegallywedded wife in the family pension shall bepayable to them in the manner given under sub-rule 7 (c) of Rule 54 of CCS (Pension) Rules,1972, along with the legally wedded wife.

3. It has also been decided that in past cases,no recovery from the previous beneficiaryshould be made. On receipt of an applicationfrom eligible child/children of the deceasedGovernment employee/pensioner born to an

ineligible mother, a decision regarding divisionor otherwise of family pension may be takenby the competent authority after satisfyinghimself/herself about veracity of facts andentitlement of the applicant (s).

4. As regards pensioners/family pensionersbelonging to the Indian Audit and AccountsDepartments, these Orders issue afterconsultation with the Comptroller and AuditorGeneral of India.

5. This issues with the concurrence of Departmentof Legal Affairs vide their FrS No. 3036, dated17.10.2012.

6. This issues with the ‘concurrence of Ministry ofFinance, Department of Expenditure vide theirI.D. No.530/E.V/2012, dated 23.11.2012.

The Governor is pleased to order that the

existing rate of Deamess Relief sanctioned vide

Finance Department Order of even number dt

25.03.2012 to the State Government Pensioners

who are in receipt of superannuation, retiring,

invalid, compensation, family and extra ordinary

pension etc. shall be revised from 65% to 72% with

effect from 01.07.2012.For the purpose of this order-(i) Pension/Family Pension in the case of pre-

01.09.2006 retirees and where Family Pensionwas sanctioned prior to 01.09.2006, means theConsolidated Pension or Consolidated FamilyPension, as the case may be, effective from01.09.2006 in terms of Finance DepartmentMemorandum No. F.12(3)FD(Rules)/ 2008dated 12.09.2008.

(ii) In the case of pensioners who retire from serviceon or after 01.09.2006 or where family pensionis sanctioned for the first time on or after01.09.2006, Pension/Family Pension meansthe Basic Pension/Basic Family Pension, as thecase may be, in terms of Finance DepartmentNotification No. F.12(3)FD(Rules)/ 2008 dated12.09.2008.

(iii) Deamess Relief will also be admissible on theadditional quantum of pension / family pensionallowed to the pensioners who have attainedthe age of 80 years and above.

(iv) Payment of Dearness Relief involving a fractionof a rupee shall be rounded off to the next higherrupee.

(v) Other provisions governing grant of dearness

relief to pensioners’ such as regulation ofdearness relief during employment/re-employment, regulation of dearness relief

where more than one pension is drawn etc.,

will remain unchanged.(vi) This order shall also be applicable in case of

Pensioners/Family Pensioners who are in

receipt of provisional pension.

(Cont from p.1) no other effective channel ormechanism for the redressal of their grievance.They are victims of rampant corruption in theGovt. departments dealing with their affairs i.e.Personnel, Finance & Health departments aswell as the Banks.

a) This conference urges the Govt. to includeretired Persons in the definit ion of‘Complainant’ in the said Bill.

b) It also requests that dissemination of uptodate information to Sr. Citizens & retiredpersons through websites of respectiveGovt. Departments & time bound redressalof their grievances should be part of citizensCharter under the said Bill.

3. WITHDRAW NEW PENSION SCHEME :As (i) Pension of Govt. employees is adeferred wage. Since wage paid out to themduring the course of work tenure is kept lowby design, to cater for pension. (ii) Pensionis a social security measure & cannot besubjected in any way to market risks (iii) Itdoes not guarantee minimum return & thuslacks the basic fiber of Social Security (iv) Itis in no way better than the existing Scheme(vi) It does not provide guaranteed FamilyPension to dependents & disabled siblingswhich exist in present scheme .

This conference therefore urges the Govt.to scrap New Pension Scheme w/o furtherdelay.

4 PENSION TO BE NET OF INCOME TAX:Purchase value of pension gets reduced dayby day due to constant inflationary spiral andhigh rise in food items and cost of medicalfacilities. Retired persons /Sr. citizens do notenjoy fully public goods and servicesprovided by Government for citizens due toimmobility and many other factors. Theirability to pay tax gets reduced from year toyear after retirement due to ever increasingexpenditure on food & medicines. Their networth at year end gets reduced considerablyas compared to the beginning of the year.

Inflation, for a pensioner, is much more thanany tax. It erodes the major part of alreadyinadequate pension. To enable pensionersat the fag end of their lives, to live honorably& to cater for ever rising cost of living, theyhave to be spared from paying Income Tax.Pension therefore, should be net of incometax as was recommended by 5th CPC VIDETHEIR PARA 167.11.

5. EARLY SETTING UP OF SEVENTH PAYCOMMISSION:- The Govt. has concededwage revision in PSUs after every 5 years –the same criteria should be applied in thecase of Central Government’ own past andpresent employees. Seventh PayCommission should, therefore, be set upforthwith for revision of wages and Pensionswef 1st January, 2011.

