We act on behalf of Thomas Dennis and seek to apply for a planning permit to use and development the land located at 37A Rose neath Road, Warncoort for the purpose of a licensed café. At this time, we also seek to apply for a planning permit to display business identification signage and to construct a rural store. Item Comments Attachment Management on the subject site: Existing Condition - Two thirds of the 60acre site slopes to the north into 25,000m3 dam abutting the M-1 Princes Highway. The homestead and accommodation precinct are located on the north slope and drain to this dam.

- The dam was constructed by VicRoads contractors during the duplication of the road. The dam was constructed to VicRoads specifications, including draining to the legal point of discharge into the highway table drain.

Proposed conditions - Stormwater runoff would be moved via open spoon/table drains alongside accessways. A design that encompasses the buildings, courtyard, drop off zone and parking will provide for flows of runoff that includes 3 pit and culvert crossings to direct the water in

Café capacity The café is to accommodate a total of 85 guests, this includes both indoor and outdoor seating.

The site area, table and chairs have been clearly indicated on the architectural plans.

Liquor Licence We recognise that the purpose of this clause in the planning scheme is to ensure that the licensed premises are situated in appropriate locations and that the impact of the licensed premises on

We note that a permit is required to use land to sell or consume liquor if a licence is required under the Liquor Control Reform Act 1998.

We understand that a licensed 'red line plan' is required to be provided showing the area where all liquor will be stored, sold and consumed on the premises. This must also include all areas where liquor is carried from inside to outside seating areas. We understand that the VCGLR guidance advises that licensees must ensure tables and chairs are available for at least 75 per cent of patrons attending the premises at any onetime. The licensee must not permit the live performance of music or the playing of recorded music on the premises at higher than background level at any time outside ordinary trading hours.

The application is limited to café use only as such all patrons will be provided with tables and chairs. All music played at the cafe will be background music only. No music will be played louder than background level without the prior written consent from Council.

Signage All vvayfinding signage is to be located internally and will not be visible from the road or neighbouring properties. Details of the location of signage is included on the architectural plans.

The proposed business identification sign will be located at the entrance of the property from Princes Highway. The sign will not have an area greater than 3m2.

Item Comments Attachment Car Parking In accordance with Clause 52.06 a total of 34 car parking spaces are to be provided. This figure is based on 85 guests in the cafe.

Car parking is to be Provided to service the proposed café use. Numbering of car parking spaces has been included on architectural plans. A Traffic and Parking Impact Assessment has been prepared to accompany the application.

Landscaping A landscaping plan has been prepared to include the following:

a. Details of surface finishes of pathways and driveways.

b. A planting schedule of all proposed trees, shrubs and ground covers, including botanicals names, common names, sizes at planting and maturity, and quantities of each plants.

c. Landscaping and planting within open areas

d. Landscaping has also been included car parking area.

We consider that all species selected support Council's preferred species list.

Application Fee We seek to advise Council that this application is being made, as it has been brought to our attention that Planning Permit PP241/2019-1 has lapsed. This is a result of our response to Council's further information request being submitted on Friday 3 April 2020, and in accordance with Council's letter dated 28 January 2020, this information was required to be lodged on or by 1 April 2020.

This was an error on our behalf and as such we are now submitting a new planning permit application.

In light of the current circumstances, in particular the economic pressures that COVID-19 has placed on the economy and the current working situation for all involved, we request that the planning permit application fee for this new application is waived. Essentially the application fee paid for PP241/2019-1 would be rolled over to this new application.
