    NOTICE OF PUBLIC HEARING ON THECITY OF LANSING'S PROPOSED FY 2010-2011 BUDGET

    The City Council of the City of Lansing will conduct a Public Hearing on Monday,April 26, 2010, at 7:00 p.m. in the City Council Chambers on the 10 th Floor ofLansing City Hall located at 124 W. Michigan Ave., on the proposed City ofLansing budget and capital improvements. The property tax millage rateproposed to be levied to support the proposed budget will be a subject ofthis hearing.

    WHEREAS, the labor movement will once again observe Workers' Memorial Dayto remember workers who have been killed or injured on the job. It is also a dayto highlight the preventable na ture of most workplace accidents and ill health andto promote campaigns and union organizations to fight for improvements inworkplace safety and health protections; and

    WHEREAS, more than three decades ago, Congress passed the OccupationalSafety and Health Act and Mine Safety and Health Act promising every workerthe right to a safe job; and

    WHEREAS, despite the efforts of the unions and their allies, who fought to makethat promise a reality, the toll of workplace injuries, illnesses, and deaths remainsenormous. Each year thousands of worker's are killed and millions more areinjured or diseased because of their jobs; and

    WHEREAS, progress in protecting workers' safety and health has slowed, andfor some groups of workers, jobs are becoming more dangerous; and

    WHEREAS, many employers, in a race to the bottom in the global economy,have been pushing to cut wages and benefits and loosen protections; and

    WHEREAS, with fewer and fewer workers having the protection of unions, moreworkers are afraid to speak out and raise job safety concerns, fearing retaliationand firing; and

    WHEREAS, on April 28, 2010, the unions of the AFL-CIO observe Worker'sMemorial Day to remember those who have suffered and died on the job and torenew the fight for safe workplaces, to speak out and bargain for safe jobs,respect, and a better future; and

    NOW , THEREFOR E, BE IT RESOLV ED, the Lansing City Council, hereby, urgesemployers and employees to continue to fight to make workers' issues a priority,to guarantee the freedom of workers to form a union, and to keep and creategood, safe jobs in this country.     WHEREAS, May 13, 2010 will be the fifth annual National Children's MentalHealth Awareness Day launched by the Substance Abuse and Mental HealthServices Administration (SAMH SA); and

    WHEREAS, National Children's Mental Health Awareness Day is an opportunityfor SAMHSA-funded communities and partner organizations to promote positiveyouth development, resilience, recovery, and the transformation of mental healthservice delivery for children and youth with serious mental health needs and theirfamilies; and

    WHEREAS, the three goals of National Children's Mental Health Awareness Dayare to:

    1. Raise awareness of effective programs for children's mental health issues;2. Demonstrate how children's mental health initiatives promote positiveyouth development, recovery, and resilience;

    3. Show how children with mental health needs thrive . in their community;and

    WHEREAS, Impact, Ingham County's System of Care initiative, seeks totransform how children and youth with serious mental health needs and theirfamilies are supported as valuable members of Ingham County by ensuringaccess to integrated and high quality mental hea lth. services and full participationin the design and implementation of their care. Children's mental health is an

    important year round commitment; and

    WHEREAS, the Committee on Personnel reviewed the City of Lansing 2010 RetirementIncentive Program Description presented and explained to the Committee by Mr.Ambrose on behalf of the Mayor and the Human R esources Director; and

    WHEREAS, the Committee recommends that the Council authorize the RetirementIncentive Program for its Council Staff Employees consistent with its provisions for theother interested and eligible C ity employees;

    NOW, THEREFORE, BE IT RESOLVED that the Lansing City Council hereby approvesand offers the following Retirement Incentive Program to the City Council StaffEmployees:

    1. ELIGIBLITY:

    Council Staff Employees eligible to retire by August 31, 2010 under theoriginal terms of their personnel rules or fringe benefit summaries, or,

    Council Staff Employees who will have at least 25 years of service on orbefore August 31, 2010 (i.e. where applicable under the terms of currentbenefits plan, any minimum age requirement will be waived).

    2. INCENTIVE:

    Council Staff Employees who retire pursuant to this incentive will be entitledto retiree healthcare without premium sharing expense if otherwise eligible forretiree healthcare pursuant to their current personnel rules or fringe benefitsummaries.

