STATEMENT EXPLAINING HOW THE COMPANY'S OPERATING PROCEDURES ENSl RE

COMPLIANCE WITH THE FCC'S CPNI RULES

I. Customer Proprietary Network Information ("CPNI")

(TNI is defined in Section 222(0 of llie Communications Act as (A) information that relates to the quantity,

technical configuration. type, destination, and amount ol us e of a telecommunications s e r v i c e subsc r i bed to b> any

customer of a telecommunications carrier, and that is made available lo the carrier hy th e cus tomer solely by virtue

of the ca r r i e r - cus tomer relationship; and (B) information con ta ined in the hills pertaining lo telephone exchange

sc r v i ce or telephone toll se r v i c e r e c e i v e d by a customer of a carrier (except that CPNI does no t include subscriber

list information).

(ienerally. CPNI includes personal information regarding a consumer's use of his or her telecommunications

se r v i c e s . CPNI encompasses information such as: (a) Ihe telephone numbers called hy a consumer: (b) the

telephone numbers calling a customer: (c) the lime, location and duration of a consumer's outbound and inbound

phone calls, and (d) th e te lecommunicat ions' and information se r v i ces purchased hy a consumer.

Call detail information (also known as"call records") is a category of (TNI that is particularly sensitive from a

p r i v a c y standpoint an d that is sought b> pretexlers. hackers an d other unautbori/ed en t i t i es fo r illegitimate

purposes. Call detail includes any information that perta ins lo the transmission of a specific telephone call,

including Ihe number called (for outbound calls), the number from which [h e call was placed (for inbound calls),

and thedale. time, location and'or duration of th e call (for all calls).

II. Use and Disclosureof CPNI Is Restricted

Ihe Company re cogn izes that CPNI includes information that is personal and individually identifiable, and mat

p r i v a c y concerns have led Congress and Ihe f'CC to impose res t r i c t i ons upon its use and disclosure, and upon the

provision of access to it by individuals or ent i t ies inside and outs ide the Company.

Ihe Company hasdesignated a CPNI Compliance Officer who is responsible for: ( I ) communicating with the

Company's atto rneys and/or consul tants regarding (TNI responsibil ities, requirements and r e s t r i c t i o n s ; ( 2 )

supervising the training of Company emp loyees and agents who use or h a v e access lo CPNI: (3) supervising the

use. disclosure, distribution or access to the Company's CPNI hv independent con t rac to rs an d joint veniurepartners: (4) maintaining records regarding the useof CPNI in marketing campaigns; and (5) receiving, reviewing

and resolving ques t ions or i ssues regarding use. d i sc losu re , distribution or provision of access to CPNI.

Company employees an d agents that may deal with CPNI have been informed that ihere arc substant ia l federal

restrictions upon C ' P N I use. distribution and access . In order to he authori/ed to use or access th e Company's

('I'M. employees and agents must r e c e i v e training wi th respec t to the requirements ol" Section 222 of the

Communications Act and the ICC'sCPNI Rules (Suhparl 1 1 of Part 64 of the l-'CC Rules).

Before an agent, i ndependent contractor or joint veniure partner may rece i ve or he allowed lo access or use the

Company's CPNI. the agent 's, independent con t rac to r ' s or j o i n t veniure partner's agreement with Ihe Company

must contain provisions (or the Company and th e agent, independent contractor or joint veniure partner must enter

into an additional confidentiality agreement which p r o v i d e s ) thai: ( a ) the ageni. independent contractor or joint

v e n t u r e partner may use th e CPNI onl\r th e purpose lor w h i c h the (TNI has been provided; (b) th e agent,

independent contractor or joint ven tu re partner may not disclose or distribute the CPNI to, or allow access to llie

CPNI by. any other parly (un less the agent, i ndependent contractor or joint venture partner is express ly andspecifically required to do so by a court order); and (c) Ihe agent, independent contractor or joint veniure partner

m us t implement appropr i a te and specific safeguards acceptab le lo the Company to ensure the confidentiality of

th e Company's CPNI.

III. Protection of CPNI

I. Ihe Company may. after r e c e i v i n g an appropriate w r i t t e n request from a customer disclose or provide the

c u s t o m e r ' s CPNI to the ctisiomer by sending il lo th e customer's address or record. Any and all such customer

requests : ( 1 ) rnusl be made in writing; (2) must include Ihe cus tomer ' s co r rec t billing name and address ami

D e c e m b e r 8, 2007, passwords may NOT be based u pon read i ly ob t a i nab l e b i ograp h ic a l in format ion (e.g., th e

customer's name, m o t h e r ' s maiden name, soc ia l sec ur i t y number or date of b i r t h ) or account in format ion (e.g., th e

customer's t e l ep ho n e n u m b e r or address).

