Commissioner/Executive officer, Arulmigu Vanabadrakaliamman Temple,
Thekkampatti, Mettupalayam Taluk, Coimbatore District invites tender in two cover
system for the construction of new 7 tier Rajagopuram work within the temple
premises from either the approved Sthapathy of of the HR & CE Department or
Class-I contractor having registration with the PWD Department, engaged himself
with the contractor work costing more than 75 Lakhs, upto 2.30 PM on 12.03.2015.
From the received tenders, pre-qualification tender (Part I cover) will be opened on
12.03.2015 at 3.00 PM by the Assistant Commissioner/ Executive Officer at the
temple Office in presence of tenderer or their representatives.

The Tender schedules can be obtained from 10.00 AM to 5.45 PM on
12.02.2015 to 11-03-2015 at temple office by remitting the cost of tender schedule
as mentioned in the above table. A Pre-Bid meeting shall be held at the office of
the Assistant Commissioner/Executive Officer, Arulmigu Vanabadrakaliamman
Temple, Thekkampatti, on 24-02-2015 at 3.00 PM for clarification of doubts, if any
regarding the scope of the works, conditions of contract or any other matter relating
to the Project. For this reason, queries, if any, must be sent to the Assistant
Commissioner/Executive Officer, Arulmigu Vanabadrakaliamman Temple,
Thekkampatti atleast two days prior to the scheduled date for the Pre-bid meeting.
All other details of the works and any information can be had from the temple office
on any working day during working hours. .

FOR THE SPECIAL ATTENTION OF THE APPLICANTS
a) Issuance of documents under two cover system i.e. qualification tender and
price tender (Commercial tender) to the applicant will be purely based on the
basic documents and information furnished along with the requisition and
cost of tender documents. Application will not confer any right on the
applicant for automatic qualification for price tender for the work.
b) Approval or otherwise of the qualification tender will be strictly based on the
detailed evaluation done on the basis of the Documents / Records /
Evidences / Certificates produced by the applicant in the qualification
application.
c) Qualification tender (Cover 1) will be opened as per Notice Inviting Tender
and after detailed evaluation. The date and time of opening of price tender
will be intimated to the qualified applicants.

QUALIFICATION & PRICE TENDER NOTICE
FORM OF CONTRACT: LUMPSUM AGREEMENT:
TWO COVER SYSTEM
1. INVITATION :
Tender under sealed two cover tender system i.e. qualification schedule & price tender (item rate tenders) are invited for and on behalf of the Governor of Tamil Nadu by the Assistant Commissioner / Executive Officer, A/M Vanabadrakaliamman Temple, Thekkampatti, Mettupalayam Taluk, Coimbatore District. One Cover contains EMD and qualification conditions and other details and the Second cover containing price tender schedule.
2. FOR SPECIAL ATTENTION :
i. The Tenderer who wish to participate in the Tender should be approved Sthapathy of the HR & CE Department (or) he / she should also be the Class I contractor having registration with the Tamilnadu State Public works Department under Class I (as per revised classification) with monetary limit above Rs. 75.00 Lakhs (Rupees Seventy Five Lakhs) and with proven track record are only eligible. The Tenderer should produce experience certificate regarding the construction of Raja Gopuram work.
ii. Class I Contractor other than approved Sthapathy participating in the
Tender has to engage an approved ornamental cut-stone work Sthapathy to supervise the work till the completion of work and his consent letter to this effect should be obtained and enclosed along with the tender.
iii. If the applicant is a registered Class I contractor he should have
completed atleast one work of similar nature with value not less than Rs. 145.00 Lakhs. (Rupees One Hundred and fourty five Lakhs) under a “Single agreement” in any single year during any period of their career. For this purpose building like Industrial sheds, workshops will not be considered. If the applicant is an approved sthapathy of HR & CE Department he should have completed atleast one work of similar Raja Gopuram with value not less than Rs. 50.00 Lakhs under a single agreement in any single year during any period of their career.
iv. Annual turnover of the registered Class I contractor should not be less
than Rs. 145.00 lakhs (Rupees One Hundred and fourty five lakhs only) per year in any one of the preceding “Three” years of the carrier. If the applicant is an approved Sthapathy of HR & CE Department annual turn over of him should not be less than Rs. 50.00 Lakhs (Rupees Fifty Lakhs only) per year in any one of the preceding “Three” year of the carrier.

3. PURCHASE OF DOCUMENTS :
a. The documents under two cover system qualification schedule & price tender will be available for sale at a cost of Rs. 15,000/- plus Rs. 750/-(Vat Tax) in the office of the Assistant Commissioner / Executive Officer, A/M Vanabadrakaliamman Temple, Thekkampatti, Mettupalayam Taluk, Coimbatore District, during office hours from 12.02.2015 to 11.03.2015 upto 5.45 pm.

Construction of 7 Tier Raja Gopuram in the Northern Side of Arulmighu Vanabadrakaliamman Temple, Thekkampatti, Mettupalayam Taluk, Coimbatore District.
5. SCOPE AND STATUS OF THE WORK UNDER THIS TENDER :
It is proposed to Construct 7 Tier Raja Gopuram at Northern side of Outer Pragara Mandapam. The widening of outer pragaram is under progress. Hence, it is proposed to construct 7 Tier Raja Gopuram to a height of 101‟-6”.
The Rajagopuram is constructed with Kalkaram upto 20‟-3” and Gopuram special Brick Work to a height of 73‟-0” (upto copper kalasam).
Base width size 52‟-9“ x 30‟-2”
Foundation Depth 13‟-0” from G.L.
6. PEROID OF COMPLETION :
The period of completion shall be 36 months - calendar months,
which is inclusive of monsoon period from the date of handing over of the
site to the successful contractor.

