IT IS RECOMMENDED THAT YOUR BOARD ACTING AS THE GOVERNING BODYOF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT:

1. Acting as a responsible agency for the proposed project, consider the

Negative Declaration prepared and adopted by the County SanitationDistrict No. 18 of Los Angeles County as lead agency, together with anycomments received during the public review process; certify that yourBoard has independently considered and reached its own conclusionsregarding the environmental effects of the project as shown in the

Negative Declaration, and find on the basis of the whole record before

your Board that there is no substantial evidence the project will have asignificant effect on the environment.

2. Find that the proposed grant of easement for sewer line purposes and the

subsequent use of said easement will not interfere with the use of CoyoteCreek for any purposes of the Los Angeles County Flood Control District.

3. Approve the grant of an easement for sewer line purposes from the

Los Angeles County Flood Control District to the County Sanitation DistrictNo. 18 of Los Angeles County within Coyote Creek, Parcels 127, 305,and 307.

4. Instruct the Chair to sign the Easement document and authorize delivery

to the County Sanitation District No. 18 of Los Angeles County.

PURPOSE/JUSTIFICA TION OF RECOMMENDED ACTION

The purpose of the recommended actions is to consider the previously adoptedNegative Declaration (attached) and allow the Los Angeles County Flood ControlDistrict (LACFCD) to grant an easement for sewer line purposes across a portion ofCoyote Creek to the County Sanitation District (CSD) No. 18 of Los Angeles County.

CSD requests the Easement in connection with their East Imperial Highway ReliefTrunk Sewer project. The granting of this Easement is not considered adverse to theLACFCD's purposes. Moreover, the instrument reserves paramount rights for theLACFCD's interest.

Implementation of Strateççic Plan Goals

This County Strategic Plan directs the provision of Community Services (Goal 6). Thistransaction allows for the continuation of sewer services to the area thereby improvingthe quality of life for County residents.

The will be no impact to the County General Fund.

There is no monetary consideration for the granting of this Easement. The LACFCD isresponsible for replacing CSD's easement due to relocation of their facilities as a resultof LACFCD's construction of Coyote Creek.

FACTS AND PROVISIONS/LEGAL REQUIREMENTS

Coyote Creek, Parcels 127, 305, and 307, are located north of Imperial Highway andwest of Marquardt Avenue in the unincorporated territory of the County of Los Angeles.

As a part of the original construction of Coyote Creek in the 1960's, CSD's waterlinewas relocated and a replacement easement was to be granted. While processingCSD's current request for a permit to relocate a part of their existing sewer line, CSDdiscovered the easement was never acquired from LACFCD. They request thisEasement for the continued right to operate and maintain their sewer line.

The proposed grant of easement is authorized by Section 2, Paragraph 13, of theLos Angeles County Flood Control Act. This Section provides as follows: "To...sell ordispose of any property (or any interest therein) whenever in the judgment of said boardof supervisors, said property, or any interest therein, or any part thereof, is no longerrequired for the purpose of said district... II

The granting of this Easement will not hinder the use of Coyote Creek for possibletransportation, utility, or recreational corridors.

The Easement has been approved by County Counsel and will be recorded.

ENVIRONMENTAL DOCUMENTATION

In this grant of Easement to CSD for sewer line purposes, LACFCD is acting as aresponsible agency. The County Sanitation District No. 18 of Los Angeles County, aslead agency, prepared an Initial Study and consulted with LACFCD in compliance withthe California Environmental Quality Act (CEQA). The Initial Study showed that there isno substantial evidence that the project may have a significant effect on theenvironment. The project is not exempt from payment of a fee to the California Department of Fishand Game pursuant to Section 711.4 of the Fish and Game Code to defray the costs offish and wildlife protection and management incurred by the California Department ofFish and Game. CSD has paid the fee. Upon your Board's approval of the project, theDepartment of Public Works (Public Works) will file a Notice of Determination inaccordance with Section 21152(a) of the California Public Resources Code and pay therequired filing fees with the Registrar-Recorder/County Clerk in the amount of $50.

