Green, Manager, Institution for Girls, Hay, was alleged to have been gu11ty of certain charges w1 thin the meaning of paragraphs (c), (e), (f) and (h) of subsection (1) of Section 56 of the Public Service Act , 1902, as amended, details of wh.ieh were set out by 1etter dated 2nd November, 1962, the Board decided to initiate an Inquiry under Section 58 of the said Aot. By letter dated 6th November, 1962, Messrs. J. Antill Millett & Partners, Solicitors, on beha.l£ of Mr. Green, denied the truth of the charges. In pursuance of the provisions of Section 56{2)(c) of the said Act, the Board appointed Mi·. J.R. Scarlett, Stipendiary Magistrate, to inquire a.s to the truth of the chargee. The InqUiry was held at this Office on )rd and 4th January, 196). Mr . S.B. Rose, of the Crown Solicitor's Office, with Messrs . E.R. Troy, Chief of Field Division, and E. Moylan, Chief of Establishments Division, represented the Department . Mr. s. Ross, of Counsel, instructed by Mr . I. W. Gordon of Messrs. J. Antill Millett & Partners , Solicitors, appeared for Mr. Green. In his report, the Stipendiary Magistrate recited that, upon the charges laid under paragraphs (f) and (h) of Section 56(1) , it was announced before him that no evidence would be offered. Such charges are to be regarded as not proved. The Magistrate :f'Urther advised the Board that he found the charge lnid under paragraph {o) of Section 56(1) wae provedl and that that laid under paragraph ( e ) of Section 56l1) was not proved. After hearing further representations at this Office on 24th January, 1963, the Board decided that Mr. Green was not to be pemitted to remain at Hay and directed that he was to be transferred to some other position in the Department of Child Welfare and Social Welfare and revert to his substantive rank . Re is to retain his substantive salary of £1419 per annum (£15.0.0 w.b.), together with such allowances, if e:ny, a.e may attach to the position within the Department to NSW.COM.502.001.2376_E