    Council Staff Employees w ith at least 20 years of service who are consideringthe purchase of additional service credits at their own cost will be chargedonly $50 for an actuarial study, with the City paying the remaining balance ofthe cost. In the event an employee retires, the City will also rebate the $50actuarial charge paid by the employee.

    One-time voluntary incentive of 100% cash payout for all accrued sick leavetime up to 1,360 hours.

    Council Staff Employees may use accumulated leave time payouts to "buyback" for inclusion in the employee's Final Average Compensation (FAC) for

    pension purposes the salary lost due to unpaid furlough days imposed ortaken through the Voluntary Unpaid Leave Program during fiscal year 09/10(July 1, 2009 - June 30, 2010), subject to Internal Revenue Service Section415 limits.

    Council Staff Employees may use accumulated leave time payouts topurchase additional service credits as provided for in the applicableretirement ordinances up to Internal Revenue Service Section 415 limits.

    termination of such armed service actually required of him or her;

    of repayment; and

    C. In no case shall any member be credited with more than five years of City

    service for all such armed service rendered by h im or her. In case of doubt as

    Trustees shall have final power to determine such period.

    During the period of a m ember's armed service in the Federal Government

    and until his or her return to C ity employment, his or her contributions to the

    retirement credit for all or part of the period of military service;

    2 B. The employee requesting military service credit shall pay the cost of an

    3 actuarial evaluation of the cost of adding such military service to his or her

    4 retirement service credit, perfoiined by the actuary denoted in paragraph

    5 (d)(4) hereof. Costs determined by said actuary shall be considered final and

    6 binding upon the City, the collective bargaining unit for which the employee

    7 is a member and the affected emp loyee;

    8 C. The emp loyee shall be responsible for the extra cost of adding such military

    9 service to his or her retirement service credit. The employee electing to

    10 exercise the right to receive military credit shall make full paym ent for the

    11 cost of such service credit no later than 60 days following receipt of the

    12 actuarial cost information;

    13 D. In no case shall any member be credited with more than two years of City

    14 service for all such armed service rendered by h im or her. In case of doubt as

    2 F. Active m ilitary service shall be defined to include periods of voluntary or

    involuntary induction into the Armed Forces of the United States of America

    under the Selective Service Act of 1940, as amended ; it shall also include the

    initial training period required to be a reserve member of the Armed Forces of

    the United States of America or the United States National Guard. But shall

    specifically exclude annual reserve training programs required of reservists or

    National Guard members.

    9 ( 4 ) A member may elect to purchase up to twee FIVE years of service credits for retirement

    10 pension benefits pursuant to IRS Code Section 415(n)(3)(b), provided the member meets all

    11 of the following additional criteria:

    12 (A) Is a member at the time of the election and purchase; and

    13 (B) Has earned at least 5 years of service credits for actual City service while a mem ber;

    14 and

    15 (C) Signs and delivers to the City a request for actuarial calculations of the member's

    16 cost to purchase service credits under this subsection (4) and pays the fee for the

    agreement to purchase a specific number of months and/or yea rs of service credits;

    2 and

    3 (E) Except for City of Lansing IRC 457 Deferred Compensation Plan direct rollovers,

    4 tenders with the signed written agreement the funds to the City to purchase service

    5 credits; and

    6 (F) By purchasing such service credits, will not exceed the limitations prescribed by IRS

    7 Code Section 415.

    8 In the event a member does not purchase at one time the full three FIVE years of service

    9 credits, he or she may purchase additional service credits of up to a maximum that does not

    10 exceed the aggregate of three FIVE years, provided that at the time of and for each purchase,

    11 the member meets all the criteria in this subsection (4). Service credits purchased pursuant to

    12 this subsection (4) shall be at 100 percent of the Chapter 294 retirement system cost to fund

    13 the member's pension benefit actuarially determined by the actuary denoted in paragraph

    14 (d)(4) for the time of purchase.

    15 Service credits purchased pursuant to this subsection (4) shall not be used or included in

    16 meeting any of the requirements for eligibility for retirement health care, contained in

    17 collective bargaining agreements, including minimum years of actual service or minimum

    18 age at which the benefit begins.