6. PENSION (FIXATION, REVISION &DISBURSEMENT): This conference wishesto draw Governments’ particular attention toH’ble Supreme Court Constitution Benchhistoric judgment delivered in case of D.S.Nakra and others on 17.12.1982 and requestthat it be implemented in letter & spirit.Pensioners should not be divided on thebasis of their date of retirement and uniformformula should be adopted for revision ofpension. All the pensioners irrespective ofClass, Category or status while in service,i.e., if a multiplication factor of 3 is given toone section of pre 2006 pensioners forrevision of pension, then by sheer logic, itshould uniformly be adopted as commonfactor for all the pre 2006 pensioners. Thisconference therefore, urges that either all pre2006 Pensioners be given a multiplicationfactor of 3 at par with HAG + level or theirpension be consolidated as per the followingformula.

Basic Pension as on 31/12/2005+86%DR+50% Grade pay as per 6th CPC. Furtherthe pre 1996 pensioners be given full parity

as per V CPC recommendation in para137.14 of their report.

7. MERGER OF DR WITH PENSIONWHENEVER IT GOES ABOVE 50%:-

The Pension of Central Govt. Pensionersundergoes revision only once in 10 to 13years during which period the pensionstructure gets seriously disaligned. 50%increase in prices take place in less than 5years and this results in considerabledamage to the financial position of thepensioner with his otherwise inadequatePension. The working employees are gettingautomatic relief by way of 25% increase intheir allowances with every 50% rise inDearness allowance. Also their annualincrement, which is now as percentage ofbasic pay, takes care of part of inflationaryeffect. As pensioners do not get anyallowances or increments, they feeldiscriminated against. In order to strike abalance, DR should be merged with pensionwhenever it goes beyond 50% or pensionbe revised every 5 years.

8. RESTORATION OF COMMUTEDPORTION OF PENSION AFTER 12YEARS:- Taking into consideration: (i)Increase in % of recovery due to increasedaverage survival age of 68 years &comparative reduction in interest rates. (ii)Pensioners repay the commuted amount inmonthly installments by way of not drawingthe commuted portion of pension, thus thebalance goes on reducing month by month.The commuted amount along with interestelement stands fully adjusted in less than12 years. That is why States are restoringcommuted portion of pension of theirpensioners after 12 years. Thus there is noreason why the Central Govt. should alsonot restore it after 12 years. This conventionurges the Central government to immediatelyissue orders for restoration of commutedportion of pension after 12 years as was

recommended by 5th CPC more than 15years back.

9. INCREASE FMA (FIXED MEDICALALLOWANCE) TO RS 1200 PM: Themeager amount of Fixed Medical allowance(FMA) of Rs 300 P.M. in lieu of, day to dayOPD facility was sanctioned wef 01.09.2008on the basis of cost of OPD treatment percard holder under CGHS during the year2003-2004, which has increased more than6 times since then.

As per the figure disclosed by M/O Health &Family Welfare under RTI Act 2005. Averagecost of OPD treatment per cardholder underCGHS during the year 2007-2008 went upto Rs 1369/-PM. This has further gone upconsiderably since then. M/O Labour &Employment, is already paying Rs 1200/- asFMA to its beneficiaries. It is therefore, urgedthat to help elderly Pensioners to look aftertheir health, FMA for all C.G. Pensioners beraised to at least Rs 1200/- PM linking it toDearness Relief for automatic furtherincrease. Ministry of Health and FamilyWelfare have no objection in raising FMAfrom Rs 300/- to Rs 1200 P.M. as intimatedvide their letter No. MOH &FW F.No20020/45/2012-CGHS (P) dtd. 22.02.2012.

Adequate raise in FMA will encourage agood number of Pensioners to opt out ofOPD facility, which will reduce overcrowdingin hospitals.

OPD through Insurance is likely to cost muchmore to the Govt. As such the demand forraising Fixed Medical allowance toPensioners is fully justified & viable. Thisconference therefore requests Minister ofFinance to grant his approval. Further thedistance restrictions imposed for sanction ofthis allowance are irrational and unjustifiedin the given facts and circumstances andtherefore they be done away with to ensureequal treatment in the matter to all centralgovernment pensioners and family

pensioners. It is also not correct to denyFMA to pre 1986 CPF/SRPF© beneficiariesand their families after being sanctioned ex-gratia since they are allowed to join any ofthe existing health schemes.

10 ADDITIONAL OLD AGE PENSION:

Elderly persons beyond normal l i feexpectancy of 67 years are subjected tosevere natural vagaries of age, to cater toits direct and indirect effects normalminimum living expenditure increasesconsiderably. Therefore, additional quantumof pension need to start from 65 years ofage onwards with 5% increase every fiveyears upto 8O years & 10% thereafterincrease to cater to the special needs ofadvancing years of age.

11.RESTORE PENSION OF PRE-1996PENSIONERS W.E.F. 1.1.2006 :- RailwayPensioners who retired prior to 1.1.1996,from specified categories of posts such asHead Clerk, JE Gr. II, Chargeman B, PWI,DSK, AYM, PI, ECRC, ASM, HTC, TI, MCMetc. etc. from scale Rs. 1400-2300 are badlyaffected due to denial of min. pension Rs.6750/- w.e.f. 1.1.2006, though over pastover 14 years they had been drawingpension as per their fixation in 5th CPC Scaleof Rs. 5000-8000. Their pension is nowbeing refixed retrospectively by placing themin scale Rs. 4500-7000 / PB1+2800 GP,instead of Rs. 5000-8000 / PB2+4200G.P,This problem exists only in Railways. Thisconference urges on the government forearly and expeditious steps in the aboveregard.

