Chairman Michael San Nicolas: The hearing will now continue on bill number 141-32. I would like to invite Senator Morrison to go ahead and make his opening statement on the bilL
Senator Tommy Morrison: Thank You Mr. Chair. I'd like to first thank Senator Tom Ada for the work that he has done on this issue and for graciously allowing me to introduce this version of the bilL with his suggested renmm1endations. I also want to thank him f(Jr heing a co-sponsor of this bilL He has done Jots of work into this. Before the enactment of Public Law 29-91, in July 18, 2008, full face tinting uf windshields was legal on Guam. While this was great t(Jr heat m1tigation, it was a serious safety problem for night time driving. It was a problem for night walking too, especially smce pedestrians were at risk f(lf getting hit hy vehicles with darkly tinted windsluelds. The reason f(1r the changes proposed m Bill 141-32 is that there are auto window films that are essentially clear and are effective at reducing the amount of ultraviOlet rays that enter through the windshield without hmdering visibility. Applymg these tilms to windshields [s
currently illegaL Quite simply, Bill 141 would allow for commumty use. Thank you.

l\1r. Joe Roberto: CJood morning. Senators. I am in full support of this bill and what I brought an.: actual samples. I want to let the Senators actually see the product. This product is one of several di ffcrent types oflilm that manuf~H.:turcrs make. By virtue of the word clear, it"s just like how you are looking at me right now. That film. through technology, cuts out lots of heat. That is why 1 have stressed to Senators in the past that technology allows so much heat to be reduced and makes you more comf(ntablc in your car. given the huge investment that it is. I gave Senators MotTison a Oyer earlier about a seminar that is happening with the Chamber [of Commerce] this atlernoon. I have here, a picture of the sun. This sun, at I OOtYo, is coming through your windshield right now as you drive through Guam. That product right there will take away one-third of what you feeL There are tllms out there that, through technology, can cut the heat right in half Jt is out there and it exists. Again. we can bring it in but it costs. It does exist. ('an you imagine ho\v much you will be saving in fuel'! By not letting that amount of heat, you will he able h) reduce the demand in your vehicle \Vith your air conditioner. \Vhen you do not let that compressor work as hard, you are going to use less fuel. J _et's just not talk about your car. hut your home or building, 'l'hc amount of heat entering your building, home, or car ... if you reduce that amount It allows you to save more on power and fueL \Ve're talking about GPA and the savings they \.Viii have. Everyone today is thinking about the green dream and that's what this is about. As written, I am in full support of Bill 141.

Senator l\tlorrison: I just want to thank you for participating in this process and educating us on this new technology. J know that you have been working closely with Senator Tom Ada. It was .:oincidental that we were trying to do the same thing. It worked ou1 in the end and we were able to put together this measure. I'm not sure in which jurisdictions these are being applied at this time. Are these already being commercially used'!

Senator Michael Limtiaco: The only question I have is in regards to the military bases. Are they allowed on the bases? I do know that the bases have strict requirements ror the tinting of the windows.
Mr. Roberto: With this product, no.
Senator Umtiaco: This will not be allowed on base.

Senator Limtiaco: Okay. In regards to the specification in the hill about the VLT at 60%,, that is not proprietary, is it? That same speciflcation is availahk t)n any manuf~1cturer of tint'!
"'lr. Roberto: Most manut~tcturcrs in the world make VI T tfom as low as 3?/(J to as high as 90(~/0.

]\~Jr. Roberto: Visible light transmittance, which is the amount of light alltn:ved to pass through the film. That's why, on that tag, it says perfect 75, That is the amount of llght allowed to pass through the film. The opposite is true in which 25 is blocked.

