    SECTION- I

    LETTER OF INVITATION TO THE EVALUATION CONSULTANT ORGANIZATION (REFERRED AS “CONSULTANT”)_

    Dear Consultant, 1. Karnataka Evaluation Authority (KEA), a registered non-profit society

    functioning under the department of Planning, Programme Monitoring and Statistics Department, Government of Karnataka (herein after may also be referred to as “Client”) invites tender proposals for evaluation of the scheme mentioned overleaf. 2. This Request for Proposal (RFP) applies to all the eligible Consultants capable of performing thematic and evaluation studies of Government schemes.

    3. The Consultant will be selected through the process of Quality-and-Cost-

    Based Selection (QCBS) procedure (refer rule 28-C of the Karnataka Transparency in Public Procurement Rules 2000).

    4. Bids will be scrutinized and evaluated by Tender Evaluation Committee(s)

    (TEC) constituted for the purpose. 5. The format of forms for submitting proposals are provided in, Sections-V, VI

    and VII of this document. 6. Tenders shall be submitted online in e-Procurement portal

    (https://eproc.karnataka.gov.in). The last date and time for submission of tenders is mentioned in Annexure-IX of this document.

    7. All other details with regard to this RFP are available in e-Procurement portal

    as mentioned above.

    SECTION-II INFORMATION TO CONSULTANTS

    A. Introduction Karnataka Evaluation Authority (KEA), a registered non-profit society functioning under the department of Planning, Programme Monitoring and Statistics Department, Government of Karnataka,intends to evaluate “Deen Dayal Upadhyaya Grameen Kaushalya Yojana (DDU-GKY) in Karnataka State, Karnataka State Rural Livelihood Mission and Rural Development and Panchayat Raj Department” by availing services of Evaluation Consultant Organization (hereinafter referred as “Consultant”). The Consultant will be selected based on Quality-and-Cost-Based Selection (QCBS) procedure (refer Rule 28-C of the Karnataka Transparency in Public Procurement Rules 2000). KEA will constitute Tender Evaluation Committee(s) (TEC) for the purpose of scrutiny and evaluation of tenders submitted by consultants.     of a Technical Proposal and a Financial Proposal as mentioned in this document. Consultants shall submit their tenders in e-Procurement portal only (https://eproc.karnataka.gov.in). Last date and time for submitting tenders is mentioned in Annexure-IX of this document.

    2. Consultants shall ensure payment of requisite fees and Earnest Money Deposit (EMD) and submission of tenders prior to the last date and time for receipt of tenders. Any delay in payment of requisite fees and / or EMD will lead to disqualification of the bidder during tender opening event.

    3. The selected Consultant shall execute a Contract Agreement as per the format

    and terms and conditions indicated in Section-IV of this document, with such modifications/ additions, which may either be specified by KEA or mutually agreed upon. The name of the Principal Investigator and the Core Team Members furnished in Part-II (A) of the Technical Proposal should be mentioned in the Contract Agreement.

    4. All interested Consultants must familiarize themselves with the details of

    assignment, the organizational context and local conditions while preparing the proposals. They are encouraged to visit the concerned department implementing the scheme/programme for any further information.

    5. Interested Consultants may attend the pre-bid meeting, as mentioned in this

    document, for clarifications on submitted queries and other points, if allowed. 6. The Terms of Reference (ToR) for the proposed evaluation is enclosed in

    Section-III of this document. It is emphasized that the sampling procedure and sample size may be meticulously read and understood. Consultants need to submit queries / suggestions on the sampling intensity and the sampling method, if any, for KEA to provide necessary clarifications / modifications / additions during the pre-bid meeting.

    7. Any enhancement of sampling intensity, after signing of Contract Agreement,

    will not be a ground for upward revision of the amount payable to the selected Consultant. 8. All participating Consultants are expected to provide a true and faithful account of themselves, their abilities and their suitability for taking up this assignment. They should not only satisfy themselves about their ability to undertake good evaluation study within the prescribed time, but the capability to retain the

    personnel taken on outsourcing/ad hoc /contract basis. 9. In case the Principal Investigator or any member discontinues his / her services with the Consultant, it shall be responsibility of the Consultant to deploy an equivalent or better replacement with prior approval of KEA. Failure deployment of suitable personnel within 30 days may lead to cancellation of Contract and / or forfeiture of Bank Guarantee. KEA reserves the right to initiate other penal measures against the Consultant based on the quantum of damage caused due to failure in timely deployment of personnel.

    10. The Consultant will be selected based on, amongst others, the technical

    competence of the Principal Investigator and two team members and the experience in handling such assignments in the past.

    11. KEA expects the participating Consultant to provide professional, objective,

    and impartial advice and at all times hold the interest of KEA paramount, without any expectation of future work. They should strictly avoid conflict of interest (which means and shall include any prior or current engagement of the Consultant for any work that may place them in a position of not being able to carry out the assignment in the best interest of KEA). The Consultant shall not participate for this RFP, in case of a conflict of interest.

