NEW DELHI, Aug 8: The Supreme Court today agreed to hear the interim bail plea of Vikas Yadav, who is serving a 25-year jail term for murder of Nitish Katara in 2002, on the ground that he has to ful- fil his business obligations. A bench of justices Dipak Misra and C Nagappan said the appeal against Delhi High Court order awarding 25 years jail to him without any remission may be listed for August 29. Senior advocate U R Lalit appearing for Yadav, son of for- mer MP D P Yadav, said the application for interim bail has been moved as he has already undergone over 14 years of sen- tence. He sought time from the court for detailed hearing of the appeal against the sentence awarded to Yadav by the High Court. The bench then posted the matter for further hearing after senior counsel Dayan Krishnan, appearing for Delhi government, did not opposed the request for additional time for hearing on the matter. The people from Karkitchoo alleged that the peo- ple of Latoo have occupied their land and they will not allow lay- ing down of the water pipes at Latoo unless the territorial and other disputes between the two villages were resolved by the administration. The people of two villages also clashed leading to injuries to four of them. (PTI) No separate Rly Div for Jammu Closure report in Maneka's case to be considered on Sept 26 NEW DELHI, Aug 8: A Special Court has fixed September 26 to consider a CBI report favouring closure of a case lodged against Union Minister Maneka Gandhi and two others for sanctioning Rs 50 lakh grant to a trust allegedly in a "fraudulent" manner in 2001. The court had earlier refused to accepted the closure filed by the probe agency in the case in 2008 and had asked the CBI to further investigate the matter. However, the CBI had again approached the court saying "alle- gations levelled against Gandhi and two others could not be substantiat- ed". Senior BJP leader Maneka Gandhi is now the Women and Child Development Minister. An FIR was lodged by CBI in 2006 against Maneka Gandhi, Dr F U Siddiqui, former secretary of Maulana Azad Education Foundation (MAEF) and Dr Vijay Sharma, former Managing Trustee of Gandhi Rural Welfare Trust (GRWT). The FIR alleged that Maneka, in conspiracy with Siddiqui, had sanc- tioned a grant of Rs 50 lakh to GRWT from MAEF in an irregular manner to construct a nursing col- lege building at Pilibhit in Uttar Pradesh and caused undue favour to Sharma. CBI alleged that further an amount of Rs 10.40 lakh was sanc- tioned to GRWT by S K Verma, the then District Magistrate of Pilibhit, from Maneka's MPLADS (Members of Parliament Local Area Development Scheme) funds for purchase of two ambulances and the fund was released to Ramakant Rampal, the Managing Trustee of GRWT. It had alleged that Rampal had purchased two jeeps which had cost much less than the approved models and failed to get them certified by the chief medical officer. The vehi- cles were also used for personal works by the managing trustee. The agency, however, again filed a closure report, saying "during the course of further investigation, the allegations levelled against Maneka Gandhi, Dr F U Siddiqui and Dr Vijay Sharma could not be substantiated." "It is, therefore, prayed that the closure report dated December 30, 2008, collectively read with this report, may kindly be accepted," it said. The FIR in the case was lodged for the alleged offences under sec- tion 120-B (criminal conspiracy) read with section 420 (cheating) of the IPC and under relevant provi- sions of the Prevention of Corruption Act. In its closure report, CBI said that the trust had purchased two jeeps with ambulance fixtures on September 15, 2003 for Rs 9,85,008, while the balance amount was returned to the government exchequer as per the terms of sanc- tion. "As such no financial irregulari- ty could be pointed out in the matter of purchase of ambulances and the change in vehicle model was found to be on justified grounds," it said. "Investigation further revealed that the DM, Pilibhit, approved pur- chase of two Mahindra Voyager ambulances. Inspecting railway infrastruc-ture, including tracks, buildingsand level crossings, Prakash saidall 312 unmanned railway cross-ings in the division would be elim-inated in a phased manner withinthree years.

“From 357, the number ofunmanned crossings has decreasedto 312 and out of these 89 will beeliminated by March 31 next”, hesaid.

He said there was a 2 per centincrease in freight this year com-pared to the previous year.

On the proposal to lay a new

25.47 km long Patti-Firozpur raillink, he said it would soon be sanc-tioned by the Ministry of Railways.

With this proposed track, thedistance between Northern Stateswith Punjab and trade capitals ofGujarat and Maharashtra will getconsiderably reduced.

On the Udhampur-Srinagar-Baramula rail link project, he saidthat the work was halted becauseof law and order issue in Jammuand Kashmir.

“Our tracks had been damagedthere and the work, which wasalready going behind schedule,was getting further delayed”, hesaid. (PTI)

Closure report in Maneka's caseto be considered on Sept 26

NEW DELHI, Aug 8:

A Special Court has fixedSeptember 26 to consider a CBIreport favouring closure of a caselodged against Union MinisterManeka Gandhi and two others forsanctioning Rs 50 lakh grant to atrust allegedly in a "fraudulent"manner in 2001.

The court had earlier refused toaccepted the closure filed by theprobe agency in the case in 2008and had asked the CBI to furtherinvestigate the matter.

However, the CBI had againapproached the court saying "alle-gations levelled against Gandhi andtwo others could not be substantiat-ed".

Senior BJP leader ManekaGandhi is now the Women andChild Development Minister.

An FIR was lodged by CBI in2006 against Maneka Gandhi, Dr FU Siddiqui, former secretary ofMaulana Azad EducationFoundation (MAEF) and Dr VijaySharma, former Managing Trusteeof Gandhi Rural Welfare Trust(GRWT).

The FIR alleged that Maneka, inconspiracy with Siddiqui, had sanc-tioned a grant of Rs 50 lakh toGRWT from MAEF in an irregularmanner to construct a nursing col-lege building at Pilibhit in UttarPradesh and caused undue favour toSharma.

CBI alleged that further anamount of Rs 10.40 lakh was sanc-tioned to GRWT by S K Verma, thethen District Magistrate of Pilibhit,from Maneka's MPLADS(Members of Parliament Local AreaDevelopment Scheme) funds forpurchase of two ambulances and thefund was released to RamakantRampal, the Managing Trustee of

GRWT.It had alleged that Rampal had

purchased two jeeps which had costmuch less than the approved modelsand failed to get them certified bythe chief medical officer. The vehi-cles were also used for personalworks by the managing trustee.

The agency, however, againfiled a closure report, saying "duringthe course of further investigation,the allegations levelled againstManeka Gandhi, Dr F U Siddiquiand Dr Vijay Sharma could not besubstantiated."

"It is, therefore, prayed that theclosure report dated December 30,2008, collectively read with thisreport, may kindly be accepted," itsaid.

The FIR in the case was lodgedfor the alleged offences under sec-tion 120-B (criminal conspiracy)read with section 420 (cheating) ofthe IPC and under relevant provi-sions of the Prevention ofCorruption Act.

In its closure report, CBI saidthat the trust had purchased twojeeps with ambulance fixtures onSeptember 15, 2003 for Rs9,85,008, while the balance amountwas returned to the governmentexchequer as per the terms of sanc-tion.

"As such no financial irregulari-ty could be pointed out in the matterof purchase of ambulances and thechange in vehicle model was foundto be on justified grounds," it said.

"Investigation further revealedthat the DM, Pilibhit, approved pur-chase of two Mahindra Voyagerambulances. A cheque dated July27, 2003 amounting to Rs 10.40lakh was received by GRWT forpurchase of Mahindra ambulancesAC Euro-II.(PTI)
