SUMMARY

Dr Fernand de Varennes is the Dean of the Faculty of Law at the Université de Moncton and one of the world’s leading experts on the human rights of minorities, and has focused particularly on the issues surrounding languages. He also has played a prominent role in promoting young Asian scholars in human rights as Editor-in-Chief of the Asia-Pacific Journal on Human Rights and the Law, and has worked and written in areas such as the prevention of ethnic conflicts, the rights of migrants, the relationship between ethnicity, human rights and democracies, as well as the use of federalism and other forms of autonomy arrangements to balance competing cultural interests.

He completed his law degrees in Canada (LLB, Moncton), the United Kingdom (LLM, London School of Economics and Political Science), and the Netherlands (Dr Juris, Maastricht). He is a Visiting Professor at the Faculty of Law at the University of Hong Kong (China) and Extraordinary Professor at the Faculty of Law of the University of Pretoria (South Africa).

As an international legal expert on human rights and the rights of minorities and indigenous peoples, he has appeared on a number of occasions before UN committees in Geneva and the European Parliament in Brussels, worked with the OSCE High Commissioner on National Minorities,

as well as prepared a number of UN (linguistic rights of indigenous peoples and minorities; prevention of ethnic conflicts; political participation of minorities) and UNESCO (rights of migrants) papers; and been involved in a dialogue seminar on minority rights with the judges of the African Court on Human and Peoples Rights. He was involved in preparing a practical handbook on the language rights for the Office of the UN High Commissioner for Human Rights. Dr de Varennes has also been keynote speaker for international conferences and taught in training sessions in Africa, Asia, Europe and the Americas.

As an academic, he has launched a number of higher education initiatives, including the first regular law course on Asia-Pacific human rights in an Australian law school, the first LL.M. in human rights in Australia, and a number of overseas international programmes for Australian law students in Italy, Switzerland and the United States. Between 1998 and 2012, Dr de Varennes was Editor-in-Chief of the Asia-Pacific Journal on Human Rights and the Law. His other academic involvement in Africa, Asia and Europe include being the former Director of the Asia-Pacific Centre for Human Rights and the Prevention of Ethnic Conflict and teaching human rights or international law in universities in Australia, Finland, Indonesia, Italy, Japan, Lithuania, the Maldives, and South Africa. He has taught a number of human rights courses in the LLM programme in human rights at Peking University in China, and federalism and autonomy at the Ethiopian Civil Service University in Addis Ababa.

As an advocate committed to human rights and the protection of minorities and indigenous peoples, he plays an advisory role in court litigation programmes at Minority Rights Group International and Interights, and sits on the advisory board of a number of research centres and scientific journals in Asia and Europe. He was consulted on the Organization of American States’ draft Inter-American Declaration on the Rights of Indigenous Peoples, on OSCE initiatives dealing with the rights of minorities (the Lund Recommendations on the Effective Participation of National Minorities in Public Life and the Oslo Recommendations regarding the Linguistic Rights of National Minorities), on the conformity of Bhutan’s Constitution with human rights standards, as well as prepared responses with minority organisations on proposed language legislation for Northern Ireland and South Africa. He was the Convener in 2012 of the 13th

Conference of the International Academy of Language Law held in Chiang Mai, Thailand, on Language Rights, Inclusion and the Prevention of Ethnic Conflicts.

In legal proceedings internationally, he has provided advice in the (successful) 2010 communication of Raihman v. Latvia before the United Nations’ Human Rights Committee, and the (also successful) 2012 case of Catan et al. v. Moldova and Russia at the European Court of Human Rights, and the successful 2010 case of Lourens v. President van die Republiek van Suid Afrika en Andere in South Africa. He was also called in 2014 as an expert-witness in a trial against the Parliament of South Africa in relation to

its constitutional obligations to have national legislation in the country’s official languages (Lourens v. Die Speaker of the National Assembly of the Parliament of the Republic of South Africa et al.).

Dr de Varennes’ research and publications record spans some 200 publications in more than 30 languages. In addition to traditional scientific books and articles, he continues to write reports for international governmental organisations such as UNESCO (on the rights of migrants), the UN Expert Mechanism on the Rights of Indigenous Peoples (on indigenous language rights), and the UN Working Group on the Rights of Minorities and UN Independent Expert on Minorities (language rights, prevention of ethnic conflicts, political participation of minorities), as well as for non-governmental organisations such as Minority Rights International (on minorities in Southeast Asia, Central Asia and East Asia). He is the editor for the upcoming Routledge Handbook of Human Rights in Asia, and is completing two further book manuscripts on Language Rights and Wrongs with Channel View Publications, and Language Rights in International Law with Brill Academic.

In recognition of his work and achievements in the field of human rights and the protection of minorities, he has received accolades from Africa, Asia, and Europe, including the 2004 Linguapax Award (Barcelona, Spain), the Tip O’Neill Peace Fellowship (Northern Ireland, UK), and was nominated for the Gwangju Prize for Human Rights (Gwangju, South Korea).