    12. The participating Consultant should not engage themselves in “corrupt or

    fraudulent practices” in the broadest sense of these terms in securing or executing this assignment. The said cited term would include wrongful or exaggerated description of the academic qualifications and publications of any of the team members, citing assignments done by other organizations/team members as their own, appending false documents to the proposal, poaching of team members of other participating Consultants, not properly briefing about the nature and quantum of work involved in the assignment to any of the team members or the Principal Investigator by them, etc.

    13. On KEA observing that any Consultant has actually indulged in any such

    practice(s) mentioned Clause 12 above, the Consultant will be disqualified from

    tender evaluation process. In case of selected Consultant, the Contract Agreement will be terminated with forfeiture of Bank Guarantee and / or other penal measures based on the quantum of damage caused to KEA.

    14. The Consultant selected to perform the evaluation should observe highest

    standard of ethics during the execution of the assignment, consistent with the standards established by the United Nations Evaluation Group/ American Evaluation Authority.

    15. The maximum permissible time for conducting and completing the assignment

    in all respects, including submission of final report is part of the Terms of Reference (ToR), which is included in Section-III of this document.

    16. KEA reserves the right to verify the data collection and data compilation work

    to establish that data is collected in the way and manner as prescribed in the ToR and recorded fully in letter and spirit.

    17. KEA reserves the right to audit the accounts of the Consultant, related to the

    assignment, by an Auditor engaged by KEA. The Consultant shall rectify the errors and deficiencies, observed during the Audit, at their own cost.

    18. The selected Consultant Organization may collect the primary data through

    App-based software solution developed by KEA or any other open source software customized for the purpose of collection of data from the field with the attributes such as Latitude, Longitude (GPS location), real time photo etc., The exercise of primary data collection from field using mobile application may be combined with manual collection of data using questionnaire, if required. 19. In case the Consultant collects data through an open source software, the link to such software shall be provided to KEA.

    20. KEA will make available all the secondary data collected from the concerned

    line Department for the preparation of ToR, which is related to the assignment, to the selected Consultant at the time of execution of Contract.

    21. The Consultant Organization has to submit progress report for every quarter of

    the study. 22. Draft Evaluation Reports received in the office of KEA from the selected

    Consultant will be assessed by Independent Assessor (s), Consultant (Evaluation), KEA and the Technical Committee members. The draft Final evaluation report submitted by the Consultant Organization will be approved by KEA, if all the necessary corrections are attended/made.

    23. The Final Evaluation Report will be graded and bench-marked. 24. The participating Consultants shall provide a list of assignments being

    performed and their status of progress. The participating Consultant shall prove its financial, technical and resource strength to undertake the assignments of KEA. The penal measures as indicated in Clause 12 mentioned above will be applicable if the participating Consultants submit false information with a purpose to mislead KEA while proving its financial, technical and resource strength.

    25. Karnataka Evaluation Authority reserves the right to add, delete and modify any of the above conditions.

    26. Karnataka Evaluation Authority reserves the right to cancel the RFP at any time

    without assigning any reasons.

    B. Clarifications and amendments to the RFP document 27. Interested Consultants may seek clarifications on any item of this RFP

    document. All such requests for clarifications shall be sent in writing (speed post, e-mail or e-Procurement portal) and shall reach within the prescribed date and time as mentioned in the e-Procurement portal. Requests received after such prescribed date and time may or may not be considered by KEA during pre-bid meeting. The details of the pre-bid meeting are mentioned in Section-IX of this document. 28. Responses to the clarifications, as sought by interested Consultants, will be

    presented during the pre-bid meeting. KEA reserves the right to consider responding to clarifications sought during the pre-bid meeting. All responses to the clarification will be published in e-Procurement portal.

    29. At any time before the last date and time of receipt of tenders, KEA may, for

    any reason, whether on its own initiative or in response to a clarification sought by any Consultant, modify any of the clauses of the RFP document by issuing an amendment(s) and publish the same in e-Procurement portal. Such amendment(s) will be binding on all the participating Consultants. KEA may at its discretion extend the deadline for the receipt of proposals, if the need arises.

    C. Preparation of proposal

    30. Interested Consultants must satisfy themselves that they have the required competency to take up the evaluation assignment based on their expertise, and demonstrably so. If there is any marginal deficiency for a specific task, they must declare it in the proposal and make up for the same before the Contract Agreement is signed. If they do not have the required expertise, they should not participate in the bid. 31. Interested Consultants are advised to carefully read Section-V of the RFP, familiarize themselves with the criteria based on which their proposals will be evaluated, and accordingly submit their technical and financial proposals. Information provided in the proposals must be complete, correct and comprehensive. Deficiencies in the information, if any, may result in lower scores, or rejection of the proposal. KEA shall not be responsible for rejection of bidders due to deficiency of information as submitted by participating Consultants.

    32. Participating Consultants shall submit their proposal as per format prescribed

    in Sections-VI and VII of this RFP document. They must use at least 12 size fonts, and scrupulously adhere to the text limit specified. The proposal should be complete in all respects, and must be signed by a person duly

    authorized for this purpose by the Consultant. 33. Participating Consultants shall pay Tender Processing Fee (as mentioned in e-

    Procurement portal) and Earnest Money Deposit (EMD) of Rs. 40,000/- (Rupees Forty Thousand only) as part of submission of tenders. The payment of this EMD indicates the commitment of the Consultant towards carrying out the assignment for which it is bidding successfully, timely and qualitatively. Non-payment of Tender Processing Fee and EMD will be a valid ground to reject the proposal during tender opening event.

