Descripción de los
hechos
Description of the
facts
En noviembre de 2015, la Concejalía de
Cultura del Ayuntamiento de Pam-
plona, capital de la región española de
Navarra, organizó una exposición lla-
mada “Desenterrados”. Se alojó en la
sala municipal de exposiciones Conde de
Rodezno, en el edificio llamado “Monu-
mento a los Caídos”.
La exposición se inauguró el 20 de no-
viembre de 2015. Una de las piezas de la
exposición era “Amén”, cuyo autor es
Abel Azcona. Esta pieza consistía en
fotografías del autor posando com-
pletamente desnudo junto a la pala-
bra “pederastia” escrita con 242 Hos-
tias Consagradas, sustraídas de cien-
tos de Misas católicas.
El 21 de noviembre de 2015 el periódico
“Diario de Navarra” advirtió de la obra
publicando el titular “Puntos de provo-
cación” con el siguiente texto:
“Uno de los proyectos expuestos se llama
“Amén”, que puede molestar a los

Culture of the Pamplona City Council,
the capital of the Spanish region Na-
varre, organized an exhibition called
“Unearthed”. It was hosted at the local
exhibition hall Count of Rodezno, in the
building called “Monument to the
Fallen”.
The exhibition was inaugurated on No-
vember 20th 2015. One of the works was
titled “Amen”, whose author is Abel
Azcona. This work consisted on pho-
tographs of the author himself pos-
ing completely naked next to the
word “pederasty” written using 242
Consecrated Hosts, subtracted from
hundreds of Catholic Masses.
On November 21st 2015 the newspaper
“Diario de Navarra” warned about the
work publishing the next headline:
“Points of provocation”, with the text:
“One of the exhibited projects is called
“Amen”, and it can disturb Christian

day, different
ways of protest
took place against
Azcona’s work,
which was a vexa-
tion against the
dignity of Chris-
tian believers, a
social majority in
Spain.
The party Union of the Na-
varre People and the Popu-
lar Party urged the Parlia-
ment of Navarre to show its
“total repulsion” towards
Abel Azcona’s vexation
against Christians.

A nivel político, las repercu-
siones fueron también muy
relevantes. El partido Unión
del Pueblo Navarro y el
Partido Popular instaron al
Parlamento de Navarra a
mostrar su “total repulsa”
por la exposición de Abel
Azcona. Además, el portavoz
de UPN en el Ayuntamiento
de Pamplona pidió en el pleno
municipal que se retire de la
exposición la obra vejatoria, y
declaró que “los ciudadanos nos
sentimos insultados y avergon-
zados, es una grave humillación
para los creyentes y una ver-
güenza para todos, creyentes o
no”.
The crimes they were ac-
cused of are:
a) Crime of desecra-
tion (article 524 of the
Criminal Code).
b) Crime against reli-
gious feelings (arti-
cle 525.1).
At a political level, impact
was very high. The politi-
cal party Union of the Na-
varre People (UPN) and
the Popular Party urged
the Parliament of Navarre
to show their “total repul-
sion” towards Abel
Azcona’s work. In addition,
UPN’s spokesman at Pam-
plona City Council asked in
the local plenary session to
remove the vexatious work.
He declared that “we citizens
are insulted and ashamed, this
is a serious humiliation against
all of us, believers or not”.
Azcona’s work did not only consist of the photo-
graphs, but also of a bowl with dozens of Conse-
crated Hosts that he subtracted.

