This Constitution, and all acts and proceedings which in the future and in due course may be enacted, shall be binding on all Local Union Officers and Members.

ARTICLE I NAME AND CONSTITUTION

Sec.1.Thisorganizationshallbeknownas the Interna-tionalBrotherhoodofElectricalWorkers,with jurisdictionoverallelectricalworkersintheUnitedStatesandCanadaas defined inArticleXXVI of thisConstitution, includingallworkers in public utilities and electricalmanufacturingplants, and shall consist of an unlimited number of localunionsacknowledgingitsjurisdictionandsubjecttoitslawsandusages,anditshallnotbedissolvedwhiletherearefive(5)dissentinglocalunions.Sec. 2.This organization, in themerging togetherof all

electricalworkersintheUnitedStatesandinCanada,fullyrecognizesthesovereigntyofeachofourgreatnationsandthe advancement of industry compatible with the laws ofeachcountryandtheobjectsofthisConstitution.Sec. 3. This Constitution, and all acts and proceedings

which,inthefutureandinduecoursemaybeenacted,shallbe absolutely binding on all L.U.’s officers andmembers.The initials “L.U.’s” as used throughout this ConstitutionshallincludeRailroadCouncils,SystemCouncilsandothersubordinatebodieswhereapplicable.Sec. 4. The following abbreviations, when used herein,

andinreportsandotherdocuments,shallmean:I.B.E.W.—InternationalBrotherhoodofElectricalWorkers.I.E.C.—InternationalExecutiveCouncil.I.P.—InternationalPresident.I.V.P.—InternationalVicePresident.I.S.T.—InternationalSecretary-Treasurer.I.R.—InternationalRepresentative.I.C.—InternationalConvention.

ARTICLE II INTERNATIONAL CONVENTION

Sec.1.TheI.B.E.W.shallmeetinregularconventionev-eryfive(5)yearsonthethirdMondayinSeptember,atsuchplaceasshallbedecideduponbytheI.E.C.Sec.2.The I.E.C.has thepower tochange thedateon

whichanI.C.istoconvene,butanychangemadeshallnotbeformorethanninety(90)daysbeforeoraftertheorigi-naldatefixed.Sec.3.UponpetitionfiledwiththeI.S.T.byanytwenty-

eight(28)L.U.’singoodstanding—notmorethanfour(4)L.U.’sfromanyoneI.E.C.district—thequestionofholdingaspecialI.C.shallbesubmittedtoareferendum;butpetitionsforavotemustspecifytheplace,time,anddateatwhichthisspecial I.C. isproposed tobeheld,and thequestionsmustbespecifiedbyeachofthetwenty-eight(28)L.U.’singoodstandingbeforeany referendumshallbe taken.NospecialI.C.shallbecalledexceptinthismanner.Theresultofthereferendumshallbepublishedinfullin

theI.B.E.W.’sofficialmonthlypublication.IfamajorityvoteinfavorofaspecialI.C.,theI.S.T.shallissuethecall.Sec. 4.The I.P. shall appoint the following committees,

consistingof eleven (11)delegateselected to the I.C.,one

from each I.V.P. district. The I.P. shall appoint one of thecommitteemembersasChairmanandoneasSecretary:1.I.P.’sReport.2.I.S.T.’sReport.3.I.E.C.’sReport.4.Law.5.Resolutions.6.Appeals.7.Anyspecialcommitteesdeemednecessary.Thesecommitteesshallmeetprior to theopeningof the

I.C.Thecompensationofmembersofthesecommitteesshallbefiftydollars($50.00)perdayandreimbursementforac-tualexpenses.ThisshallceasethedaytheI.C.opens.Sec.5.TheI.S.T.priortotheI.C.shalldepositsufficient

funds in theconventioncity tobeused todefrayexpensesoftheI.C.Sec.6.Aquorumforthetransactionofbusinessshallcon-

sistofonethirdofthedelegatesseated.ImmediatelyaftertheI.C.isopened,theI.E.C.shallreportoncredentialsandrules.TheorderofbusinessoftheI.C.shallproceedinaccordancewith therulesadoptedby theConvention.ThebusinessoftheI.C.shallincludethefollowing:1.CalltoOrder.2.PresentationofCredentials.3.ReportonCredentialsandRules.4.AppointmentofCommittees.5.CommunicationsandBills.6.Resolutions,etc.7.ReportsofCommittees.8.UnfinishedBusiness.