    34. It is the responsibility of the participating Consultant to ensure that the Tender Processing Fee and EMD are received by e-Procurement project in their respective account within the last date of receipt of tenders as mentioned in e-Procurement portal. The participating Consultant is advised to initiate the payments well in advance in order to have sufficient time for performing corrective measures in case of any failures due to reasons beyond the control of the participating Consultant.

    35. Participating Consultants may withdraw / amend their proposals any number

    of times in e-Procurement portal till the last date and time of receipt of tenders. After expiry of last date and time of receipt of tenders, the Consultants shall not withdraw / modify their proposals till the completion of the tender evaluation and award of contract, except where such an amendment is only as a matter of elaboration or explanation. If the Consultant withdraws / modifies their proposal during tender evaluation and award of contract, the proposal shall be rejected and Earnest Money Deposit (EMD) forfeited. 36. The Earnest Money Deposit (EMD) of the selected Consultant will be retained with KEA till the successful completion of the contract.

    D. Submission of Technical Proposal

    37. While preparing the Technical Proposal, the participating Consultants should

    ensure that:

    i. Their employees and team members have the essential expertise required for the assignment. Joint ventures and partnerships with other firms/Consultants are not allowed. Poaching of team members of other participating Consultants will result in rejection of the proposal as stated above.

    ii. They are capable of constituting a coherent team of competent key professionals to handle the assignment from initiation to completion.

    iii. Key professional staff have the experience of handling similar projects earlier.

    iv. The Curriculum Vitae (CV) of the key professional staff (Principal Investigator and team members) are true and correct.

    v. All team members have a working knowledge of Kannada and the local culture or they have a competent translator in each team, in case of lack of working knowledge of Kannada.

    38. The Technical Proposal includes, inter alia, the following information:

    i. A brief description of the Evaluation Consultant Organization and its

    activities. ii. Duly signed Curriculum Vitae of the Principal Investigator and team

    members iii. Brief description of similar assignments handled earlier. iv. All other details as per Section-V of this RFP document.

    39. The Consultant shall present their technical competence, understanding of the

    assignment and other details related to their technical proposal to the Technical Evaluation Committee(s) (TEC) constituted by KEA for the purpose. Their presentation will be evaluated as per criteria mentioned in Part-II (B) of this RFP document. KEA reserves the right to record the presentation (through audio/video/documentation etc.) for future reference. 40. The maximum time permitted for each Consultant for the presentation will be 30 minutes. Tender Evaluation Committee may extend the time of presentation, discussion or force stop the presentation. KEA reserves the right to seek

    additional documents from the Consultants substantiating their technical proposals. Consultants will not be allowed to submit any document other than those sought by KEA.

    41. The technical presentation of the Consultant will be on one-on-one basis and

    exclusively arranged for the Consultant. 42. The Principal Investigator (of the Consultant) shall present the technical

    competence and other details of the technical proposal to the TEC. If the Principal Investigator is unable to be present physically at the time of the technical proposal presentation, the Consultant will be disqualified from tender evaluation and will be rejected for the tender.

    E. Currency and Cost details in Financial Proposal

    43. Participating Consultant should enter the financial prices in the e-Procurement portal only. The Financial Bid format as mentioned in Section-VII of the RFP is only for reference and participating Consultants shall NOT upload the Financial Bid format in e-Procurement portal. The price quoted by the Consultant in e-Procurement portal should be in Indian Rupees only. 44. The price quoted by the Consultant should include all costs associated with the assignment comprehensively and realistically. It should include remuneration for key professional staff and support staff, out-of-pocket expenses for their subsistence while on tour (TA and DA), seminar/workshop/training cost, pilot test cost, field data collection cost, logistics cost (hiring charges of temporary office space, equipment, furniture, telephones etc., additionally acquired for the purpose of this assignment), cost of books, stationery and printing, translation and incidentals like institutional overheads, taxes etc.

    F. Procedure for Submission of Tenders in e-Procurement Portal 45. Interested Consultants need to obtain Digital Signature Certificate (DSC) and

    register in e-Procurement portal (https://eproc.karnataka.gov.in). If they have been registered earlier, they can continue to use the same login credentials for

    submission of proposal. 46. Interested Consultants are advised to contact the following offices for training

    47. Participating Consultants shall pay the required tender processing fee and EMD

    through any of the online (credit card, debit card, net banking) or offline (NEFT / RTGS, Over-the-Counter) modes available in e-Procurement portal, provide necessary information, upload various technical documents (PDF versions) and enter the financial prices against the items as specified in the portal. 48. Participating Consultants shall submit their tenders in e-Procurement portal only. KEA and e-Procurement Cell, Centre for e-Governance shall not be liable if Consultants are unable to submit their bid due to technical / operational problems at their end. Also, KEA and e-Procurement Cell, Centre for e-Governance shall not be liable if the Consultants are rejected during tender opening event due to technical / operational problems at their end / at their “Sending Bank” while transferring tender processing fee and EMD to e-Procurement.

