But some provisions of CLND act with its noble intentionof quick and adequate compensation of victims, has failed to allaymany fears generated by it.This act makes both the operator and supplier liable to providecompensation whereas international practice recognizes theliability of operator only. The same provision (section 17b) placesunlimited liability in terms of time and quantum on suppliers whichis unacceptable to them. If an accident occurs because of a smallinstrument even after 50 years of installation, then the supplier willhave to pay compensation in millions.This open-ended liability makes them difficult to find insurer andeven if they do find one, it makes nuclear energy economicallyunviable. The insurance pool is about $350 mn recently suggestedby India discarded saying insufficient.Finally there are some ambiguities regarding section 46. Instead ofchannelizing liability to operator for victims, the provision opensdoor for filing any case (civil or criminal) against the supplier by anylaw other than CLND act. Moreover, there is no clarity over theterm nuclear damage.Indian government must realize such provisions are affecting andforeign and domestic suppliers equally. Finite liability for suppliers,
