CUSTOMS CONVENTION ON THE TEMPORARY IMPORTATION FOR PRIVATEUSE OF AIRCRAFT AND PLEASURE BOATS

PREAMBLE

The Contracting Parties,

Having regard to the Agreement providingfor the Provisional Application of the DraftInternational Customs Conventions on Tour-ing, on Commercial Road Vehicles and on theInternational Transport of Goods by Road,done at Geneva on 16 June 1949, and in par-ticular, to article V of the Agreement, whichprovides that in the event that world-wide con-ventions dealing with the subject matter of thedraft conventions provisionally applied by theAgreement "should be concluded, and upontheir entry into force, any Government partyto this Agreement, which becomes a party toone or more of those Conventions shall auto-matically be regarded as having denounced thepresent Agreement with respect to the DraftConvention or Conventions corresponding toany of those Conventions to which that Gov-ernment has become a party" ;

Having regard to the Convention concern-ing Customs Facilities for Touring and theCustoms Convention on the Temporary Im-portation of Private Road Vehicles, both doneat New York on 4 June 1954;

Considering that unlike the Draft Inter-national Customs Convention on Touringbrought into provisional application by theAgreement of 16 June 1949, the said Con-ventions contain no provision concerning tem-porary duty-free importation of aircraft andpleasure boats other than kayaks and canoesin use and under 5.5 metres in length;

Desiring to facilitate the development of in-ternational touring by means of aircraft andpleasure boats ;

Have agreed as follows:

CHAPTER I

DEFINITIONS

Article 1

For the purpose of this Convention :

(а) The term "import duties and importtaxes" shall mean not only Customs duties butalso all duties and taxes whatever chargeableby reason of importation ;

(б) The term "boats" shall mean all pleas-ure boats and pleasure vessels with or withoutengines together with their spare parts, andtheir normal accessories and equipment whenimported with the boats or vessels ;

(c) The term "aircraft" shall mean all air-craft with or without engines together withtheir spare parts and their normal accessoriesand equipment when imported with the air-craft ;

The term "private use" shall mean theuse of aircraft or boats, by their owners or bypersons who have possession or control ofthem, whether on hire or otherwise, for non-commercial purposes and, in particular, forpurposes other than the transport of personsfor remuneration, reward or other considera-tion or the industrial and commercial trans-port of goods with or without remuneration;

(e) The term "temporary importationpapers" shall mean the Customs documentidentifying the aircraft or boat and providing

Les parties contractantes,

Considérant l'Accord relatif à l'applicationprovisoire des Projets de Conventions interna-tionales douanières sur le tourisme, sur lesvéhicules routiers commerciaux et sur le trans-port international des marchandises par laroute, en date, à Genève, du 16 juin 1949 et,en particulier, l'article V de cet accord qui pré-voit que, dans le cas où des conventions mon-diales traitant des matières qui font l'objet desProjets de Conventions mis en application pro-visoire par l'Accord "viendraient à être con-clues, et à dater du jour de leur entrée envigueur, tout gouvernement partie à l'Accord,qui deviendrait partie à l'une ou à l'autre deces conventions, sera ipso facto censé avoir dé-noncé le présent Accord en ce qui concernele ou les Projets de Conventions correspondantà la convention ou aux conventions auxquellesil sera devenu partie" ;

Considérant la Convention sur les facilitésdouanières en faveur du tourisme et la Con-vention douanière relative à l'importation tem-poraire des véhicules routiers privés, toutesdeux en date, à New-York, du 4 juin 1954;

Considérant que, contrairement au Projet deConvention internationale douanière sur letourisme, mis en application provisoire parl'Accord du 16 juin 1949, lesdites conventionsne contiennent aucune disposition relative àl'importation en franchise temporaire desaéronefs et des embarcations de plaisanceautres que les kayaks et les canoës en coursd'usage d'une longueur inférieure à 5, 5 m ;

Désireuses de faciliter le développement dutourisme international au moyen d'embarca-tions de plaisance et d'aéronefs ;

Sont convenues de ce qui suit:

CHAPITRE PREMIER

DÉFINITIONS

Article premier

Aux fins de la présente Convention, on en-tend:

а) Par "droits et taxes d'entrée", non seule-ment les droits de douane, mais aussi tousdroits et taxes quelconques exigibles du fait del'importation ;

б) Par "embarcations", tous bateaux deplaisance et embarcations de plaisance, avec ousans moteur ainsi que leurs pièces de rechange,leurs accessoires normaux et leur équipementnormal importés avec ces embarcations;

c) Par "aéronefs", tous aéronefs avec ousans moteur ainsi que leurs pièces de rechange,leurs accessoires normaux et leur équipementnormal importés avec ces aéronefs ;

d) Par "usage privé", l'utilisation d'unaéronef ou d'une embarcation, par le proprié-taire ou la personne qui en a la jouissance enlocation ou à tout autre titre, à des fins autresque commerciales et, en particulier, autres quele transport de personnes moyennant rémuné-ration, prime ou autre avantage matériel et letransport industriel et commercial de marchan-dises avec ou sans rémunération;

e) Par "titre d'importation temporaire", ledocument douanier permettant d'identifierl'embarcation ou l'aéronef et de constater la

(/) The term "persons" shall mean bothnatural and legal persons unless the contextotherwise requires.

CHAPTER II

TEMPORARY IMPORTATION WITHOUT PAYMENTOF IMPORT DUTIES AND IMPORT TAXES AND FREEOF IMPORT PROHIBITIONS AND RESTRICTIONS

Article 2

1. Each of the Contracting Parties shallgrant temporary admission without paymentof import duties and import taxes and free ofimport prohibitions and restrictions, subjectto re-exportation and to the other conditionslaid down in this Convention, to aircraft andboats owned by persons normally resident out-side its territory which are imported and util-ized, for their private use on the occasion ofa temporary visit, either by the owners of theaircraft or boats or by other persons normallyresident outside its territory.

2. Such aircraft and boats shall be coveredby temporary importation papers guarantee-ing payment of import duties and import taxes,and if the case should arise, of any Customspenalties incurred, subject to the special pro-vision of paragraph 4 of article 27.

Article 3

The fuel contained in the supply tanks ofaircraft and boats temporarily imported shallbe admitted without payment of import dutiesand import taxes and free of import prohibi-tions and restrictions, provided that the supplytanks are of normal capacity, are located in theusual places and are connected to the engine,it being understood that the fuel contained in

these tanks is intended exclusively for con-sumption by the aircraft or boat.

Article 41. Component parts imported for the repair

of a particular aircraft or boat already tem-porarily imported shall be admitted temporar-ily without payment of import duties and im-port taxes and free of import prohibitions andrestrictions. Contracting Parties may requirethese parts to be covered by temporary im-portation papers.

2. Replaced parts which are not re-exportedshall be liable to import duties and importtaxes except where, in conformity with theregulations of the country concerned, theymay be abandoned free of all expense to theExchequer or destroyed, under official super-vision, at the expense of the parties concerned.

Article 5

Temporary importation papers sent to as-sociations authorized to issue the papers inquestion by the corresponding foreign asso-ciations, by international organizations or bythe Customs authorities of the ContractingParties, shall be admitted without payment ofimport duties and import taxes and free of im-port prohibitions and restrictions.

CHAPTER ш

ISSUE OF TEMPORARY IMPORTATION PAPERS

Article 6

1. Subject to such guarantees and undersuch conditions as it may determine, each Con-tracting Party may authorize associations, suchas those affiliated to an international organiza-tion, to issue either directly or through corre-sponding associations the temporary importa-tion papers covered by this Convention.