12.EXTENTION OF BENEFIT OF ENHANCEDFAMILY PENSION FOR 10 YEARS: Thisconvention urges the Government of Indiato extend the benefit of enhanced familypension for a period of 10 years in cases ofdeath of Pensioner after retirement also.

13.a) WITHDRAWAL of APPEALS AGAINSTJUDGMENTS ON PENSIONERS CASES:

This conference urges the govt. that at leastwhile dealing with retired Persons/SrCitizens, it should change its attitude aslitigant. Instead of appealing against each &every judgment favoring Pensioners/SrCitizens, Govt. should sportingly implementCourt’s orders. Accordingly Government isrequested to withdraw all pending appealsin such cases.

b) WITHDRAWAL of APPEAL AGAINSTJUDGMENTS OF PRINCIPAL CAT NEWDELHI IN OA 655-2010: This conferenceespecially appeals to the Government towithdraw its above Appeal against the FullBench judgment of CAT New Delhi deliveredon 01.11. 2011

14.GRIEVANCE REDRESSAL:

Pensioners do not have representation evenin Forums & Committees wherein pensionpolicies & connected matters are discussed.The forum of Pension Adalat too is not ofmuch avail as it meets only once a year,which is too long a period for an elderlynearer to his end. Moreover, these Adalatsdeal with settlement claims only. SCOVA toomeets only once a year and the scope ofSCOVA is l imited to feedback onGovernment policies. DOP (P&PW) is atooth less authority which lacks directService Delivery Capability. Though, it hasbeen striving over the years for redressal ofPensioners’ grievance through ‘Sevottam’model of the Department of AdministrativeReforms & Public grievances which in theabsence of strict timeline with punitive clauseis proving to be a failure. Grievances areeither not resolved for years or closedarbitrarily without resolving.

This conference therefore, appeals that forresolving Pensioners complaints (i) A stricttime line with punitive clause be introducedin “Sevottam model” (ii) Grievances are notallowed to be closed without resolving.

PROCEEDINGS: AGM -2012

The House assembled on 12.10.12 at 10:00hours. The Chief Guest for this 57th Annual

Conference was Mrs. Mala Kapur Shankardas,

the renowned Sociologist. She was received

with warmth and affection by the President, Sr

Vice President, Secy Gl and Secy (Railways)

of BPS. After a brief welcome remarks by thePresident, the proceedings started with

collective singing of the National Anthem. R N

Tripathi, Sr VP anchored the proceedings of the

meeting.

Shri K C Pipal, President thanked the Chief

Guest for her acceptance of the invitation from

the BPS and also sparing her valuable time to

be with the delegates from across the country.

He also thanked Sh. Shiv Gopal Mishra (Genl.

Secy.) of All India Railwaymen’s Federation(who could not attend this meeting on account

of his other pre-ocupations) and each member/

office bearer of the Management Committee,

BPS. (Text of his welcome speech has already

Nov.’12 issue).

Thereafter, the President requested the

Chief Guest to honour the Members of Platinum

Age Brotherhood and 27 Members were invited

to attend the function those who graced theoccasion were honoured with garlands and

presented with citations and shawls. One of the

members of Platinum Age Brotherhood thanked

the BPS for this honour. A Group Photograph

of this Brotherhood was also taken.

The Chief Guest Dr. Mala Kapur Shankardas

in her address thanked the BPS for warm

reception accorded to her. She expressed her

happiness to join this conference. She said that

she felt honoured to be invited to this large All

India gathering. She spoke in detail on the elderabuse problems(A complete text of her speech

has already been published at pp 7-9 of

BHARAT PENSIONER – Nov’12.)

This was followed by ‘BPS PMES AWARDS-

2012’ to the outstanding affiliates. The President

and the Chief Guest presented trophies/ cash

prizes. (Details have already been published at

p 9 of BHARAT PENSIONER - Nov.’12.)

First session before Tea-Break came to an

end after Sr VP conveyed ‘Vote of Thanks’ to

the Chief Guest, distinguished members on the

dais, members of Platinum Age Brotherhood

and all members of the BPS. When membersassembled after Tea-break, R N Tripathi moved

a resolution paying rich tributes to members who

left for their heavenly abode since the last AGM.

The House stood in silence for 2 minutes as a

mark of respect to them.

Thereafter, Secretary General’s Report was

taken up for discussion. In the absence of any

formal report of Secy Genl, Shri Shyam Sunder

recalled that most of our activities are being

covered regularly in our monthly magazine –

‘Bharat Pensioner’. He mentioned that BHARATPENSIONER was published regurlarly and

punctually throughout the year. He mentioned

that a Dharna by pensioners led by BCPC

alongwith the serving employees was held at

Jantar Mantar, New Delhi on 25.11.11 in whichBPS participated and lent its full support. He

also spoke about All India Railway Pensioners

3rd National Convention held by BPS at New

Jalpaiguri (West Bengal) on 27.03.12. He told

members that another Special Supplement

(March 2012) on Govt. orders etc. was printed

by BPS and distributed to members at nominal

cost. He also expressed his happiness that the

Dharna held at Jantar Mantar the ti this AGM

day (11.10.2012) was a grand success and that

there was a record participation of more than

300 members from across the country. Hemade an announcement that 4 th Railway

Pensioners Convention would be held at Nagpur

on 09.02.13 which our V.P. Western Zone, J

Narayana Rao, has already taken up in right

earnest and necessary action/steps to make it

clarifications, the House approved the report of

the Secy Genl by Voice Vote.