7. EARNEST MONEY DEPOSIT :
7.1. Earnest money deposit of : Rs. 1,56,000/- (Rupees One fifty six Thousand
Only) must accompany the qualification schedule for this work.
7.2. The Earnest money deposit may be produced in any one of the following
forms.
i. Demand Draft / Fixed Deposit Receipt issued by Nationalised or
Scheduled Banks drawn in favour of the Assistant Commissioner /
Executive Officer, A/M Vanabadrakaliamman Temple, Thekkampatti,
Mettupalayam Taluk, Coimbatore District.
7.3. Qualification schedule not accompanied with Earnest money deposit will be
rejected as „Non-responsive‟ tender.
7.4. If the tenderer withdraws his tender after the acceptance of tender or fails to
pay the requisite security deposit amount within the specified period of time,
the Earnest money deposit paid with the tender will be forfeited.
7.5. Communication to the unsuccessful tenderers will be sent in 7 (seven) days
time from the date of communication sent to the successful tenderer. Within
15 (fifteen) days from the date of receipt of refund vouchers duly stamped and
signed from the unsuccessful tenderer, refund of earnest money deposit will
be made.
8. SECURITY DEPOSIT :
8.1. The successful tenderer shall furnish a Security Deposit for an amount
equivalent to 2% of the contract value, which includes the earnest money
deposit already paid within 15 days (Fifteen days) from the date of receipt of
work order. If the successful tenderer fails to execute the contract (i.e. sign the
agreement) within the aforesaid 15 days time, the Earnest Money Deposit
amount with the Qualification schedule will be forfeited.
8.2. The Security Deposit in the shape of irrevocable bank guarantee will also be
accepted.
8.3. In addition to the aforesaid security deposit, the Assistant Commissioner /
Executive Officer will deduct from the running account bills, a sum of
equivalent to 5% (Five Percent) of the total value of each bill as retention
money.

8.4. 2 ½ % (TWO AND A HALF PERCENT) of the total value of the work will be
retained in the final bill of the work for a period of one year reckoned from the
date of completion of the work or as soon after the expiration of such period of
the one year as all defects shall have been made good according to the true
intent and meaning hereof whichever shall last happen.
8.5. The retention money of 2 ½ % (Two and a Half Percent) of the total value of
contract after deducting any amount due to the Department, shall be refunded
to the contractor after the defects liabilities attached to the contract is over (as
per Para 8.4 above) subject to the following conditions :
i. The Assistant Divisional Engineer, concerned should certify that no
liability is due from the contractor.
ii. The contractor should execute and produce an indemnity bond for a
further period of “FOUR” year indemnifying the Government against
any loss or expenditure, incurred to rectify and defects noticed due to
faulty workmanship by the contractor or Sub-Standard materials used
by the contractor, during the period of “FOUR” years.
8.6. Concessions granted to standing contractors on payment of deposits are not
applicable to this contract.
9. LANGUAGE OF TWO COVER TENDER SYSTEM :
Tenders shall be offered only in the prescribed forms in “ENGLISH” only.
10. VALIDITY OF PRICE TENDER:
The price tender shall be valid for a period of 90 days (Ninety days) from the
date, notified for opening of price tender.

11. SUBMISSION OF PRICE TENDER BY TWO COVER SYSTEM :
11.1. Tenderers should quote their rates both in figures and in words for each item per unit and amount for each item of work for full quantity. Grand total of the whole contract should be furnished without fail in the last page of schedule “A” of Price tender.
11.2. The two cover (i.e. Qualification schedule and Price tender) must be submitted
in a wax sealed envelope. The Cover No.1 containing the Qualification schedule, documents & Earnest Money Deposit and Cover No.2 containing the Price tender must be superscribed as mentioned below and addressed to the tender calling authority.

11.3. If the cover is not sealed and superscribed as instructed, no responsibility will be assumed for any misplacement of tender or premature opening of the envelope or parcel.
11.4. Tenders received late on any account or any reasons whatsoever will not be
opened or considered and will be returned to the tenderer unopened.
11.5. Telegraphic tenders will not be accepted.

12. OPENING OF TENDERS :
The qualification schedule will be opened by the Assistant Commissioner /
Executive Officer, A/M Vanabadrakaliamman Temple, Thekkampatti, Mettupalayam,
Coimbatore District at 3.00 P.M. on the notified date in the presence of the
tenderers or their authorized representatives who choose to be present. After
detailed evaluation of qualification schedule, price tender of the qualified contractors
those who are satisfy the minimum criteria only will be opened. The date and time of
opening of price tender will be informed to the qualified tenderers by the Assistant
Commissioner / Executive Officer, A/M Vanabadrakaliamman Temple,
Thekkampatti, Mettupalayam, Coimbatore District later.
13. NEGOTIATION :
Negotiation of rates will be made only with the lowest tenderer for reducing the
quoted rates.
14. RATES AND PRICES :
Price adjustment clause (To account for rise or fall in the money value during
the contract period is operable for this contract as per G.O.Ms.No.60. Public
works Department dated: 14.03.2009 and certain amendments made in
G.O.Ms.No. 101 PWD (G2)/ dt. 10.06.2009. Price Adjustment Clause is eligible for
Estimate value put to tender above Rs.100 lakhs subject to the following
a. Full price adjustment on all the components is applicable, if the contract period is
above 12 months as per specified formula.
b. Price adjustment will apply only when the fluctuation of rates exceeds by 3% compared
to the estimate rates (Reserve Bank of India – Index price).
c. Price adjustment will be calculated only on the estimated cost of work.
d. Bitumen and POL will be considered on “pass through” basis with payment of actual
rates / price at the rates charged by Indian Oil Corporation.
e. Price adjustment will be made for both increase and decrease in the cost of materials.
f. Price variation will be calculated once in a quarter in respect of cement and steel as
per specified formula from the date of agreement upto the end of agreement period.

g)For the purpose of calculated price adjustment, the quarter would be reckoned with
reference to the quarter of the calendar year in which the agreement is signed.
h)Price escalation will be calculated based on milestones fixed in physical terms and
prefixed time line for usage of inputs, which would be utilized for the work in each time
period between two milestones.
i)Escalation will be given for only those quantities which have been used had the contractor
stuck to this original time line.
j)If the contractor does a certain quantity of the work in the quarter which he should have
done in the second quarter, he can still claim escalation on that quantity at the rates as
applicable in the second quarter.
k)Price adjustment mechanism will cease to operate for the value of work executed beyond
the agreement period.