Sec.7.NoL.U.shallbeentitledtorepresentationatanI.C.unlessitspercapitatotheInternationalUnionhasbeenpaidon itsmembership for the period six (6) calendarmonthspriortothefirstofthemonthinwhichtheI.C.isheld.

Sec.8.ThebasisofrepresentationattheI.C.shallbeasfollows:

EachL.U.shallbeentitledtoapercapitataxvoteon“A”and“BA”members;thatis,one(1)voteforeachmemberingoodstandingthree(3)calendarmonthspriortothefirstofthemonthinwhichtheI.C.isheld.

route toandwhileattendingtheI.C., theI.S.T.willpayeachdelegateasumequaltoninetycents(90¢)amile,oneway,bytheshortestpracticalroute.Each delegate remaining until the close of the Conven-

tionshallbereimbursedforexpensesintheamountofonethousanddollars($1,000.00).L.U.’smaypaytheirdelegatesadditionalsums.Sec.10.Nomembershallbenominatedasadelegateor

alternateunlessheispresentorsignifieshiswillingnessinwriting,norshallhebeeligibletobeadelegateoranalter-nateunlessincontinuousgoodstandinginhisL.U.atleasttwenty four (24)months immediatelyprior to nomination,providedhisL.U.hasbeeninexistencethatlong.However,nosuchmembershallbedisqualifiedbecausehisL.U.hasbeenmergedoramalgamatedwithanotherL.U.orL.U.’s.The two (2) years membership requirement shall not

beapplicable tomembersofL.U.’saffiliatedwithSystem

Councils,whoareemployedbyasingleemployerandwhotransferbetweenL.U.’swithinaSystemCouncil,provided,however,thatanysuchmembermusthavebeenamemberincontinuousgoodstandingfortwo(2)yearsinatleastoneoftheL.U.’saffiliatedwiththeSystemCouncilinvolved.WheretheL.U.Bylawsspecify,priortoelectiontoapar-

ticularelectiveoffice,thatoneofthefunctionsofsaidelectiveofficeshall includeserviceasadelegatetotheI.C.orotherbody,aspecialelectionoftheofficerholdingsuchofficetobeadelegateisnotnecessary.Intheeventavacancyshouldoc-curinthesaidelectiveofficeanditisfilledpursuanttoArticleXVI,Section16,priortoMayintheConventionyear,theL.U.shallelectareplacementdelegate.Thepersonappointedtofilltheparticularelectiveofficeshallbeacandidateforelectionasadelegate.If,however,thevacancyisfilledbetweenMayintheConventionyearandtheholdingoftheI.C.,thepersonappointedtothevacancyintheelectiveofficeshallserveasdelegate,exceptthat,asprovidedbylaw,suchdelegatemaynotvoteinanyelectionforInternationalOfficers.Delegatesandalternatesshallbeelectedbysecretballot.