CHAPITRE II

IMPORTATION TEMPORAIRE EN FRANCHISE DESDROITS ET TAXES D'ENTRÉE ET SANS PROHI-BITIONS NI RESTRICTIONS D'IMPORTATION

Article 2

1. Chacune des parties contractantes admet-tra temporairement en franchise des droits ettaxes d'entrée, sans prohibitions ni restrictionsd'importation, à charge de réexportation etsous les autres conditions prévues par la pré-sente Convention, les embarcations et les aéro-nefs appartenant à des personnes qui ont leurrésidence normale en dehors de son territoireet qui sont importés et utilisés pour leur usageprivé à l'occasion d'une visite temporaire, soitpar les propriétaires de ces embarcations ouaéronefs, soit par d'autres personnes qui ontleur résidence normale en dehors de son terri-toire.

2. Ces embarcations et aéronefs serontplacés sous le couvert d'un titre d'importationtemporaire garantissant le paiement des droitset taxes d'entrée et, éventuellement, desamendes douanières encourues, sous réservedes dispositions spéciales prévues par le para-graphe 4 de l'article 27.

Article 3

Seront admis en franchise des droits et taxesd'entrée, et sans prohibitions ni restrictionsd'importation, les combustibles et carburantscontenus dans les réservoirs des embarcationsou aéronefs importés temporairement, si cesréservoirs sont de capacité normale, sont placésaux endroits habituels et sont reliés aux mo-teurs, et étant entendu que les combustibles etcarburants contenus dans ces réservoirs sont

destinés à être utilisés exclusivement par l'em-barcation ou l'aéronef.

Article 4

1. Les pièces détachées importées pourservir à la réparation d'une embarcation oud'un aéronef déterminé déjà importé tempo-rairement seront admises temporairement enfranchise des droits et taxes d'entrée et sansprohibitions ni restrictions d'importation. Lesparties contractantes peuvent exiger que cespièces soient placées sous le couvert d'un titred'importation temporaire.

2. Les pièces remplacées non réexportéesseront passibles des droits et taxes d'entrée àmoins que, conformément à la réglementationdu pays intéressé, elles ne soient abandonnéesfranches de tous frais au Trésor public ou biendétruites, sous contrôle officiel, aux frais desintéressés.

Article 5Seront admises au bénéfice de la franchise

des droits et taxes d'entrée et ne seront sou-mises à aucune prohibition ou restriction d'im-portation, les formules de titres d'importationtemporaire expédiées, aux associations auto-risées à délivrer les titres considérés, par lesassociations étrangères correspondantes, parles organisations internationales ou par les au-torités douanières des parties contractantes.

CHAPITRE Ш

DÉLIVRANCE DES TITRES D'IMPORTATIONTEMPORAIRE

Article 61. Conformément aux garanties et sous les

conditions qu'elle pourra déterminer, chaquepartie contractante pourra habiliter des asso-ciations, et notamment celles qui sont affiliéesà une organisation internationale, à délivrer,soit directement, soit par l'intermédiaire d'as-sociations correspondantes, les titres d'impor-tation temporaire prévus par la présente Con-vention.

2. Temporary importation papers may bevalid for a single country or Customs territoryor for several countries or Customs territories.

3. The period of validity of these papersshall not exceed one year from the date ofissue.

Article 7

1. Temporary importation papers valid forthe territories of all or several of the Contract-ing Parties shall be known as carnets de pas-sages en douane and shall conform in respectof aircraft to the standard form contained inAnnex 1, and, in respect of boats, to the stand-ard form contained in Annex 2, to this Con-vention.

2. If a carnet de passages en douane is notvalid for one or several territories, the issuingassociation shall indicate the fact on the coverand on the importation vouchers of the carnet.

3. Temporary importation papers intendedfor boats and valid only for the territory of asingle Contracting Party may conform to thestandard form contained in Annex 3 to thisConvention. Contracting Parties may also useother documents, in accordance with theirlegislation or regulations.

4. The period of validity of temporary im-portation papers other than those issued byauthorized associations as provided for in Arti-cle 6 shall be laid down by each ContractingParty in accordance with its legislation or regu-lations.

5. Each Contracting Party shall, upon re-quest, supply the other Contracting Partieswith models of temporary importation papersvalid for its territory, other than those appear-ing in the Annexes to this Convention.

CHAPTER IV

PARTICULARS ON TEMPORARY IMPORTATIONPAPERS

Article 8

Temporary importation papers issued by au-thorized associations shall be made out in thename of the persons who own the aircraft orboats temporarily imported or who have thepossession or control of them. When suchpapers, issued in respect of hired aircraft orboats are made out in the name of the personletting out on hire, the words "On hire to . . ."followed by the name and the address of thenormal residence in a foreign country of theperson concerned, shall, when the Customs au-thorities of the country of temporary importa-tion so require, be inserted on all counterfoilsand vouchers used in connexion with the jour-neys of the person taking the aircraft or boaton hire.

Article 9

1. The weight to be declared on temporaryimportation papers is the net weight of aircraftor boats. It shall be expressed in the metricsystem. In the case of papers valid for one coun-try only, the Customs authorities of that coun-try may prescribe the use of another system.

2. The value to be declared on temporaryimportation papers valid for one country onlyshall be expressed in the currency of that coun-try. The value to be declared on a carnet depassages en douane shall be expressed in thecurrency of the country where the carnet isissued.

3. The articles and tool-kit which form thenormal equipment of aircraft or boats need notbe specially declared on the temporary impor-tation papers.

4. When the Customs authorities so require,spare parts and accessories not considered asconstituting the normal equipment of the air-

Article 7

1. Les titres d'importation temporaire vala-bles pour les territoires de toutes les partiescontractantes ou de plusieurs d'entre elles se-ront désignés sous le nom de "carnets de pas-sages en douane" et seront conformes, pour lesembarcations, au modèle qui figure à l'annexe2 de la présente Convention et, pour les aéro-nefs, au modèle qui figure à l'annexe 1.

2. Si un carneî de passages en douane n'estpas valable pour un ou plusieurs territoires,l'association qui délivre le titre en fera mentionsur la couverture et les volets d'entrée ducarnet.

3. Les titres d'importation temporaire des-tinés aux embarcations et valables exclusive-ment pour le territoire d'une seule partie con-tractante pourront être conformes au modèlefigurant à l'annexe 3 de la présente Convention.Il sera loisible aux parties contractantes d'uti-liser également d'autres documents, conformé-ment à leur législation ou à leur réglementa-tion.

4. La durée de validité des titres d'impor-tation temporaire autres que ceux délivrés,conformément à l'article 6, par des associationsautorisées sera fixée par chaque partie contrac-tante suivant sa législation ou sa réglementa-tion.

5. Chacune des parties contractantes trans-mettra aux autres parties contractantes, surleur demande, les modèles de titres d'importa-tion temporaire valables sur son territoire,autres que ceux figurant aux annexes de laprésente Convention.

CHAPITRE IV

INDICATIONS À PORTER SUR LES TITRESD'IMPORTATION TEMPORAIRE

Article 8

Les titres d'importation temporaire délivréspar les associations autorisées seront établis aunom des personnes qui sont propriétaires desembarcations ou aéronefs importés temporaire-ment ou qui en ont la jouissance. Lorsque detels titres, délivrés pour des embarcations ouaéronefs en location, seront établis au nom duloueur, la mention "En location à ..." suiviedu nom du locataire et de l'adresse de sa rési-dence normale à l'étranger sera portée, dansle cas où les autorités douanières du pays d'im-portation temporaire l'exigent, sur tous lesvolets et souches utilisés à l'occasion de voyagesdu locataire.

Article 9

1. Le poids à déclarer sur les titres d'im-portation temporaire est le poids à vide desembarcations ou aéronefs. Il sera exprimé enunités du système métrique. Lorsqu'il s'agit detitres valables pour un seul pays, les autoritésdouanières de ce pays pourront prescrire l'em-ploi d'un autre système.