INFORMATION AND INSTRUCTION FOR
TENDERS UNDER TWO COVER SYSTEM
I. FOR SPECIAL ATTENTION :
Qualification schedule hereunder is invited in accordance with the PWD
Procedure for Qualification of Tenderers. The tenderers should submit
credentials the time of tendering itself. The submission of particulars to
establish their qualification criteria for items 1 to 6 are mandatory. Otherwise
the tender will be rejected summarily.
II. MINIMUM CRITERIA FOR QUALIFICATION :
1(a). The Applicant in the same “NAME” and “STYLE” should have been in the Civil Engineering Construction field atleast for the past “THREE” years.
EVIDENCE TO BE PRODUCED :
i. Audited Balance sheet with Chartered Accountant‟s Certificate for the past “THREE” years in the case of individual Contractors, Partnership Firms,
Private / Public Limited Companies.
ii. Registered Partnership deed in the case of Partnership Firms.
iii. Articles of Association and memorandum of Association registered with
Registrar of Companies as per company act in the case of Private Limited
Companies and Public Limited Companies.
1 (b). The Applicant should be registered contractor of Tamilnadu State Public
Works Department under Class I, as per revised classification with monetary limit
above Rs.75.00 Lakhs (Rupees Seventy Five Lakhs) with proven track record. In
the case of Sthapathy registered in HR & CE Department he should have
completed similar Raja Gopuram work costing more than 50.00 Lakhs and the
completion certificate obtained from the competent authority should be enclosed.
EVIDENCE TO BE PRODUCED :
i. Attested copy of the communication issued by the Registering Authority,
registering the name of the Applicant as Class I Civil Contractor in
Tamilnadu State Public Works Department as per Revised Classification
and Live Certificate.
1 (c). The Applicant shall be solvent to a tune of at least Rs. 30.00 Lakhs (Rupees
Fifty Lakhs only) on immovable properties.

EVIDENCE TO BE PRODUCED (For Class I Registered Contractor) :
i. Revenue Solvency Certificate for not less than least Rs. 30.00 Lakhs (Rupees Thirty Lakhs Only) issued by Tahsildar concerned on or after 2.02.2015
ii. Encumbrance Certificate issued by the Registration Department on the
properties listed out in the Solvency Certificate for the period from the date of solvency to 3.02.2015 without any break.
iii. If the date of solvency certificate is on or after 3.02.2015 Encumbrance
Certificate need not be produced.
1 (d). The Class I Contractor / Approved Sthapathy Registered in HR & CE Department should produce the clearance of Income Tax and Sales Tax Registration details and Sale Tax Verification Certificate valid for the current period 2013-2014 along with Pre- Qualification application / Tender forms.
EVIDENCE TO BE PRODUCED :
i. The Income Tax claimed and paid during the past “THREE” years and the total contract amount received in the past “THREE” years should have been indicated in the Income Tax Clearance Certificate.
ii. Attested Copy of Registration Certificate showing the TNGST / CST / TIN No
Number assigned by the Commercial Tax Department issued by the Competent State / Central Commercial Tax Department officials.
iii. Attested Photocopy of the Sales Tax verification certificate issued by competent
State / Central Commercial Tax Department officials for the previous year shall be produced. 1 (e). The Applicant should furnish the details of major building works, civil works and experience certificate regarding the construction of Raja Gopuram work completed during his / their total career.

b) Building works executed for Private parties
The building works executed externally for private parties may also be
considered for the same, provided that, the contractors shall produce an affidavit
with regard to building works they have executed externally (i.e.) other than
Government / Quasi Government works). The Executive Engineer, PWD in-
charge of the jurisdiction, after his personal inspection of the buildings
referred to by the contractor and also based on local enquiry, shall issue a

The Certificate should be furnished along with pre-qualification tender for consideration.
2. Annual turn over of the applicant shall be not less than Rs.145.00 lakhs (Rupees
One Hundred and forty five lakhs only) in any one of the five years in the total career.
c) Raja Gopuram works executed for Private parties
The Raja Gopuram works executed externally for private parties may also
be considered for the same, provided that, the Sthapathis produce an affidavit
with regarding the Raja Gopuram or similar works from the Assistant
Commissioner / Executive Officer incharge of the Temple after his personal
inspection of the buildings referred to by the Contractor and also based on local
enquiry shall issue a certificate on the following aspects.
I. Value of the Raja Gopuram executed by the contract to externally.
II. Stages of Raja Gopuram (3 Tier, 5 Tier, 7 Tier with Kalkaram)
III. Quality of the work.
IV. Understanding with the employer (Trustees) etc., (whether the Sthapathy were
cordial relationship with the private employer)

EVIDENCE TO BE PRODUCED :
i. Audited Balance sheet, Profit and loss Account etc., duly certified by the
Chartered Accountant in any one of the “THREE” years in his / their total carrier.
ii. The total contract amount received as shown in the Balance Sheets should
have been reflected in the Income Tax Clearance Certificate also. In case if there is difference in the contract amount received as depicted in the Balance sheets and as furnished in the Income Tax Clearance Certificate, lesser among the two figures alone will be taken for consideration.
4. The applicant should have a minimum issued and called up Share capital plus capital reserves equal to at least 20% of the value of work which prequalification tenders & price tender have been called for – (In this case 20% value of the work is Rs. 58.20 Lakhs (Rupees Fifty Eight Lakhs Twenty Thousand only)
EVIDENCE TO BE PRODUCED :
i. Audited Balance Sheet for the preceding three years duly certified by the Chartered Accountant.
ii. The amount indicated in the Audited Balance Sheets as

b. One month current activity means, sum total of the value of the unfinished portion of
works already committed by the applicant and being executed by the applicant – (out standing value) – divided by the balance period available for completion of each of

the committed works under execution plus the value of the work for which the qualification schedule & price tender is called for divided by the number of months stipulated for its completion.
c. Outstanding value of committed works means the total value of each project under
execution minus the value of work completed as on the date of submission of
qualification application. Evidences / documents to be produced: a. List of works already committed by the applicant and are in progress. b. Certificate – (for each of the committed works) – issued by the Engineer – in –
charge – (Not below the rank of Executive Engineer / Project Engineer) – of the work, being executed by the applicant with the following details.

NOTE : Fixed Deposit in the name of the “Applicant” will also be considered for the purpose of working capital, on production of “Certificate” issued by the Respective Banks, clearly stating that the Fixed Deposits are available in the Name of the
“Applicant” and the same are “Encumbrance Free” and can be readily “Encashable”.
6. The applicant should not have any of his contracts terminated / rescinded due to
breach of contract on the part of the applicant during the past “THREE” years by any
agency.
Evidence to be Produced:
(i). Sworn in affidavit duly certified by Notary Public, is to be produced (Specimen
appended) – in twenty rupee Non – Judicial Stamp Paper.
7. Class I Contractors other than approved Sthapathis participating in the Tender has to
engage an approved ornamental cut stone work Sthapathy to supervise the work till the
completion of work and his consent letter to this effect should be obtained.