MembersingoodstandingintheL.U.shallbegivenatleastfifteen (15) days notice of the time, place andmanner ofmakingnominationsandoftheelection,andmayparticipatetherein, except for thosewhomaybe expresslyprohibitedbyapprovedprovisionof theL.U.bylaws.Theelectionofdelegatesandalternatesshallbedecidedforthosereceivingthemostvotesandballots,andrecordsoftheelectionshallberetainedforone(1)year.Ifbetween theelectionand the I.C., anelecteddelegate

shouldresignorotherwisebeunabletoattendtheI.C.,thenthealternatedelegatewiththehighestnumberofvotesinthe

electionshalltakehisplaceasadelegate.ShouldasecondelecteddelegateresignorotherwisebeunabletoattendtheI.C.,thenthealternatedelegatewiththenexthighestnumberofvotesintheelectionshalltakehisplaceasadelegate,andsoforth.Intheeventtherearenootherelectedalternates,theExecu-

tiveBoard shall appoint suchdelegates,provided,however,thatappointeddelegatesmaynot,asprovidedbylaw,voteinanyelectionforInternationalOfficers.Sec.11.Credentialsofthedelegateandalternateshallbe

inthehandsoftheI.S.T.orinthemailatleastsixty(60)dayspriortotheI.C.Failingtocomplywiththis,thedelegateoralternate shall receivenomileageorotherpayments. (TheCredentials Committee shall pass upon whether such del-egateoralternateshallbeseated.)Sec.12.AnyInternationalorL.U.officer,oranymember,

whowillfully commits fraud in connectionwith obtainingor furnishingcredentials fordelegates to the I.C.—orwhoisconnectedwithanyfraudinvotingduringtheI.C.—shallbetriedbytheI.E.C.TheI.E.C.shallrenderadecisionanddecidethepenalty.Sec.13.TheI.P.shallnominate,andtheI.C.shallelect,

two(2)delegatestoconventionsoftheAmericanFederationofLaborandCongressofIndustrialOrganizations;two(2)delegates to theBuilding andConstructionTradesDepart-ment;two(2)delegatestotheMetalTradesDepartment;one(1)delegatetotheUnionLabelandServiceTradesDepart-ment;one(1)delegatetotheMaritimeTradesDepartment;andtwo(2)delegatestotheCanadianLabourCongress.Eachofthesedelegatesshallbethebusinessmanagerorprincipal

officerofhislocalunion.Ifthedelegate’sstatusasbusinessmanagerorprincipalofficerchanges,heshallresignandtheI.P.shallappointareplacementdelegate.The I.P. shall appoint allotherdelegates toanyconven-

tionsatwhichtheI.B.E.W.isentitledtorepresentation.Hemayappointasubstituteforanydelegatewhodoesnotde-sire, or is unable, to attend any convention towhichhe iselected.Allsuchdelegatesshallserveatermoffive(5)yearsandbecompensatedatfiftydollars($50.00)adayfortimespentinattending,andtravelingtoandfromtheconvention,andbereimbursedforactualexpenses.

ARTICLE III INTERNATIONAL OFFICERS

Sec.1.TheofficersoftheI.B.E.W.shallbetheInternationalPresident, International Secretary-Treasurer, eleven (11) In-ternational Vice Presidents, International Executive CouncilChairmanandeight(8)InternationalExecutiveCouncilmem-bers.Theofficersshallbenominatedandelected,bydulyelect-eddelegates,attheInternationalConvention.Theyshallassumeofficethirty(30)daysaftertheirelection,andshallserveforfive(5)yearsoruntiltheirsuccessorsareelectedandqualified.Sec.2.Nooneshallbeeligibleasanofficerexceptamem-

ber having five (5) years continuous good standing in theI.B.E.W.immediatelypriortonomination.Sec.3.TheelectionsoftheInternationalPresident,Inter-

national Secretary-Treasurer, and International ExecutiveCouncilChairman shall be by secret ballot, per capita taxvotewhenthereismorethanonecandidate,andshallrequireamajorityofallvotescast toconstituteanelection.When

there aremore than two candidates for the sameoffice, atevery unsuccessful balloting the one receiving the lowestnumberofvotesshallbedropped,thevotingthentocontinueuntilonehasreceivedamajorityoverall.However, thechoiceforInternationalVicePresidentsand