The Secretary General and other officerbearers regretted their inability to present

Audited Accounts for 2011-12 due to

circumstances beyond their control particularly

the pre-ponement of holding this AGM in

October itself instead of November. The House

was informed that the accounts would befinalized soon. It was, however, decided to

engage the services of the same auditor (Garg

Bros & Associates) for the current financial year

2012-13.

In his extempore and enlightening speech,

Sh. S.S. Ramachandran – Chairman, BCPC

and Secy General, AICCPA made a scathing

attack on the Government for the passive and

hostile attitude in solving our genuine problems.

He did not spare serving bureaucrats for theirever bending nature (for which they got 207.5%

increase in their basic pension from Rs. 13,000/

- to Rs. 40,000/- as against hardly 100%

increase in basic pension by Pensioners’ of

Group ‘D’ to Group ‘A’ – Dy. Secy. Level

officers). He gave a clarion call to pensionersto remain united and continue to fight for our

genuine demands.

After lunch, the session started with self

introduction of Affiliated Associations. This time,there was unusually a very large gathering

particularly because there were more delegates

from far and wide (more from North East and

Andhra Pradesh) who had come to attend

Dharna on the previous day. Com. Harbajan

Singh Sidhu, Secy. Genl. of All India HindMazdoor Sabha gave another extempore

illuminating speech which was spell bound

though occasionally punctuated by huge

applauses from the audience. He said he was

very much impressed with the gathering. He

promised that he was duty bound to extend anyhelp to the BPS. He exhorted that pensioners

should stand united and speak with one voice.

In the open house discussion, 36 resolutions

were passed out of which 14 have been

published in this Issue itself (Title Page). The

remaining 22 would be published next month.

In addition, the Secy. General moved aresolution regarding the need to change the

name of Y.C. Rai, Editor (for the purpose of the

Act). He proposed the name of D. Jayaraman

as Editor for this purpose also and it was

unanimously approved.

Thereafter, Secy. Gl. started the election

proceedings to the Management Committee. He

read out the agreed panel of Office Bearers/

MC members finalized after careful

consideration and discussions. Office Bearers

and MC members as per this agreed panel weredeclared elected unanimously by the House

through raising of hands and thunderous

members has already been published at p4 of

Nov.-12 Issue). He men

expressed by participants/accredited delegates

of affiliated associations. The main speakers

were S/Shri M Somasekhar Rao, VP (South

Zone), R N Dutta, VP (East Zone), M ChandraMowli, Hyderabad, S K Kanjilal from North East

and other delegates/Office Bearers from North

East. Sh. Kanjilal thanked Sh. R. N. Tripathi,

Sr. V.P. and Sh. M.M. Kapur, former editor BPS

and now MC member, for having arranged their

nice and comfortable stay etc at Delhi (whenthey came here for Dharna and this AGM).

The newly elected Secy General S.C.

Maheshwari explained the need and necessity

to carry out Amendments to Rules andRegulations of BPS. He read out the existing

provisions and proposed amendments thereto.

These amendments were unanimously

approved by the House. (Amendments have

already been published at p12 of Nov.-12).

The A.G.M. ended with vote of thanks to the

chair proposed by R N Tripathi, Sr. V.P.

3.Elder abuse :-

(1) Abuse by Govt. & semi Govt. agenciescan be easily handled by strict enforcement ofCitizens’ Charter & strong Grievance redressalmechanism with strict time line, punitive clause& monitoring at different levels.

2.Abuse in the family : Here again laws & Actsalone can not help. A lot is to be done by theelderly themselves. They may be able to leadhappier life if they :

(i)Remember : You have lived your life theway you wanted. Now let others live as they want.

(ii)Do not interfere or render advise unlessasked for.

 (iii)Never loose control over your assetsduring your lifetime. Do not yield to emotions.

 (iv)Remember ‘Anekant’ i.e. there can be

several ways to do a work. Each one has his/herown way to do it .Do not try to impose your wayof working on others.

(v)As far as may be, do not loose yourusefulness in the family, volunteer yourself forthe jobs you can easily do.

(vi)You own a treasure of wisdom, knowledge &experience. You have no right to keep it to yourself.Share with the society as much as you can

(vii) Be an asset instead of being a liability.

So my elderly brothers & sisters, try to be partof the solution, instead of always being aProblem.

This Writ Petition is filed under Articles 226and 227 of the Constitution of India praying toissue a writ of certiorari setting aside the orderpassed in Original Application No. 131/2010dated 13.4.2011 passed by the CentralAdministrative Tribunal, Bangalore Bench,Bangalore vide Annexure - B.

This Writ Petition coming on for PreliminaryHearing this day, Kumar, J., made the following:

ORDER

The Union of India has preferred this writpetition againt the order passed by the CentralAdministrative Tribunal, Bangalore Bench,Bangalore on 13th April, 2011.