Square Metres)
vii. Mechanical spray set for curing : 4 Nos. – (Four Numbers)

ix. Crane capacity : 1 No – (One Number)
DOCUMENTS TO BE PRODUCED:
i. Xerox copy of the R.C. Books for the Machineries / Vehicles owned by the
applicant
ii. Sworn in Affidavit and Chartered Accountant‟s Certificate stating the details of equipments, tools and plants available with the applicant with make year of
purchase, capacity, present working condition of the equipment etc.,
iii. If the Tools and plants are proposed to be taken on lease or already on lease with
the applicant, the source, from which the Tools and plants have been taken on
lease or proposed to be taken on lease with proof, should be furnished in addition
to the particulars in item - ii.
NOTE
1. If any of the information furnished by the applicant is found to be concealed or
false at a later date, the contract will be terminated forthwith without prejudice to
the rights thereon, consequent on termination and the contractor will be banned
from business dealings.
2. All the documentary evidences should be stitched neatly (Spiral Binding should be
avoided) and the pages should be serially numbered. Index of the Documents
produced should be prepared and reference to page number of the documents
produced should be furnished in the index.
3. The Qualification schedule evaluation shall be done on a PASS or FAIL basis
against each of the above 8 (Eight) Criteria.

4. The evaluation will be done only based on the information, evidence, documents,
Records particulars furnished by the applicant and hence the applicants are
advised to furnish adequate and relevant information along with requisite
documentary evidences without any omission.
5. As far as possible, details shall be furnished in the schedules appended to this
Application. If the space left is found insufficient, additional sheets may be
attached to the Schedules.
6. Photograph of the building works completed by the applicants may be pasted in
thick white paper and produced along with the documents.
7. Brochures, Pamphlets etc., shall also be stitched along with the documents
volume.
8. All applicants are cautioned that the Qualification schedule documents containing
any deviation from the contractual terms and conditions, specifications or other
requirements will be rejected as Non- Responsive and low performance reliability.
III. METHODS OF TENDERING:
i. If the Qualification application is made by an individual, it should be signed
by the individual, with his full name and his current address.
ii. If the Qualification application is made by a sole Proprietary firm, it shall be
signed by the proprietor along with his full name and full name of the firm with
it‟s current address. Documents with regard to registration as firm by the Registrar of Firms should be produced.
iii. If the Qualification application is made by a FIRM in partnership, it shall be
signed by all the partner of the firm with their full names and current address
or by a partner authorized by the firm (either as per Articles of the Deed of
Partnership / by power of attorney)- for signing in Tenders, Agreements etc. In
which case, certified copy of the registered deed of Partnership along with
current address of all the partners and a certified photocopy of the Registered
Power of Attorney issued in favour of the Signatory should be produced.
iv. If the Qualification Application is made by a “Limited Company” or a “Limited Corporation”, it shall be signed by a duly authorized person holding the Power of attorney for signing the application, in which case, the certified copy of the
power of attorney shall accompany the qualification application. Such limited
company or corporation shall also furnish satisfactory evidence of its existence
along with the Qualification Application.

iv. QUALIFICATION APPLICATION FROM JOINT VENTURES ARE
NOT ACCEPTABLE.
v. All the signatures in the Qualification Application and all the signatures in the
Documents produced Shall be dated.
vi. All the originals of the documentary evidences shall be produced, if asked for,
verification at the time of opening of Qualification schedule.

i. Qualification schedule & Price Tender schedule will be received in sealed cover
(Separately) upto 14.30 Hours on 12.03.2015. Qualification schedule will be
opened on the same day at 15.00 hours by the Assistant Commissioner / Executive
Officer, A/M Vanabadrakaliamman Temple, Thekkampatti, Mettupalayam Taluk in
Coimbatore District in the presence of the applicant or their authorized
representatives (who should produce the authorization issued by the Firm /
Company) who choose to be present.
ii. Then qualification schedule cover received will only be opened and evaluated on a
PASS or FAIL basis against each of the 8 (Eight) Criteria in Para II above.

Tender Conditions
1. Works should be carried out as per M.D.S.S. and other rules and regulations in force.
2. Works should be carried out under the direct supervision of the officials of the Assistant
Commissioner/ Executive Officer, Arulmigu Vanabadrakaliamman Temple, Thekkampatti
Devasthanam and the instructions and directions that may be issued to the contractor in the
matter of works should be strictly adhered to by the contractor.
3. The Assistant Commissioner/ Executive Officer of Arulmigu Vanabadrakaliamman Temple,
Thekkampatti Devasthanam has got every right to suspend works in any stage and terminate the
contract and assess the value of the works so far done any pay accordingly to the contract and
the contractor should not question the action of the Assistant Commissioner/ Executive Officer.
4. Successful tenderer on receipt of work orders should execute an agreement on stamp papers to
value of Rs.20.00 in the form prescribed by the temple and commence the works forthwith and
complete works within 36 months from the date of commencement.
5. Payment will be made to the contractor as per actual measurements for the quantity of works
done.
6. Earnest money deposit of the unsuccessful tenderer‟s will refunded as early as possible after the tender is settled. Earnest money deposit of the successful tenderer will be retained as security
for his proper carrying out of the works entrusted to him and will be refunded only after the audit
of the accounts of the temple is over. If any defects are noticed in audit of the loss if any
sustained by the temple is pointed out by the auditors that may be made good by the contractors.
7. If the contract is cancelled for acts of omission and commissions on the part of the contractor and
the works completed by other means the loss if any sustained on this score the contractor should
vouch for the same at his own risk.
8. If the contractor fails to complete the works within the stipulated period, he is liable to penal action
and the decision of the Assistant Commissioner/ Executive Officer of this temple is final and
cannot be questioned by anybody.