theInternationalExecutiveCouncil(exceptI.E.C.Chairman)shallberecommendedtotheConventionbyeachdistrict.TheConvention shall adopt the district’s recommendation as itsownaction,bytheI.S.T.castingone(1)ballotforthedistrict’schoice.Thechoiceofeachdistrictshallbedecidedbyamajor-ityoftheL.U.’softhedistrictrepresentedattheConvention—andpresentandvotingatthetimethechoiceismade—onthebasisofone(1)voteforeachL.U.,bysecretballot,notbyadelegateorpercapitataxvote.Ifthedistrictisunabletodeter-mineitschoice,thentheConventionshalldecideanycontestbyarollcall,percapitataxvote.ThevoteofeachL.U.shallbedecidedbyamajorityof

itsdelegates.IfthedelegatesofaL.U.areequallydivided,thentheL.U.shallhavenovote.Whentherearemorethantwo(2)candidatesforthesameofficeinthedistrict,andnocandidatereceivesamajorityonthefirstballot,thereshallbearun-offelectionbetweenthetwo(2)candidatesreceivingthehighestnumberofvotes.(NothinginthisConstitutionshallbeconstruedtoconflict

withtheabovesection.)Sec.4.Atallelectionswhenitbecomesnecessarytohave

an electronic, secret ballot vote, thepresidingofficer shallappointanelectionjudgeand,ifnecessary,tellers.Heshallannouncethenamesofthecandidatesinrotation.Eachcan-didatemaybepresentorberepresentedbyamemberduring

thevote tally.Allelection records shallbepreserved foraperiodofone(1)year.Sec.5.TheofficersshallattendtheI.C.andalltheirex-

pensesshallbepaidoutoftheGeneralFund.Theyshallhavevoicebutnovote,andnoofficershallbeeligibletorepre-senthisL.U.asadelegate.Theofficers,exceptI.V.P.’s,shallhave their reports printed and ready for distribution to thedelegateswhentheConventionisorganized.Sec.6.EachofficerelectedshallsignandfileintheI.O.

thefollowingpledgeandoathofoffice:“I, ,doherebysolemnlypledgeonmy

honor,thatIwillfaithfullydischargemydutiesasanofficeroftheInternationalBrotherhoodofElectricalWorkers.Iwillsupportbyeverymeanswithinmypower itsConstitution,andIwillenforceittothebestofmyability.Attheexpira-tionofmytermofoffice,Ishalldelivertomysuccessorallbooks,papers,moneyandotherpropertyinmypossessionbelongingtotheI.B.E.W.oritsL.U.’s;andIshallnotbere-lievedfromanybondorobligationunlessanduntilIcomplywiththislaw.”(Signed) (Witness)Sec.7.Allofficersattheexpirationoftheirtermshallde-

Compensation and BenefitsSec.8.SalariesoftheInternationalPresident,International

Secretary-Treasurer, International Vice Presidents, I.E.C.Chairman,I.E.C.Members,ExecutiveAssistants,Directors,andSeniorInternationalRepresentativesshallbe increasedannually onOctober 1.The increase shall be equal to thecombinedaverageofthepercentageincreasesnegotiatedandapprovedforthemembersoftheConstruction,Manufactur-ing,Telephone,andUtilitybranchesoftheI.B.E.W.forthetwelve-monthperiodendingAugust31ofeachyear.AllsuchOfficersandRepresentativesshallbereimbursed

for actual expenseswhenaway fromhomeonbusinessoftheI.B.E.W.inaccordancewithrulespromulgatedbytheI.P.Sec.9.TheservicesoftheI.E.C.Chairmanshallbeavail-

abletotheI.B.E.W.inanadvisorycapacityandforfulfillingotherassignmentsintheinterestsoftheI.B.E.W.Sec. 10.Members employedby the I.B.E.W. as officers