The grievance of petitioner is that though theimpugned order passed by CentralAdministrative Tribunal is in accordance with law,it has not taken into consideration the variousfactors in particular the contributions collectedfrom the employees who are serving in thosecities as well in other places which has directbearing on post retiremental benefits beingextended to them.

That is not what was contended before theTribunal. On the contrary, the order which isimpugned in this writ petition is passed on aconcession made by the respondents as is clearfrom para 4 which is extracted as under:

“4 The learned Counsel for respondents

graciously agreed that in view of the citation

quoted by the learned Counsel for applicant and

from the legal position as it obtains from the

above quoted citation, the claim in OA cannot

be disputed, The learned Counsel for

Respondent-4 i.e., KVS also maintains the same

stand.”

Therefore the Tribunal has proceeded to passthe order as per para-5 which is as under;

5. In view of this, the OA is allowed. No orders

as to costs. The Respqndents-2&3 are directed

that the necessary health facilities should be

extended to the applicant and to issue necessary

instructions which is effect will extend the benefit

of CGHS to the applicant as prayed for in

represnetation dated 18.2.2005. The

respondents-2&3 will also issue a suitable

general clarification confirming availability of

CGHS facilities to retired employees of KVS in

Bangalore.”

4. The Tribunal cannot be found fault with, ifthe said concession made is unauthorised or if itis on account of a bonafide mistake or if it iscontrary to the law, the appropriate course is toapproach the very same Tribunal seeking forreview of the impugned order, dated 13.4.2011,if the counsel who made the concession iswithout the authority, to proceed against him. Asthe said order is passed on the concession madeby the learned Counsel appearing for therespondents before the Tribunals, one cannotfind fault with the Tribunal. Therefore no casefor entertaining this writ petition before this Courtis made out.

Accordingly, the writ petition is dismissed.

Vijayawada (A.P.): Central & StatePensioners’ Organization: AGM was held on06.10.12. The President briefed members aboutthe concessional telephone facility to PostalPensioners who had put in not less than 20 yearsof Service. Gen. Secy. briefed members onvarious issues viz unsatisfactory services at thelocal P&T dispensary, take over of all P&Tdispensaries by CGHS, increase in pension at theinterval of 5 years beginning with 65 years of age,delay in issue revised PPO’s, increase in FMA,Grant of Funeral expenses to the wards at thetime of death of the pensioner/family pensioner,travel concessions to the pensioners etc.

Vijayawada (A.P.): Welfare Association of theTelecom and BSNL Pensioners: AGM was heldon 18.11.12. It was attended by 450 members. GNatarajan, Gen. Sarma, MCMember, BPS visited Dindigul (TN) on 5.11.2012.He was Chief Guest at the meeting of railwaypensioners called there by Railway Pensioners’Welfare Association, Dindigul. He handed over tothe President of the Association the Award givento the Association by Bharat Pensioners’ Samaj inits 57th Annual Conference held at New Delhi on12.10.2012 for outstanding performance topensioners and family pensioners. He honouredon behalf of BPS, D. Krishna Murthy, Genl Secy,NFRP (South) for rendering dedicated services torailway and other central govt pensioners of thearea. RULES AND REGULATIONS OF

BHARAT PENSIONERS SAMAJ

(ALL INDIA FEDERATION OF PENSIONERS’ ASSOCIATIONS)

(As amended upto 12.10.2012)

1. Preamble: The Bharat Pensioners Samaj,which is an All-India. Federation of Pensioners’Associations will represent all categories, groupsand classes of Pensioners, who draw Pensionarybenefits from the Central or State Governments,or Public Sector Undertakings, Corporations orlocal bodies and their dependents with a view topromoting general welfare of pensioners andageing persons and to help them in all possibleways. Active members of the Samaj will beencouraged to utilize their time and experiencein social work, to raise the status and strength ofthe people and to improve the image of India bybringing about a change in their attitudes andthinking.

2. The Samaj shall be a non-political, non-commercial, secular and social welfareorganisation, free from party, group, provincialor linguistic affiliation. Its Registered office shallbe at Delhi/New Delhi.

3. Definitions :

(a) ‘Samaj’ means the BHARATPENSIONERS’ SAMAJ.

(b) ‘President’-means the President of theBHARAT PENSIONERS’ SAMAJ.

(c) ‘Member’ means and includes Patron. LifeMember, Ordinary Member and Members ofNational Council of Pensioners.

(d) A ‘Year’ shall be deemed to commenceon 1st April and end on 31st March next year.

(e) ‘Affiliated Association’ means and includesa State Association (or a District Associationwhere a State Association does not exist) andany Departmental Association of Pensionersaffiliated with and admitted to the privileges ofthe Samaj).

(f) A Pensioner means a person who retiredfrom Civil, Railways, Posts & Telegraph, orDefence Services of the Government of India or

any State Government or Union TerritoryAdministration in India or from the Governmentof undivided India or Burma, Pakistan, or fromthe service of any Local Body, Council, or PublicSector Undertaking.

4. Aims and Objects

(a) To promote the general welfare ofPensioners and elderly persons.

(b) To promote such measures as may beconducive to material benefits of members of theSamaj.

(c) To accept donations, grants-in-aid, loansfrom members of the general public and otherorganisations including Government and Semi-Government bodies and local authorities with aview to promote interests of the Samajparticularly in :-

(i) Providing medical and Social welfarefacilities for Pensioners and their dependents,

(ii) Arranging educational facilities fordependant wards of Pensioners.

