Notification of an activity or application for permission toconduct an activityTo submit a notification of a ground disturbance, or request for permission for a ground disturbance pursuant to the AER Requirements for Landowners and Industry for Safe Excavation Near Pipelines, or for permission to conduct an activity within an ATCO Pipelines’ right-of-way, a letter must be provided to ATCO Pipelines, which includes:

• Complete legal name(s) and contact information of the person or company for whom the work is being done

• Legal land description• Description of the activity• Equipment to be used• Access requirements• Survey plan or a clear drawing indicating

all measurements to ATCO Pipelines’ facility

ATCO Pipelines will respond to your request within 21 days of receipt. Upon approval and if required, an ATCO Pipelines Crossing or Proximity Agreement is issued for signing and return to ATCO Pipelines.

ATCO Pipelines has an extensive network of high-pressure pipelines and above ground facilities throughout the Province of Alberta. To ensure the safety of the public and to protect pipeline facilities, the Province of Alberta Pipeline Act and the Pipeline Regulation govern the activities that take place in the vicinity of a pipeline. If you are planning to undertake an activity that involves a ground disturbance within 30 meters of a pipeline (the controlled area), the Alberta Energy Regulator (AER) Requirements for Landowners and Industry for Safe Excavation Near Pipelines sets out the procedures you must follow. A copy of the guide is attached for your information and is available on the AER website.

Right-of-Way and Controlled AreaIn addition to the requirements set out in the AER Requirements for Landowners and Industry for Safe Excavation Near Pipelines with respect to ground disturbances; if you are planning any activity (other than normal agricultural operations) within an ATCO Pipelines’ right-of-way, written permission is required from ATCO Pipelines prior to the commencement of any work. Examples of such activities include a vehicle (greater than ¾ ton) or equipment crossing, adding of fill material, landscaping, paving and building construction. If you are unsure if your planned activity requires permission, please contact ATCO Pipelines to receive clarification.