2. La valeur à déclarer sur un titre d'im-portation temporaire valable pour un seul payssera exprimée dans la monnaie de ce pays. Lavaleur à déclarer sur un carnet de passages endouane sera exprimée dans la monnaie du paysoù le carnet est délivré.

3. Les objets et l'outillage constituantl'équipement normal des embarcations ouaéronefs n'auront pas à être spécialement dé-clarés sur les titres d'importation temporaire.

4. Lorsque les autorités douanières l'exi-gent, les pièces de rechange et accessoires quine sont pas considérés comme constituant

Article 10

Any particulars inserted on temporary im-portation papers by the issuing association maybe altered only with the approval of the issuingor guaranteeing association. No alteration tothe papers may be made after they have beenpassed by the Customs authorities of the coun-try of importation except with the consent ofthose authorities.

CHAPTER v

CONDITIONS OF TEMPORARY IMPORTATION

Article 11

1. Aircraft and boats admitted under coverof temporary importation papers may be used,for their private use, by third persons duly au-thorized by the holders of the papers, providedthat those third persons normally reside out-side the country of importation and also fulfilthe other conditions laid down in this Conven-tion. The Customs authorities of the Contract-ing Parties shall have the right to require evi-dence that such third persons have been dulyauthorized by the holders of the papers and ful-fil the aforesaid conditions. If this evidencedoes not appear sufficient, the Customs authori-ties may refuse use of these aircraft and boatsin their country under cover of the papers. Inthe case of aircraft or boats which have beenhired, each Contracting Party may require thatthe person taking the aircraft or boat on hirebe present at the time of importation of the air-craft or boat.

2. Notwithstanding the provisions of thepreceding paragraph, the Customs authoritiesof the Contracting Parties may permit, under

conditions of which they shall be the solejudges, an aircraft or boat circulating undercover of temporary importation papers to bemanned by a crew composed of persons whoare normally resident in the country of impor-tation, in particular when the crew of the air-craft or boat acts on behalf of or under instruc-tions from the holder of the temporary impor-tation papers.

Article 12

1. Aircraft or boats mentioned in tempo-rary importation papers shall be re-exportedin the same general state, except for wear andtear, within the period of validity of suchpapers. In the case of aircraft or boats whichhave been hired, the Customs authorities ofthe Contracting Parties shall have the rightto require the re-exportation of the aircraft orboat as soon as the hirer has left the countryof temporary importation.

2. Evidence of re-exportation shall be pro-vided by the exit visa properly appended tothe temporary importation papers by the Cus-toms authorities of the country into whichthe aircraft or boat was temporarily imported.

3. Contracting Parties may, however, makethe discharge of temporary importation papersfor aircraft subject to proof of the arrival ofthe aircraft in foreign territory.

Article 13

1. Notwithstanding the requirement of re-exportation laid down in article 12, the re-ex-portation of badly damaged aircraft or boatsshall not be required, in the case of duly au-thenticated accidents, provided that the air-craft or boats :

(а) Are subjected to the import duties andimport taxes to which they are liable; or

(б) Are abandoned free of all expense tothe Exchequer of the country into which theywere imported temporarily; or

CHAPITRE v

CONDITIONS DE L'IMPORTATION TEMPORAIRE

Article 11

1. Les embarcations et les aéronefs se trou-vant sous le couvert de titres d'importationtemporaire pourront être utilisés, pour leurusage privé, par des tiers, dûment autorisés parles titulaires de ces titres, qui ont leur résidencenormale en dehors du pays d'importation etqui remplissent les autres conditions prévuespar la présente Convention. Les autorités doua-nières des parties contractantes auront le droitd'exiger la preuve que ces tiers ont été dûmentautorisés par les titulaires des titres et remplis-sent les conditions précitées. Si les justificationsfourmes ne leur paraissent pas suffisantes, lesautorités douanières pourront s'opposer àl'utilisation de ces embarcations et aéronefsdans leur pays sous le couvert des titres en ques-tion. En ce qui concerne les embarcations etaéronefs loués, chaque partie contractantepourra exiger que le locataire soit présent aumoment de l'importation de l'embarcation oude l'aéronef.

2. Nonobstant les dispositions du para-graphe précédent, les autorités douanières desparties contractantes pourront tolérer, dans les

conditions dont elles demeurent seules juges,que l'équipage d'une embarcation ou d'unaéronef circulant sous le couvert d'un titred'importation temporaire soit constitué par despersonnes dont la résidence normale se trouvedans le pays d'importation de l'embarcation oude l'aéronef, notamment lorsque l'équipageagit pour le compte et sur les instructions dutitulaire du titre d'importation temporaire.

Article 12

1. L'embarcation ou l'aéronef qui fait l'ob-jet d'un titre d'importation temporaire seraréexporté à l'identique, compte tenu de l'usurenormale, dans le délai de validité de ce titre.Dans le cas d'une embarcation ou d'un aéronefloué, les autorités douanières des parties con-tractantes auront le droit d'exiger la réexpor-tation de l'embarcation ou de l'aéronef aumoment où le locataire quitte le pays d'impor-tation temporaire.

2. La preuve de la réexportation sera four-nie par le visa de sortie apposé régulièrementsur le titre d'importation temporaire par lesautorités douanières du pays où l'embarcationou l'aéronef a été importé temporairement.

3. Toutefois, les parties contractantes pour-ront subordonner la décharge du titre d'impor-tation temporaire délivré pour un aéronef à lapreuve de l'arrivée de l'appareil en territoireétranger.

Article 13

1. Nonobstant l'obligation de réexportationprévue à l'article 12, la réexportation, en casd'accident dûment établi, des embarcations etaéronefs gravement endommagés ne sera pasexigée, pourvu qu'ils soient, suivant ce que lesautorités douanières exigent:

a) Soumis aux droits et taxes d'entrée dusen l'espèce ; ou

fr) Abandonnés francs de tous frais au Tré-sor public du pays d'importation temporaire;ou

(с) Are destroyed, under official supervi-sion, at the expense of the parties concerned,any salvaged parts and materials being sub-jected to the import duties and import taxesto which they are liable, as the Customs au-thorities may require.

2. When an aircraft or boat temporarilyimported cannot be re-exported as a result ofa seizure, other than a seizure made at the suitof private persons, the requirement of re-ex-portation within the period of validity of thetemporary importation papers shall be sus-pended for the duration of the seizure.

3. The Customs authorities shall notify, sofar as possible, to the guaranteeing association,seizures made by or on behalf of those Customsauthorities of aircraft or boats admitted undercover of temporary importation papers guar-anteed by that association and shall advise itof the measures they intend to take.

Article 14

An aircraft or boat imported into the terri-tory of one of the Contracting Parties undercover of temporary importation papers may notbe used, even incidentally, for transport againstremuneration, reward or other considerationbetween points within the frontiers of that ter-ritory or outwards from that territory. It maynot be hired out after importation and if itwas imported on hire it may not be re-hired toany person other than the person who hiredit originally.

Article 16When temporary importation papers with-

out detachable vouchers for each passage areused for boats, the visas given by the Customsofficers between the first entry and the final exitshall be provisional. Nevertheless, when thelast visa is a provisional exit visa, it shall beadmitted as proof of the re-exportation of theboat or component parts temporarily imported.

Article 17When temporary importation papers with

a detachable voucher for each passage are used,each entry visa implies the passing of the docu-ment by the Customs authorities, and each sub-sequent exit visa constitutes its final discharge,except as provided in article 18.

Article 18When the Customs authorities of a country

have finally and unconditionally dischargedtemporary importation papers they can nolonger claim from the guaranteeing associationpayment of import duties and import taxes,unless the certificate of discharge was obtainedimproperly or fraudulently.