General Conditions. 1. The work shall be carried out in strict accordancw with Tamil Nadu Building Practice and its
volumes.
2. The contractor shall make his own arrangements for the procurement of cement, steel,
binding wire and all the construction materials to the required specification required for the work.
The rates for several items of work involving the cement and steel will be inclusive of the cost of
cement, steel etc.,
Cement shall confirm to clause No.4 of I.S.456-2000 for the purpose of specification.
For specification of ordinary rapid hardening and low heat Portland cement I.S.269-1989
and for Portland Pozzalona cement 148-1991 shall apply.
3. In case where the contractor is required to procure Portland cement for the work shall
always purchase Portland cement as fresh as possible after manufacture and shall on demand by
the Executive Officer, furnish a laboratory certificate of a character meeting with approval of the
Assistant Executive Engineer, this should be demanded in every case where there is reason to
believe that the cement has been long stored and may have thereby deteriorated in quality.
The quality of cement and steel procured shall be in confirmation with I.S.I. standards. The
quality test shall be conducted by the contractors at their own cost, in the technical education
centre laboratories (or) in the Government approved testing laboratories (or) in the laboratories of
PWD if available at various stages. PWD has the liberty confirm the quality of the materials
supplied by the contractor at various levels and stages at their own laboratory at the cost of
contractors.
4. The Assistant Executive Engineer shall reject any cement which is proved to be not
according to standards.
5. Contractor required to procure Portland cement for the work be shall notify the Assistant
Executive Engineer of the arrival of each consignment of Portland cement on the work, informing
him at the same time of the brand, agent from whom obtained and age of the cement.
Transportation from place of supplying to the batching plant shall be whether flight, rail, cars,
trucks, conveyers and other means which will protect the cement completely from exposure to
moisture. Immediately upon receipt at the job site, bulk cement shall be stored in dry weather
light, properly ventilated places until the cement is used on works, cement which has become
vaked perished by moisture other causes on no account be used on the work.
6. All storage facilities shall be subject to approval of the Engineer in charge and shall be
constructed with easy access for inspection and identification and to avoid storage for long
periods and do not store at all if possible during the rain season.
Prevent circulation of air through the cement by close packing and cover with a tarpaulin.
For other precautions in this regard I.S.4002-1987 shall apply. Cement should be stored
in a building or shed which is leak proof and as moisture proof as possible.

7. Temporary store at sight:
Very often bags of cement have to be stored in the work site out in the open, for use on
work for one or more days. In such cases, the bags shall be laid on a dry platform made of
wooden planks resting on brick masonry, concrete or dry sand or aggregate platform about
150mm above the ground.
The number of bags of cement have to be kept to a minimum preferable just sufficient for
the days consumption.
Care shall be taken to see that every point in the pile, is well covered by tarpaulin or
polythene sheet and protected against the moisture in air. The tarpaulin shall overlap each other
properly.
8. No payment will be made for wasted concrete in replacement of damaged or defective
concrete in extra concrete required as a result of over excavation and in concrete placed by the
contractors.
All operations shall be borne by the contractor himself no extra payment will be made to the
contractor him for such additional quantity of cement.
9. Use of pozzlona cement on works:
Ordinary Portland cement confirming to I.S.269-1989 shall be used for masonry work.
Portland pozzalona cement confirming to I.S.1489-1991 may also be used for masonry work in
the event of non-availability of ordinary Portland cement with the period approval of the Engineer-
in-charge.

General Conditions
1. If the tenderer who is not professionally qualified fails to employ the technical men as
indicated above for the works shall be levied as follows during the period of non-employment of
technical men.
a. Rs.6,300/- per month for diploma holder.
b. Rs.7,000/- per month for degree holder.
Note: In case the contractor who is professionally qualified is not in a position to remain always at
the site of work during working hours personally checking all items of works and paying extra
attention to such works as may be deemed special attention. (eg) RCC works etc., he should
employ technically qualified men as prescribed for the work.
The employment of technical assistant should be based only on the value of contract.
Engineers with mechanical engineering qualification and retired from civil engineering department
are also suitable to supervise the civil engineering works because of their experience in civil
engineering field.
A movement register should be opened and maintained for technical assistants employed
by the contractor or for the technically qualified contractor. The Technical Assistant or technically
qualified contractor should note the arrival and the departure timings every day along with their
initials. Such register should be produced during the inspection of the inspecting officer.
2. One I.T.I. Trained mason for every 10 masons or part there of should be employed.
3. The tenderer shall not employ the child labour as per Government Orders.
4. He should offer employment to ex-servicemen, ex-toddytappers and unemployed
agricultural labourers as far as possible.
5. Sufficient labourers as may be required by the Engineer shall be employed on the work so
as to avoid slow down the progress of the work.
6. The tenderer shall have not claim for any loss due to unforeseen circumstances including
suspension of work due to any cause.
7. Accident to people employed by the contractor resulting compensation to be paid as per
the Workmen Compensation Act, it shall be to the contractor‟s account. 8. The contractor should take risk insurance at their cost against losses due to unprecedented
flood and other Act of God. (G.O.Ms.No.626 Transport Department dated 22.7.1978)
9. The tenderer should make his own arrangements for the conveyance of materials to the
work site from the Assistant Commissioner/ Executive Officer‟s office stores specified. 10. The quarry specified in the schedule is the nearest one to the work spot wherein the
materials of specification happened to be excavated at the nearest distance to the work spot than
to the quarry noted in the schedule, the Assistant Commissioner/ Executive Officer shall have the
right to ask the contractor to quarry the required materials only from the nearest quarry and to
allow rates for the same based on the lesser lead during the time of the extinction of work.
11. Payment will be made on detailed measurement. Any of the terms in the schedule may be
omitted or altered radically and variation in the rate shall become payable to the contractor on
account of the omission of variation in quantities.