    (a) (1) A mem ber of the retirement system may elect to purchase service credit for prior full-

    11 time service as an employee with the City, upon request, upon verification of the

    12 employment by documentation satisfactory to the Board of Trustees and upon

    13 payment to the retirement system of an amount equal to 14.9 percent of the member's

    14 current annual rate of com pensation, including longevity bonus, m ultiplied by eac h

    15 year and fraction of a year of service to be purchased.

    16 (2) As used in this SUBsection, "service as an employee with the City" consists of prior

    17 full-time employment with the City or its boards and commissions, or with the

    18 District Court, which employment has not already been credited to the member's

    19 service account and for which the member would not otherwise be entitled to a

    2 0 service credit, but for this section; "service as an employee w ith the City" includes

    21 periods during which the member's income from the City or its boards or

    2 2 commissions, or from the District Court, consisted of Workers' Compensation

    3 (3) In order to purchase service credit pursuant to this SUB section, a member must elec

    4 to do so in writing prior to July 16, 1988, and, within 30 days of such election, pay in

    5 one lump sum the amount required by subsection (a) hereof.

    6 (b) (1) An employee who elects an option to return as a member of the employees'

    7 retirement system pursuant to Subsections 292.14(c)(2) through (c)(4) may purchase

    8 service credits. Service credits purchased pursuan t to this option shall be actuarially

    9 determined at 83.9 percent of the employees' retirement system's actuarially accrued

    10 liability as of October 1, 2000; except for a FOP 911 Operators' Division employee's

    11 date for determ ining the actuarially accrued liability shall be as of May 1 , 2001. A

    12 City executive managem ent plan employee, exempt employee, or a Team sters 580

    13 and 214 supervisory and non-supervisory employees shall have until September 1,

    14 2000 to purchase service credits. A district court teamster or district court exempt

    15 employee shall have until September 22, 2000 to purchase service credits. A FOP

    16 911 Operators' Division employee shall have until April 20, 2001 to purchase service

    17 credits.

    18 (2) The ceiling amount of service credits that may be purchased by these employees shall

    19 be in accordance with Section 292.01(f) and (r) including the time the employee was

    2 0 excluded pursuant to Section 292.14(c)(1).

    (3) An employee, who becomes a member pursuant to Section 292.14(d), Section

    5 pursuant to Sections 292.14(c)(2) through (4) and has remained a member but did not

    7 purchase ceiling in accordance w ith Section 292.155(b)(2), may elect to purchase solely by

    8 in-service transfer from the City of Lansing IRC 457 Deferred Compensation Plan, up to the

    9 years and months of service credits for retirement pension benefits pursuant to IRS Code

    10 Sections 415(n)(3)(A) and 457(e)(17) limited to the difference between his or her service

    11 credits previously purchased and the service credits ceiling, provided the member meets all

    12 of the following criteria:

    13 (1) Is a member at the time of the election and purchase; and

    14 (2) Signs and delivers to the City on or before February 3, 2006 a request for actuarial

    15 calculations of the member's cost to purchase service credits under this subsection (c)

    16 and pays the fee for the actuarial services and cost of worksheet preparation; and

    17 (3) Signs and delivers to the City within 60 days of his or her receipt of the actuarial cost

    18 worksheet the requisite written agreement to purchase service credit and elects in the

    19 agreement to purchase a specific number of months and/or years of service credits

    2 0 within his or her aforestated limitation; and purchases the service credits within 30

    21 days of the delivery of the signed agreement by an in-service transfer [as described in

    10 In the event a member does not purchase at one time the full twee FIVE years of

    11 service credits, he or she may purchase additional service credits of up to a maximum that

    12 does not exceed the aggregate oftie FIVE years, provided that at the time of and for each

    13 purchase, the member meets all the criteria in this subsection (d). Service credits purchased

    14 pursuant to this subsection (d) shall be at 100 percent of the Employees' Retirement System

    15 cost to fund the member's pension benefit actuarially determined by the Employees'

    16 Retirement System's actuary for the time of purchase.

    17 Service credits purchased pursuant to this subsection (d) shall not be used or included

    18 in meeting any of the requirements for eligibility for retirement health care, whether

    19 contained in Chapter 293, collective bargaining agreements or applicable fringe benefit

    2 0 plans, including the minimum of15 years of actual service or the minimum age at which the

    21 benefit begins.