    G. Evaluation of proposals

    47. The TEC(s) constituted by KEA will scrutinize and evaluate the Technical and

    Financial Proposals. The Principal Investigator of the Consultant, along with other team members, should present their proposal, provide necessary clarifications and extend full cooperation with the TECs during evaluation process.

    48. The TEC will evaluate the proposals on the basis of evaluation criteria as mentioned in Section-V of this RFP. The technical proposal consists of two parts- Part-II A of Section-VI for 100 marks and Part-II B of Section-VI for 200 marks.

    49. Each participating Consultant will be intimated through e-mail, the date and

    time on which their Principal Investigator is expected to make the presentation. The presentation will be the basis on which the TEC will arrive at a technical score on Part-II B of Section VI.

    50. The evaluation of every Technical Proposal will be done by TEC through a

    fiduciary relationship with the KEA. The scores assigned by various members of TEC will be submitted to KEA. These scores shall be exempt from disclosure as provided by section 8(e) in the Right to Information Act 2005.

    51. Consultants having scored 60% and above in Part-II A and also in Part-II B

    respectively qualify for opening of Financial Prices. The EMDs of Consultants not qualifying in technical evaluation will be refunded.

    52. Single tender (either at technical evaluation stage or financial evaluation stage)

    will be rejected as a rule, though exceptions are possible. 53. The EMDs of all Consultant Evaluation Organizations who do not make it to the financial proposal evaluation stage will be refunded.

    54. TEC will scrutinize the financial rates quoted by technically-qualified

    Consultants, verify the numerical accuracy and confirm the total cost of each proposal. No changes can be made to the cost by the Consultant at this stage, except as a clarification or elaboration which may or may not be accepted by the TEC. Deficient, incorrect, abysmally low-priced or erroneous proposals will be rejected summarily.

    55. The technical and financial proposals will be combined to derive the Total

    Score of the Consultant.

    H. Scoring of Consultants based on Quality and Cost Based Selection (QCBS) Method

    56. The Technical proposals will be allotted weightage of 80% while the

    Financial (Cost) proposals will be allotted weightage of 20%.The proposal with the Lowest Evaluated Cost (LEC) will be given a financial score of 100 points and other proposals shall be given financial scores that are inversely proportional to their prices. The total score, both technical and financial, shall be obtained by weighing the quality and cost scores and adding them up. 57. Highest point’s basis: On the basis of the combined weighted score for quality and cost, Consultants will be ranked in terms of the total score obtained. The Consultant obtaining the highest total score in evaluation of quality and cost will be ranked as H-1 followed by others with lesser scores as H-2, H-3. The Consultant securing the highest total score and ranked H-1 will be generally recommended for award of contract.

    An example is illustrated as follows. Three Consultants viz., A, B and C submitted proposals in response to an RFP. The TEC assigned their technical scores as 75, 80 and 90 respectively (technical scores reduced to 100). The minimum qualifying score is 60%. Hence, all the 3 proposals are technically suitable and their financial proposals (Costs) will be opened.     proposals:- A: 100000 / 120000 = 83 points,

    B: 100000 / 100000 = 100 points C: 100000 / 110000 = 91 points.

    In the combined evaluation, thereafter, the TEC will calculate the combined technical and financial score as under:- Consultant A: 75 x 0.80 + 83 x 0.20 = 76.6 points.

    Consultant B: 80 x 0.80 + 100 x 0.20 = 84.0 points. Consultant C: 90 x 0.80 + 91 x 0.20 = 90.0 points. The three Consultants in the combined technical and financial evaluation will

    be ranked as under:- Consultant A: H3.

    Consultant B: H2. Consultant C: H1.

    Consultants having been ranked as H-1 will, therefore, be recommended to be

    declared as successful and for award of contact. The recommendation will be sent to KEA for necessary approval.

    I. Negotiations

    58. KEA reserves the right to negotiate with the successful bidder (Consultant

    ranked as H-1) when felt necessary.

    J. Award of contract 59. TEC may draft the proceedings of the tender evaluation process in the format

    suggested in Section VIII of this RFP document and submit them to KEA for seeking necessary approval. The contract will be awarded by KEA. 60. The Consultant selected for the assignment and awarded the contract shall sign the Contract Agreement within four weeks of the contract being awarded.

    Delay or default will result in the presumption that the Consultant, for reasons best known to it, is not interested in the assignment.KEA may engage the Consultant ranked at H-2 for the contract, if H-2 accepts to undertake the work at the price quoted by H-1, if it is lower. The EMD of H-1 shall be forfeited in all such cases. An undertaking in this respect shall be submitted by all Consultants as part of the tender submission documents.

    61. The form of the Contract Agreement shall generally be as prescribed in

    Section IV of this RFP document. Clarifications on the Contract Agreement may be obtained in the pre-bid meeting. The selected Consultant cannot insist for changes in the Contract Agreement at the time of signing. Only minor modifications or statute related changes may be made to the Contract Agreement with prior approval of KEA. Any major change in the Contract Agreement need to be approved by the Governing/General body of the Karnataka Evaluation Authority.

