Prime Minister Narendra Modi onThursday launched the coun-try’s first auction for commer-

cial coal mining and sale in the openmarket.

This is the first major auction by thegovernment this year in midst of alooming slowdown.

Modi said commercial miningwould unlock the country’s coal sec-tor from the “lockdown of decades”.

“The country’s coal sector wasentangled in a web of captive and non-captive. It was excluded from competi-tion, (and) there was a big problem oftransparency. Major scams had takenplace in coal action earlier, but the sys-tem has been made transparent,” hesaid.

Speaking at the event, UnionMinister for Coal Prahlad Joshi saidstate-owned Coal India Ltd (CIL) wouldcontinue to be the dominant player inthe sector.

“We have given CIL a target of 1 bil-lion tonnes by 2023-24, for which theywill spend nearly ~50,000 crore on landacquisition, mine development,procuring machinery, and evacuation,”said Joshi.

CIL is the world’s largest coal minerand almost a monopoly supplier of coalin India. The Central government hadearlier this year amended the CoalMines (Special Provisions) Act, 2015, tosimplify auction and attract investor

interests. The ministry kicked off theauction with 41 coal blocks, which areestimated to earn the mine-bearingstates ~20,000 crore annually.

Modi said India should be theworld’s largest exporter of coal.

Pitching for the flagship scheme ofthe Centre to battle the Covid-inducedslowdown, the prime minister said“AatmaNirbhar Bharat” translated intoreducing imports.

“It entails that India developresources domestically so that thecountry does not have to rely onimports. It also means becoming thebiggest exporter of commodities thatwe now import,” he said.

Modi also said there would beemployment with investment in thesector.

“Eastern and Central India will ben-

efit a lot from this reform. Regions richin coal and minerals will progress dueto these reforms. These are the areaswhich have aspirational districts. Thecoal blocks that are getting auctionedtoday will provide lakhs of jobs in theseareas,” he said.

The Centre is also planning to use100 million tonnes of coal for gasifica-tion by 2030. He said four projects wereidentified for this and about ~20,000crore would be invested in coal-gasifi-cation projects.

Modi said coal reforms would havea positive impact on power, steel, alu-minium, cement, and fertiliser.“Consumption and demand areapproaching the pre-Covid level. Insuch a situation, there cannot be a bet-ter time for a new beginning,” he said inthe virtual address.

Vedanta Executive Chairman AnilAgarwal, Tata Group Chairman NChandrasekaran, and Federation ofIndian Chambers of Commerce andIndustry President Sangeeta Reddywere part of the digital launch.

Agarwal said prosperity wouldcome to areas where mine explorationtook place. “I want to assure Coal Indiathat they should not worry about anyjob loss. So I urge them to support us(private miners).”

He asked the ministry to have apublic hearing in the case of any dis-pute and, to save time, have self-certi-fication for the bidders. He also askedthe government to look at privatisingHindustan Copper.

Hoping to attract a slew ofinvestors for India’s first auc-tion of coal mines for com-mercial mining and saleprocess, the Ministry of Coalhas liberalised the terms ofqualification. However, thefinal decision on successfulbidders will need governmentapproval.

There is effectively no stricteligibility criterion for partici-pating in the auction. The com-panies/joint ventures shouldbe registered in India. Bidderswho have won coal mine undercaptive auction and have beenconvicted of an offence relat-ing to coal allocation are disal-lowed to participate.

In a presentation, a coalministry official said the mineson offer were a mix of smalland large mines in order tocater to all kinds of players,especially non-mining com-panies. Of the total 41 mineson offer, 11 are in MadhyaPradesh, nine each inChhattisgarh, Jharkhand, andOdisha, and three in

Maharashtra. The total geo-logical reserve of the mines is16,979 million tonnes.

“Of the 41, seven mineshave environment clearance;six have forest clearance. Landacquisition has been done in12 mines. There are five minesin production up for auction,”said the coal ministry.

The Centre is expectingcumulative revenue of ~20,000crore annually to the mine-bearing states from the auc-tion of 41 mines.

The new methodology alsoprovides the bid parameter tobe on ‘revenue-share’ mode.The bidders will be required tobid for a percentage share ofrevenue payable to the stategovernment from the produc-tion and sale of mined coal.The floor price is kept at 4 percent of revenue share.