    Notwithstanding other sources of funds used to purchase service credits under this

    2 subsection (d), and solely in the event that the member retires within 60 days of his or her

    3 receipt of the actuarial cost worksheet and otherwise complies with this subsection (d), the

    4 service credits may be purchased after retirement for a period not to exceed 3 0 days

    5 following the retirement date, by a direct rollover of eligible rollover distributions [as

    6 described in IRS Code Section 401(a)(31)] otherwise payable to the eligible employee from

    7 the City of Lansing IRC 457 Deferred Compensation Plan.

    8 Section 2. All ordinances, resolutions or rules, parts of ordinances, resolutions or rules

    9 inconsistent with the provisions hereof are hereby repealed.

    10 Section 3. Should any section, clause or phrase of this ordinance be declared to be invalid, the

    11 same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part

    12 so declared to be invalid.

    13 Section 4. This ordinance shall take effect on the 30th day after enactment unless given

    14 immediate effect by City Council.

    Chair Baerman presented to the Board the letter he prepared for the Mayor, on sidewalksnow rem oval. After some discussion, Mr. Bloomberg m oved, Ms. Rodgers seconded,MO TION CA RRIED UN ANIM OUSLY , to approve the letter on sidewalk snowremoval.

    The Board discussed supporting "Lansing for Cesar E. Chavez Ave.", but decided theydid not have enough information.

    Mr. Marshall still would like percentages on the report. Mr. Marshall questioned projectsbeing closed out - what it really means. Mr. Gamble stated the construction part of theproject is closed but not some of the paperwork.

    The Board m embers questioned when the Wet W eather Plan would be presented to themfor comment. Mr. Gam ble will do presentation next Month.

    Mr. Marshall wanted more information on the Central Interceptor Rehabilitation Project.Mr. Johnson gave m ore information.

    Both Ms. Schmidt and Ms. Rodgers gave comm ents to the WRS Personnel part of thereport.

    Operations and Maintenance Section: A written report was distributed.

    Ms. Schmidt voiced her concern over C rego Park possibly being reopened. Mr. Gamblediscussed briefly the information he had on the subject.

    Mr. Gamble gave an update on the status of the Budget.

    NEW BUSINESS

    Summer Kids Camp

    Brett Kaschinkse, Manager of Leisure Services, stated this evening Michigan Recreation and Park Associationrecognizing through their community service awards Cooley for Kids Program, which is Cooley Law School asponsor for the summer. kids camp trip to the Lansing Lugnuts; also MSU 4-H Extension for their work with Lanyouth.

    Brett Kaschinke stated in the Board packet was a proposal for changes to the Kids Camp Summer Program for2010. This proposal changes playgrounds from 15 sites throughout the city, not including the community cente4 sites this summer by bussing from old sites to the 4 schools proposed. Kaschinske stated Carrier requested thuse of Wainwright instead of Woodcreek. The Lansing School District (LSD) is looking at going to four ten hodays and they would not be open on Friday's for us to be at 15 schools. Our proposal was to go to the 4 schoolsand be open all five days.

    Dusty Fancher reiterated the proposal is to have 4 sites, bus kids in and be open Monday through Friday with band after care. Fancher asked if the bussing is just for the main program or will there be several timesthe busses will run. Kaschinske stated the bussing would be for the main program and parents would beresponsible for transportation for drop off and pick up for the before and after care.

    Dusty Fancher stated we are talking about children age 5 to 12 and she has concerns about the younger childre

    being dropped off at the bus stop and if a parent is not there to pick them up. Kaschinske stated in the past whe

    we had a grant for extended camp we had a staff person ride the bus. Carrier stated the school districts policy isthat if the child is kindergarten or younger the parent has to be there. Fancher inquired if it is not a parent picking upthe child, would there be a list of who may pickup the child. Kaschinske stated yes, there is currently a release formused for open recreation listing who children may be released to.

    Luke Canfora inquired what busses would be used. Kaschinske stated they are Lansing School District (LSD)busses. It is a competitive bid and the only time we do not use LSD busses is when there is a special need and

    LSD contracts with Dean Transportation.