12. Before payment of final bill, the contractor shall produce certificate from the income-tax
authority that all income-tax payable by him upto date has been paid and certificate from sales
tax authority that all the sales tax payable by him upto date has been paid.
13. The Assistant Commissioner/ Executive Officer will be at liberty to withdraw any portion of
work or to carryout any portion of the work at any time either departmentally or through any other
agency in the interest of Government without assigning any reasons to the contractor who is
actually doing the work and the Assistant Commissioner/ Executive Officer‟s decision will be final and binding on the contract. The contractor is not entitled for any compensation on account of
the same.
14. The rates should be inclusive of all taxes payable to the government by the tenderer.
15. The rate shall be for the finished items of works and no extra will be paid for seignorage.
16. Tenders in which the rates are not written in words will be summarily rejected. In case of
any discrepancy while expressing the rates in words, the rate which ever is advantageous to
Government will be only to taken into account.
17. Tenders containing over writing or corrections which are not attested by the tenderer will be
liable for rejection.
18. Tenders received without EMD will be summarily rejected.
19. The site should be cleared by the contractor after completion of the work as required by the
Assistant Commissioner/ Executive Officer.
20. The work shall be carried to without any hindrance or to the existing cross works.
21. Recovery towards hire charges of machineries will be made at the rates specified and for
the time actually utilised by the contractor or for time required as per the data considering the out
turn which ever is higher.
22. Payment for sand will be made for quantity of sand stacked after making necessary
deduction for bulkage from the stacked quantity.
Net Quantity= (Gross stacked quantity X 1.00) / (100+ Percentage of bulkage)
The percentage of bulkage will be determined from the test conduct according to the
procedure indicated in the Chief Engineer‟s circular memo No.595 G/63-FP dated 9.1.1963 on
the undisturbed sample taken from the stacks. The rates to be quoted shall therefore be for one
cubic meter of net quantity of sand to be stacked after necessary deduction of the bulkage.
23. The contractor should prepare a Bar chart for the works costing more than Rs.5.00 lakhs
and produce the same before starting the work.
24. In case of any dispute of difference between the parties to the contract either during the
progress or after the completion of the works or after determination, abandonment, breach of the
contract or as to any matter or thing arising there under except as to matters left to the sole
discretion of the Assistant Commissioner/ Executive Officer under clause 18,20,25D, 27-1, 34,35
and of the general conditions of contract of as works holding Assistant Commissioner/ Executive
Officer of the payment of any bill to which the contractor may claim to be entitles then, either party
shall forthwith give the other notice or such dispute or difference shall be and is hereby referred to
the competent civil cout.

25. The contractor has to maintain the progress of work as per the percentage of work
specified in tender notice. If the contractor fails to keep the rate of progress as stipulated in the
tender notice, penalty will be imposed on the contractor for his slow progress with reference to
clause of TNBP under preliminary specification.
26. Similarly for the lighting arrangements to do any work to keep up the accepted progress of
work, the contractor has to make his own arrangements at his cost. Possible help to get power
connection from the electricity board will be given by the Assistant Commissioner/ Executive
Officer. The contractor will be permitted to do night work so as to complete the work within the
accepted period. But concreting has to be done in day time. No extra payment will be paid for
such works.
27. The leads and lifts involved for the various materials as well finished work are clearly
furnished in the schedule. However the contractors are requested to inspect the places of work
casting yard for precast blocks and the canal reach for in site concrete and borrow areas for the
conveyance of earth and quarries for sand and metal and satisfy themselves about the adequacy
of the provisions made for lift and lead before tendering. The contractor will not be eligible for
extra lead and lift even if it actually involved during the course of the work.

General Conditions:
1. Period of completion 36 months.
2. Successful tenderer will be required to make a further security deposit at the direction of the
accepting authority. Execution and completion of the work should be within period specified in
the tender notice from the date of commencement of work or handing over of site which ever is
earlier.
3. Specifications for the various materials and the execution of all works shall be as per Tamil
Nadu Building Practice.
4. It must be distinctly and specifically understood that whole works will be executed complying
with the specification in metric system governed by TNBPS. Payment will be made as per
measurement recorded in metric units only.
5. Every tenderer before tendering is expected to inspect the proposed work site. Any claim for
extra cost on account of increase in lead of materials will not be accepted.
6. The work shall be proceeded with expeditiously from the date on which the site is handed
over and complete as early as possible as required by the Departmental Officers.
7. The contractor must make his own arrangement to form approach roads and ramps if any
required at his own cost and maintained the same through out the period of contract. On
permission for using existing roads if any by the contractor will be recommended to the authorities
concerned and the contractor must bear all charges incidental to using the road, no extra cost on
account will be entertained by the department.
8. If night work is required is to fulfill the agreed date of progress all arrangements shall be
made by the contractor including lighting the area without any additional claims.
9. The plan and schedule of quantities are subjected to alteration during execution and payment
shall be made as per actual measurement of works done. No claims for any extra cost of works
whatsoever shall be entertained for such revision in design extra.
10. The rates specified in the schedule for the different item of works are for finished works and
no extra will be paid for baling and pumbing charges incidental on the work.
11. The shed for storing the materials should be put up by the contractor at his own cost. The
contractor‟s special attention is invited to clause general conditions of TNBPS and also required
to provide at his own expenses sheds, latrine, water, lights, urinals etc., for his workmen.
12. In case it is found by the departmental officers that the contractor has brought any of the
required materials from quarry with lesser lead than that specified in the schedule, proportionate
deduction will be made from the contractor‟s rate of payment for finished work for the respective item.
13. The contractor will be held responsible for the proper and safe custody of all the
departmental materials which are handed over to the contractor until they are finally used on the
work or taken over by the department.
14. The Assistant Commissioner/ Executive Officer will be at liberty to withdraw and carry out
any portion of the work through any other agency, in the interest of work.

15. The contractor rates are inclusive of sales tax payable by the contractor to the government
as per the Chennai General Sales Tax Act 1939 as amended from time to time. No enhanced
rates will be payable to the contractor for any upward revision of sales tax during the currency of
the contract.
16. Tenders should obtain from the authorities concerned an income-tax clearance certificate
and sales tax clearance certificate for the current year and submit it along with tenders. The
tenderers who are engaged in works contract as well as business for selling materials should
produce sales tax clearance certificates or they should produce NIL certificate.
17. The work executed by the contractor under the contract shall be maintained at the
contractor‟s risk until the work is taken over by the Assistant Commissioner/ Executive Officer.
Government shall not be liable to pay for any loss or damages occasioned by or arising out of
fire, flood, volcanic eruption, earthquake, other convulsions of nature and all other natural
calamities, risk arising out of Act of God during such period and that the option whether to take
insurance coverage or not to cover such risks is left to the contractor.
18. If there are any dues from the contractor for this work and if it is not recoverable from the
contractor under this contract, the dues will be recovered from the contractor by revoking the
provisions of the Tamil Nadu Revenue Recovery Act 1864 (Tamil Nadu Act 5 of 1864).