itasofficers,representativesorassistants,whohaveattainedtheageof sixty two (62) andhave ten (10)ormoreyearsservice,shall,uponrequestof the individual,beretiredbytheI.E.C.Theannualrateofcompensationpayableuponre-tirementshallbethreeandthree-quarterspercent(3.75%)oftheaverageannualsalaryforthethree(3)yearsduringwhichthehighestsalarywaspayabletotheindividual,multipliedbythenumberofyearsofservice,nottoexceedtwenty(20)years,plusonepercent(1%)ofsuchaveragesalary,multi-pliedbytheadditionalnumberofyearsofserviceinexcess

oftwenty(20)years,nottoexceedfive(5)additionalyears.Thisretirementcompensationshallbepayablemonthly.(b) Officers, representatives, or assistants who have at-

tainedtheageoffiftyfive(55)andhavefifteen(15)ormoreyearsservice,shall,uponrequestoftheindividual,beretiredbytheI.E.C.andshallreceiveretirementcompensationonthesamebasisasprovidedinSubsection(a)above.(c) Officers, representatives, or assistants who become

permanentlydisabledwhileemployedbytheI.B.E.W.shallreceive retirementcompensationon thesamebasisaspro-videdinSubsection(a)ofthisSection,orasprovidedinAr-ticleIII,Section10,whileincapacitated.(d) Any officer, representative, or assistant who leaves

I.B.E.W.serviceaftercompletingfive(5)ormoreyearsofservicebeforebecomingeligibleforretirementunderSub-section(a)abovemayelecteithertohavehiscontributionsreturnedtohimortobegrantedavestedrighttoretirementcompensationwhichwillentitlehimtoreceive,commencingatagesixtyfive(65),retirementcompensationonthesamebasisasprovidedinSubsection(a)above.(e)Inlieuofthepaymentofretirementcompensationon

thebasisoutlinedinSubsections(a),(b),and(d),anofficer,representative,orassistantmayelectimmediatepaymentofhispensioninreducedpensiononajointandsurvivorbasiswithpaymentscontinuingtohissurvivingspouse.Ineachsuchcasethereducedamountofretirementcompensationpayableundersuchelectionshallbeactuariallyequivalentto the retirement compensation otherwise payable.To beeffective,allsuchelectionsshallconformtotherulesandregulationsadoptedforsuchpurposebytheI.E.C.Thepro-

visionsofthisSubsectionshallnotapplytothoseofficers,representatives,orassistantswhoretiredonorbeforeSep-tember14,1962.(f)Intheeventofthedeathofanofficer,representative,

assistant,orspouse,anyunusedportionofhisfivepercent(5%) contribution which was previously required shall bepayableinalumpsumtothedesignatedbeneficiary.In the event of the death of both—theofficer, represen-

tative, or assistant and his spouse—any unused portion ofthefivepercent(5%)contributionwhichwaspreviouslyre-quiredshallbepayableinalumpsumtohisbeneficiary.(g)TheI.E.C.shallenterintoatrustagreementwithareli-

ableandlongestablishedtrustcompanytoactastrusteeinthehandlinganddisbursementoftheretirementpay.(h)TheI.S.T.shallturnovertosuchtrustcompanyfrom

theGeneralFundtheamountnecessarytoassurethateacheligibleofficer,representative,orassistantshallreceivehisretirementpaywhendue.(i) The I.E.C. is authorized to make such changes or

amendments necessary to qualify this plan under Section401(a)oftheInternalRevenueCode.(j)AnyemployeeoftheI.B.E.W.notcoveredbySection

11,Subsections(a)through(i),shallbecoveredbyaretire-mentplan, theprovisionsofwhichshallbeestablishedbythe I.B.E.W., consistentwith legal requirements including,where applicable, the duty to bargain in good faithwith arecognizedcollectivebargainingrepresentative.(k)TheI.B.E.W.shallenterintoatrustagreementwitha

reliableandlongestablishedtrustcompanytoactastrustee

Constitutionandtheprinciplesitsetsforthandshalldonoth-ingdirectlyorindirectlytoinjuretheI.B.E.W.oritsmembers.(n) The I.E.C. is authorized to make such changes or

amendmentsnecessarytoqualifythisplanunderSection401(a)oftheInternalRevenueCode.(o) Insofar as Canadian officers and employees of the