secrated Hosts to his
Facebook account.
El alcalde de Pamplona, Joseba Asirón,
consideró que estaba amparada por la li-
bertad de expresión. Tras la negativa del
Ayuntamiento de retirar la obra, miles de
personas salieron a la calle reclamando
su cierre bajo el lema: “Navarra pide
respeto”. Se convocaron muchas Misas de
reparación por la profanación y la gente
acudió a rezar ante la obra.
La exposición finalizó el 17 de enero de
2016. Durante dos meses las instituciones
públicas han agredido las convicciones más
íntimas de una parte importante de la so-
ciedad española. El funcionamiento de-
fectuoso de la justicia lo ha empeorado,
impidiendo la celebración de un juicio,
lo que ha provocado indefensión de la
Asociación ante esta injerencia injusti-
ficada e innecesaria en una sociedad de-
mocrática.
The Mayor of Pamplona, Joseba Asi-
rón, considered that the exhibition was
protected by freedom of expression.
After the City Council’s negative to re-
move the work, thousands demon-
strated asking its closing under the
motto: “Navarra demands respect”.
Many reparation Masses were called and
people prayed in front of the work.
The exhibition finished on January 17th
2016. For two months, public institutions
attacked seriously the most intimate be-
liefs of an important part of the Spanish
society. This got worse due to a defec-
tive functioning of justice. The cele-
bration of a trial was prevented, and
the Association was defenselessness as
a result of this interference, which is
unjustified and unnecessary in a demo-
cratic society.

Legal proceedings of
the case
El 23 de noviembre de 2015, la Asocia-
ción de Abogados Cristianos pre-
senta una querella contra Abel Az-
cona, ampliada posteriormente contra
la concejal de cultura del Ayuntamiento
de Pamplona, Maider Beloki. Se acusa al
autor de la obra vejatoria de delito de
profanación (artículo 524 del Código
Penal) y delito contra los sentimientos
religiosos (artículo 525.1).
El 11 de enero de 2016, el Juzgado de
Instrucción número 2 de Pamplona
emite auto de incoación de diligencias
previas y admite a trámite la querella
presentada por la Asociación.
On November 23rd 2015, the Associa-
tion of Christian Lawyers submits a
criminal complaint against Abel
Azcona. Later on, it was extended
against Maider Beloki, head of the De-
partment of Culture at the Pamplona
City Council. The author of the vexa-
tious work is accused of crime of dese-
cration (article 524 of the Criminal
Code) and crime against religious feel-
ings (article 525.1).
On January 11th 2016, Pamplona In-
struction Court number 2 submitted a
court order to initiate pre-trial proceed-
ing and deems the complaint by the As-
sociation’s complaint admissible.
Hundreds visited the local exhibition hall just to say prayers of reparation for Azcona’s desecration next to the
photographs of the Consecrated Hosts and the bowl containing some of Them.

El 10 de noviembre de 2016 el Juz-
gado de Instrucción de Pamplona
emite un auto en el cual acuerda el ar-
chivo de la causa. Afirma que:
a) El querellado no realizó actos de
profanación de las formas consa-
gradas, a pesar de que les dio un
“uso profano”. Pero es exculpato-
rio que no lo hizo en templo o lu-
gar destinado al culto.
b) La obra expuesta “no constituye un
escarnio de los dogmas, creencias, ri-
tos o ceremonias de la Iglesia católica
ni de quienes profesan dichas creen-
cias”.
On November 10th 2016, the Pam-
plona Instruction Court submitted a
court order dismissing the case. The
judge states that:
a) The defendant did not perform
any acts of desecration of the
Consecrated Hosts, despite he ap-
plied Them to “profane purposes”.
But it is exculpatory for him that
it was not performed in a temple
or a place destined to the cult.
b) The exhibited work “does not con-
stitute a derision of the dogmas, be-
liefs, rites, or ceremonies of the Cath-
olic Church, or of those who profess
those beliefs”.
Thousands of citizens demonstrated at the local exhibition hall, ask the City Council the removal of the work, and
prayed together in reparation for Azcona’s desecration.

Fue en este auto donde el Juez de Ins-
trucción a sabiendas de la importan-
cia de las Formas Consagradas utili-
zadas por Abel Azcona para los cris-
tianos, que son el mismo Dios para
los católicos, se refirió a ellas como
“objetos blancos y redondos de pe-
queñas dimensiones”, dañando grave-
mente las convicciones más íntimas
de los cristianos. Hecho que lo costó
una queja ante el Consejo General del
Poder Judicial.
In this court order the Instructor re-
ferred to the Consecrated Hosts as
“white, round, small-sized objects”,
despite he knows the importance that
these Hosts have for Christians,
which are God himself for Catholics.
The Instructor’s words seriously
harmed the most intimate beliefs for
Christians. These words entailed a
complain before the General Council
of the Judiciary.