    62. This tender may be cancelled by KEA at any stage of evaluation and award of

    contract without assigning any reasons.

    SECTION-IV CONTRACT AGREEMENT (TEMPLATE)

    (All names, dates, addresses and subjects etc. are for indications only) This agreement is made and executed at Bangalore on this ____day of ____ 2018 by and between: The Karnataka Evaluation Authority (hereinafter to be referred to as KEA), registered as a Society under the Karnataka Societies Registration Act, 1960, under the Ministry of Planning, Programme Monitoring and Statistics Department of the Government of Karnataka, and having its office at Room No.542, II Gate, M S Building, Dr. B R Ambedkar Veedhi, Bangalore – 560 001, represented by the Chief Evaluation Officer of KEA (hereinafter the term and expression shall mean and include his / her successors, executive assistants and legal representatives) as the FIRST PARTY, and, ---------------------------------------Agency/Firm/Society/Company/Institution/Centre of Excellence/University(strike off whichever is not applicable), having its registered office at ------------- represented by its ---------- designated as --------, whose full postal address for communication is -----------, email id is -------------and contact phones are -----------, working under the overall control, guidance and superintendence of the registered office and having legal competence to enter into contract agreements on behalf of the Agency/Firm/Society/Company/Institution/Centre of Excellence/University(strike off whichever is not applicable), detailed at the commencement of this paragraph (hereinafter referred to as the “Consultant”, which term and expression shall mean and include his / her/their successors, assignees and legal representatives), as the SECOND PARTY. WHEREAS The Government of Karnataka is desirous of undertaking an Evaluation Study in the name and title of -----------, and has set up the KEA, amongst other purposes, for the same vide Government of Karnataka order no. PD/8 /EVN (2)/2011 dated 11th July 2011. The KEA being an independent agency to aid and promote effective, independent and transparent evaluation of public programmes and policies in the State of Karnataka, it proceeded to get the Evaluation Study done through a qualified external Consultant, following the due procedure. The Second Party (Consultant), having proved its credentials and capabilities in the process to successfully accomplish the task, was offered the assignment of undertaking the above study in accordance with the Terms of Reference (ToR) cited at Annexure I to this agreement;

    AND the Consultant, having assured the KEA of possessing the required competencies in their research team headed by the Principal Investigator ----------------- whose complete postal address and contact details are ----------- , to undertake the above Evaluation Study in all its dimensions and in accordance with the ToR prescribed, offered to do so to the satisfaction of the KEA; AND in consideration whereof the KEA agreed to pay the Consultancy Charges to the Consultant vide schedule that is described later in this agreement and accepted by both parties to the agreement; NOW, therefore, in consideration of the mutual promises and obligations, this agreement is entered into by the above named two parties on the following terms and conditions: 1. The KEA agrees to engage and retain the services of the Consultant for

    conducting the study till it is completed in all respects and final report and related information/records thereto are submitted and the report is approved by KEA.

    2. The Consultant agrees to conduct an in-depth study of the evaluation topic in accordance with the best academic standards and scientific rigor, and submit a detailed evaluation report to KEA within the stipulated time in accordance with the ToRand to the satisfaction of KEA.

    3. The study shall be completed and the Final Draft Report of the study to be approved by KEA within the period of the duration mentioned in the ToR unless specifically prescribed.

    4. The following deliverables and the timelines shall be maintained by the Consultant: a. An inception report containing a detailed road map for the study shall be

    submitted to the first party within a period of one month from the date of this agreement. This report shall contain templates of survey instruments, results of pilot test, specifics of sampling design and research methodology. The same will be approved by KEA The remarks, comments and alterations suggested will be informed to the Consultant. The Consultant will comply with these within four weeks of receiving the information and submit final inception report for approval of KEA. Only after such approval, should the Consultant proceed according to the mentioned specifications.

    b. The Consultant and their field data collection agency will provide complete details of field data collection plans to the first party sufficiently in advance to communicate the same to all concerned. Following the communication, the Consultant should proceed with the data and information collection as per the approved design, and complete the same within two months.

    c. The data collected should be processed statistically and a draft report should be prepared by the Consultant. Five copies of draft report of the study along with soft copy of the data collected shall be submitted to KEA within one month from the date of completion of field work. The Consultant is expected to make a comprehensive presentation of the draft report to the Technical Committee of KEA on the time, date and venue fixed for the purpose. The Committee, after examining the report in detail and taking note of the details as elaborated in the presentation, can either accept or express the need for modifications and / or supplementary work. The Consultant shall ensure incorporation of all suggestions etc., within one month from the date on which the communication of modifications / supplementary work was received, and submit the revised draft report to KEA.

    d. After approval of the draft report, the Consultant shall prepare a final report both in Kannada and English versions and submit their sample copy separately, in the prescribed format and manner, to KEA. On KEA approving the final report, the Consultant shall proceed with other activities of printing, binding, data copying etc.

