What a year this has been. I must confess that at the beginning of my term I was uncertain as to how I would satisfy or fulfill all of the duties of being the president of our association. However, as the year unfolded the experiences that I have had have made this a rewarding and enjoyable time.

I can’t believe how fast these past twelve months have gone when I think back over all of the things that have occurred.

Many things stand out in my mind. The trip to Washington DC where I was able to meet with my counter-parts across the nation and dis-cuss with them the challenges that we face here in South Dakota only to find out that those same chal-lenges exist throughout the coun-try. We are not alone in having inadequate funding to do all of the responsibilities that county gov-ernment has. Whether it’s most rural counties or the most urban counties, we are all united in this regard. The dedication that people

have to their po-sitions also was reassuring that we all take our responsibilities very seriously.

Having traveled around the state and meeting many of you has been an-other rewarding experience and a better under-standing of the uniqueness of counties as they face their day-to-day responsi-bilities.

I remember tes-tifying in front of the legislature which is a new experience for me and when

completed that I felt they had lis-tened and one of the major pieces of legislation was SB1 that gave county governments the ability to have additional funds for their roads and bridges.

I represent the county of Mellette which has a great deal of govern-ment land which does not give us any revenue for our budget. One of the reasons that NACo is so im-portant to our state and to counties like mine is that they are one of the main reasons that PILT is passed every year which allows for com-pensation for the loss of taxes off of these government lands.

Learning more about NACo’s over-all influence in national govern-ment and all of the services that it provided for counties if they chose to use them was also an eye-open-ing revelation. As we approach a new legislative year it is my hope that our as-sociation looks carefully at what it proposes and that we are able to give full endorsement to these measures that are passed by our association and also provide full support for our executive director as he lobbies in our legislature.

I wish to thank all of you for your support and friendship and this has been an experience that I will never forget. I wish all of you well.

SDACO PresidentDonna MayerIn July, I had the privilege of at-tending the NACo Conference in Charlotte, North Carolina. It was a great educational and entertaining experience. The first day, Christie Gunkel and I attended the Technol-ogy Innovation Summit. Emerg-ing as the biggest growing cyber threat is health records because they have so much of our personal information. The phone number “211” was created for the public to call to seek assistance as to which government agencies possibly can help them in their time of crisis. Also was covered how technology has helped Texas counties saved money by creating a collaboration among urban counties Sheriff’s office, States Attorney, Public Defenders/defense attorneys in which the charges, evidence, filed documents are all in a file system that they can access can open and examine per their clearance. Since their offices were miles apart, they saved time from people going back and forth to examine everything and were able to have quicker trials for the defendant. So think out of the box to create uses to help your county through tech-nology.

Saturday was exhibits, committee meetings and steering committee meetings, which we could attend. The public lands committee hear-ing was very educational and en-tertaining watching people negoti-ate the changes to the resolutions.

The Premier Solutions Session was about helping counties reduce

costs by making our printers, cop-ies and other office machine work more efficiently for us and methods to secure copies or documents created to be picked up only the producer of the copy or document. What I liked is Premier Solutions work with our local vendors when available, so we are not cutting out our local businesses.

I attended a County Prosperity Form – Economic Development in Small and Mid-sized Counties. NACo has developed a proto type, where they work with communities that have lost their major factory, coal mines shut down, etc. Instead of just throwing a lot of money at them, they had the local people come together and really brain-storm to use what they had avail-able in their area to restart. They had some uphill battles, but what was surprising was the talent that was available in their area that no one knew anything about. The proto type really helps people to think of the box. I also attended forums on illegal immigrants and legalizing marijua-na. Colorado said to hold off until they work out the problems (my thought – is that possible?) Colo-rado law is set up that each county can decide to legalize marijuana or not. Only very few counties have legalized marijuana in Colorado.There were four people running for the 2nd Vice President. So a lot

of campaigning and caucus meet-ings. The general business ses-sion for the election of the NACo 2nd VP was exactly like you see on TV for the US President candi-dates, where the state’s delegate goes up to a microphone to an-nounce the particular states vote.

Thank you for this opportunity and everyone should really really take the effort to attend.

The first County Summer Legisla-tive Study was held August 19th and 20th. I attended the Wednes-day session and thought every-one who testified did a great job. Thank you! The next hearing will be on September 16th and 17th. Make every effort to attend, please.

On August 28th in Ft. Pierre there will be a Work Group meeting organized by the SD Municipal League and is made up of city and county representatives. The Work Group representatives from SDA-CO are: Doreen Priebe, Brule Co. Treasurer; Susan Kiepke, Davison Co. Auditor; Kathy Glines, Harding Co. Auditor; Deb Tridle, Lawrence Co. Treasurer; and Donna Mayer, Pennington Co Register of Deeds.

