2. Eligible agencies may visit/ inspect the site on any working day (between 0930 hrs to 1600 hrs Monday

to Friday) for inspection and clarification and in order to collect all information that may be required for

preparing the E- Tender and entering into a contract for the service to be rendered.

3. Earnest Money Deposit (In form of a Demand Draft) for a sum of Rs 1,00,000/- (Rs. One lakh Only) ,

in the name of ESI Fund A/C No.1, Payable at Mumbai shall be dropped on or before 13/01/2020

upto 1300 hrs in the tender box placed at Chamber of Deputy Medical Superintendent,2nd floor, ESI

Hospital, Akurli road, Kandivali, Mumbai. The bids received without submission of EMD will

summarily be rejected.

4. Details of the E- Tender document can be seen and downloaded at www.esic.nic.in and on CPP

Portal www.eprocure.gov.in/eprocure/app .

5. The interested tenderers should upload duly completed tender form and their bids along with scanned

copies of all relevant certificates, documents, etc. in support of their technical and financial bids on the

website CPP Portal www.eprocure.gov.in/eprocure/app by date----13/01/2021 till 1300 hr , Upload

relevant or essential documents only.

6. Tenderers whose technical bids are accepted will be informed about the date of the opening of financial

Annexure –B

IMPORTANT INSTRUCTIONS TO THE E-TENDERERS

1. ELIGIBILITY CRITERIA

1. The bidding firm should be a registered company/firm engaged in Operation & maintenance of Medical

Gas Pipe Line, Gas Manifold plant equipment and Modular OT for at least three years till publishing

of this tender.

2. The bidder must be registered with ESIC & EPFO.

3. The bidder must have a PAN Number and GST Number.

4. Average annual turnover of the firm in last three financial years i.e. 2017-18, 2018-19 and 2019-20

should be minimum of Rs 40 lakh in each year certified by Chartered Accountant.

5. Firm should not be blacklisted/ delisted by any Government or Other organization.

2. INSTRUCTIONS TO THE TENDERERS

1. Bidders are required to apply online in two separate Bids i.e. – Technical Bid and Financial Bid.

2. The declaration should be uploaded on line.

3. The bidders should upload duly completed tender form and their bids along with scanned copies of

relevant certificates, documents etc. in support of their technical and financial bid on the website CPP

Portal www.eprocure.gov.in/eprocure/app by 13/01/2021 till 1300hrs. And Earnest money deposit

(EMD) of Rs 1,00,000.00/- (One lakh) in the form of Demand Draft from scheduled bank drawn in

favor of ESI Fund A/C No.1, Payable at Mumbai in original in a sealed envelope captioned “E-

Tender for comprehensive annual Operation & Maintenance of the Medical Gas Pipeline

System & Manifold Plant and Modular OT” must be dropped to Medical Superintendent, ESIC

Hospital, Andheri, Maharashtra-100093 on or before date and time mentioned in schedule of Tender.

In absence of EMD, the Tender shall be rejected summarily. The earnest money deposit of

unsuccessful bidders shall be refunded, without accrual of any interest, in due course of time as per

official convenience. EMD of successful Tenderer will be refunded after submission of performance

security without accrual of interest.

4. All entries in the e- tender form should be legible and filled clearly.

5. The bid shall be valid for 90 days from the date of opening.

6. The tenderers shall quote for all works (CAMC + Manpower) failing which the bid shall be

considered non – responsive.

7. E- Tender incomplete in any form will be rejected outright. Conditional tenders will be rejected

outright.

8. The closing date and time for receipt of tenders will be Date 13/01/2021 at 1300 hrs. The technical

bid shall be opened in the 2nd floor, DMS Chamber, ESIC Hospital, Akurli road, Kandivali East,

Mumbai-93 in presence of the tenderers or authorized representatives of the tenderers.

All the technical bids will be scrutinized, relevant documents checked for their authenticity and the tenderers

whose technical bids are accepted will be informed by e-mail and telephone about the date and time for opening

the financial bids.

9. The decision of Medical Superintendent, ESIC Hospital, Andheri, Maharashtra shall be final and

shall not be open for discussion. No correspondence will be entertained in this regard.

10. In case the successful tenderer declines the offer of contract, for whatsoever reason(s), his EMD will

be forfeited.

11. Formal contract shall be entered into with the successful tenderer. In this contract, the successful

tenderer shall be defined as contractor.

12. Performance Security - The successful tenderer will have to deposit a performance security deposit

of 10% of cost of work order by way of Demand Draft from any scheduled bank drawn in favor of “

ESI Fund A/C No.1”, Payable at Mumbai. The Performance Guarantee shall be initially valid for

a period up to 365 days beyond the Stipulated Contract Period. In case the Contract Period of work

gets extended, the contractor shall get the validity of Performance Guarantee extended, at his own

cost; to cover such extended time for Contract Period. The Performance Guarantee shall be refunded

without accrual of interest after successful completion of Contract.

13. The successful tenderer will have to commence the work within 15 days of acceptance of offer.

Otherwise the contract may be cancelled and EMD will be forfeited.

