Background• April 2012 Department of Environment & Local

Government (DoECLG) issue a document titled; “Strengthening the Building Control System”.

• Chapter 5 – “Future Focus” referred to:• Register of Approved Certifiers, • Registration of Builders and Contractors, • Electronic lodgement of design drawings at commencement

stage.

• DoECLG invited CIF to submit proposals relating to voluntary registration process for builders and contractors.

Building Control (Amendment) Regulations 2014

• Effective for Commencement Notices lodged on and after 1st March 2014.

• Mandatory Certificates seek CIRI Registration Number for Builders / Contractors where applicable.

Governance• Construction Industry Register Ireland (CIRI) has been

established and is operated by the CIF.

• Registration approvals governed by the Construction Industry Registration Board (CIRB).

• Complaints & Appeals Committee.

• Operated by the CIRI Office.

Who is the Register for?Designed for all construction practitioners including:

• Main contractors and builders.

• Specialist contractors and sub contractors.

• Other trades.

Annual registration is required.

Established to develop and promote best practice.

CIRI Introduction

• All registered contractors / builders / specialists committed to proper building principles and to Industry Code of Ethics.

• Register contains important information about its members.

• Assist all persons procuring construction services when selecting a builder / contractor / specialist.

CIRI Introduction• Established initially on a voluntary basis:

• commitment based principles• scope to evolve to a statutory register on standards based principles.

• Members required to:• submit current Tax Clearance Certificate• abide by the Industry Code of Ethics• adhere to builder / contractor obligations required under the

registration process.

CIRI IntroductionApplicants for entry to Register must:

• Undertake to adhere to Industry Code of Ethics and Commitments.

• Demonstrate competence and experience of construction.

• Have knowledge of building practice, building regulations and other regulatory obligations.

CIRI Introduction• Undertake an initial induction programme to ensure

awareness of the obligations under the registration process.

• Commit to continuing professional training and development

• Declare any convictions under the Building Control Act or Safety Health & Welfare at Work Act.

Entry to the RegisterApplicants must demonstrate that their business or company has:

• Practical hands on construction experience generally for a period of no less than 3 years;

• Understanding of the legislative and regulatory context in which construction is practiced;

• Delivery of construction services and construction management / technical experience.

Entry to the Register• Adhere to the Code of Ethics and Member Obligations

for members of Construction Industry Register Ireland;

• Commit to ongoing CPD training and development;

• Demonstrate a record of regulatory compliance applicable to the industry.

ComplianceMembers:

• Must submit a valid Tax Clearance Certificate on date of application for entry on the Register;

• Should include their registration number and the Register logo on development sites and vans;

• Should retain records of all CSCS / Safe Pass cards for staff engaged on site, and

• Should encourage sub-contractors / specialists to register with Construction Industry Register Ireland.

Registered Members’ Obligations Under Commitment Based Registration System

Example of what Applicants shall commit to:

• Abide by industry Code of Ethics;

Membership of the Construction Industry Registration Board shall not exceed 10 members, in addition to a Chairperson, all of whom shall have relevant knowledge of the construction industry.

The Complaints and Appeals Committee (CAC)

Functions

• The Complaint & Appeals Committee (CAC) shall deal with all valid complaints regarding registered members and requests for appeal of any decision of the CIRB.

• Independent Chairperson; and• 4 members who are not members of the CIRB:

– 2 appointed by Minister for Environment– 2 appointed by CIF:

• 1 a construction professional who cannot be a registered member of CIRI.

• 1 who qualifies for registration as a member of CIRI.

• Complainant or the registered member may appeal the CIRB decision to the CAC.

• Notice of appeal must be received by the CIRI within 21 days of the date of the CIRB’s decision.

CPD Introduction• CIRI recognises the need for all construction professionals to

embrace CPD as an integral part of their professional lives.

• A central purpose of the CIRI registration process is to assist governance and statutory performance compliance.

• The CPD element of the CIRI registration process is central to regulatory compliance and market credibility.

• CPD is learning that adds to and enhances a person’s occupational, technical and professional competence in a process of lifelong learning.

CPD Introduction

• As an industry, the construction industry must meet the demands of:

– More rigorous building regulations;

– More complex and competitive procurement processes;

– The use of innovative and diverse technologies in design and construction processes; and

– Increasingly demanding building contracts.

CPD in PracticeCIRI Registrants will be required to plan, record and verify the CPD activities of its personnel.

CPD will focus on management and supervisory staff whose input is essential to achieving legislative and regulatory compliance.

CIRI Registrants should develop a staff development plan based on identified training needs. This should lead to the development of the detailed CIRI CPD Plan.

The CIRI CPD Plan (template) should outline CPD training and up-skilling requirements.

Personnel may hold membership of professional bodies which already require CPD. Such appropriate CPD can be used to address CIRI CPD.

CPD in PracticeCIRI Registrants will commit to structured and informal CPD that falls under the following four main pillars:

1. Building & Building Control Regulations2. Health & Safety3. Technology & Innovation4. Business & Management

Structured CPD 1

Engagement in further education and research directly related toprofessional role. Examples include:

• Postgraduate Certificate, Diploma, Masters or Doctorate.

• Attendance and completion of accredited courses or workshops.

• Dissemination of research findings through presentation or publication for peer review.

• Development of materials such as video, audio or software, instructional manuals etc. to advance professional and /or site skills.

Structured CPD 2• Attendance at courses, conferences, seminars & briefings (that are directly linked to

construction activity: e.g. Building Regulations, Building Control Regulations, Health & Safety Regulations)

• Attendance of specific conferences and courses (e.g. CIF annual conference, Branch or Association Committee meetings).

• Attendance at multidisciplinary and subject-specific conferences.

• Attendance at certified conferences, workshops or courses.

• Specialist lectures / workshops.

• Preparation and delivery of presentations, in house training and courses (e.g. from material suppliers).

• Distance learning e.g. completion of e-modules.

• Relevant programmes provided by recognised educational institutions will be listed on the CIRI website.

Informal CPD

• Informal CPD includes:– Learning from colleagues on the job– Reading– Reflecting on one’s own work– Activities undertaken outside work which feed back into work

“The nature of CPD will vary to reflect the particular role in thecompany and the type of company”

CPD Process• The CIRB will establish a CIRI CPD audit procedure for sampling of

CPD records. The CIRB will also establish the information relating to completed CPD for the annual renewal process.

• There will be an Appeal Process should a company fail to meet the required standards of the CPD audit.

• An Audit process will be in place to review appeals of findings.

Conclusion• New Regulatory environment for Construction industry.