Azcona’s vexatious work was legally prosecuted by three institutions: the Public Prosecutor, the Archbishopric of
Pamplona and Tudela, and the Association of Christian Lawyers.

a) Se habían tenido en cuenta las ma-
nifestaciones extraprocesales del
investigado en orden a su exculpa-
ción y sin embargo no se diera im-
portancia o se limitaran sus decla-
raciones en redes sociales y medios
de comunicación.
b) El Auto se había dictado sin las ga-
rantías del proceso, puesto que el
juez había obviado la labor de la
instrucción al examinar cuestiones
que exigían la práctica de pruebas
correspondientes al acto del juicio.
El 28 de abril de 2017 la Audiencia
Provincial de Navarra dictó auto por
el que desestimaba el recurso de ape-
lación presentado tanto por la Asocia-
ción de Abogados Cristianos como por
la Fiscalía de la Comunidad Foral de
Navarra, y el Arzobispado de Pam-
plona y Tudela.
a) The Instructor had taken into ac-
count the defendant’s declara-
tions produced before the crimi-
nal complaint that led to his ex-
culpation and not those declara-
tions that could have led to an-
other decision.
b) The order was submitted without
procedural guarantees, because
the Instructor obviated the in-
struction’s work and he examined
issues that demanded the practice
of truly proofs in an oral trial.
On April 28th 2017, the Navarre
Court of Appeal submitted a court
order dismissing the appeals by Aso-
ciación de Abogados Cristianos, Na-
varre Public Prosecutor, and the
Archbishopric of Pamplona and
Tudela.

instructor took into
account the defend-
ant’s declarations
that exculpated him
and not those that
could have charged
him.

En este Auto la Audiencia Provincial
afirmó que:
a) No hay indefensión puesto que el
instructor actúa dentro de las com-
petencias que le permite la ley.
b) No hay delito de profanación
puesto que nadie lo ve sustrayendo
las Hostias, con lo que no hay
ofensa.
c) A pesar de que la obra de Azcona
ofende los sentimientos religiosos
“inequívocamente”, no basta con ello
sino que la ofensa debe realizarse
con la expresa e inequívoca inten-
ción de ofender los sentimientos
religiosos, lo que “no queda consta-
tado” y por ello resulta procedente
el archivo de la causa.
In this order the Court of Appeal stated
that:
a) There is no defenselessness since
the instructor acts within the lim-
its of the law.
b) There is no crime of desecration
since nobody saw him subtract-
ing the Hosts, therefore there is
no offense.
c) Despite Azcona’s work offended
religious feelings “unequivocally”,
that is not enough because it is
mandatory that the offense is
committed with the express and
unequivocal intention of offend-
ing religious feelings, what “is not
verified”, and thus the dismissal is
appropriate.
The Navarre Court of Appeal used shameful arguments such as
there is no crime of desecration because nobody saw him sub-
tracting the Consecrated Hosts, or that the crime against reli-
gious feelings is applicable only when the defendant says that
he wants to hurt religious feelings.

de la Constitución Espa-
ñola y del derecho a la li-
bertad religiosa, protegido
por el artículo 16.
On June 8th 2017, the As-
sociation of Christian
Lawyers submitted the
constitutional protection
appeal number 3129-
2017 before the Consti-
tutional Court.
This appeal was based on a
violation of the right to ef-
fective judicial protection,
guaranteed in article 24.1
of the Spanish Constitu-
tion, as well as of the right
to religious freedom, guar-
anteed in article 16.
Para demostrar la gran trascendencia
constitucional del asunto, entre otras for-
mas, se hizo referencia a una recogida de
firmas que había superado las 100.000
firmas contra la obra vejatoria de Abel
Azcona.
To prove the great constitutional signif-
icance of the issue, a +100,000-signa-
ture online petition against Azcona’s
vexatious work was provided, among
other things.
The Constitutional Court dis-
missed an almost two-year
case and a 25-page appeal
with three lines of text argu-
ing a lack of “appreciation of
constitutional significance”.