Article 15

Persons entitled to temporary importationfacilities may, during the period of validity oftemporary importation papers, import the air-craft or boats covered by those papers as oftenas necessary, on condition that they have eachpassage (entry and exit) established by a visa

Autant que possible, les autorités doua-nières notifieront à l'association garante lessaisies pratiquées par elles ou à leur initiativesur des embarcations ou aéronefs placés sousle couvert de titres d'importation temporairegarantis par cette association et l'aviseront desmesures qu'elles entendent adopter.

Article 14

Une embarcation ou un aéronef importédans le territoire de l'une des parties contrac-tantes sous le couvert d'un titre d'importationtemporaire ne pourra être utilisé, même acces-soirement, à des transports s'effectuant contrerémunération, prime ou autre avantage maté-riel entre des points situés à l'intérieur des fron-tières de ce territoire ou au départ de ce terri-toire. Un tel aéronef ou embarcation ne pourraêtre donné en location après son importationet, s'il était en location au moment de son im-portation, il ne pourra être ni reloué à une per-sonne autre que le locataire initial ni sous-loué.

Article 15

Les bénéficiaires de l'importation tempo-raire auront le droit d'importer autant de foisque de besoin, pendant la durée de validité destitres d'importation temporaire, les embarca-tions ou aéronefs qui font l'objet de ces titres,sous la réserve de faire constater chaque pas-

sage (entrée et sortie), si les autorités doua-nières l'exigent, par un visa des agents dedouane intéressés. Toutefois, il pourra êtreémis des titres valables pour un seul voyage.

Article 16Lorsqu'il sera fait usage, pour une embarca-

tion, d'un titre d'importation temporaire necomportant pas de volets détachables à chaquepassage, les visas apposés par les agents desdouanes entre la première entrée et la dernièresortie auront un caractère provisoire. Néan-moins, losque le dernier visa apposé sera unvisa de sortie provisoire, ce visa sera admiscomme justification de la réexportation del'embarcation ou des pièces détachées im-portées temporairement.

Article 17Lorsqu'il sera fait usage d'un titre d'impor-

tation temporaire comportant des volets dé-tachables à chaque passage, chaque constata-tion d'entrée comportera prise en charge dutitre par la douane et chaque constatation desortie ultérieure entraînera décharge définitivede ce titre, sous réserve des dispositions del'article 18.

Article 18Lorsque les autorités douanières d'un pays

auront déchargé définitivement et sans réserveun titre d'importation temporaire, elles nepourront plus réclamer à l'association garantele paiement des droits et taxes d'entrée à moinsque le certificat de décharge n'ait été obtenuabusivement ou frauduleusement.

Article 19Les visas des titres d'importation temporaire

utilisés dans les conditions prévues par la pré-sente Convention ne donneront pas lieu aupaiement d'une rémunération pour le servicedes douanes si ces visas sont apposés dans unbureau ou dans un poste de douane pendantles heures d'ouverture de ce bureau ou de ceposte.

CHAPTER VI

EXTENSION OF VALIDITY AND RENEWAL OFTEMPORARY IMPORTATION PAPERS

Article 20

The lack of proof of re-exportation withinthe time allowed of aircraft or boats temporar-ily imported shall be disregarded when the air-craft or boats are presented to the Customsauthorities for re-exportation within fourteendays from the expiry of the papers and satis-factory explanations of the delay are given.

Article 21

Each of the Contracting Parties shall recog-nize as valid extensions of validity of carnets depassages en douane granted by another Con-tracting State in accordance with the procedurelaid down in Annex 4 to this Convention.

Article 22

1. Requests for extension of validity of tem-porary importation papers shall be presentedto the competent Customs authorities beforethe expiry of the period of validity of thesepapers, unless this is rendered impossible byforce majeure. If the temporary importationpapers have been issued by an authorized asso-ciation, the request for extension shall be madeby the association which guarantees the papers.

2. Extensions of time necessary for the re-exportation of aircraft or boats or componentparts imported temporarily shall be grantedwhen the persons concerned can establish tothe satisfaction of the Customs authorities thatthey are prevented by force majeure from re-exporting the said aircraft, boats or componentparts within the time allowed.

Article 23

Each of the Contracting Parties shall, unlessthe conditions of temporary admission are no

longer satisfied, authorize, subject to whatevermeasures of control it may consider necessary,the renewal of temporary importation papersissued by the authorized associations and relat-ing to aircraft, boats or component parts tem-porarily imported into its territory. Requestsfor renewal shall be presented by the guaran-teeing association.

CHAPTER VII

REGULARIZATION OF TEMPORARYIMPORTATION PAPERS

Article 24

1. If temporary importation papers havenot been regularly discharged, the Customsauthorities of the country of importationshall (whether the papers have expired or not)accept as evidence of re-exportation of the air-craft, boats or component parts the presenta-tion of a certificate based on the standard formshown in Annex 5 to this Convention, issuedby an official authority (consul, Customs,police, mayor, judicial officer, etc.), attestingthe facts that the aircraft, boat or componentparts in question have been presented to it andare outside the country of importation. Thesaid Customs authorities may also accept anyother documentary evidence that the aircraft,boat or component parts are outside the coun-try of importation. In the case of papers, otherthan carnets de passages en douane, which havenot expired, the said Customs authorities mayrequire the papers to be surrendered to thembefore the date on which the aircraft or boatin question was certified to be outside the coun-try of temporary importation. In the case ofcarnets, account shall be taken, as evidence ofre-exportation of the aircraft, boats, or com-ponent parts, of the visas entered thereon bythe Customs authorities of countries subse-quently visited.

CHAPITRE VI

PROLONGATION DE VALIDITÉET RENOUVELLEMENT DES TITRES

D'IMPORTATION TEMPORAIRE

Article 20

Article 21

En ce qui concerne les carnets de passagesen douane, chacune des parties contractantesreconnaîtra comme valables les prolongationsde validité accordées par l'une quelconqued'entre elles conformément à la procédureétablie à l'annexe 4 de la présente Convention.

Article 22

1. Les demandes de prolongation de validitédes titres d'importation temporaire seront, saufimpossibilité résultant d'un cas de force ma-jeure, présentées aux autorités douanières com-pétentes avant l'échéance de ces titres. Si letitre d'importation temporaire a été émis parune association autorisée, la demande de pro-longation sera présentée par l'association quile garantit.

2. Les prolongations de délai nécessairespour la réexportation des embarcations, aéro-nefs ou pièces détachées importés temporaire-ment seront accordées lorsque les intéresséspourront établir à la satisfaction des autoritésdouanières qu'ils sont empêchés par un cas deforce majeure de réexporter ces embarcations,aéronefs ou pièces détachées dans le délaiimparti.

Article 23

Sauf dans le cas où les conditions de l'impor-tation temporaire ne se trouvent plus réalisées,

chacune des parties contractantes autorisera,moyennant telles mesures de contrôle qu'ellejugera devoir fixer, le renouvellement des titresd'importation temporaire délivrés par les asso-ciations autorisées et afférents à des embarca-tions, aéronefs ou pièces détachées importéstemporairement sur son territoire. La demandede renouvellement sera présentée par l'associa-tion garante.