14. Each page of the E- Tender document should be signed and stamped by the bidder/ authorized

representative of tenderer in acceptance of the terms and conditions laid down by ESIC.

15. Medical Superintendent, ESIC Hospital, Andheri, Maharashtra reserves the right to withdraw/ relax

any of the terms and conditions mentioned above.

16. Medical Superintendent, ESIC Hospital, Andheri, Maharashtra reserves the right to reject all or any

tender in whole, or in part, without assigning any reason thereof.

17. For finalization of contract, the tenderer whose rates, as given in the financial bid, are the lowest in

comparison to other tenders will be considered as L1 i.e. the tender would be decided on basis of the

total of the rate quoted for the items in financial bid. Weightage will be given to experience. However,

decision of Medical Superintendent, ESIC Hospital, Andheri, Maharashtra will be final.

3. GENERAL CONDITIONS OF CONTRACT(GCC)

1. The break down call should be attended within an hour/ Immediate and the persons deployed by the

contractor should be properly trained, have requisite experience and skills to carryout operations &

Maintenance of MGPL and related equipment and Modular OT using appropriate materials and

tools/equipment.

2. The contractor should ensure the safety measures of the employees deputed at ESI Hospital as well

as hospital staffs, Akurli road, Kandivali(E), Mumbai.

3. Existing MGPL system and Modular OT can be visited / Inspected by interested firms after

permission from Hospital Authority on any working day between 0930 hrs to 1600 hrs (Monday to

Friday) before pre-bid meeting.

4. The payment of CAMC shall be paid by ESIC Hospital on quarterly basis against Service

Certificate and Invoices after providing of satisfactory performance certificate from the In charge

of the department.

5. For Manpower wages shall be released on quarterly basis after submission of requisite documents

i.e. ESIC, PF Challan, attendance sheet, Satisfactory Performance Certificate dully certified by

Authorized personnel of Hospital.

6. Uniform, ID cards/Name plates and all safety accessories must be provided by the contractor to all

the staff members.

7. No advance payment will be given.

8. The contract includes monthly preventive maintenance as mentioned in the service manual of

manufacturer/ installer apart from attending any number of breaks down calls, as and when required.

Breakdown calls have to be attended within 1 hour. Immediately, failing which a penalty of Rs 2000

per day will be levied and company should provide stand by device during break down period to

ensure uninterrupted services.

9. All type of spares and accessories should be available with the vendor for repairs of MGPL &

Manifold equipment & Modular OT. Only original manufacturers equipment spares should be used

for repair or replacement.

10. All the repairs have to be taken up within the hospital as far as possible. The instrument will be

allowed to be taken out with the permission of Medical Superintendent, ESIC Hospital, Akurli Road,

Kandivali (E) only. During repair backup instruments should be supplied by contractor at his own

cost.

11. Medical Superintendent, ESIC Hospital, Andheri, Mumbai reserves the right to reject/ accept any

tender / modifications in the terms and conditions without assigning any reason thereof. No

correspondence will be entertained in this regard.

12. The bidders should consider the amount of all necessary spare parts, needed for smooth functioning

of MGPL system and Modular OT. Quoted amount should be valid for One (01) years, extendable

for further one (01) year including all taxes.

13. Subletting of Contract: The contractor shall not sublet, transfer or assign the contract or any part

thereof.

14. Arbitration Clause:- Any dispute and differences relating to the meaning of the specifications,

designs, drawings and instructions herein before mentioned and as to the quality of workmanship of

materials used in the work or as to any other question, claim, right, matter or thing whatsoever in

any way arising out of or relating to the contract, designs, drawings, specifications, estimates,

instructions or these conditions or otherwise concerning the works or the execution of failure to

execute the same whether arising during the progress of the work or after the completion or

abandonment thereof in respect of which amicable settlement has not been reached shall be referred

to the Sole Arbitrator appointed by the Chief Engineer, Employees' State Insurance Corporation,

who shall proceed as per the Arbitration Act, 1996.

(a) The Work under the contract shall continue, during the Arbitration proceedings.

(b) The award of the Arbitrator shall be final, conclusive and binding on both the parties

(the Employer and the Contractor).

15. Termination of Contract: The employer reserves it’s right to terminate the contract/works by

giving 60 days’ notice at any time during currency of the contract, if the services of the contractor

are not found satisfactory as per the opinion of employer or his representative for which no claim

or compensation shall be entertained by the Employer.

16. Indemnity Clause: The contractor shall ensure full compliance with tax clause and labour law of

India with regard to this contract and shall be solely responsible for the same. The contractor shall

fully indemnify against liability of the levies/ taxes, interest, penalty etc. of the contractor.

17. The ESIC shall not be liable for/ in respect of any damages/ compensation payable to any workman

for death / injury resulting from any act / default of the contractor. The contractor shall indemnify

and keep indemnified the Medical Superintendent, ESIC Hospital, Andheri, Mumbai against all

such damages compensations and expenses whatsoever in respect there of or in relation thereto.

