1. Introduction This technical guideline provides permitting and licensing requirements for transportation,

treatment and recycling facilities. The waste management permitting or licensing does not

allow the entity to operate the facility unless all relevant permits or licenses from other

authorities are obtained like, vehicle registration with UAE traffic department,

Environmental Permit from Environmental Agency Abu Dhabi (EAD), Industrial License

from Industrial Development Bureau (IDB) etc.

2. Requirements

2.1 Legal Requirements

Listed below are the main legislative requirements related to the hazardous waste within

the Abu Dhabi Emirate. All the requirements listed within these documents shall be

adhered to, however compliance with this document and those referenced within, shall

ensure compliance with the requirements stated within the legal standards listed below:

(i) Federal Cabinet Resolution No. (39) of 2006 on Banning the Import and

Production of Asbestos;

(ii) Federal Law No (24) for the year 1999 on the Protection and the Development

of the Environment;

(iii) Federal Law No. (28) of 2001 Regarding the Establishment of the emirates

authority for standards and Meteorology;

(iv) Federal Regulation for Handling Hazardous Materials, Hazardous Wastes and

Medical Wastes, issued by Cabinet Decree No. 37 of 2001;

(v) Law No (21) for the year 2005 on Waste Management in the Emirate of Abu

Dhabi;

(vi) Decree 2G24 of 2009 for Tariff System of the Waste in the Emirates of Abu

Dhabi;

(vii) Centre of Waste Management Board of Directors Decree No 1/2010 for Waste

Tracking System;

(viii) Decree No 17 of 2008 Establishing the Centre of Waste Management – Abu

Dhabi;

(ix) Decree No 42 of 2009 Requirements of the Abu Dhabi Emirate Environment,

Health and Safety Management System (EHSMS) Regulatory Framework;

(x) The Trade Effluent Control Regulations, 2010; and

(xi) Basel Convention Protocol for Liability and Compensation on the Control of

Transboundry Movement of Hazardous Wastes and their Disposal (Texts and

Annexes).

(xii) Recycled Water and Bio-solids Regulations 2010.

2.2 Permits and Licensing

Listed are the specific licensing and permitting requirements relevant to this technical

guideline. The Waste Generator is required to ensure that all licensing and permitting

requirements have been complied prior to commence any work.

a) Hazardous waste carriers / transporter:

(i) To be approved by CWM-AD.

b) Hazardous waste Facilities:

(i) To be approved by CWM-AD.

c) Testing Facilities:

(i) All testing facility shall be approved for the purpose (Scope of accreditation)

by Emirates Standardization and Metrology (ESMA) Authority.

3. Permits and Licensing Requirements for Transportation, Treatment and Disposal Facility

(I). This technical Guideline explains the licensing and permitting of transportation,

treatment and disposal facility & submission of request or application in the Emirate

of Abu Dhabi through the following CWM Customer Service offices:

1. This technical guidelines shall be applicable for Permits & Licensing of the

following:

A. Waste Transportation Permit

B. Waste Treatment Facility Permit

C. Waste Recycling Facility Permit

2. Registered Service Provider shall submit application along with all legal,

administrative and technical documents to the Center of Waste management-Abu

Dhabi through at any of the above mentioned offices in table 1.

3. Registered Service Provider shall submit the following technical documents along

with the legal and administrative documents & application:

A. Waste Transportation Permit

a. Emergency Plan in case of Hazardous & Medical Waste transportation only

b. Training Certificate of Driver & Operator by 3rd Party approved by AD EHS

Center

c. Lifting Equipment Test certificate by approved 3rd Party in case of Waste

transportation vehicle equipped with lifting device.

d. Vehicle Fitness certificate by AD Police.

e. EHSMS Registration in case of Nominated Entity by SRA.

f. Waste Transportation ESP application for renewal will only be considered if the

ESP has regularly submitted ‘Monthly ESP Register’ and ‘Manifestation’.

New Waste treatment & recycling facility licensing shall involve following 3 stages:

1. Initial Permitting based on technological assessment;

2. Onsite assessment before commissioning to ensure conformity to what has

been permitted as ‘Initial Permit’, if need be CWM may ask for Certificate of

Conformity (CoC); and

3. Final Permit for operation based on test certificates of waste (before and

after) and other technical documents as required including calibration

certificate, AD Civil Defence approval, wastewater discharge consent,

Environment Permit from EAD, Industrial License from IDB, etc.

3.1 Waste Transportation Permit Requirements 1. RSP shall comply with CWM Technical Guideline No. 1, 2 & 3 for Hazardous and

Medical Waste Transportation vehicle.

2. RSP shall comply with CWM Technical Guideline No. 9 for Waste Transportation

Vehicle and GPS Requirements.

3. Mechanism for permits and licensing shall be complied as specified in Annexure 1

& 2 for new & renew, respectively.

4. Application template for waste transportation vehicle shall be used as specified in

Annexure 7.

3.2 Waste Treatment Facility Permit Requirements


& 4 for new & renew, respectively;

2. The application for new treatment facility will be subject to a detailed technical

evaluation of the technology of waste treatment;

3. Renewal applications will only be considered if detailed record of monthly

submission of waste manifestation / treated waste laboratory analysis, calibration

certificates is submitted;

4. Application template for waste treatment facility shall be used as specified in

Annexure 8.

3.3 Waste Recycling Facility Permit Requirements


& 6 for new & renew, respectively.

2. Renewal applications will only be considered if detailed record of monthly

submission of waste manifestation / treated waste laboratory analysis, calibration

certificates is submitted.

3. Application template for waste recycling facility shall be used as specified in

Annexure 9.