CHAPITRE VII

RÉGULARISATION DES TITRESD'IMPORTATION TEMPORAIRE

Article 24

1. Si le titre d'importation temporaire n'apas été régulièrement déchargé, les autoritésdouanières du pays d'importation accepteront(avant ou après péremption du titre), commejustification de la réexportation de l'embarca-tion, de l'aéronef ou des pièces détachées,la présentation d'un certificat conforme aumodèle figurant à l'annexe 5 de la présente Con-vention, délivré par une autorité officielle (con-sul, douane, police, maire, huissier, etc.), etattestant que l'embarcation, l'aéronef ou lespièces détachées précités ont été présentés àladite autorité et se trouvent hors du pays d'im-portation. Ces autorités douanières pourrontégalement admettre toute autre justificationétablissant que l'embarcation, l'aéronef ou lespièces détachées se trouvent hors du pays d'im-portation. In the case of the destruction, loss or theftof temporary importation papers not regularlydischarged but relating to aircraft, boats orcomponent parts which have been re-exported,the Customs authorities of the country of im-portation shall accept as proof of re-exporta-tion the presentation of certificates based onthe standard form shown in Annex 5 to thisConvention issued by an official authority (con-sul, Customs, police, mayor, judicial officer,etc.), attesting the facts that the aircraft, boatsor component parts in question have been pre-sented to it and are outside the country of im-portation after the date of expiry of the papers.They may also accept any other documentaryevidence that the aircraft, boats or componentparts are outside the country of temporary im-portation.

3. In the case of the destruction, loss or theftof carnets de passages en douane while aircraft,boats or component parts to which they referare in the territory of one of the ContractingParties, the Customs authorities of that Partyshall, at the request of the association con-cerned, accept replacement documents thevalidity of which shall expire on the date ofexpiry of the validity of the carnets which theyreplace. This acceptance will annul the pre-vious acceptance of the carnets destroyed, lostor stolen. If, instead of replacement documents,export licences or similar documents are issuedfor the re-exportation of the aircraft, boats orcomponent parts, the exit visas on theselicences or documents shall be considered assufficient proof of re-exportation.

4. If aircraft or boats are stolen after havingbeen re-exported from the country of importa-tion, without the exit having been regularlyendorsed on the temporary importation papersand in the absence of entry visas on the papersentered thereon by the Customs authorities of

countries subsequently visited, the papers maynevertheless be regularized provided that theguaranteeing association furnishes the paperstogether with such evidence of theft as may beconsidered sufficient. If the temporary impor-tation papers have not expired, the Customsauthorities may require their surrender.

Article 25

In the cases referred to in Article 24, theCustoms authorities shall have the right tocharge a regularization fee.

Article 26

Customs authorities shall not have the rightto require from the guaranteeing associationpayment of import duties and import taxes onaircraft, boats or component parts temporarilyimported when the non-discharge of the tem-porary importation papers has not been noti-fied to the guaranteeing association within oneyear of the date of expiry of the validity of thosepapers.

Article 27

1. The guaranteeing associations shall havea period of one year from the date of notifica-tion of the non-discharge of temporary impor-tation papers in which to furnish proof of there-exportation of the aircraft, boats or com-ponent parts in question under the conditionslaid down in this Convention.

2. If such proof is not furnished within thetime allowed, the guaranteeing associationshall forthwith deposit or pay provisionally theimport duties and import taxes payable. Thisdeposit or payment shall become final after aperiod of one year from the date of the depositor provisional payment. During the latterperiod, the guaranteeing association may stillavail itself of the facilities provided by the pre-ceding paragraph with a view to repayment ofthe sums deposited or paid.

En cas de destruction, de perte ou de vold'un titre d'importation temporaire, qui n'apas été régulièrement déchargé mais qui se rap-porte à une embarcation, à un aéronef ou à despièces détachées qui ont été réexportés, lesautorités douanières du pays d'importation ac-cepteront, comme justification de la réexpor-tation, la présentation d'un certificat conformeau modèle figurant à l'annexe 5 de la présenteConvention délivré par une autorité officielle(consul, douane, police, maire, huissier, etc.),et attestant que l'embarcation, l'aéronef ou lespièces détachées précités ont été présentés àladite autorité et se trouvaient hors du paysd'importation à une date postérieure à la dated'échéance du titre. Elles pourront égalementadmettre toute autre justification établissantque l'embarcation, l'aéronef ou les pièces dé-tachées se trouvent hors du pays d'importation.

3. En cas de destruction, de perte ou de vold'un carnet de passages en douane survenantlorsque l'embarcation, l'aéronef ou les piècesdétachées auxquels ce carnet se rapporte setrouvent sur le territoire d'une des parties con-tractantes, les autorités douanières de cettepartie effectueront, à la demande de l'associa-tion intéressée, la prise en charge d'un titre deremplacement dont la validité expirera à ladate d'expiration de la validité du carnet rem-placé. Cette prise en charge annulera la priseen charge effectuée antérieurement sur le car-net détruit, perdu ou volé. Si, en vue de la réex-portation de l'embarcation, de l'aéronef ou despièces détachées, il est délivré, au lieu d'un titrede remplacement, une licence d'exportation ouun document analogue, le visa de sortie apposésur cette licence ou sur ce document sera ac-cepté comme justification de la réexportation.

4. Lorsqu'une embarcation ou un aéronefest volé après avoir été réexporté du pays d'im-portation, sans que la sortie ait été régulière-ment constatée sur le titre d'importation tem-poraire et sans que figurent sur le titre des visasd'entrée apposés par les autorités douanières

de pays postérieurement visités, ce titre pourranéanmoins être régularisé à condition que l'as-sociation garante le présente et fournisse despreuves du vol qui soient jugées satisfaisantes.Si le titre n'est pas périmé, son dépôt pourraêtre exigé par les autorités douanières.

Article 25

Dans les cas visés à l'article 24, les autoritésdouanières se réservent le droit de percevoirune taxe de régularisation.

Article 26

Les autorités douanières n'auront pas ledroit d'exiger de l'association garante le paie-ment des droits et taxes d'entrée pour une em-barcation, un aéronef ou des pièces détachéesimportés temporairement lorsque la non-décharge du titre d'importation temporairen'aura pas été notifiée à cette association dansle délai d'un an à compter de la date d'expira-tion de la validité de ce titre.

Article 27

1. Les associations garantes auront un délaid'un an à compter de la date de notification dela non-décharge des titres d'importation tem-poraire pour fournir la preuve de la réexporta-tion des embarcations, aéronefs ou piècesdétachées en question dans les conditions pré-vues par la présente Convention.

2. Si cette preuve n'est pas fournie dans lesdélais prescrits, l'association garante consi-gnera sans retard ou versera à titre provisoireles droits et taxes d'entrée exigibles. Cette con-signation ou ce versement deviendra définitifà l'expiration d'un délai d'un an à compter dela date de la consignation ou du versement pro-visoire. Pendant ce dernier délai, l'associationgarante pourra encore, en vue de la restitutiondes sommes consignées ou versées, bénéficierdes facilités prévues au paragraphe précédent.

3. For countries whose regulations do notprovide for the deposit or provisional paymentof import duties and import taxes, paymentsmade in conformity with the provisions of thepreceding paragraph will be regarded as final,it being understood that the sums paid may berefunded when the conditions laid down in thisarticle are fulfilled.

4. In the case of the non-discharge of tem-porary importation papers, the guaranteeingassociation shall not be required to pay a sumgreater than the total of the import duties andimport taxes applicable to the aircraft, boatsor component parts not re-exported, togetherwith interest if applicable.

Article 28

The provisions of this Convention do notaffect the right of the Contracting Parties, inthe event of fraud, contravention or abuse, totake proceedings against holders of, or the per-sons using, temporary importation papers, forthe recovery of the import duties and importtaxes and also to impose any penalties to whichsuch persons have rendered themselves liable.In such cases the guaranteeing associationsshall lend their assistance to the Customsauthorities.

CHAPTER vin

MISCELLANEOUS PROVISIONS

Article 29

The Contracting Parties shall endeavour notto introduce Customs procedures which mighthave the effect of impeding the development ofinternational touring.