Payment Procedure:

(A) Payment shall be made for the actual days of employment as per certified attendance sheet record

in each shift. As per biometric/Manual attendance record in each shift attendance will be verified by

the person authorized by competent authority.

(B) CAMC amount of equipment and Operational Highly skilled/skilled Labour wages bills shall be

paid on quarterly basis.

(C) Wage should not be less than the prescribed minimum wages for skilled/ semi-skilled personnel, as

prescribed by central government time to time.

(D) Contractor should ensure that the salary to manpower is paid in their Bank Account by ECS/NEFT

only.

(E) Copy of Certified Attendance sheet of Manpower with their copy of Wages Register, ESI, EPF

Challan, Bank Statement for Salary Compliance, All Service Reports, All Breakdown Call Reports

etc.

(F) Rates quoted in Financial Bid should be exclusive of all taxes, ESI & EPF contribution & levies etc.

Annexure –C

SCOPE OF WORK

The Medical Gas Pipe Line System manufactured by different manufacturers. It consists of following

system/ equipment.

1. Medical Gas Pipe Line System (MGPL)

2. Medical Gas Manifold Room Equipment

3. Medical Gas Pipeline Support Equipment

4. Modular Indian OT – 04 Nos (Price to be quoted per unit)

5. Modular Imported OT – 02 Nos (Price to be quoted per unit)

6. Minor OT currently running at Ground floor ( At present Minot OT is not connected with MGPL plant

& for the connection with MGPL plant no extra payment will be made by ESIC ).

• Comprehensive Annual maintenance contract is intended to serve the purpose of operation &

maintenance of entire pipe line functionality along with supporting equipment’s and Modular OT.

The operation staff should be available round the clock to attend the breakdown calls. The complete

annual maintenance will also include calibrations, regular monitoring of equipment with preventive

maintenance services as mentioned in the manufacturer’s service manual.

• Item if any which is not covered under CAMC and need to be replaced shall be replaced by the successful

bidder without any additional cost.

• Whenever there is requirement of any kind of material or any part related to Medical Gas Pipeline

System, Gas Manifold Plant and Modular OTs, the agency shall provide such material for part without

any delay without any additional cost.

• Service Report, Log Book and Maintenance Register must be got signed after every service by

Engineer/Hospital officials.

• Manpower engaged will replace the Cylinder of Manifold when it shows low pressure in control panel

and will also replace the empty Cylinder with new filled cylinders and keep the record of incoming &

outgoing cylinders in a register.

• Manpower deputed will also look after the proper functioning of functioning Air Compressor, Vacuum

Pumps, Oxygen /Nitrous Control panel, Bad head panel, pressure alarms etc.

• Presently the some of the OTs and gas manifold are not in use. Bidders are requested to

visit/inspect the site prior to quote the rates for CAMC of OTs and Gas Manifold. The defected

items if found any during inspection, the same are to be consider to make the complete system

functional by the successful bidder should be considered under CAMC of equipment. Nothing

extra payment to make the OTs , Gas Manifolds and Gas Plant functional will be paid by ESIC.

• Hence all bidders are requested to consider the cost of such defect rectification/replacement of

any parts of MGPL, OTs (Repair/replacement of sensors, batteries of sensors of doors and

scrubs, lights of OTs, floor springs etc. ) if required.

• Before quoting the rate of for CAMC of Gas manifold, bidders are requested to visit/inspect the site

during office Hrs. to inspect entire installation. The defect rectification of non-functional/non-

operational bed head panels, leakage of gases, electric work in the panel room/control room, repairing

of motors etc. if required will be in the scope of CAMC of successful bidder. No any additional cost

shall be paid by ESIC.

• The tenderers are also advised to inspect and examine the site and its surroundings and satisfy

themselves before submitting the tenders, the form and nature of site, the means of access to the

site etc. A tenderer shall be deemed to have full knowledge of the site whether he inspects it or

not and no extra charges consequent on any misunderstanding or otherwise shall be allowed.

• Inspection of Site: The existing MGPL system and Modular OTs can be visited/ Inspected by interested

firms after permission from Medical Superintendent/Authorized official on any working day before pre

bid meeting. (Between 1000hrs to 1600 hrs Monday to Friday)

2. In case of absence of any of the above-mentioned workers without providing suitable replacement,

an amount for each day salary shall be recovered as below. In case of suitable replacement, payment

of ESIC, EPF, and other Labour laws must be followed.

3. Penalty Clause - For not deploying of the required staff, recovery shall be made from their bill at

the following rate: -

Technical Supervisor (Highly Skilled) - Rs 800.00 per person per day

Technician (Skilled) - Rs 500.00 per person per day

Note:

• Only Professionally Qualified and having proper experienced staff shall be deployed.

• This work force should be on the pay roll of the Contractor.

• Medical Superintendent, ESIC Hospital, Andheri, Mumbai shall depute Officers from time to time

for physical verification of employees deployed by the contractor. If it is found no. of persons are

deployed less than as prescribed in Contract Agreement, then penalty will be imposed as per

Penalty Clause mentioned above.

4. All breakdowns/faults shall be attended immediately and rectified promptly.

CONTRACT AGREEMENT