(iii) Establishing homes, hostels, healthresorts with or without facilities for board andlodging for recreation of Pensioners on a no-profitno loss basis and

(iv) To acquire, by purchase on lease or free- hold basis, any land/built-up premises for officeetc, of Bharat Pensioners’ Samaj.

(v) Helping pensioners and their dependents

in distress.

(d) To take such steps as may be necessaryto help Pensioners in the redress of theirlegitimate grievances and complaints.

(e) To establish Information Centres to guide,help and assist pensioners in matters relating totheir rehabilitation on retirement, providingcounsel and other information of interest to them.

(f) To carry out survey, collect statistics andmaterial on living conditions of Pensioners andtheir dependents and disabilities from which theysuffer and plan projects for promoting theirwelfare.

(g) To publish books, periodicals, newspapersand useful literature of Interest to Pensioners andelderly persons.

(h) To affiliate itself with InternationalAssociations with similar aims and objects.

(i) To encourage members to utilize their timeand experience in social and welfare work.

(j) To take such steps as may be necessaryto carry out the above objects in co-operationwith other Associations and social welfareorganizations with similar objects in views.

(k) To establish branches of the Samaj Invarious States and Districts and associate itselfwith other Associations working with similar aimsand objects.

5. Membership :

Every Pensioner irrespective of community,caste, creed or religion is eligible to become amember of the Samaj on payment of such feeand on such conditions as may be laid down bythe Managing Committee of the Samaj with amajority of two-third members present in themeeting.

Membership Fee :

(a) Life Members - A Pensioner who paysRs. 1000- will become a Life Member. [He willbe entitled to receive all Publications of BPSincluding ‘BHARAT PENSIONER’ Journal freeof cost.

(b) Any person may become a subscriber to‘BHARAT PENSIONER’ & Member of BPS onpayment of Rs 250-* per annum. He will receiveall publications of BPS including ‘BHARATPENSIONER’ free of cost for one year only.

Note : The rates of subscription for LifeMembers, Annual, Biennial & Triennial Membersand for Affiliated Associations, including cost ofsingle copy of ‘BHARAT PENSIONER’, may befixed by Managing Committee from time totime”. Effective from 01.04.2013.

6. Patrons :

Patrons - Any person who is in sympathy with

the aims and objects of the Samaj and donatesa sum of Rs. 5000/- or more may become aPatron of the Samaj, The Managing Committeeof the Samaj may also nominate any person asPatron for reasons of distinguished services tothe country or to the Samaj.

7. Affiliation Fee :

An Affiliated body of Pensioners shall pay toBharat Pensioners’ Samaj an annual fee Rs, 500-and receive all publications of BPS including‘BHARATPENSIONER’ for one year.

7-A : The Managing Committee may, forreasons to be recorded, revise the above rates,as and when necessary, and notify the same onemonth before the new rates are Implemented.

8. Cessation of Membership : Membershipof Bharat Pensioners’ Samaj shall cease onmember’s:

(i) Death

(ii) Resignation when accepted by ManagingCommittee,

(iii) Expulsion by Managing Committee forreasons to be recorded,

(iv) Conviction in a Court of Law on groundsinvolving moral turpitude, and

(v) Failure to pay the dues of the Samaj within6 months after the end of the period to which thesubscription relates.

9. General Body :

(i) Patrons, Life Members and OtherMembers.

(ii) Two representatives from each of theAffiliated Associations.

10. Function of the General body:

The General Body shall have supremeauthority over the affairs of Bharat PensionersSamaj.

Its functions shall be as follows:-

I. To consider the Annual Report on theworking of the Samaj.

II. To pass such resolutions as are considerednecessary in the Interest of the Samaj and to laydown general policy for the guidance of theManaging Committee In matters pertaining to co-ordination work at various levels and establishclose relationship between the AffiliatedAssociations and to Issue guidelines and suchdirections and or instructions to AffiliatedNational/ State / District level bodies to enablethem to carry on work on a uniform basis toachieve the aims and objects of the Samaj.

III. To appoint Standing and Ad-hocCommittees for specific purposes and an Auditor,who must be a Chartered Accountant.

IV. To consider and to pass budget for thefollowing year.

V. In case of contest for election to any officeor for membership of the Managing Committeeand to pass any Resolution the procedure forvoting shall be by show of hand.

VI. To amend the Constitution.

11. Procedure for holding Meetings of theGeneral Body.

(i) A meeting of General Body shall be heldonce a year and shall be presided over by thePresident and in his absence by the Vice-President from Delhi; and in the absence of bothby a person elected to take the Chair. In the eventof an equality of votes the Chairman shall havea second or a casting vote. The quorum for sucha meeting shall be fifty.

Every Pensioner who has enrolled himself/herself as a member of Bharat Pensioners’Samaj or is an authorized representative of anAffiliated Association and has paid thesubscription by 30th September preceding thedate of the AGM in which elections are to beheld, is entitled to vote and stand for election asa member of the Managing Committee.

(ii) However, to be an office bearer, he/sheshould be a Life Member of the Samaj and shouldhave paid the subscription by 30th September

preceding the date of the Annual GeneralMeeting in which elections are to be held.