Senator Tom Ada: I want to say that I first became interested in this clear film fur the windshield hecause ~1r. Roberto had a demonstration table set up at the recent sustainahility conference. He had a demonstration, and you could tCel for yourself the amount of heat that was filtered out by this film. I just wam to dear. j()r the record. that arc laws do not a!Jo\Y any film lo he put on the \\;indshicld primarily because the hnv enforcement people want to make sure th;:!t they can ~ec imo the vehicle, more so than for their saiCty. Also, the saiCty of the motorist.,, not impairing :heir ability to see througJL \Vhat this hill does is acknowledges the advances in the technology with respect to clear film. The une question I have: I believe that the law now prescribes that your windshid(L whether it is fltctory made. must allnw a certain percentage t)f light to come through.
1\'lr. Roberto: Correct As it is written, it allows me to hlock as much as 40°/()-50°/Q.
Senator Ada: Okay. With this clear l!lm technology, it will unly block ouL

Senator Ada: 25%. So, it is still within the requin:ments'"

Senator Ada: Is this dear film in compliance with DOT requirements'?
Mr, Roberto: I have not read up on any DOT requirements.
Senator Ada: In terms or how much light it allows through, there is a DOT requirement, correct'!
Mr. Roberto: For the Department ofTnmspmtation, what I do know, relative to vehicles, is the way glass has to he made. The side windows have to he tempered glass and the !font windshield must be laminated glass. That lamination is het\veen two pieces of glass. On every vehide out there right now, there is already a film between two pieces of glass. Also, the back glass has to he tempered. As il1r as something retrofitted or something applied after solid glass hy itself I have not read up on anything in that regard.
Senator Ada: 1 don't have any other questions.

By turning ofT the lights, you arc that much more power. By saving more power, you are saving mnre fud and money. Now. because you have it covered is because of all the heat
especially in the afternoon that comes through there. Can you imagine a film that \Vas to block out a bow 75(~/;)-9()~/o iJfthat heat'! Open the blinds, don't let the heat in and turn off the lights. The air conditioning that we're lCcling will fed the exact same way, therd(m; saving th<!t much more po\ver and money Actually. the compressor, when reaching a certain temperature, automatically shuts off \Vith reducing 1he amount of heat into a room or a car. it shuts off that much f~tstcr. l'lwt's \Vhat this is all about vvith wirH..hnv film saving power. saving money and saving fuel.

Section I. Legislative Findings and Intent. I Liheslaturan Guiihan finds that a
preeminent reason the authors sponsored Public Law 29-91 was to ensure that the
night vision of drivers was not impaired by dark window tint on the 1hmt
5 windshield. Public Law 29-9 L enacted a restriction on fl·ont windshield
6 tinting/glazing that did not allow any tinting or glazing material to extend below l\
7 inches fron1 the top of the front \Vindshield.
g I Liheslatura/ilrther finds that since l!V rays are the primary factor fi·om sunlight
•J that raises the internal temperature of the passenger compartments of motor

( ii) Privacy drapes, curtains or blinds, or any combination, installed on the
interior of motor vehicles while parked and nnt being operated on a public

light ravs and still penn its a VLT of60% (+ 5%).

II If the proposed legislation becomes law, there is a potential negative Impact on funding going towards the Judicial Building Fund. The proposed legislation is an amendment tllat would allow transparent sun screening film materials to be applied to the entire windshield of a motor vehicle provided that the sun screening nlm permits a visible light transmittance (VLT) of 60%. Subsection (C) of Title Hi GCA, Article 2, Chapter 3, Section 3209 currently states that transparent sun screening film materials can be instaUed, aff'ued, or applied along the top edge of the windshield so long as such materials measure no lower than eight {8) inches below the top of the windshield. Violators of subsection (C) are subject to a fine of no les.< than Fifty Dollars ($50) and no more than Two Hundred Hfty Dollars ($25tl) for each separate offense. Assuming that there are two to four citations per year for non-compliance to this legislative measure, the Bureau estimates that no less than $100 (lowest potential revenue for two citations) and no more than $1,000 (highest potential revenue for four citations) of potential revenues will not be received by the Judiciary's .Judicial Building f'und.
