III. THE ADJUSTED ON LOSS/DAMAGE & COMPENSATION

This is based on Ship-owner, The Cargo Insurance & "Buyer/ Receiver” have considered on the

settlement of this case.

The seller is not responsible for this matter.

IV. OPINION

Basing on the official results of our inspection, and refer to the relative document, we are of the

opinion that the damages to the above mentioned cargo happened in the ship’s holds during the

discharge at Hai Phong port, Vietnam due to the following causes:

• The sweep ing cargoes were s l ight ly s ta ined at due to Ho ld s s l i gh t ru s t ed .

• Dunnage materials were not applied for segregation of the cargo from ship’s holds

construction.

GENERAL VIEW OF CRANE NO.2 AFTER HOISTING WIRE DAMAGES NOTED:- THE CRANE APPEARED IN SOUND CONDITION

4.4 In accordance with 4.3, we found the No.1 and No.2 crane hoisting wires had suffered

excessive ‘jags’ and strand‘ break up’. This condition is certainly indicative of mishandling/

carelessness with generally appears to be numerous scraping by all appearances that hardly

frequent come into contact with hatch coamings by the crane operator during discharging

operation.

3.1 All of equipment and devices were damaged by mechanics without damages/loss effected

due to due to water, chemical on these equipment & devices.

3.2 The entire remaining of this equipment & devices were in normal condition.