1 8. S ince D e c e m b e r 8 , 2007. customers may obtain an i n i t i a l or replacement password: ( i ) i f they come i n person

to th e Company's bus iness off ice , produc e a dr iver ' s l i c ense , passport or o t her government - i s sued iden t i f i c a t ion

v e r i f y i n g t h e i r i d en t i t y , an d c orrec t ly answer c er t ain qu es t ions regard i ng t he i r service an d address; or ( i i ) i f they

cal l a spec if ied Company telephone number f rom their telephone number of record, and then wait at that n u m b e r

u n t i l a Company representat ive cal ls them back and o b t a i n s correct answers t o c er t a in ques t ions regard ing t he i r

service and address.

1 9 . Sinc e Dec ember 8 , 2007, the Company w i l l not i fy customers imm edi a t e ly o f c er t a in c hanges in t h e i r accounts

that may affec t privacy or securi ty mat ters .

a . The types of cha n ges tha t r e q u i r e i m m e d i a t e not i f i c a t i on i nc lude : (a) change or request for change of the

customer's password; (b ) c hange or reques t fo r c hange of th e customer's address of record; (c ) change or

r e q u e s t fo r c hange of any s i g n i f i c a n t e l e m e n t of the c us t omer ' s on l ine ac c ount ; and (d) a c h a n g e or r e q u e s tfo r change to the cus tomer ' s responses wi th respect to the back -up me ans of authent icat ion for lost or

forgot ten passwords.

b . The no t i c e may be p ro v i ded by: (a) a C o m p a n y call or v o i c e m a i l t o t he c us t omer ' s t e l ephone number o f

record; (b) a Company t ex t message to the c u s t o m e r ' s t e l e p h o n e n u m b e r of record; or (c) a w ri t t en not i c e

m a i l e d to t h e c us t omer ' s address of record (to the custo me r's prior addre ss of record i f the chang e i n c l u d e s a

c hange in the customer's address of record).

v o ice ma i t message c o m p r i s i n g th e notice; and (c) the da te and t ime tha t th e no t i ce w as sent.

20. Since Decemb er 8, 2007, the Company m u s t p r o v i d e an in i t ia l notice to law e n fo rce me n t and a subsequen t

not i ce to th e cus tomer i f a s ecur i ty breach resul ts in the disclosure of the customer 's CPNI to a third par ty without

th e customer's au thor i sa t i on .

a. As soon as pract icable (and in no event more than seven (7) days) af ter the Company di scover s tha t a

person (wi thout au thor i za t i on or exceeding au tho r i za t ion ) has in te n t io n a l ly gained access to , used or

disclosed CPNI, the Company mus t p rovide e l ec t ron ic notif ication of such breach to the U n i t e d States Secret

Service and to the Federal Bureau of Invest igat ion via a centra l repor t ing fac i l i ty accessed through a l i n k

maintained by the FCC at lHtp : / /vyw\v . lcc .gg,> ' / eb /cmi i .

21 . Since December 8 , 2007, the Company will provide customers with access to CPNI at its retail locations if the

customer presents a v a l id photo ID and the v a l i d photo ID matches the name on the account .

22. Since December 8, 2007, the Company takes reasonable measures to discover and protect against act ivi ty that

is i n d i c a t i v e of pretext ing i n c l u d i n g requ ir ing Company e mplo yees , agents , i ndependent contractors and joint

record," " te lephone n um ber o f record" or other signif icant se rv i ce in f orm ation ); (c) any and al l discove red

instances where access to the Company ' s e l ec t ron ic f i les or databases containing passwords or C P N I w as den ied

due to the p ro v is io n of incorrect l og i ns and/or passwords; and (d) any complaint by a customer of unauthor ized or

inappropriate use or disclosure of his or her CPNI. T h e CPNI Compl iance O f f i cer wi l l r eques t fu r ther in fo rma t ion

in w r i t i n g , and invest igate or supervi se th e i nves t iga t ion of , any i nc iden t or group of incid ents that reasonab ly

appear to entail pretexting.

In addit ion to th e speci fic matters required to be r eviewed and approved by the Company ' s CPNI Compl iance

Off i ce r , e m p l o y e e s an d agents, i ndependen t contractors an d jo int v enture par tners ar c strongly encouraged to br ing

an y and al l other qu est ions , issues or uncer ta in t i es r ega rding th e use, disclosure, o r access to C P N I to the a t t en t ion

of the Company's CPN I Com pliance Of ficer for appropr ia te inve st igat ion, review and guidance. The exten t to

w h i c h a par t icular employee or agent brought a CPNI mat ter to the a t t en t ion o f the C P N I C o m p li a nc e O f f i c e r an d

received appropr ia te guidance is a mater ia l considerat ion in any discipl in ary act ion brought against the emp loyee

or agent f or impermissible use, disclosure or access to C P N I .

c i r cums tances o f the v io la t ion ( i n c l u d i n g the sever i ty of the viola t ion, whether the v i o l a t i on was a f irst t ime o r

repeat v i o l a t i o n , w h e t h e r approp r iate gu idanc e w a s sought or r ece ived f rom th e C P N I C o m p l i a n c e Off i cer , a nd th e

extent to w h i c h th e v io la t ion was or was no t de l i b e ra t e or mal ic ious ) .
