Should Contractors Be Required to Report Settlements and Judgments to CSLB?

On June 16, 2015, a balcony at Library Gardens Apartments in Berke-ley, CA collapsed, killing six students and injuring seven others. The company that constructed the apartment complex, Segue Construc-tion Company, had a history of questionable work. Notably, over the past three years, the company paid out $26.5 million dollars in construction defect settlements.

State law, however, does not require contractors to report defect settlements to the Contractors State License Board (CSLB). In relation to other trade professions, licensees such as architects and engineers are required to report settlements and judgments to their appro-priate regulator. While the Board for Professional Engineers, Land Surveyors, and Geologists receives roughly 60 settlement reports per year, the California Architects Board receives 29 settlement reports per year. Both boards underscore that there are minor, absorbable costs associated with this enforcement measure and underline that they conduct their own independent analysis of the settlement reports.

In response to the Berkeley balcony collapse and in recognition of the requirements of other trade professions, Senators Jerry Hill and Lon-nie Hancock introduced SB 465, which is currently pending in the As-sembly Committee on Business and Professions on reconsideration (it didn’t have the votes last year and reconsideration has been granted). Among other things, the bill would require a licensee to report to the registrar within 90 days of the date that the licensee has knowledge of a felony or any other crime substantially related to the qualifica-tions, functions, and duties of a licensed contractor or any civil action settlement or administrative action resulting in a settlement worth $50,000 or more, or a binding arbitration or administrative action resulting in binding arbitration worth $25,000 or more. Failure to comply with this requirement would be grounds for disciplinary ac-tion, including suspension or revocation of the license.

What Would the CSLB do with the Information? Similar to other regulatory entities, in order to determine whether a complaint is appropriate for investigation, the CSLB would review the information on a case-by-case basis, looking at such factors as the severity of the allegations, and whether a licensee has a history of complaints or discipline. Complaints involving a threat to the public’s health and safety, and cases where consumers have suffered a signifi-cant financial injury are given the highest priority. According to the authors, “this bill increases transparency so that consumers have the

tools necessary to make an informed decision about the quality of the contractor they hire.” “The bill also establishes greater account-ability for contractors by ensuring the public has critical information about licensees.”

As a result, only those settlements or arbitration awards that are investigated, and would subject a Licensee to suspension, revoca-tion, or criminal prosecution, not merely just a citation, would be made available to the public, which is the type of information that is already disclosed. In addition, licensees are already required to report unsatisfied final judgments to the CSLB, and are required to disclose convictions when applying for licensure. For licensees that have already been fingerprinted by the CSLB, the CSLB will receive notifications from the Department of Justice when that licensee is the subject to additional criminal action; however, not all licensees have submitted their fingerprints to the CSLB; hence, the reason for disclosure of felonies and other substantially related crimes.

In certain instances the need for this bill be appropriate, but the BIG question is, is there such a HUGE problem out there or is this really just an excuse for the applicant attorneys to gain access to a plethora of new ‘work’ that would now be disclosed for them to ‘pick and choose from? Interestingly, it was noted during the informational hearing this past Monday that attorneys typically receive two thirds of MOST settlements!!! Makes you want to go, hmm!

Obviously, there’s a lot more to discuss on this matter. Stay tuned for next week’s continuing discussion. There are two sides to every story, but I’m concerned the attorneys are ‘circling the water smelling blood!’

April 25, 2016 HOME SALES REBOUND Bouncing back from a drop of 7.3% in February, existing home sales improved 5.1% last month. In its March report, the National Association of Realtors announced a median sale price of $222,700, 5.7% higher than a year ago.1,2

BUILDERS BREAK GROUND ON FEWER PROJECTS While home sales increased last month, the pace of both housing starts and building permits declined. Census Bureau data shows an 8.8% reduction in groundbreaking for March. Building permits were down 7.7% for the month.1,2

OIL PRICES RISE FOR A THIRD STRAIGHT WEEK WTI crude settled at $43.73 on the NYMEX Friday. Expectations of declining production helped oil gain 4.8% in five trading days. Gasoline futures were also up 4.8% on the week.3

You’ve heard the expression, “You are what you eat.” Well, with welding, one could say you are what you breathe.

Welding smoke is a complex mixture of very small, condensed solids (fumes) and gases. The base and filler metals, fluxes, coatings, and shielding gases all contribute. Even chemical changes to the surrounding atmosphere from the intense radia-tion and heat can add to the mix.

The effects of welding smoke on a person will depend on the par-ticular components of the smoke and how much of it the welder breathes. Some effects may occur shortly after exposure; these are acute effects. Long-term or chronic effects may not become apparent until after years of exposure.

Metal fume fever is the most common acute respiratory illness experienced by welders. It is a flu-like illness that lasts 24–48 hours. It is typically caused by exposure to zinc fumes, but cop-per, magnesium, and cadmium are also known to cause metal fume fever. Acute exposures to high concentrations of cadmium can be more serious though, producing severe lung irritation, pulmonary edema, or even death.

Long-term exposure to welding fumes may pose the risk of serious respiratory, nervous system, and reproductive effects, but more research is needed. Some metals we know are especially hazardous. These metals include lead, cadmium, beryllium, and mercury. But even welders who don’t work with these toxic materials may be at risk.

Carbon steel, which includes mild steel, is the most common mate-rial welded. The manganese in the steel and the filler metal some-times results in overexposure to manganese. Chronic manganese poisoning can cause Parkinson’s-like disease and other neurological effects.

Stainless steel, high alloy steels, and nickel alloys expose work-ers to chromium and/or nickel fumes. Both nickel and hexavalent chromium are classified as human carcinogens.

Hazardous gases can also be produced during welding. Depend-ing on the specifics of your process, these could include ozone, nitrogen dioxide, carbon monoxide, and fluorine compounds. These gases may cause both short and long-term effects.

To protect workers from welding fumes and gases, ventilation is of-ten necessary, especially when welding with particularly hazardous materials or for long periods. It’s essential in enclosed or confined spaces. While air-purifying respirators can filter out metal fumes, they don’t protect workers from all of the hazardous gases produced or oxygen deficiency.