The price of coal extractedwill be determined through theNational Coal Index (NCI),which the Ministry of Coal willset up. The NCI will have amarket-linked benchmark,said the coal ministry.

The auction is a two-partround — technical and finan-

cial. The nominated authorityfor the coal auctions — a jointsecretary-level official from theMinistry of Coal — will evalu-ate the technical bids. Bidderswill be required to submit theireligibility criteria, along withan initial offer to the nominat-ed authority.

The financial bid roundcomprises two stages. The ini-tial offer of technically quali-fied bidders is ranked indescending order for determi-nation of qualified bidders.These qualified bidders are eli-gible to participate in the e-

auction and submit their finaloffer. The highest bidder for amine selected for evaluationby the government will bedeclared a ‘successful bidder’.

In a tender documentuploaded by the Ministry ofCoal for commercial coal auc-tions, however, mentioned thenominated authority “reservesthe right (without incurringany liability whatsoever) toreject all or any of the bid-ders/bids without assigningany reason whatsoever”. Onebid per company for a mine isallowed.

The preferred bidder whosubmits the highest bid in theauction could lose the mine ifthe government’s evaluationof the bid deems it unfit. In thepast when the coal ministryawarded coal mines for cap-tive (self) use, it cancelled bidsof private companies, citingthem to be too low. This led tolegal tussles.

There is no restriction onthe sale and consumption ofcoal. “The coal produced fromthe coal mine may be sold bythe successful bidder in anymanner as may be decided bythe successful bidder, includ-ing sale to affiliates and relatedparties, utilisation of coal forany purpose, including but notlimited to captive consump-tion, coal gasification, coal liq-uefaction, and export of coal,”said the tender document.

The miners will also havethe freedom to explore coal-bed-methane, coal gasifica-tion, and minor minerals at thecoal mining site. The Centrewill also provide rebates onrevenue payment in case ofearly production and usage ofclean-coal technologies.

NOTICE is hereby given that pursuant to provisions of Section 124(6) of the Companies

Act, 2013 and Investor Education and Protection Fund Authority (Accounting, Audit,

Transfer and Refund) Rules, 2016, as amended from time to time (‘the Rules’), the

Company is required to transfer/ credit all such shares in respect of which dividend

has not been claimed by the Shareholder for seven consecutive years to the Investor

Education and Protection Fund.

Shareholders are requested to note that the dividend declared during the Financial

Year 2012-13 which remained unpaid or unclaimed for a period of seven years from

the date of transfer to Unpaid Dividend Account will be due to be credited to the IEPF in

September, 2020. The corresponding shares on which dividend was unclaimed for seven

consecutive years will also be transferred as per the procedure set out in the Rules.

In view of outbreak of COVID-19 pandemic in India and lockdown, there is a possibility

that the individual notice to the concerned shareholders, who have not claimed their

dividend for seven consecutive years or more in terms of the said Rules and whose

shares are liable to be transferred to IEPF under the Rules, may not be received by them.

However, the Company is making all efforts to dispatch the individual notices to the said

shareholders physically at their registered address or by email to those shareholders

whose e-mail addresses are registered either with the Company or the Depository

Participants providing them the details of their unclaimed dividend and giving them an

opportunity to claim the unclaimed dividend before the due date.

Please note that the due date for claiming unpaid / unclaimed dividend amounts(s),

declared during the Financial Year 2012-13, is September 27, 2020. All concerned

Shareholder(s) are requested to make an application to the Company/Company’s

Registrar and Share Transfer Agents preferably by August 31, 2020 with a request

for claiming unpaid/unclaimed dividend for the year 2012-13 and onwards to enable

processing the claims before the due date.

In case no valid claim in respect of unclaimed dividend is received from the concerned

Shareholder(s) by due date, the Company shall, in compliance with the aforesaid Rules,

transfer the dividend and corresponding shares to the IEPF authority without any further

notice.

In case shares are held in Physical form: The Company would be issuing duplicate

share certificates(s) in lieu of the original share certificate(s) held by concerned

Shareholder (s) for the purpose of transfer of shares to the Demat Account of the IEPF

stands registered in concerned Shareholder (s) name will stand automatically cancelled.

In case shares are held in electronic form: The Demat Account of the concerned

shareholder(s) will be debited for the shares liable to be transferred to the Demat Account

The concerned shareholder (s) would be entitled to claim the transferred shares and

dividend from IEPF Authority by making an Application in the prescribed E-form IEPF-5