(iii) The agenda proposed for the GeneralBody Meeting shall be published one monthbefore the date of the meeting in the ‘BHARATPENSIONER’ notifying the date, time and placeof the meeting. Copies of the notice containingthe agenda shall be sent to all members 14 daysin advance of the meeting,

(iv) An extraordinary Meeting of the GeneralBody may be called by the President or by theSecretary General at the request of fiftymembers, after giving 30 days notice andspecifying the agenda for the meeting.

(v) If within an hour from the time appointedfor the meeting of the General Body quorum isnot complete, the meeting shall stand adjournedfor half an hour and proceed with the agendathereafter,

(vi) Decision at a meeting of the General Bodyshall be taken by a majority of votes of memberspresent,

(vii) Amendments to the Constitution of theSamaj shall be made by the General Body with3/5th majority of the members present and voting(See Rule - 14)

(viii) A record of the proceedings shall be keptby the Secretary General and be signed by thePresident (or the Chairman). Important decisionsshall be published In the ‘BHARAT PENSIONER’for general Information of members of the Samaj.

(ix) Progress on action taken on therecommendations or resolutions passed by theGeneral Body shall be reported in the‘BHARATPENSIONER* by the SecretaryGeneral.

12. Managing Committee :

(a) Managing Committee shall consist of thefollowing who must be primary members of BPS:

(i) President ........ ONE

(ii) Working President ….. ONE

(iii) Vice-Presidents (cum-zonal organizers),....... SIX

(1) One from Delhi and five others elected ornominated at State level bodies by rotation fromeach Northern, North-Eastern, Southern, Easternand Western Zones. They will also act as ZonalOrganizers in their respective zones. TheseZones will comprise:

(2) Northern Zone: States of Delhi, Haryana,Himachal Pradesh, Jammu & Kashmir, Punjab,Uttar Pradesh, Uttranchal and Chandigarh.

(3) North - Eastern Zone: States of ArunchalPradesh, Assam, Mizoram, Meghalaya,Nagaland, Manipur and Tripura;

(4) Eastern Zone : States of Bihar, Jharkhand,Orissa, Sikkim, West Bengal and Andaman andNicobar Islands,

(5) Southern Zone: States of Andhra Pradesh,Karnataka, Kerala, Tamilnadu. Lakshadweepand Pondicherry.

(6) Western Zone : States of Goa, Gujarat,Madhya Pradesh, Chattisgarh, Maharashtra andRajasthan.

(iv) Secretary General .......... One

(v) Joint Secretary General .......... One

(vi) Assistant Secretary General......... One

(vii) Secretaries .......... Five

[one each for {Civilian/ Posts & Telegraphs},Rly, Defence, {BSNL/PSU} and PR]

(viii) Treasurer .......... One

(ix) Editor .......... One

(x) Members .......... Sixteen

(xi) Immediate past President and immediatepast Secretary General shall continue asMembers of Managing Committee for the nextterm.

a. All office Bearers shall normally hold officefor two years. They shall, however be eligible forre-election but shall not be eligible for election inthe same office after 4 years (I.e. two terms of 2years each. If for any reason elections are

delayed, old office bearers shall continue tofunction till fresh elections are held. This subruleof two terms shall, however, be applicable onlyin case of President, Working President,Secretary General & Treasurer.

12a(i) Out of the two posts i.e. President &Working President incumbent of one post willbe from outside NCR

b. With the approval of the President, theManaging Committee may co-opt such persons,not exceeding four, as are considered useful forits work for any general or specific purpose.

c. Meetings of the Managing Committee shallbe called by the Secretary General for transactionof the affairs of the Samaj as often as necessaryand on such date, time and place as thePresident may direct, provided that ordinarily anotice of ten days for such a meeting shall begiven to members of the Committee.

d. Quorum for meetings of the ManagingCommittee shall be seven of whom 3 will be nonoffice bearers. If a member of the ManagingCommittee fails to attend three (3) consecutivemeetings without prior notice or reasonablecause to the satisfaction of the ManagingCommittee, this name may be removed from thelist of Managing Committee Members.

e. The Managing Committee shall

(i) Be responsible for implementation ofdecisions and policies of the General Body,

(ii) Review from time to time the financialposition of the Samaj and suggest to the GeneralBody improvements which may be considereddesirable.

(iii) Arrange for deputations of the Samaj orof State Organisations to Central or StateGovernment wherever such a course Isconsidered desirable.

(iv) Organise social welfare and personalservices for pensioners and elderly persons inco-operation with official agencies and other non-official Institutions.

(v) Maintain and operate Pensioners’Benevolent Fund for relief of Pensioners and theirfamilies in distress.

(vi) Initiate measures for aid, help andguidance to pensioners in matters relating topension and redress of their other complaintsand grievances.

(vii) Have full powers to incur expenditureagainst the budget allotments made by theGeneral Body and make rules for its properfunctioning.

f. Study all aspects of the possibleadvancement of Aims and Objects of the Samajand all matters referred to the Samaj by AffiliatedAssociations or Individuals and submit to theGeneral Body such measures as it considersnecessary. It will co-ordinate the work of AffiliatedAssociations, deal with State and CentralGovernment and other matters relating to theinterest of members, lay down policy and line ofaction on general or specific issues.

g. The Managing Committee may fill anyvacancies which may occur during the term ofits existence.

