with the Ninth Circuit Court, which could end the litigation.

What does all this mean? The current Officers and Trustees remain in office until the litigation is either resolved by the Ninth Circuit Court or the U.S. Hawaii District Court. While I believe the second election ballots will eventually be counted, this will be determined by the courts. The attorneys cannot give us a firm date when this may occur.

STATEWIDE ELECTIONSOn December 1, 2014 Democrats

David Ige and Shan Tsutsui were sworn in as the new Governor and Lieutenant Governor. In our Congressional race we have Democrat Senator Brian Schatz and Democrat Representative Tulsi Gabbard back in office, along with newly elected Democrat Representative Mark Takai. They will also be joining Democrat Senator Mazie Hirono, who was not up for election in 2014.

I would also like to take the time to say Mahalo to Representative Colleen Hanabusa for all of her years of service in the Hawaii Legislature and represent-ing Hawaii as our Congresswoman in Washington D.C.. We wish her well in her future and I’m sure politics and the people of Hawaii are still in her heart.

CONTRACT NEGOTIATIONSOceanic Time Warner has been in con-

tract negotiations since May of 2014 and talks continue for the Kauai and Oahu Blue and White Collar workers. Maui’s Blue and White Collar workers both ratified the Company’s “Last, Best, and Final” offer. To this day, the Union has asked to sit down

T his year will be a big year for Local 1186 as we celebrate our 75th Anniversary. Founded in 1940 by

members from our Federal Sector (Unit 2), we have grown some 75 years later to over 3,300 members representing Construction Electricians, Telecommunications, Cable (Oceanic Time Warner), and Federal Employees on all of our military bases.

Local 1186 Business Manager Akito “Blackie” Fujikawa advanced Hawaii's construction Unions by visiting New York and bringing back the idea of get-ting Benefits for our working men and women. Now we enjoy the fruits of his efforts by receiving Pensions, Annuities, Paid Vacation/Holidays, & Medical benefits that many unions in Hawaii offer today. UPDATE ON UNION ELECTIONIt’s been a long time since the June

elections in our Local. I apologize to the delay in reporting on the status of the elec-tions, but it’s difficult to do since things change from month to month. Here is where we are today.

Craig Inagaki, Harry Ono, and Steven Leong filed a lawsuit in Federal court, in part, to stop the second election. Because of the lawsuit, the IBEW International and the Local Union agreed that the ballots for the second election would be collected but not counted. The Federal Judge then ordered that everything was to stay the same until the trial in this matter. This meant that the second election ballots would not be opened and the existing Officers and Trustees would remain in office.

A date was scheduled to hold the trial starting on October 27, 2015. After the trial date was set, the International filed a motion to have the case reviewed by the Ninth Circuit Court, and the Federal Department of Labor also filed a motion to intervene. The Federal Judge granted both motions and vacated the October 27, 2015 trial date. The International Union has filed a Petition

We all know what the Spirit of Aloha means. But . . . when it comes to non-union electrical contractors taking our jobs while breaking laws, underpaying workers to make profits by diving on bids and not competing fairly, then we certainly want Aloha to mean GOODBYE!

RMA Land performed the electrical work on the new FBI Building in Kapolei. A very big THANK YOU to the work-ers that came forward to your Hawaii Electricians Market Enhancement Program (HEMEP) Compliance Department and subsequently filed their complaints with the Hawaii Department of Labor. RMA Land was ordered to pay back- wages to the electricians on the project in the amount of $319,939.00.

RMA Land has allowed their electrical contractors license to expire and it is currently terminated. They will need to re-apply if they want to be licensed to perform electrical work in Hawaii. So to RMA Land we bid Alooooooha! And if they choose to re-apply for a license and continue to do electrical work in Hawaii . . . we will be watching and making sure that they compete fairly and comply with the same laws as our sig-natory contractors, or be prepared to face additional fines.

We also want to note that this is the THIRD non-union electrical contractor that has allowed their license to be terminated after investigations by your HEMEP Compliance Department have been turned in to authorities and fines have been imposed on them. These companies are NO LONGER licensed to perform electrical work here. Again, we say Aloooooooha to all of them!

Hawaii’s Best Electricians – Local 1186 Members Save the Day

Location: Downtown HonoluluParties of Interest: Non-Union Electrical ContractorsProject: Chain retail store (rhymes with Fallmart)Allegations: License violations and way behind construction schedule

From sources within the project, HEMEP Compliance was regularly notified on how far behind schedule the non-union electrical contractor was on construction. Then, we were noti-fied by Local 1186 Members that an electrical contractor from California had arrived and was performing work on the project to help get the project caught up.

HEMEP Compliance took immediate action. We verified that Superior Electric from California was on the project. We took photos and video, and then contacted the Hawaii Department of Commerce and Consumer Affairs (DCCA). State Investigators arrived for an inspection, and Superior Electric workers fled the project and began walking aimlessly around downtown. We were able to photograph and video these workers for the DCCA Investigation.

The Result: Superior Electric contacted Local 1186 and signed a Project Labor Agreement, and then 10 of our Local 1186 electricians came off the books and headed out to the project, helping to get construction back on schedule and get the store open. WAY TO GO, LOCAL UNION 1186 ELECTRICIANS!