    e. The following shall be submitted by the Consultant to KEA. a. FIFTEEN hard copies in ENGLISH b. FIFTEEN hard copies in KANNADA c. Both Kannada and English final evaluation reports as mentioned

    under (a) & (b) should be submitted simultaneously. d. THREE soft copies PDF & DOC format each of the approved final

    report (in English as well as Kannada) e. THREE soft copies of raw field data, data collection instruments

    and processed data outputs f. ONE hard copy of raw field data, data collection instruments and

    processed data outputs. f. The Consultant present the Final Report to the first party for the purpose

    of benchmarking the quality of the report and dissemination of findings/recommendations.

    g. The evaluation report should generally conform to the United Nations Evaluation Guidelines (UNEG) “Standards for Evaluation in the UN System” and “Ethical Standards for Evaluations”. The report should be complete and logically organized in a clear but simple language. Besides conforming to the qualities covered in the Terms of Reference, the report should be prepared as per the prescribed format of KEA which is enclosed.

    5. Monitoring and coordination of sample survey and data collection work: A representative of the department/Board/ Urban or Rural body or State Undertaking concerned may act as the Chief Coordinator for the project work

    and would closely interact with the Consultant. He / She will nominate coordinators for supporting the field work, briefing and debriefing sessions.

    6. Consultancy fee and payment schedule: KEA agrees to pay Rs._________ (Rupees ______________ only) towards the total Consultancy fee payable for the task, including taxes. The payment schedule is as follows; a. The first installment of Consultancy fee amounting to 30% of the total

    fee will be payable as advance to the Consultant after the approval of the inception report (as prescribed in clause 4a. above) and submission of a bank guarantee from a nationalized bank valid for a period of at least 12 months from the date of approval of such report. The Second Party shall renew the Bank Guarantee for such a period till the submission and approval of Draft Evaluation Report. b. The second installment of Consultancy fee amounting to 50% of the total fee will be payable to the Consultant after the approval of the Draft report (as prescribed in clauses 4b&c. above).

    (i) If the Second Party does not furnish Bank Guarantee, they will not be entitled to get the first installment of consultancy fees.

    (ii) The Second Party can claim first and second installment of consultation fees together, without furnishing the Bank Guarantee, on approval of the draft report by KEA.

    c. The third and final installment of Consultancy fee amounting to 20% of

    the total fee will be payable to the Consultant after the receipt of the hard and soft copies of the final report in such format and number as prescribed in this agreement, along with all original documents containing primary and secondary data, processed data outputs, study report and soft copies of all literature used to the final report (as prescribed in clauses 4d&e. above and clause 7 I h. below).

    7. Performance Warranties:

    I. Warranties on behalf of the Consultant: The Consultant agrees to provide the following warranties to KEA; a. That the Consultant undertakes to perform the study with the highest

    professional standards, competency and ethical integrity. The Consultant agrees to adopt the following principles:

    i. To foster social equity & justice in evaluation by including relevant perspectives and interests of all stakeholders.

    ii. To secure informed consent of all survey participants and stakeholders, respect their privacy, dignity, freedom of expression and provide complete anonymity and confidentially to the information provided by them.

    iii. To hold the evaluation enquiry systematically, gather evidence completely, comprehensively and independently, uninfluenced by any interested person or party and maintain good, accurate and proper records of the data, results, methods adopted and the procedures followed in connection with the evaluation work and to share them with the KEA.

    iv. To arrive at the findings based entirely on the data and information gathered for the study free from bias of any kind and to provide a balanced and judicious report on the strengths and weaknesses of policy, programme and the manner of implementation based on sound and verifiable reasons.

    b. The Evaluation Report submitted by the Consultant will be its sole work and not infringe the copy right of any other(s).

    c. That the Consultant agrees NOT to change key personnel listed in the ToR / RFP and associated with the evaluation study till the final evaluation report is submitted. If for reasons beyond the control of the Consultant, if becomes necessary to replace the key personnel, the Consultant shall forthwith provide a replacement with a person of equivalent or better qualification acceptable to KEA.

    (i) The name and other details of Principal Investigator and Core Team Members who are involved in this evaluation study should be as mentioned in the TOR.

    d. That the Consultant will NOT subcontract the study wholly or in part to any other agency. However, the Consultant may engage another agency having trained and qualified staff for survey and sample data collection purposes. Similarly, the Consultant may engage a qualified agency for printing the final report. While doing so, the Consultant will ensure that the quality of work or timeline is not compromised in any manner whatsoever.

    e. That the Consultant takes full responsibility for making payment to its staff and workers so engaged for this study promptly and fairly, and will not create any obligations to KEA to clear any pending payments.

    f. That the Consultant will maintain total confidentiality of the data, facts, findings and recommendations of the study. It shall not disclose any confidential information acquired in the course of the study to any one without the prior written consent of KEA. The Consultant shall sign a Non-Disclosure Agreement with KEA.

    g. That the role conflict faced by the Consultant, if any, perceived at any time of the study, shall be fully and properly disclosed to KEA without any loss of time.

    h. That after completing the study, the Consultant will submit all original documents containing primary and secondary data, processed data outputs, study report and soft copies of all the literature cited in the final report to KEA along with the final reports. Neither the Consultant, nor his staff or agents will not make any unauthorized use of the data or information.

