    SAMPLE

    DELEGATION AGREEMENT

    between the Department and the

    Massachusetts Human Resources Division

    In accordance with the provisions of MGL Chapter 31, section 5(l), thisagreement between the Human Resources Division (HRD) and the Department is for the purpose of delineatingthe responsibilities of the parties in the delegation of certain duties andpowers of the HRD to the City/Town/Department pertaining to the selectionprocess for , Department.

    The City/Town/Department has agreed to hire a consultant to develop,construct, validate, administer and score a assessment center and

    to pay all attendant costs associated with same. With the exception ofadditional points as required by statute or rule, including credit foremployment or experience in the title, this delegated selectionprocess for will be used as the sole basis for scoring and rankingcandidates on an eligible list. The City/Town/Department may forego the useof any written test administered by HRD. Nothing in this delegationagreement precludes the use of a written examination componentdeveloped by the consultant as part of the overall assessment centeractivities.

    Upon the Citys/Towns/ Departments submission to HRD of the

    credentials and references of the proposed consultant and the approval ofHRD regarding the selection of the consultant, HRD will work with andapprove the actions of the consultant in, but not limited to, the followingareas:

    1. Determination of the knowledges, skills, abilities and personalcharacteristics (KSAP's) that are supported by job analysis data thatwill be evaluated during the assessment center exercises.

    2. The development of the departmental promotional examinationannouncement to be used to solicit applications including a description

    of duties; the required knowledges, skills, abilities and personalcharacteristics as supported by job analysis data which will be measuredby the delegated selection activities; a description of the testing processto be used including any reading lists and preparation guides; testingdate(s); deadline for filing applications; salary for the position; and anyapplicable fees. HRD will, upon request, provide sample language for theannouncement, consistent with statutory requirements, regarding

    eligibility for the selection process and statutory preferences. TheCity/Town/Department must ensure proper posting of the examinationannouncement in all City/Town/Department stations.

    3. Discussions relative to the job-related, content valid questions/activities

    that will be used during the assessment center.

    4. The security plan that will be utilized to ensure the integrity of theassessment center.

    5. Any training materials or sessions that will be distributed to/conductedfor applicants prior to the administration of the assessment center inorder to familiarize them with assessment center procedures.

    6. The review of any validation materials which support the assessment

    center activities.

    7. The composition and selection of the assessors for the assessmentcenter exercises.

    8. The training of the assessors in the use of the rating schedules andadministration of the exercises.

    9. The review and approval of the rating schedules to be used.

    10. The Human Resources Divisions and Citys/Towns/Departments

    representation as observers only for the assessment center components.

    11. Reviews permitted pursuant to Section 22 of Chapter 31 shall be theresponsibility of the consultant, with the approval of HRD.

    12. The determination of a passing point for the assessment center.

    It is agreed that:

    I. HRD authorizes , , Organizational DevelopmentGroup/Civil Service Unit, (617)878-xxxx, to act as its representative in

    all matters relative to this delegation agreement.

    II. Primary responsibility for the administration of all delegated civil servicefunctions, as described herein, for the City/Town/Department will beassigned to , who will serve as Delegation Administrator.He/she, or his/her designee, will be responsible for all matters relativeto this delegation agreement.

    III. The Delegation Administrator shall be responsible for the following:

    A. all notifications to all eligible candidates, acceptance and processingof examination applications, verification of examination eligibility,and security of the administration and scoring of the selection

    process that results in the establishment of an eligible list for;

    B. establishment and maintenance of the eligible list for for aminimum of two years in accordance with applicable statutorypreferences; and

    C. certification from the eligible list in accordance with laws, rules,regulations and procedures.

    IV. The Delegation Administrator will be responsible for ensuring continued

    public access to all records determined to be public information. Theeligible list, certifications and reasons for selection must be madeavailable for review by any individual or group of individuals uponrequest. All information relating to name and standing is deemed publicinformation and must be made available; information relative to date ofbirth/age, social security number, marital status and other personaldata must be removed by the Delegation Administrator from lists orcertifications undergoing public review.

    V. Copies of the eligible list and certifications must be made available tomembers of the public upon request at a reasonable cost.

    VI. The Delegation Administrator will be responsible for ensuring thatcandidates can review their standing on the established eligible listupon written request. (Such review must be made in the presence ofthe Delegation Administrator or designee to ensure that there is noalteration or destruction of material.) Should an individual wish copiesof any materials such copies shall be provided to the individual at areasonable cost.

    VII. Periodic or random audits of all delegated personnel transactions maybe conducted at any time by representatives from HRD. All records,

    ledgers and correspondence relating to the delegated civil servicefunctions shall be made readily available and accessible to the HRDauditor. A report on audit findings will be made available to theDelegation Administrator and corrective action, if necessary, on anyproblems or errors found during that audit must be taken by theCity/Town/Department within thirty 30 days from receipt of the auditreport. A written report of that corrective action shall be submitted toHRD.

    VIII. It will be the responsibility of HRD to provide and explain to theDelegation Administrator any changes in civil service law and ruleswhich may directly affect any of the delegated functions.

    IX. The Human Resources Division will be responsible for notifying theDelegation Administrator on a timely basis of any changes in internalprocedures which may affect the delegated functions.

    X. The assistance of HRD will be consistently available to the DelegationAdministrator throughout the delegation process and HRD will providetechnical assistance to the Delegation Administrator for any delegatedfunction as required.

    XI. Changes in approved procedures for the administration of delegatedfunctions may not be made without the review and approval of both

    parties. No duties may be assumed by the Delegation Administratorwhich have not been authorized by this agreement or subsequentattachment.

    XII. The cost of all services, forms, and materials provided directly by HRDshall be assumed by HRD unless otherwise agreed to by both parties.All other costs involved in the delegation of civil service functions will bethe responsibility of the Department.

    XIII. The City/Town/Department may elect to charge a reasonable fee, as setby statute (currently $125 per application), to offset the administrative

    costs of the selection process. Any processing fees realized through thedelegation of these functions are considered the property of theCity/Town/Department.

    XIV. If at any time after this initial agreement either theCity/Town/Department or HRD determines that delegation authorityshould be discontinued, reversion of the authority for all delegatedfunctions to the City/Town/Department may be effected through 30days written notice, by registered mail, by either theCity/Town/Department or the Personnel Administrator (Chief Human

    Resources Officer ).

    XV. The specific functions to be delegated are described and detailed in thisAgreement. As further functions are delegated, detailed descriptionsshall be reviewed by both parties and appended to this Agreement.