ADDITIONAL CONDITIONS
1. Plain Concrete:
a) Only river sand and hard broken granite stones from approved quarries specified in the tender
schedules shall alone be used for the work. The broken stone shall be thoroughly washed before
use.
b) All concrete for the work shall be machine mixed and hand mixing shall not be allowed except
with prior approval of the Assistant Commissioner/ Executive Officer.
c) All concrete shall be protected against injury until final setting concrete shall be kept moist
continuously for not less than fourteen days (14 days).
2. Stone Masonry:
a) Only clean river sand and good stones etc., shall be used in the works.
b) Bond stones, of length not less than 25” or 0.63M. shall be used at the rate of one in every
1.83 M. length of stone. Such stone should have a point of chisel mark for easy identification.
3. Special Condition for Cut Stone Masonry:
a) Cut Stone: I.S. 1597 Part II 1967 Para 6.1.1 shall apply. By fine dressing is meant the finest
surface which can be given to a stone with a chisel and without rubbing.
b) Masonry shall be laid as per I.S. 1597 Para II 1967 and I.S. 1127-1970.
4. Special Condition:
For the Item Nos. of 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28,
29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 39 and 40 under works as special in the Schedule-“A” be Technical specification and method of execution should be carried out from the instruction of the
Engineer-in-charge during execution of works.

Special Condiiton
1. The contractor shall be responsible for the safe custody and storage of the materials under dry
conditions at the places approved by the Assistant Commissioner/ Executive Officer.
2. No royalty shall be charged where due for materials quarried. Assistance as necessary will be
given to the contractor by the department to obtain access to quarries approved by the Assistant
Commissioner/ Executive Officer. The rent shall be charged so far materials stocked in the
temple land during the course of construction provided such materials are removed within a
month after the works are complete.
3. Royalty charged for use of private quarries and private land shall be paid by the contractor
himself.
4. The contractor should make his own arrangement for providing approach road to the work sites
for which no extra will be paid to him. On completion of the work, the contractor shall not be
permitted to remove the materials laid for formation of road. If the contractor is allowed to use the
existing roads he shall maintain it in good condition at his own cost through out the period of the
execution of work.
5. Reference to TNBPS Nos. in the schedule of quantities referred to Vol.I and Vol II of 85 and 88.
6. The contractor shall abide by the contract labour regulations framed by the Tamil Nadu
Government.
7. The contractor should bear his own expense for providing footwear for any labourer doing cement
mixing work and shall types of works and on his failure to do so the Assistant Commissioner/
Executive Officer shall be entitled to provide the same and the cost will be recovered from the
contractor.
8. When there are any complaints of non-payment of wages, the labour bill of the contractor may be
withheld pending clearance certificate obtained from the labour department.
9. Any amount fallen due to the contractor even after effecting recovery from his bill for this work
and other works entrusted to the contractor will be arranged to be recovered from the contractor
under the provision of the Revenue Recovery etc., Amount due from the contractor(s) to the
Department will be recovered under the Tamil Nadu Revenue Recovery Act., T.N.Act 11/1964

10. The Assistant Commissioner/ Executive Officer duly authorised in this behalf or the Assistant
Commissioner/ Executive Officer may put an end to the Agreement at his option at any time.
11. Provided in respect of work costing above Rs.2500/- a notice of 10 days shall be given in writing
before such termination work or for sub-letting any portion of the work or for any other reason.
12. In case of bad work or materials, action will be taken as provided in the clause TNDSS 27(c)
Standard Preliminary specification.

13. When agreement is terminated under the clause TNDSS 27 (c) above, the officer terminating the
agreement shall have the option to take over any or all the materials and other equipments at a
value of assessed by him and of the contractor does not agree to this, he shall clear the site by
removing at his own cost of all such materials, equipment within 10 days from the termination of
the agreement, failing which the Assistant Commissioner/ Executive Officer may remove and sell
the same after holding the costs for removal and sale and remit the balance, if any, to the credit
of the contractor.
14. Contractor‟s rates for the different items of the work involving the use of cement are inclusive of the cost of cement.
15. The contractor shall be responsible for the safe custody and proper storage of the material at the
place near the work spots approved by the Assistant Commissioner/ Executive Officer. The stock
of cement with the contractor should be accessible by the officer‟s verification at any time.

Conditions for Sanitary Arrangements
Rules for the provisions of health and sanitary arrangement
for workers employed by Thekkampatti temple and its contractors.
The contractor‟s special attention is invited to clause of general condition of contract in TNBPS
Vol.II and he is requested to provide at his own expense the following amenities to the
satisfaction of the Assistant Commissioner/ Executive Officer.
1. First Aid:
At the site, there shall be maintained in a readily accessible place First Aid appliances and
medicines including an adequate supply of sterilized dressing and sterilized cotton wool. The
appliances shall be kept in a good order. They shall be placed under the charge of a responsible
person who shall be readily available during working hours.
2. Drinking Water:
a) Water of good quality fit for drinking purpose shall be provided for the work people on a scale
not less than three gallons per head per day.
b) Where drinking water is obtained from an intermittent public water supply, each work shall be
provided with storage tank where such drinking water shall be stored.
c) Water supply and storage shall be at a distance of not less 50 feet from any latrine, drain,
pollution. The well shall be properly closed before water is drawn from it for drinking. All such
wells shall be entirely closed on the top and be provided with a trap door which shall be dust and
water proof. The trap door shall be locked and opened only for cleaning or inspection which shall
be done at least once a month.
d) A reliable pump shall be fitted to each covered well.
3. Washing and Bathing places:
Adequate washing and bathing places shall be provided separately for men and women. Such
places shall be kept clean and in drained condition. Cleaning of vessels or washing could not be
allowed in or nearby drinking well.
4. Latrine and Urinals:
In every work place latrine and urinals shall be provided in an accessable places and the
accommodation separately for each of them shall be on the following scale so directed by the
Assistant Commissioner/ Executive Officer in any particular case.
i) Where the number of persons employed do not exceed 50 --- 2 (Two)
ii) Where the number of persons employed exceed 50 but does not exceed 100 --- 4 (Four)

Special conditions
The contractor has to maintain the progress of work as per the percentage of work specified
below.
If the contractor fails to keep the rate of progress as stipulated below, penalty will be imposed on
the contractor for his slow progress with reference to clauses from 55 to 57 – 6 of General
Conditions of contract in TNBP volume II print 1988.

2) Chitravanam - 4th months
3) Upapeedam - 10th months
4) Adistanam - 15th months
5) Patham - 22nd months

9) Painting - 36th months
1. Work should be completed fully at the end of Thirty Six months.
2. Contractor should engage a Government Approved Stapathy for the above work.