    II. Warranties on behalf of the KEA: The KEA agrees to provide the following warranties to the Consultant: a. That the KEA will facilitate the evaluation study in all possible and

    tenable ways. It agrees to issue a letter of authorization to the Consultant to access the available official records, documents, data and reports, etc., connected with the study and also for seeking interviews with key personnel connected with the execution of the programme and policies relevant to the study.

    b. That the KEA assures the Consultant that review & comments on the draft documents and any proposals submitted by the Consultants will be communicated generally within four weeks from the date of such a request or such time as may be prescribed in this agreement. The Consultant should but take due notice of the comments and suggestions made and agree to undertake necessary corrective action without compromising on the facts and findings.

    c. That the KEA agrees to release the advances and payments in accordance with the timelines and schedules agreed to in clause 6 above. If payments are not released within 15 days from the date of request for release after qualifying for the same (duly supported by necessary and sufficient documents), the consultant is entitled for commensurate extension of time in the agreement period. The agreement shall not be jettisoned solely on account of delay in releasing funds.

    8. Other rights and obligations: a. The Government of Karnataka and KEA have a right for periodic spot

    check and /or verification of data collected, either directly, or through their subordinate officers to ascertain the rigor and quality of field work. The Consultant agrees to make good the defects, if any, observed during such checks / verifications.

    b. Copy right of the data and reports shall vest with KEA. Data, information and reports generated during the evaluation study shall be the property of KEA. Copy right of the survey formats, raw data, pictures, maps, reports and any other documents generated during the study shall vest with KEA.

    The Consultant cannot make use of such materials or ideas for any other purpose or transfer it to a third party without the prior written permission of KEA.

    c. Any new methodologies, techniques, principles, proprietary materials such as software, programmes, macros, algorithms and modules developed or created by the Consultant in the course of the study, which are of generic nature and not produced exclusively for KEA, will remain the exclusive property of Consultant. However, they will be shared with KEA to the extent needed to understand the processes, procedures and methodologies used in conducting the study and arriving at conclusions.

    d. Both parties to this agreement agree to indemnify, defend and hold the other parties harmless against any liabilities arising out of due discharge of duties under this agreement.

    e. KEA reserves the right to add, delete and modify any of the conditions of this Contract Agreement.

    f. KEA reserves the right to cancel this Contract Agreement any time without assigning any reasons.

    9. Penalties a. If quality of the Consultant’s work is poor and beyond redemption in

    the opinion of KEA, it may issue a notice to that effect to the Consultant and, after hearing the Consultant’s explanation both in writing and orally and if the work is proved to be poor, terminate this agreement forthwith. If any advance has been paid against Bank Guarantee to the Consultant, it shall be invoked and deposited to KEA. Thereafter, the Consultant will be removed from the list of Empanelled Consultants.

    b. If the Consultant fails to meet the timeline for any specific deliverable, upon a written request quoting reasons, he / she/they may be given an extension of Three months (Two months at the time of field visit & primary, secondary data collection and one month in general). For delay beyond three months or part thereof, KEA is entitled to impose a penalty. Extension of time is the sole discretion of KEA, which may be granted on examining the documentary evidence submitted by the Consultant.

    (i) If the Consultant does not submit the Inception Report within stipulated time period, the work contract shall be cancelled after two extensions of one week each time by KEA.

    (ii) If there is a delay in the submission of draft evaluation report within the prescribed time to KEA, 10% of the entire contract amount shall be paid as penalty for every month of delay up to three months. Beyond three months, KEA will decide the

    further course of action either to extend the time with penalty or terminate the contract whatever is in the best interest of the Government. If KEA decides to terminate the contract, it reserves the right to engage any other Consultant at the risk and cost of the Second Party. Amounts payable to the Second Party shall be kept on hold for an indefinite period of time.

    (iii) If the Second Party does not submit final evaluation report to KEA, (after the period mentioned 9 (c) (ii), penalty has to be paid at the rate of 10% on the balance payable amount for every month of delay. Beyond three months of delay, KEA may terminate the contract and engage any other Consultant to complete the tasks at the risk and cost of the Second Party. Amounts payable to the Second Party shall be kept on hold for an indefinite period of time.

    (iv) If KEA reject the reports at any stage in the process of evaluation, the Contract agreement shall be cancelled and the Consultant is not eligible for any payment. If payment is already made, the same will be recovered from the Consultant. Study will be re-tendered at the risk and cost of the Second Party.

    c. If it is found any time that the Consultant: i) secured this evaluation work by misrepresentation of facts or by

    deceit; or ii) has engaged in corrupt, fraudulent, collusive, coercive or

    obstructive practices at any time; or iii) has indulged in malpractices such as plagiarism; or iv) Committed any illegalities which may attract criminal liability; The agreement shall be cancelled forthwith after giving a notice in writing and giving an opportunity of being heard. If the charge is proved, all payments due to the Consultant shall be kept on hold and legal action under the relevant laws shall be initiated by KEA.