IMPACT ON CURRENT SERVICES (OR PROJECTS)

This action allows for the joint use of LACFCD's right of way without interfering with theprimary mission of the LACFCD.

EASEMENT

For a valuable consideration, receipt of which is hereby acknowledged, the LOS ANGELESCOUNTY FLOOD CONTROL DISTRICT, a body corporate and politic (hereinafter referred to asDISTRICT), does hereby grant to COUNTY SANITATION DISTRICT NO. 18 OF LOS ANGELESCOUNTY, a body corporate and politic (hereinafter referred to as GRANTEE), a perpetual easementfor sewer line purposes and the right to lay, construct, maintain, reconstruct, use, and operatesewers and appurtenances in, on, over, under, and across the real property in the unincorporatedterritory of the County of Los Angeles, State of California, described in Exhibit A attached hereto andby this reference made a part hereof.

Together with the further right to enter upon and to pass and repass over and along saideasement and right of way and to deposit tools, implements and other materials thereon byGRANTEE, its offcers, agents, and employees, and by persons under contract to construct saidsewers and appurtenances, and their employees, whenever and wherever necessary for thepurposes above set forth, and the right to enter upon and use such land adjoining said easementand right of way as is necessary for construction of said sewers and appurtenances.

PROVIDED, however, that this conveyance is made under and subject to the followingreservations and conditions which the GRANTEE, by the acceptance of said easement and right ofway, agrees to keep and perform, viz:

1. DISTRICT reserves the paramount right to use said land for flood control purposes.

2. GRANTEE agrees that it will not perform or arrange for the performance of anyconstruction or reconstruction work in, on, over, under, and across the land hereindescribed until the plans and specifications for such construction or reconstruction

work shall have first been submitted to and been approved in writing by the ChiefEngineer of the Los Angeles County Flood Control District, which approval shall notunreasonably be withheld. Such approval by DISTRICT shall not be interpreted orinferred as an endorsement or approval as to the design, accuracy, correctness orauthenticity of the information shown on the submitted plans and specifications.DISTRICT does not accept ownership or responsibility for the improvements.

3. GRANTEE agrees that it will indemnify and save harmless DISTRICT, its officers,agents, and/or employees, from any and all liability, loss, or damage to whichDISTRICT, its officers, agents, and/or employees, may be subjected as the result ofany act or omission by GRANTEE, its officers, agents, or employees, arising out of theexercise by GRANTEE, its officers, agents, or employees of any of the rights grantedto it by this Easement.

4. It is expressly understood that DISTRICT will not be called to construct, repair,

maintain, or reconstruct any structure or improvement to be erected or constructedpursuant to this Easement.

5. DISTRICT reserves the right to build structures or other improvements for flood controlpurposes over and across the herein described land. GRANTEE shall be responsiblefor reinforcing or relocating seWers and appurtenances, if required, due to the exerciseof the rights reserved to DISTRICT as above provided. DISTRICT agrees to submit tothe Chief Engineer and General Manager of GRANTEE plans and specifications forthe structures or improvements at least 12 months before the commencement ofconstruction.

6. DISTRICT reserves the right to pave, raise, or lower the ground surface elevation ofthe herein described land. GRANTEE shall be responsible for reinforcing the sewersand adjusting the grades of its manhole covers if required due to the exercise of thisright by the DISTRICT.

7. GRANTEE will restore and replace the surface of the ground and the improvementsover the above mentioned right of way and will repair any and all damage to theproperty of DISTRICT adjoining the said right of way, which is injured or damaged inthe construction, operation, or maintenance of the said sewers and appurtenances.

8. The provisions and conditions contained in this Easement document shall be binding

upon GRANTEE, its successors, and assigns.

However, the constrction related traffic impact wiJ not increase the level of servce of the impacted streets.Constrction related traffc wil be Jimited to off-peak commute hours to the extent feasible, and any needed