Supply of Steel and Cement by contractors for works
Cement:
1. Cement to be used on works shall be ordinary Portland cement confirming to I.S.269-1967 and
shall be packed in HDPE bags with details such as Portland cement and ISI mark printed on each
bag.
2. Cement in 50 Kg bags shall always be as fresh as possible after manufacture and shall be
procured from authorised stockists and dealers only.
3. Test certificate for the quality of cement shall be obtained from Government testing labortories.
Facilities available in the Government owned Engineering Colleges and Polytechnics. Building
Center Division and SM & R Division of the PWD may be utilised.
4. Contractor shall notify the arrival of each consignment of cement with particulars such as brand,
agent from whom procured and age of the cement.
5. Storage of cement shall confirm to SI No.10 of TNBP Volume I and IS:4082-1967.
6. Cement not used on work for more than three months after completion of tests shall be got
re-tested before use and will be rejected. If it fails to confirm to any of the requirements list
above.
Steel:
1. Steel to be used on work shall be mild steel medium tensile steel or deformed medium tensile
steel bars confirming to IS 432 (Part I) IS:1139-1966 as the case may be.
2. Steel shall always be as fresh as possible after manufacture and shall be well and clearly rolled to
the dimension and weights specified. They shall be sound and free from loose, dirt, rust, oil,
paint, grease, cracks, surface flaws, laminations and rough jagged and imperfect edged and other
defects. Steel shall be procured from authorised stockists and dealers.
3. Test certificate for the mechanical (tensile) properties and the unit weight of steel under each
category shall be obtained from Government testing laboratories. Facilities available in the
Government owned Engineering Colleges and Polytechnics. Building Center Division and SM &
R Division of the PWD may be utilised.
4. Contractor shall notify the arrival of each consignment of steel with particulars such as brand,
agent from whom procured and age of the steel.
5. Steel excessively rusted, manufactured from waste steel through the process of re-rolling and not
confirming to any of the requirements listed above will be rejected.

DEPARTMENT PENALTY CLAUSE
as per G.O.Ms.No.2559 Public Works Departments Dated 25.12.1970
(Extract from the Tamil Nadu Buildings Practice Volume II)
56. Delays in commencement or progress or neglect of work or suspension of work by the contractor
and forfeiture of Earnest Money Security Deposit and withheld amounts.
57. 1) Time shall be considered as the essence of the contract. If at any time, the Assistant
Commissioner/ Executive Officer shall be of the opinion that the contractor is delaying
commencement of the work, neglecting or delaying the progress of work as defined in the tabular
statement “Rate of progress” in the Article of Agreement or the contractor fails to maintain the
rate of progress in the Article of Agreement plus any extension of time or the contractor shall
suspend the works or sub-let the work or a portion thereof without the sanction of the Assistant
Commissioner/ Executive Officer or violates any of the provisions of the contract, the Assistant
Commissioner/ Executive Officer shall so advise the contractor and at the same time demand
compliance. If the contractor neglects to comply with such demand within seven days after
receipt of such notice, it shall then or at any time be lawful for the Assistant Commissioner/
Executive Officer to impose a penalty or forfeiture on the contractor from the deposit or to
determine the contract.
2) The Penalty or forfeiture referred to in clause 57(1) shall not exceed 5% of the value of the
work executed and is imposed in cases where the contractor is allowed to proceed with the whole
or part and complete the whole or such part of works. The penalty or forfeiture imposed by the
Assistant Commissioner/ Executive Officer under this clause is however subject to modification or
waiver at the absolute discretion of any authority higher in rank than the Assistant Commissioner/
Executive Officer.
3) It shall be a further right of the Assistant Commissioner/ Executive Officer to give any part of
the work to any other contractor at his discretion or have it done departmentally in order to
maintain the rate of progress and the contract shall then be determined for only that portion of the
work given to other contractor or done departmentally. The forfeiture under clause 57(2) will in
these circumstances be applied and any expenditure incurred on this account shall be recovered
from the original contractor.

4) Determination of the contractor referred to in clause 57(1) shall carry with it the forfeiture of the
security deposit. After determining the contract the Assistant Commissioner/ Executive Officer
shall have the right to give any part of work to any other contractor in the unexecuted portion of
the contract in which case any expenses which may be incurred in excess of such amount which
would have been paid to the original contractor and may be deducted from any money due to him
by the Government under this contract or any other account whatsoever. Provided also that, if
the expenses incurred by the Government are less than the amount payable to the contractor at
his agreement rates, the difference will be paid to the contractor.
5) In the event of any one of the above clauses being adopted by the Assistant Commissioner/
Executive Officer, the contractor shall have no compensation for any loss sustained by him by
reason for his having purchased or processed any materials or entered into any engagement or
made any advance on account or with a view to the execution of the work or the performance of
contrct and in case action is taken under any of the provisions aforesaid and the contractor shall
not be entitled to be paid any sum for any work actually performed under the contract unless and
until the Executive Engineer has certified in writing the performance of such work and the value
payable in respect thereof and shall only be entitled to be paid the value so certified.
6) In the event of the Assistant Commissioner/ Executive Officer putting in force all or any of the
powers vested in him under the clause 57(4), he may, if he so desires, after giving notice in
writing to the contractor take possession of the works and site and all such plant materials
thereon (or any ground contingencies thereof) and all such plant and materials as above
mentioned shall thereupon be at the disposal of Government absolutely for the purpose of
completing the work. After such notices shall have been given, the contractor shall not be at
liberty to remove from the site of work or from the ground contiguous thereto, any plant or
materials belonging to him which shall have been placed thereon for the purpose of the above
work. Government shall not be able to make any payment to the contractor on account of use of
such plant for the completion of the works,under the provision herein before contained. On taking
possession of the materials and stores belonging to the contractor or procured by the contractor
and intended to be used for the execution of the work or any part thereor, the contractor shall be
paid for the same in account, at the contract rates to be certified thereof shall be final, otherwise
the Government may give notice in writing to the contractor to remove any of his plant or
materials from the site and not required for the completion of the works. If such plants or
materials or not removed within 14 days after notice shall have been so given, the Government
may remove and sell the same, holding the proceeds less the cost of removal and sale, to the
credit of the contractor. The certificate of the Assistant Commissioner/ Executive Officer as the
expense of any such removal and sale shall be final and binding on the contractor.