Article 30

Any breach of the provisions of this Conven-tion, any substitution, false declaration or acthaving the effect of causing a person or an ar-ticle improperly to benefit from the system ofimportation laid down in this Convention, may

render the offender liable in the country wherethe offence was committed to the penalties pre-scribed by the laws of that country.

Article 31

Nothing in this Convention shall preventContracting Parties which form a Customs oreconomic union from enacting special provi-sions applicable to persons normally residentin the countries forming that union.

Article 32

Nothing in this Convention shall be deemedto prejudice the right of each Contracting Partyto apply import prohibitions or restrictionsbased on considerations other than economicin character, for example considerations ofpublic morality, public security, public healthor hygiene.

CHAPTER IX

FINAL PROVISIONS

Article 33

1. Countries members of the EconomicCommission for Europe and countriesadmitted to the Commission in a consultativecapacity under paragraph 8 of the Commis-sion's terms of reference, may become Con-tracting Parties to this Convention:

(а) By signing it;

(б) By ratifying it after signing it subjectto ratification;

(c) By acceding to it.

2. Such countries as may participate in cer-tain activities of the Economic Commission forEurope in accordance with paragraph 11 of theCommission's terms of reference may becomeContracting Parties to this Convention by ac-ceding thereto after its entry into force.

Article 28

Les dispositions de la présente Conventionn'affectent pas le droit des parties contrac-tantes, en cas de fraude, de contravention oud'abus, d'intenter des poursuites contre lestitulaires de titres d'importation temporaire etcontre les personnes utilisant ces titres, pourrecouvrer les droits et taxes d'entrée ainsi quepour imposer les pénalités dont ces personnesse seraient rendues passibles. Dans ce cas, lesassociations garantes prêteront leur concoursaux autorités douanières.

CHAPITRE Vu!

DISPOSITIONS DIVERSES

Article 29

Les parties contractantes s'efforceront de nepas instituer de formalités douanières qui pour-raient avoir pour effet d'entraver le développe-ment du tourisme international.

Article 30

Toute infraction aux dispositions de la pré-sente Convention, toute substitution, faussedéclaration ou manœuvre ayant pour effet defaire bénéficier indûment une personne ou unobjet du régime d'importation prévu par la

présente Convention exposera le contrevenant,dans le pays où l'infraction a été commise, auxsanctions prévues par la législation de ce pays.

Article 31

Aucune disposition de la présente Conven-tion n'exclut le droit pour les parties contrac-tantes qui forment une union douanière ouéconomique de prévoir des règles particulièresapplicables aux personnes qui ont leur rési-dence normale dans les pays faisant partie decette union.

Article 32

Aucune disposition de la présente Conven-tion ne sera interprétée comme portant atteinteau droit de chaque partie contractante d'appli-quer aux importations temporaires d'embarca-tions de plaisance et d'aéronefs des prohibi-tions ou des restrictions basées sur des considé-rations de caractère non économique, par ex-emple sur des considérations de moralité, desécurité, de santé ou d'hygiène publique.

CHAPITRE IX

DISPOSITIONS FINALES

Article 33

1. Les pays membres de la Commission éco-nomique pour l'Europe et les pays admis à laCommission à titre consultatif conformémentau paragraphe 8 du mandat de cette commis-sion peuvent devenir parties contractantes àla présente Convention:

а) En la signant;

б) En la ratifiant après l'avoir signée sousréserve de ratification;

c) En y adhérant.

2. Les pays susceptibles de participer à cer-tains travaux de la Commission économiquepour l'Europe en application du paragraphe 11du mandat de cette commission peuvent deve-nir parties contractantes à la présente Conven-tion en y adhérant après son entrée en vigueur.

3. The Convention shall be open for signa-ture until 31 August 1956 inclusive. There-after, it shall be open for accession.

4. Ratification or accession shall be effectedby the deposit of an instrument with the Secre-tary-General of the United Nations.

Article 34

1. This Convention shall come into force onthe ninetieth day after five of the countries re-ferred to in article 33, paragraph 1, have signedit without reservation of ratification or havedeposited their instruments of ratification oraccession.

2. For any country ratifying or acceding toit after five countries have signed it withoutreservation of ratification or have depositedtheir instruments of ratification or accession,this Convention shall enter into force on theninetieth day after the said country has de-posited its instrument of ratification or acces-sion.

Article 35

1. Any Contracting Party may denouncethis Convention by so notifying the Secretary-General of the United Nations.

2. Denunciation shall take effect fifteenmonths after the date of receipt by the Secre-tary-General of the notification of denuncia-tion.

3. The validity of temporary importationpapers issued before the date when the denun-ciation takes effect shall not be affected therebyand the guarantee of the association shall holdgood. Extensions granted in accordance withthe conditions laid down in article 21 of thisConvention shall similarly remain valid.

Article 36

This Convention shall cease to have effectif, for any period of twelve consecutive monthsafter its entry into force, the number of Con-tracting Parties is less than five.

Article 37

1. Any country may, at the time of signingthis Convention without reservation of ratifica-tion or of depositing its instrument of ratifica-tion or accession or at any time thereafter,declare by notification addressed to the Secre-tary-General of the United Nations that thisConvention shall extend to all or any of theterritories for the international relations ofwhich it is responsible. The Convention shallextend to the territory or territories named inthe notification as from the ninetieth day afterits receipt by the Secretary-General or, if onthat day the Convention has not yet enteredinto force, at the time of its entry into force.

2. Any country which has made a declara-tion under the preceding paragraph extendingthis Convention to any territory for whose in-ternational relations it is responsible may de-nounce the Convention separately in respect ofthat territory in accordance with the provisionsof article 35.

Article 38

1. Any dispute between two or more Con-tracting Parties concerning the interpretationor application of this Convention shall so faras possible be settled by negotiation betweenthem.

2. Any dispute which is not settled by nego-tiation shall be submitted to arbitration if anyone of the Contracting Parties in dispute sorequests and shall be referred accordingly toone or more arbitrators selected by agreementbetween the Parties in dispute. If within three

Article 35

1. Chaque partie contractante pourra dé-noncer la présente Convention par notificationadressée au Secrétaire général de l'Organisa-tion des Nations Unies.

2. La dénonciation prendra effet quinzemois après la date à laquelle le Secrétaire géné-ral en aura reçu notification.

3. La validité des titres d'importation tem-poraire délivrés avant la date à laquelle la dé-nonciation prendra effet ne sera pas affectée parcette dénonciation et la garantie des associa-tions restera effective. Les prolongations ac-cordées dans les conditions prévues à l'article21 de la présente Convention conserveront demême leur validité.

Article 36

La présente Convention cessera de produireses effets si, après son entrée en vigueur, lenombre des parties contractantes est inférieurà cinq pendant une période quelconque dedouze mois consécutifs.

Article 37

1. Tout pays pourra, lorsqu'il signera laprésente Convention sans réserve de ratifica-tion ou lors du dépôt de son instrument deratification ou d'adhésion ou à tout momentultérieur, déclarer, par notification adressée auSecrétaire général de l'Organisation des Na-tions Unies, que la présente Convention seraapplicable à tout ou partie des territoires qu'ilreprésente sur le plan international. La Con-vention sera applicable au territoire ou auxterritoires mentionnés dans la notification àdater du quatre-vingt-dixième jour après récep-tion de cette notification par le Secrétaire géné-ral ou, si à ce jour la Convention n'est pas en-core entrée en vigueur, à dater de son entréeen vigueur.

2. Tout pays qui aura fait, conformémentau paragraphe précédent, une déclarationayant pour effet de rendre la présente Conven-tion applicable à un territoire qu'il représentesur le plan international pourra, conformé-ment à l'article 35, dénoncer la Convention ence qui concerne ledit territoire.

Article 38

1. Tout différend entre deux ou plusieursparties contractantes touchant l'interprétationou l'application de la présente Convention sera,autant que possible, réglé par voie de négocia-tion entre les parties en litige.