    Paul Carrier inquired if this proposal is a one time pick up. Kaschinske stated yes.

    Dusty Fancher inquired if there is going to be a policy for children under the age of 7 to ensure they will not be left ata bus stop to early. Kaschinske stated we already have that issue where parents drop children off and tell them towait until the program opens.

    Brett Kaschinske stated we have known the program has been used as "day care" even though it is a drop-inprogram. We are now going to be a licensed day camp and the changes reflect this with the before and after care.The kids camp program was free before, now there will be fees attached to this program.

    Brett Kaschinske provided comparisons from other communities ie: YMCA charges $112 a week for members. PaulCarrier inquired about scholarships to offset the cost. Brett Kaschinske stated we do offer scholarships; however itis only $40 per term, per child.

    Luke Canfora inquired about staffing and what are these positions and if staff are from the area or if staff are collegestudents. Brett Kaschinske stated this is our TEA (temporary employment agreement) staff that we hire for thesummer. They are mostly college students who are from the area or are local college students. We also haveretirees, adults and teachers who want summer work.

    Pat Murray stated he was in shock when he saw this plan. He was shocked in the past when the program wentdown to 15 sites. In his area of Moores Park the majority of kids walked to Moores Park before it was shut downand they did not arrive until around 11 a.m. and they will not make the 8:15 a.m. bus. The kids who need thisprogram the most can not afford $50 a week.

    Paul Carrier inquired if this wasn't the same issue in last year's budget and didn't the board agree to reallocatemoney to keep all the sites open. Is there somewhere to take money from and place back into the summer campprogram.

    Brett Kaschinske stated in last year's budget $132,000 was spent on the kids' camp/playground summer program.Paul Carrier stated when you look at last year's budget it was being based on the kids that participated and the waythe 2010 summer program is structured and the reasons that have been outlined this evening, the numbers will notbe as high at the original sites because the kids stay up to late to make the bus.

    Brett Kaschinske stated it is fully understood the number of kids will not be the same as they have been in the past.

    Dusty Fancher reiterated last year the city spent $132,000 on kids' camps, so why is there a charge for this year. Iflast year the camps ran for free and the money was budgeted for kids' camps this year, why is there a charge toserve fewer kids? Dusty Fancher stated she will not support this; the mission of the kids' camps is to be free.

    Paul Carrier is concerned with the early bus pick up and would like to consider regionalizing the bus pick-ups towhere the kids that are utilizing the programs and have multiple pick-ups.

    Brett Kaschinske clarified Parks is not trying to make money on this program. Even with the charges, it is anestimated $43,000 loss.

    Pat Murray stated he understands fewer locations as he has witnessed sites with very few kids and all different agesand there is an advantage to have larger sites, but there has to be a zero option for those who can not pay and asecond pick up at noon.

    Dusty Fancher stated she does not have a problem with fees for the before and after care, but the main programhas to be free. Brett Kaschinske stated he is not sure if before and after care can be provided if it cannot pay foritself.

    Paul Carrier stated the Lansing School District completes the free and reduced lunch list and it is thoroughlychecked out by staff and people fall within a formula to determine their co-payment. What we offer to the publicneeds to be accessible to everyone.

    Brett Kaschinske stated it is his charge to somehow make money and if he does not he has to make cuts and thatbecomes tough to do.

    Brett Kaschinske stated the LSD will not be open five days as they are cutting back to four ten-hour days, but theyhad agreed to open it up for five days at the 4 schools listed for a charge of $1,000 per site, $4,000 total.

    Murdock Jemerson stated our dilemma is what happened last year and people are looking at us as daycare. Weneed to have some way to offer a program that people will not look at us as day care, but as recreation whereneighborhood kids could walk to, play and leave when they are ready.

    Pat Murray asked if there is a cost to running this new program that is different than the cost of running the previousprogram. Brett Kaschinske stated it is the cost of transportation. Pat Murray clarified the only transportation wewere providing in the past was for field trips.

    Lujo Luke Canfora inquired what the attendance was for the pools for the summer. Paul Carrier inquired if therecould be a small charge for the pool.

    Brett Kaschinske asked the Board members for another proposal with a sliding scale, if the Board wants no fees healso needs to hear this.