As a result of additional investigation, the General Contractor on the project, Austin Jones, agreed to a fine of $100,000, for other license violations. Superior Electric continues to be under a pending case as a result of their license violations early on the project, and any fines or penalties are still pending.

and continue discussions with Time Warner. Telecommunications Contract negotiations also continue, with some signatory con-tractors agreeing with the Union's proposal and another four contractors still continuing negotiations. Electric Boat/General Dynamics members working in the Motor Shop, as well as Surface Ships and Submarines in Pearl Harbor, have begun negotiating and will continue through the month in January. Whether these Contracts are ratified or turned down, we ask all of our member-ship for their support.

WHAT'S IN STORE FOR 2015In 2015 we look forward to more work in construction. About

a dozen high rises are currently under construction (by Wasa Electrical Services, Electricians Inc., American Electric, and A-1 A-lectrician), as well as a new tower at Hilton Hawaiian

Village (Rosendin Electric). Kapiolani Hospital finished their parking structure (A-1 A-lectrician) and now is building its new NICU Building (Cache Valley Electric). Rail Transit (West Oahu, Kamehameha Hwy., Maintenance/Storage Facility, and Core Contract) has many of our signatory contractors busy. Our projects also include the Pharmaceutical School in Hilo, Telescopes on Maui and Mauna Kea, & Kauai’s Koloa Landing.

As you can see, the work we have today culminated from years of good relationships with Legislators, Developers and General Contractors; testimonies in front of Land Commission Boards, License Boards, HCDA, and many other bodies. Your Staff is always working hard to look out for the best interests of our membership. Have a Great Year! And a Safe one too!

Oceanic Time Warner Contract Update

Dear Sisters and Brothers,

Happy New Year! For most Oceanic members this year opened on a somber note without a ratified contract as of this writ-ing, except for Maui’s White and Blue Collar Agreements.

Oceanic Time Warner (OTWC) negotia-tions opened in April wanting the Union to remove the Annuity contributions and having employees contribute their own money to their 401(k) Plan, and also having all of the employees making Medical co-pays with no caps.

The Union’s counterproposal was to keep the Annuity as-is and offer that the Medical come under the Hawaii Electrician’s Health & Welfare Trust Fund, saving the Company around

$18,000 per month in medical premi-ums.

The Company’s earlier proposal prior to their Last and Best consisted of leaving the Annuity contributions as-is, an offer of wage increases not in-line with the cost of living in Hawaii, and having now a Medical co-pay for employees out of their paycheck with no caps.

The Union again offered to transfer the Company’s Medical to the Hawaii Electricians Health and Welfare Fund, which would save the Company on average $18,000 a month and provide Medical to employees when they retire.

Oceanic’s reasoning for denying the Union’s offer is they want “control” over the Medical, and that all employees should pay because the non-bargaining side has to pay too. Obviously it’s not about cost but how much more money

they would like to put in their pockets. After all OTWC made over $15 million in profits, and that’s without all bargaining employees paying Medical co-pay.

Our members at OTWC work hard every day, despite the Company com-ing up with more and more stricter rules. Customer service is Number 1 here in Hawaii and remains that way to do well for all of Time Warner. To avoid a “Strike” the company is coming back to discuss their Last and Best offer, and we are hopeful that something can be worked out to avoid such a situation.

American Electric Finishing Biomass(ive) Project[KAUAI - HAWAII] — American Electric was awarded the electrical contract for the Kauai Bio-Mass project. Along with General Contractor Bodell Construction and project owners Green Energy, the proj-ect started in January 2014.

The seven megawatt plant is located behind a site called "Half-Way Bridge" behind acres of Albizia trees, which they will be using for fuel. All installations of main feeder duct lines and conduits for power and control, and various apparatuses were performed by American Electric in challenging, muddy, and wet conditions.

They are currently 13 men working on fin-ishing the Plant and Substation Switch yard on this multi-million dollar project. At the project's peak, American Electric had about 20 men on the project, including several High-Voltage Splicers. If all goes well the project is slated to finish in early 2015.

Brother Egdamin Earns RetirementDear Brothers and Sisters,

Thank you for allowing me to serve you as both Referral Agent and Organizer for all these years. That experience is priceless, as I came to know many of our members in an intimate and per-sonal manner. I would not trade any of those times away, for it has given me more insight into life than anyone could imagine.

During the November 2014 Unit 1 meeting, I officially announced my retirement. If you missed that meeting, I would like to reas-sure you that it was completely my own choice due to the per-sonal health of a very close family member.

As stated at the November Union meeting, I will continue to support this Administration, for the vision it has is for growth, strength, and prosperity. I wanted to personally speak to the membership and answer any questions that might come up, such as when I made a lateral move in the past from Referral Agent to Organizer.

As in most organizations, I trust all our members would want to hear things for themselves, and prevent any rumors from spread-ing that can only separate and divide us. That is something this brotherhood cannot afford!

At the present time I’m living in Las Vegas, Nevada, and serving at a little known church called “The Lord of Harvest East Gate”. Trust me, those experiences you allowed me to go through are paying dividends today. May God continue to be with all of you!

As part of its 2020 force structure realignment, the U.S. Army is con-sidering a proposal that would eliminate 19,800 soldiers and approximate-ly 30,000 civilians in Hawaii. The total is roughly 5% of Honolulu’s total population. This proposal would mean the elimination of roughly 20,000 Hawaii jobs and a nega-tive economic impact of $1.35 billion.