2. Tout différend qui n'aura pas été réglépar voie de négociation sera soumis à l'arbi-trage si l'une quelconque des parties contrac-tantes en litige le demande et sera, en consé-quence, renvoyé à un ou plusieurs arbitreschoisis d'un commun accord par les parties en

3. The decision of the arbitrator or arbi-trators appointed under the preceding para-graph shall be binding on the ContractingParties in dispute.

Article 39

1. Each Contracting Party may, at the timeof signing, ratifying, or acceding to, this Con-vention, declare that it does not consider itselfas bound by article 38 of the Convention. OtherContracting Parties shall not be bound by ar-ticle 38 in respect of any Contracting Partywhich has entered such a reservation.

2. Any Contracting Party having entered areservation as provided for in paragraph 1 mayat any time withdraw such reservation by noti-fying the Secretary-General of the UnitedNations.

3. No other reservation to this Conventionshall be permitted.

Article 401. After this Convention has been in force

for three years, any Contracting Party may, bynotification to the Secretary-General of theUnited Nations, request that a conference beconvened for the purpose of reviewing the Con-vention. The Secretary-General shall notify allContracting Parties of the request and a reviewconference shall be convened by the Secretary-General if, within a period of four months fol-lowing the date of notification by the Secretary-General, not less than one third of the Con-tracting Parties notify him of their concurrencewith the request.

2. If a conference is convened in accordancewith the preceding paragraph, the Secretary-General shall notify all the Contracting Partiesand invite them to submit within a period ofthree months such proposals as they may wishthe Conference to consider. The Secretary-General shall circulate to all ContractingParties the provisional agenda for the confer-ence together with the texts of such proposalsat least three months before the date on whichthe conference is to meet.

3. The Secretary-General shall invite to anyconference convened in accordance with thisarticle all countries referred to in article 33,paragraph 1, and countries which have becomeContracting Parties under article 33, para-graph 2.

Article 41

1. Any Contracting Party may propose oneor more amendments to this Convention. Thetext of any proposed amendments shall betransmitted to the Secretary-General of theUnited Nations who shall transmit it to all Con-tracting Parties and inform all other countriesreferred to in article 33, paragraph 1.

2. Any proposed amendment circulated inaccordance with the preceding paragraph shallbe deemed to be accepted if no ContractingParty expresses an objection within a periodof six months following the date of circulationof the proposed amendment by the Secretary-General.

3. The Secretary-General shall, as soon aspossible, notify all Contracting Parties whetheran objection to the proposed amendment hasbeen expressed. If an objection to the proposedamendment has been expressed, the amend-ment shall be deemed not to have been acceptedand shall be of no effect whatever. If no suchobjection has been expressed the amendmentshall enter into force for all Contracting Parties

litige. Article 39

1. Chaque partie contractante pourra, aumoment où elle signera ou ratifiera la présenteConvention ou y adhérera, déclarer qu'elle nese considère pas liée par l'article 38 de la Con-vention. Les autres parties contractantes neseront pas liées par l'article 38 envers toutepartie contractante qui aura formulé une telleréserve.

2. Toute partie contractante qui aura for-mulé une réserve conformément au paragraphe1 pourra à tout moment lever cette réserve parune notification adressée au Secrétaire généralde l'Organisation des Nations Unies.

3. Aucune autre réserve à la présente Con-vention ne sera admise.

Article 40

1. Après que la présente Convention auraété en vigueur pendant trois ans, toute partiecontractante pourra, par notification adresséeau Secrétaire général de l'Organisation desNations Unies, demander la convocation d'uneconférence à l'effet de reviser la présente Con-vention. Le Secrétaire général notifiera cettedemande à toutes les parties contractantes etconvoquera une conférence de revision si, dansun délai de quatre mois à dater de la notifica-tion adressée par lui, le tiers au moins desparties contractantes lui signifient leur assenti-ment à cette demande.

2. Si une conférence est convoquée con-formément au paragraphe précédent, le Secré-taire général en avisera toutes les parties con-tractantes et les invitera à présenter, dans undélai de trois mois, les propositions qu'ellessouhaiteraient voir examiner par la conférence.Le Secrétaire général communiquera à toutesles parties contractantes l'ordre du jour pro-visoire de la conférence, ainsi que le texte deces propositions, trois mois au moins avant ladate d'ouverture de la conférence.

3. Le Secrétaire général invitera à toute con-férence convoquée conformément au présentarticle tous les pays visés au paragraphe 1 del'article 33, ainsi que les pays devenus partiescontractantes en application du paragraphe 2de l'article 33.

Article 41

1. Toute partie contractante pourra pro-poser un ou plusieurs amendements à la pré-sente Convention. Le texte de tout projetd'amendement sera communiqué au Secrétairegénéral de l'Organisation des Nations Unies,qui le communiquera à toutes les parties con-tractantes et le portera à la connaissance desautres pays visés au paragraphe 1 de l'article33.

2. Tout projet d'amendement qui aura ététransmis conformément au paragraphe précé-dent sera réputé accepté si aucune partie con-tractante ne formule d'objections dans un délaide six mois à compter de la date à laquelle leSecrétaire général aura transmis le projetd'amendement.

3. Le Secrétaire général adressera le plus tôtpossible à toutes les parties contractantes unenotification pour leur faire savoir si une objec-tion a été formulée contre le projet d'amende-ment. Si une objection a été formulée contrele projet d'amendement, l'amendement seraconsidéré comme n'ayant pas été accepté et serasans aucun effet. En l'absence d'objection,l'amendement entrera en vigueur pour toutes

Article 42

In addition to the notifications provided forin articles 40 and 41, the Secretary-General ofthe United Nations shall notify the countriesreferred to in article 33, paragraph 1, and thecountries which have become ContractingParties under article 33, paragraph 2, of:

(a) Signatures, ratifications and accessionsunder article 33 ;

(fe) The dates of entry into force of thisConvention in accordance with article 34;

(c) Denunciations under article 35 ;

(df) The termination of this Convention inaccordance with article 36 ;

(e) Notifications received in accordancewith article 37 ;

(/) Declarations and notifications receivedin accordance with article 39, paragraphs 1and 2;

(g) The entry into force of any amendmentin accordance with article 41.

Article 43

As soon as a country which is a ContractingParty to the Agreement providing for the Pro-visional Application of the Draft InternationalCustoms Conventions on Touring, on Commer-cial Road Vehicles, and on the InternationalTransport of Goods by Road done at Genevaon 16 June 1949 becomes a Contracting Partyto this Convention, it shall take the measuresrequired by article IV of that Agreement todenounce it as regards the Draft InternationalCustoms Convention on Touring, in so far asthis denunciation does not already result auto-matically from article V of that Agreement.

Article 44

The Protocol of Signature of this Conven-tion shall have the same force, effect and dura-tion as the Convention itself of which it shallbe considered to be an integral part.

Article 45

After 31 August 1956, the original of thisConvention shall be deposited with the Secre-tary-General of the United Nations, who shalltransmit certified true copies to each of thecountries mentioned in article 33, paragraphs1 and 2.

б) Les dates auxquelles la présente Conven-tion entrera en vigueur conformément àl'article 34;

c) Les dénonciations en vertu de l'ar-ticle 35;

à) L'abrogation de la présente Conventionconformément à l'article 36 ;

e) Les notifications reçues conformément àl'article 37;

/) Les déclarations et notifications reçuesconformément aux paragraphes 1 et 2 de l'ar-ticle 39;

g) L'entrée en vigueur de tout amendementconformément à l'article 41.