En su recurso al Tribunal Constitucional,
Abogados Cristianos alegó que “es nece-
sario un pronunciamiento constitucio-
nal a favor de la libertad religiosa res-
pecto al artículo 525 del Código Penal,
en apoyo de la reiterada jurisprudencia de
Estrasburgo, y de que en el caso de España las
ofensas a los católicos afectan a una multitud
de sujetos, habida cuenta de las raíces católi-
cas de nuestro país y de que el 77,3% se decla-
ran católicos”.
El derecho a la libertad ideológica, reli-
giosa y de culto está reconocido en el
DUDH, el Pacto Internacional de Dere-
chos Civiles y Políticos, la Constitución
Española y las de nuestro entorno. Según
el Tribunal Europeo de Derechos Huma-
nos, “la libertad de pensamiento, de concien-
cia y de religión representa uno de los logros
de las sociedades democráticas” (STEDH de
20 de agosto de 1994), “uno de los funda-
mentos de las sociedades democráticas”
(STEDH de 25 de mayo de 1993).
The Association of Christian Lawyers al-
leged in its appeal that “a constitutional
pronouncement is necessary in favor of
religious freedom, also with respect of
article 525 of the Criminal Code, in sup-
port of the reiterated jurisprudence by the Eu-
ropean Court of Human Rights. Offenses to
Catholics affect lots of people in Spain, taking
into account the Catholic roots of our country
and the government statistics stating that
77.3% declare themselves as Catholics”.
The right to freedom of thought, con-
science, and religion is recognized by the
Universal Declaration of Human Rights,
International Pact on Civil and Political
Rights, the Spanish Constitution, and
every constitution similar to ours. Accord-
ing to the European Court of Human
Rights, “freedom of thought, conscience, and
religion represents one of the achievements of
democratic societies” (ECtHR, August 20th
1994), “one of the foundations of democratic
societies” (ECtHR, May 25th 1993).

tional Court did not
admit the constitu-
tional protection ap-
peal because “special

cance was not appre-
ciated”. The Associa-

yers announced that
they will take this case
before the European
Court of Human
Rights.

There was not a fair law-
suit
Tanto el juez de instrucción como los
magistrados de la Audiencia Provin-
cial incumplieron su obligación de
fundar su razonamiento jurídico so-
bre hechos objetivos. Se pueden obser-
var numerosas incongruencias entre los
fundamentos reseñados por el juzgador,
lo cual dejó a la Asociación en situación
de indefensión absoluta.
Both the instructor and the judges at
Navarre Court of Appeal failed to ful-
fill their duty to base their legal rea-
soning on objective facts. Many con-
tradictions can be found in the judge’s
reasons, what left the Association in a po-
sition of total defenselessness.

The principle of
equality of arms
was also vio-
lated. This sup-
poses that the par-
ties should have
the same proce-
dural opportuni-
ties to allege and
prove. But in this
case there was not
a fair lawsuit by an
independent, im-
partial judge since
facts were recon-
structed in a bi-
ased manner.
Many contradictions can
be found in the judge’s
reasons. And this left the
Association in a position
of total defenselessness.