The County Convention is coming right up and will be in Pierre on September 14-16. The theme is “COUNTY GOVERNMENT 101 An Essential Conference for All Coun-

Well I am sorry to have to tell you this will be my last arti-cle. Now the famous and most outstanding Mr. Rod Polley will take over this newsletter space, his stories will be different and I’m sure better!

Rod is the main man for Clay County which is in the southeast corner of our wonderful State of South Dakota. Rod has been a Highway Superintendent since 2005. His articles will be all positive and with no sob sto-ries, their county probably has all new roads and new bridges

so he just takes it easy all day and tries to find some where to spend all that extra money!!!!!

The County Conference is in Pierre soon. I’m sure I will see you all there and have some meetings to attend. Don’t forget the meetings after the regular

meetings are informative also!

The Regional Local Road Con-ference will be on October 21st and 22nd, 2015 in Rapid City which is a very good meeting, I believe all new Highway Super-intendent’s should attend this meeting. This is a very informa-tive meeting with many other state’s and county’s there with different ideas. Hope to see you all in Rapid City.

Hopefully you don’t shed many tears knowing this is my last ar-ticle. It’s been fun telling you all great my great stories, I’m sure Rod will fill these pages with good articles during his term as president!

Wow! What a year it has been!!

My term as SDACWO President is coming to a close. I can’t tell you how much work it takes to serve. I can tell you though, what an honor it has been to serve the great peo-ple of SDACWO and would like to thank them all for the opportunity. It has been one of the greatest learn-ing experiences of my life. With so many challenges and so many things to get done, it can be quite intimidating. However, I was not alone in facing them. With so many knowledgeable and helpful welfare officials across the state, there was nothing we couldn’t accomplish when working together.

I want to take this moment to thank all of the association members for your dedication to helping the indigent and taxpayers by working hard to serve both with integrity while being cognizant of tax dol-lars. You are unsung heroes that deserve the acknowledgement of your hard work. Although you may never hear it, you are appreciated and respected for what you do.

I want to thank a few individuals for their extra time and guidance throughout my term. First, I want to thank Beadle County Welfare Director, Deb Bozentko, and Min-nehaha County Medical Coordina-tor, Ray Koens, for helping us out throughout the year. These two individuals are some of the most knowledgeable and respected veterans within the association and

from working with them both I can tell you that they are always work-ing for what is best for all South Dakota counties. Thank you both very much for your assistance and consultation.

Secondly, I want to thank the rest of the executive committee for working so well as a team. With Secretary Mike Holzhauser from Brookings County stepping up this year to be our newest member and always willing to learn and provide assistance in any way he can, it was good to have his kind of energy to a group. In addi-tion, the current Vice President, Charlene Doorn from Pennington County, was a resource, that I can say with certainty, was very valued. She was always willing to take on things even in the wake of unfortunate circumstances during the year. She has been a great team mate, mentor and most im-portantly, friend that I couldn’t be

more grateful to have. I know you will do great next year during your term.

In closing, I want to say what a privilege it is to be a public servant. It is hard work, heavily scrutinized and often thankless, but it is more rewarding than anyone could ever imagine. Thank you all for the won-derful year and all your hard work.

Innovative Loss Control Inspection ProcessBy Ron Burmood, Director of Mem-ber Services, South Dakota Public Assurance Alliance

A task that many entities strug-gle with is the completion of loss control inspec-tions of sidewalks, curbs, gutters, and storm drains. It is a time-consuming process for public entities, which are already strapped for time and resources. However, these inspections are a nec-essary part of your risk management efforts and by doing them and correcting potential hazards, you may minimize your losses and your liability.

While I was recently on a SDPAA Member visit to the City of Freeman, I visited with City Admin-istrator, Carroll Vizecky, and he shared his loss control story with me.

Carroll stated that the city received a grant for a body camera to be utilized by the local police de-partment. The police department decided to take this one step further and docu-ment city property. They mount-ed the camera to the side of the light bar on the top of the police vehicle. The police depart-ment officers then proceeded to drive two to three miles an hour along the right side of the streets throughout the city. In two and a half days they had the entire city sidewalk system documented on video. This information was then transferred to DVDs.

I reviewed one of the videos and found the quality very impres-sive. The sidewalk areas were clearly visible as well as the curb, gutter, and storm drains.

Boulevard trees and low lying branches were also visible. The video also had captions documenting street names.

By reviewing the detailed video, the city could identify problem areas and implement measures to correct those problems. In the event a claim arises, the city can refer back to the video and determine the condition of the area prior to the loss. This could help determine if there was a pre-existing problem or if something recently developed. The city intends to update their video inspections every two years.

This is an excellent example of a cost effective approach to self-inspection by the City of Free-man. We thank the City of Freeman for sharing this story with us and hope that it helps other enti-ties with their loss control measures.

During the course of a meeting we may hear reports, hold public hearings, listen to presentations and conduct business. In order to bring business before the assembly, a member of the assembly is required to make a motion. A motion is a formal proposal by a member to take certain action.