Article 43

Dès qu'un pays qui est partie contractanteà l'Accord relatif à l'application provisoire desProjets de Conventions internationales doua-nières sur le tourisme, sur les véhicules routierscommerciaux et sur le transport internationaldes marchandises par la route, en date, àGenève, du 16 juin 1949, sera devenu partiecontractante à la présente Convention, il pren-dra les mesures prévues à l'article IV de cetaccord pour le dénoncer en ce qui concerne leProjet de Convention internationale douanièresur le tourisme, pour autant que cette dénon-ciation ne résulte pas déjà ipso facto de l'articleV de cet accord.

Article 44

Le Protocole de signature de la présente Con-vention aura les mêmes force, valeur et duréeque la Convention elle-même dont il sera con-sidéré comme faisant partie intégrante.

Article 45

Après le 31 août 1956, l'original de la pré-sente Convention sera déposé auprès du Secré-taire général de l'Organisation des NationsUnies, qui en transmettra des copies certifiéesconformes à chacun des pays visés aux para-graphes 1 et 2 de l'article 33.

ANNEX 4

EXTENSION OF VALIDITY OF THE "CARNET DE PASSAGES EN DOUANE"

1. The stamp for extension of validity shall con-form to the model given in the present annex.

The text shall be drawn up in French, but maybe repeated in another language.

2. The following procedure shall be observed bythe person requesting the extension and by the guar-anteeing association dealing with the request:

(a) When the holder of a carnet de passages endouane finds himself obliged to request an extensionof the period of validity of the document, he shouldsend the cornet to the guaranteeing association witha request for its extension, explaining the circum-stances which oblige him to make the request. Heshould enclose with his request, as supporting evi-dence, a medical certificate, a statement from therepair shop repairing his vehicle, or some otherauthentic document to prove that the delay in ques-tion is caused by force majeure.

(b) If the guaranteeing association considers thatthe request for extension can be passed on to theCustoms authorities, it should affix the stamp re-ferred to in paragraph 1 on the front cover of thecarnet de passages en douane in the space left spe-cially for the purpose.

(c) In the left-hand section of the stamp theguaranteeing association should enter, in figures

and words, the date until which the extension isrequested. The President of the association or hisrepresentative should affix his signature and thestamp of the association.

(d) The length of the extension must not exceeda reasonable time in which to complete the journey,and should not normally exceed three months fromthe previous date of expiry of the carnet.

(e) The guaranteeing association should thensend the cornet to the competent Customs authorityin its country, with the holder's application and thesupporting evidence attached.

(/) The Customs authority will decide whetherthe extension can be granted. It may shorten theperiod of extension requested, or refuse to grant anyextension whatsoever. If an extension is granted, thecompetent Customs officer should fill in the remain-ing spaces on the stamp affixed on the cover of thecarnet by the guaranteeing association, inserting aserial or registry number, the place and date, hisofficial status, and adding his signature and the Cus-toms stamp.

(g) The carnet should then be returned to theguaranteeing association, which in turn should handit back to the person concerned.

PROLONGATION DE LA VALIDITE DU CARNET DE PASSAGES EN DOUANE

1. La formule de prolongation de validité doitêtre conforme au modèle figurant dans la présenteannexe.

La formule est libellée en français. Les mentionsqu'elle contient peuvent être répétées en une autrelangue.

2. La personne qui demande la prolongation etl'association garante qui s'occupe de cette demandese conforment à la procédure indiquée ci-après:

а) Dès que le titulaire d'un carnet de passages endouane s'aperçoit qu'il est contraint de demanderune prolongation du délai de validité de son docu-ment, il remet avec son carnet, à l'association garante,une demande de prolongation expliquant les circons-tances qui l'ont obligé à formuler cette requête. Atitre justificatif, il joint à la demande, selon le cas,un certificat médical, une attestation de l'atelier deréparation, ou toute autre pièce authentique établis-sant que la force majeure invoquée est réelle.

б) Si l'association garante estime que la demandede prolongation peut être présentée à la douane, elleimprime, au moyen d'un timbre humide, la formulevisée au paragraphe 1 sur la couverture du carnetde passages en douane, à l'endroit spécialement ré-servé à cet effet.

c) L'association garante indique, dans la partiegauche de la formule, jusqu'à quelle date (en lettres

et en chiffres), la prolongation est sollicitée. Y sontapposés la signature du président de l'associationou de son délégué ainsi que le cachet officiel del'association.

d) La durée de prolongation ne doit pas excéderle délai raisonnablement nécessaire pour terminerle voyage, délai qui ne devrait normalement pasdépasser trois mois à compter de la date de péremp-tion du carnet de passages en douane.

e) L'association garante transmet ensuite le car-net à l'autorité douanière compétente de son pays.Elle joint au carnet la demande du titulaire, accom-pagnée des pièces justificatives.

/) L'autorité douanière décide si la prolongationdoit être accordée. Elle peut réduire la durée de laprolongation demandée ou refuser d'accorder touteprolongation. Si la prolongation est accordée, lefonctionnaire compétent de la douane complète laformule imprimée sur la couverture du carnet parl'association garante, lui donne un numéro d'ordreou d'enregistrement, fait mention du lieu, de la dateet de sa qualité. Il revêt ensuite la formule de sasignature ainsi que du cachet officiel de la douane.

g) Le carnet de passages en douane est alors ren-voyé à l'association garante, qui le restitue à l'in-téressé.

At the time of signing the Convention ofthis day's date, the undersigned, duly author-ized, make the following declarations :

1. When a Contracting Party considerscarnets de passages en douane indispensablefor certain commercial aircraft, the provisionsof this Convention shall be applied mutatismutandis.

2. The terms of this Convention set outminimum facilities. It is not the intention of theContracting Parties to restrict the wider facili-ties which are granted or may be granted bycertain of them in respect of the temporaryimportation of aircraft and pleasure boats.

4. The Contracting Parties recognize thatthe satisfactory operation of this Conventionrequires the provision of facilities to the au-thorized associations for:

(а) The transfer of the currency necessaryfor the payment of import duties and importtaxes claimed by Customs authorities of one ofthe Contracting Parties for non-discharge ofthe temporary importation papers covered bythis Convention;

(б) The transfer of currency when repay-ment of import duties or import taxes is madein accordance with the arrangements laid downin article 27 of this Convention; and

3. The Contracting Parties reserve the rightto grant the same advantages to persons nor-mally resident on the territory of non-Contract-ing Parties.

(c) The transfer of currency for paymentfor temporary importation papers sent to theauthorized associations by the correspondingassociations or federations.

Au moment de procéder à la signature de laConvention portant la date de ce jour, les sous-signés, dûment autorisés, font les déclarationssuivantes:

1. Lorsqu'une partie contractante estime nepouvoir dispenser certains aéronefs commer-ciaux de carnets de passages en douane, les dis-positions de la présente Convention s'appli-quent mutatis mutandis.

2. Les dispositions de la présente Conven-tion déterminent des facilités minimales. Iln'est pas dans l'intention des parties contrac-tantes de restreindre les facilités plus grandesque certaines d'entre elles accordent ou pour-raient accorder en ce qui concerne l'importa-tion temporaire des embarcations de plaisanceet des aéronefs.

3. Les parties contractantes se réservent ledroit de consentir les mêmes avantages auxpersonnes ayant leur résidence normale sur leterritoire des pays non contractants.

4. Les parties contractantes reconnaissentque la bonne exécution de la Convention re-quiert l'octroi de facilités aux associations au-torisées en ce qui concerne:

а) Le transfert des devises nécessaires aurèglement des droits et taxes d'entrée réclaméspar les autorités douanières d'une des partiescontractantes pour non-décharge des titresd'importation temporaire prévus par la Con-vention ;

б) Le transfert des devises lorsqu'il y a res-titution des droits ou taxes d'entrée en confor-mité des dispositions de l'article 27 de la Con-vention; et