    10. Amendment(s) or termination of this agreement: This agreement may be amended or terminated under the following circumstances: a. Both the parties to the agreement, by mutual consent, may modify the

    terms of agreement appropriately at any time. b. In the case of the Government of Karnataka making any rule or issuing

    any direction that is in disagreement with any of the terms of this

    agreement, the said change will be deemed to have been incorporated in the agreement from the date on which the said rule or direction came into effect, though such amendment in writing is not available.

    c. All directions given by the KEA or its authorized representatives/ Committee members involved in the processes described before, shall have the same effect as a clause of this agreement which the concerned party to the agreement will have to abide with within the time period prescribed, though a formal written supplementary agreement on such directions is not available.

    d. The KEA may terminate the agreement in accordance with Clause 9 above.

    11. Grievance Redressal Mechanism a. If any party is aggrieved by any direction or order of KEA, he / she/they

    shall try and sort out the matter amicably by mutual consultation. If the matter could not be resolved, then the same shall be submitted in writing and a notice to this effect shall be served on the other parties as soon as possible. The other parties shall consider such a notice and make every effort for removing the difficulties. If it could not be so resolved, then the aggrieved party may appeal to the Addl. Chief Secretary/Principal Secretary/Secretary, Planning, Programme Monitoring and Statistics Department of the Government of Karnataka, whose decision in the matter will be final and binding on both parties.

    b. If any law suits arise on account of this agreement, it shall be governed by and construed in accordance with the laws of India and shall be subject to the exclusive jurisdiction of the Courts in Bengaluru, India.

    12. Miscellany a. No party to this agreement shall be liable for any failure or delay in

    performance under this agreement, caused by any natural calamity, strike, bandh, lockout, curfew, riot, fire, sabotage, etc., provided that the party affected by such an event had taken all reasonable precautions, due care and reasonable alternative measures, with the objective of carrying out the terms and conditions of this agreement.

    b. A party affected by an event of force majeure shall give the other parties a written notice as soon as possible, with full details, and in any event not later than five calendar days of the occurrence of the cause relied upon. In the event of a force majeure, the dates by which performance obligations are scheduled to be met, shall be extended suitably. The Consultant shall be entitled to proportionate payment for the value of work done, in case force majeure leads to termination of the project.

    c. Any action taken by the KEA under this agreement to protect the public and government interest shall stand fully indemnified and he / she/it shall not be liable personally to pay any compensation or face criminal action even if the Consultant is entitled to launch such proceedings. Any appeal in this regard shall lie with the Addl. Chief Secretary/Principal Secretary/Secretary to Government of the Administrative Secretariat concerned and his / her decision shall be final and binding on the Consultant.

    d. If any dues remain irrecoverable after exhausting all the avenues available under this agreement, the same shall be recovered as arrears of land revenue as in the Karnataka Land Revenue Act, 1964 and rules there under, from the Consultant or the individual heading the Organization, at the time the money becomes due.

    e. Any notice intended to be served for legal purpose shall be in writing and shall be served on the persons mentioned below under acknowledgement. No cognizance shall be taken of any notice served otherwise. i. For and on behalf of KEA:

    Chief Evaluation Officer, Karnataka Evaluation Authority, Room No.542, M S Building, Dr. B R Ambedkar Veedhi, Bangalore-560 001.

    ii. For and on behalf of the Consultant:

    f. The Parties to this agreement will stand discharged from the obligations

    of this agreement on the occurrence of any of the following events- i. Full and final discharge after completing the tasks envisaged under

    this agreement and after submitting the audited statement of accounts, if so, required by this agreement;

    ii. On mutual agreement to terminate; iii. On termination of the agreement by the Authority in accordance with

    SECTION-V This Section is only for Reference

    CRITERIA FOR EVALUATION OF PROPOSALS

    1. Proposals submitted will be evaluated based on three important criteria as

    under: a. Technical competence of the team (100 points) b. Ability to articulate key issues of the study, methodology proposed, work

    plan and the arrangements for the study (200 points) c. Financial prudence in appropriately quoting for the study.

    2. Parts (a) and (b) above will be having a combined weightage of 80% in the

    score and the financial proposal will have 20% weightage. Thus, each Consultant will be assigned a score on a scale of 100. Interested Consultants must familiarize themselves with the details and ensure submission of enough information to facilitate TEC on awarding scores to all items listed.

    Only those Consultant Evaluation Organizations which are not

    empanelled with KEA have to submit Part-I of the Technical Proposal. In case they score 50% of the marks or above, their technical and financial proposals will be considered. The scores obtained in Part-I is only of qualifying nature and will not be used in evaluating their proposal. Consultants empanelled with KEA need not submit Part-I.

    3. Written Technical Proposal in Part -II (A) will be evaluated for 100

    points for all Empanelled and Non-Empanelled participating Consultants. It will be followed by a presentation on criteria set out in Part -II (B) which will be evaluated for 200 points. The total number of points obtained from the technical appraisal process (Parts I and II combined) will be reduced to a scale of 80, from the scale of 300. All Consultants scoring 60% and above in Part-II A and also in Part-II B respectively will be qualified to participate in the financial bidding. Single tender will be rejected as a rule, though