12-A (i) May approve purchase/acquisitionof land/built up premises etc. of BharatPensioners’ Samaj in terms of rule 4 (c) (iv).

(ii) May authorize President/SecretaryGeneral to execute and sign all documents etc.on behalf of Bharat Pensioners’ Samaj for the

purposes of Rule (4) (c) (iv) and rule 12-A (i) ofthese rules.

13. Office Bearers-

(a) President: The President shall preside atmeetings of the Genera! Body and of theManaging Committee. In the absence of thePresident, Working President, the Sr. Vice-President shall preside. In the absence of allthree, any other member elected as Chairmanshall preside.

Note: The Working president shall functionas President in his absence.

He shall lead delegations, deputations to a

Central or State Government as and whennecessary.

He shall exercise directional authority overall office bearers and appellate authority over allemployees of the Samaj.

He may, in consultation with Senior VicePresident/Secretary General, fix suitableremuneration for any person (s) engaged for theactivities of Bharat Pensioners Samaj.

(b) VIce-President-cum-Zonal Organisers :

The Vice-President from Delhi shall be theSenior Vice-President and shall exercise fullpowers of the President in the absence of thelatter or that of the Working President.

Vice-President-cum-Zonal Organisers fromoutside Delhi shall act on behalf on the Presidentin their respective zones and be responsible forlooking after Pensioners’ Associations in thoseareas.

(c) Secretary General:

The Secretary General shall be the PrincipalExecutive Authority for the working of the Samajunder the general direction and guidance of thePresident and shall be the administrativeauthority over all employees of the Samaj, Heshall -

a. Implement all decisions of the GeneralBody and of the Managing Committee,

b. Carry on all correspondence with theCentral and State Governments and withAffiliated Associations and individuals In thename of the Samaj.

c. Hold an Imprest of Rs. 6000/- and renderits account to the Treasurer.

d. Prepare and present annual report on theactivities and achievements etc. of BPS,

e. Mobilize resources of the Samaj with theassistance of other members of the ManagingCommittee.

f. Printing and publishing of ‘BHARATPENSIONER’ with the assistance of his staff,

g. Bharat Pensioners Samaj shall sue or be

sued in the name of the Secretary General.

(d) Secretaries :

All the five Secretaries will examine anddispose of the problems of Pensioners of therelated wings, in accordance with the Rules ofBharat Pensioners Samaj, direct; except in policymatters which will require prior consultation/consent of the President and/or SecretaryGeneral

(e) Joint Secretary General :

The Joint Secretary General shall assist theSecretary General and perform such duties asmay be assigned to him by the Prosident or theSecretary General: His chief assignment shallbe to Issue notice of meetings, record minutesof meetings of the Managing Committee and ofGeneral Body and coordination of work asbetween the Samaj and the various Standing andAd-hoc Committees and State, District andDepartmental Associations.

(f) Assistant Secretary General : TheAssistant Secretary General shall assist theSecretary General and the Joint SecretaryGeneral particularly :

(i) In maintenance of upto-date register ofMembers and Affiliated ‘Associations and toorganize campaign for their enrolment

(ii) To deal with correspondence with Statesand Districts, and

(iii) In publishing list of members periodicallyas may be decided by the Managing Committee.

(g) Treasurer:

(i) Treasurer shall operate the bank accountjointly with either the President or SecretaryGeneral, He shall supervise accounts maintainedby the Accountant.

(ii) Certify the correctness of monthlyaccounts of all receipts and expenditure preparedby the Accountant and the balance In hand.

(iii) Arrange to have accounts audited by theAuditor and place these before the ManagingCommittee for approval.

(i) Secretary Public Relations :

Secretary Public Relations shall assist theManaging Committee and also the AffiliatedAssociations in accordance with the generalpolicy of the Samaj, under the directions of thePresident He shall maintain close liaison withvarious Ministries and departments concernedwith pension and welfare of Pensioners and alsothe Press and Mass-media for publicity work

(j) Editor :

He will collect material for the JournalBHARAT PENSIONER, prepare editorial, fix uppriorities and supply the same to publisher toensure its dispatch to members by the prescribeddue dates.

(k) Auditor;

With the help of the Treasurer, the Auditorshall audit accounts of the Samaj.

14. Amendments to the Constitution.

The General Body of Bharat Pensioners’Samaj shall have the power to amend, add, alteror rescind any provision of the Constitution withconsent of 3/5th majority of the members presentIn a meeting and voting and to frame rules there-under and to amend or rescind them.

14-A. However, for day-to-day working of theSamaj, in all its prescribed activities, theManaging Committee may decide, by a majorityvote on amending/introducing any new

operational measure, but without Interfering withthe basic Aims and Objects of the Organisation.

The reasons for the same will be duly broughton record In the minutes of the ManagingCommittee. Any such new amendment/ additionwill be later got ratified at the next AGM,

15. Dissolution and disposal of assets of theSamaj :

The Samaj may be dissolved by a vote of 3/5th of the members of the General Body andafter such dissolution the assets of the Samajshall, after discharge of all liabilities, be donatedto such charitable purposes as may be directedby the General Body authorising such dissolution.