There are many parliamentary motions that can be offered during a meeting but there is only one that brings business before the assembly and that is the main motion. Motions to Amend, Lay on the Table, Refer, etc. are procedural in nature and cause a cer-tain action to take place, but it is the main motion that brings business before the assembly.

A main motion is in order when no other question is pending; it is out of order when another member has the floor, or a motion must be seconded, is debatable, is amendable and requires a majority vote unless otherwise specified.

There are four steps by which a motion is brought before the assembly. The first is to obtain the floor. This can be done in a variety of ways depending on the circumstances. It may involve raising your hand, standing, pushing a button or in some cases catching the chair’s eye. A member has not obtained the floor until recognized by the chair.

Once the member is recognized by the chair, the member then states the motion, “I Move to adopt the resolution to increase supervisor’s salaries by 10% or Move to adopt resolution...”

A second to the motion is now in order. A member does not need to be recognized or obtain the floor to second the motion – you can just shout out, “I second the motion.” If no one volunteers to second then the chair should ask, “Is there a second to the motion?” A member does not have to support the motion to second, but may second to allow the matter to be debated. If there is no second, the motion dies.

After receiving a second, the chair then restates the motion, “The motion before the body is to Adopt

resolution...to increase supervisor’s salaries by 10%.” Neither the mak-ing nor the seconding of a motion places it be-fore the assembly; only the chair can do that by restating the motion. The question (motion) is now said to be “pending” or “ready for debate.” If the assembly votes in the affirmative, the motion is said to be “approved,” “adopted” or “carried.” If the assembly votes to deny, the motion it is said to be “denied,” rejected” or “lost.”

Members should avoid negative statements in a motion where the effect is calling for a position to be taken; a negative statement may confuse members as to the effect of voting for or against the motion. For example, instead of moving the county take a position not in support of the assembly bill to eliminate county government, move to oppose the assembly bill.... It should be noted that if the motion is voted down then no opinion has been expressed.

Sometimes during debate the maker of the motion realizes the motion was in poor taste or was not what was intended. Can the maker of the motion with-draw the motion? No, because it no longer belongs to the member that made the motion. Once the chair restates the motion, it becomes the property of the as-sembly. However, if the chair feels the body supports withdrawal, the chair can state, “If there are no objec-tions to withdrawal” and there are no objections, the chair then states, “the motion is withdrawn.” You can always take action with unanimous consent, which will be discussed in more detail in a future article.

Celebrating the Keystone Pipelines, Past

and Future

In July, TransCanada celebrated the fifth anniversary of the comple-tion of the Keystone Pipeline and the billionth barrel of oil delivered, while looking forward to adding the Keystone XL project to the system.

At a July 23 gathering in Yankton, local officials looked back on the construction of the pipeline in the area in 2009. The Yankton Press and Dakotan coverage of the event included the comments from Yank-ton Mayor Dave Carda: "In 2009, Yankton was fortunate enough to have (Keystone) to help our econ-omy grow when the pipeline was built through Yankton," Carda said. "Our economy was slow at the time [and] this was a huge boost… These skilled workers worked with their families … moved in to enjoy what we have in Yankton and the surrounding communities, eating at our restaurants, shopping at our stores and enjoying all our local tourist attractions that we have in our community at a time we really needed that."

The article also included com-ments from Bob Cappell, who was director of the Yankton Chamber of Commerce when the project be-gan: "In my years of working with the business community, I don’t know that there’s a better group of people to work with."

Similarly last month, others looked forward to the construction and op-eration of the Keystone XL Pipeline

with strong comments filed with the Public Utilities Commission as part of the process to reaffirm the state construction permit originally issued in 2010, while the company waits for a federal permit.

Several counties along both the operating Keystone Pipeline and the proposed Keystone XL Pipeline filed comments and resolutions of support. In addition, positive com-ments poured in from the region.

Landowners highlighted that “We have the first line running through our land and we were treated very well.” And, “They did all that they said that they would do including putting the property back to its pre-vious condition. Their subcontrac-tors were courteous, easy to work with and just like us were ordinary people trying to make a living.”

The South Dakota Oil & Gas Association said “Key-stone XL will help improve American energy security, modernize America's energy infrastructure and transport a critical and needed product to U.S. refineries that are actively looking for this oil to create products we all rely on every day.”

The North Dakota Petroleum Council highlighted why the project is in the national interest: “The review of this

project by both state and federal regulators has been thorough, public and encompassing, and has yielded extraordinarily positive re-sults. It is time to move the project forward!”

Governor Dennis Daugaard summed it up like this: “This project has been studied and ana-lyzed as thoroughly as any project in our nation's history. I urge your approval of this permit.”

Two former South Dakota county officials now work with TransCana-da. Mark Johnson, who served as a Yankton County Commissioner, represents the company locally and Jeremy Dangel, former Yank-ton County Emergency Manager, directs the company’s emergency response area.