La Asociación de Abogados Cristianos
no tuvo un recurso efectivo, sino que fue
una mera formalidad en lugar de una se-
gunda instancia. El contenido del auto
desestimatorio de la Audiencia Provincial
de Navarra demuestra que se trató el re-
curso de forma apropiada, como exige el
artículo 13 del Convenio Europeo de
Derechos Humanos (CEDH).
No podemos olvidar que estos gravísi-
mos hechos no han sido ni siquiera juz-
gados en España. No se practicaron las
diligencias que pedía la acusación durante
la instrucción, que sobrepasó sus funciones
y entró en la valoración subjetiva del caso.
Por lo tanto se puede concluir que España
ha violado el derecho a un proceso
equitativo que protege a la Asociación
de Abogados Cristianos, según recoge el
artículo 6 del CEDH.
Pese a que el TEDH no tiene competencia
para conocer los errores supuestamente
cometidos por una jurisdicción interna, es-
tos errores han llevado a una violación de
los derechos salvaguardados por el Conve-
nio. Y el Tribunal puede excepcional-
mente apreciar los fundamentos de he-
cho o de derecho de una jurisdicción
nacional en caso de flagrante y evidente
arbitrariedad (cf. Sysoyeva c. Letonia).
The Association of Christian Lawyers
did not have an effective remedy. It was
a mere formality rather than a second in-
stance. The content of the dismissal order
by the Navarre Court of Appeal proves that
there was not a proper treatment of the ap-
peal, required by article 13 of the Euro-
pean Convention on Human Rights
(ECHR).
It cannot be forgotten that these ex-
tremely serious facts have not even been
judged in Spain. Proceedings asked by the
prosecution during the pre-trial phase were
not carried out, and the Instructor exceeded
his powers and valued the case subjectively.
In conclusion, we can say that Spain vio-
lated the Association of Christian Law-
yers’ right to a fair trial, protected by ar-
ticle 6 of the ECHR.
Despite the ECtHR is not competent to
know the supposed mistakes of a domestic
jurisdiction, in this case those mistakes led
to a violation of the rights safeguarded by
the Convention. And the Court can excep-
tionally observe the reasons in fact and
in law of a domestic jurisdiction in case
of flagrant and evident arbitrariness (as
in Sysoyeva v. Latvia).

Se ha violado el derecho a
la libertad religiosa
The right to religious
freedom was violated
La Constitución Española protege la li-
bertad religiosa “sin más limitaciones que
las previstas por la ley” (artículo 16). Sin
embargo, el Estado español no ha ga-
rantizado este derecho al organizar
desde una institución pública, el
Ayuntamiento de Pamplona, una ex-
posición altamente ofensiva contra el
colectivo cristiano.
Esta exposición contenía Hostias Con-
sagradas apropiadas de forma indebida
de 242 Misas católicas. Dichas Hostias
forman parte esencial de la práctica
de una religión generalmente acep-
tada, y por lo tanto están protegidas
por el artículo 9 del CEDH (cf. Pichon
y Sajous c. Francia). Sin embargo fueron
usadas con un fin totalmente vejatorio,
que conllevó un ataque contra los miem-
bros de la comunidad cristiana, consti-
tuyendo una vulneración malintencio-
nada del espíritu de tolerancia que debe
caracterizar una sociedad democrática.
The Spanish Constitution protects reli-
gious freedom “with no other restriction
than may be necessary to maintain public or-
der as protected by law” (article 16). How-
ever, the Spanish State did not guaran-
tee this right taking into account that
a public institution, the Pamplona
City Council, organized a highly of-
fensive exhibition against the Chris-
tian community.
This exhibition contained Consecrated
Hosts improperly taken from 242 Catho-
lic Masses. Those Hosts are an essen-
tial part of the practice of a generally
accepted religion, thus they are pro-
tected by article 9 of the ECHR (as in
Pichon and Sajous v. France). However,
they were given a totally profane pur-
pose, which entailed an attack against the
members of the Christian community.
This was a malicious violation of the
spirit of tolerance that should character-
ize a democratic society.
We can say that Spain violated
the Association of Christian Law-
yers’ right to a fair trial, pro-
tected by article 6 of the ECHR. AEAC v. Spain | 17

nocerse su contenido gravemente hi-
riente, alterando la vida religiosa de la
comunidad cristiana y atentando con
ello contra el desarrollo normal de la
participación en la vida de la comunidad.

regional, and national, allowed the exhi-

El gravísimo ataque de Abel Azcona es-
taba disfrazado como producción artís-
tica. Sin embargo, tanto el Ayunta-
miento de Pamplona como el Poder Ju-
dicial justificaron esta exposición veja-
toria valiéndose de las disposiciones del
Convenio. En concreto, la libertad ex-
presión protegida por el artículo 10.1.
No obstante, la permanencia de esta
supuesta producción artística llevó
consigo la destrucción de los dere-
chos y libertades reconocidos por los
artículos 8, 9 y 14 del Convenio.
Por otro lado es importante señalar que
el Tribunal Europeo de Derechos
Humanos ha considerado que una
postura de odio disfrazada bajo la
apariencia de producción artística es
tan peligrosa como un ataque frontal
y abrupto (M’bala M’bala c. Francia).