I.B.E.W.areconcerned,theI.E.C.isauthorizedtomakesuchchanges and amendments in the Pension Plan as it deemsappropriateandnecessarytoprovidetheminimumbenefitsrequiredbyapplicabledominionorprovinciallaws.(p) The I.E.C. is authorized to effect such changes and

amendmentsinbenefitsbyrulesandregulations.(q)TheI.E.C.isempoweredtoestablishsuchrulesand

regulationsasitdeemsappropriateandtomodifysamefortheeffectuationandadministrationoftheprovisionsofthisArticle.WithrespecttotheplanforemployeesnotcoveredbySection11,Subsections(a)through(i),thispowershallbeexercisedconsistentwith theprovisionsofSubsection(j).TheI.E.C.isfurtherauthorizedtomakedefinitionsofterms used in thisArticle and tomake interpretations oftheseconstitutionalprovisionsanditsrulesandregulations,whichshallbefinalandbinding.ThedecisionsoftheI.E.C.

onallquestionsarisinghereunder,includingcasesofeligi-bilityforandcomputationoftheamountofbenefits,shallbefinalandbinding.(r)Innoeventshallanyofficer,representative,orassistant

oranyotheremployeeoftheI.B.E.W.whoretiresunderArti-cleIII,Section11,bepaidamonthlypensionbenefit(asdeter-minedbeforeanyreductionrequiredbytheelectionofoptionunderSubsection(e))thatislessthanhewouldhavereceivedunderSection11of theConstitutionprior toSeptember30,1974.Theamountpaidofficers,representatives,orassistantspriortoSeptember30,1974,shallremainunchanged.(s)Notwithstandingany language to thecontrary in this

Section11,theInternationalPresidentshallhavefullauthor-ity and discretion to decide on compensation, retirement,andbenefitcoverageoforganizerswhoareemployedbytheI.B.E.W.Sec.12.Nocandidate(includingaprospectivecandidate)

forInternationalOffice,andnosupporterofacandidateforInternationalOffice,maysolicitoracceptfinancialsupportoranyotherdirectorindirectsupportofanykind(exceptanindividual’sownvolunteeredpersonaltime)fromanynon-memberoftheI.B.E.W.orfromanyfoundation,corporationorotherentitywhosefundsarederivedinwholeorinpartfromanypersonnotamemberoftheI.B.E.W.Thisruledoesnotapplytothefinancingoflitigationconcerningthelegalrights of candidates or other members in connection withelectionsforInternationalOffice.The I.E.C. shall adopt such regulations as arenecessary

to implement this provision.The regulations shall providefor themaintenanceof such recordsand thefilingof such

reports,bycandidatesandtheirsupporters,asmaybeneces-saryfortheadministrationandenforcementofthissection.

ARTICLE IV INTERNATIONAL PRESIDENT

Sec.1.TheI.P.shallbebondedintheminimumamountof $500,000 for the faithful performance of his duties.Should the amountbeinghandled at any timeexceed theamountofhisbond,heandtheI.E.C.shallhavethebondincreasedaccordingly.HeshallpresideatallsessionsoftheI.C.Whenunabletopresideheshallselectsomeoneelsetodoso.HeshallperformsuchotherdutiesasareoutlinedinthisConstitutionandarenecessarytoprotectandadvancetheI.B.E.W.Sec. 2.The I.P. shall see that all other officers perform

theirduties.Incaseofnonperformanceofdutiesordisabil-ityor incompetenceof any I.V.P.or the I.S.T., the I.P.hasthepowertoremovesuchofficer,withsuchremovedofficerhavingtherightofappealtotheI.E.C.Heshallfillallvacancies,includingthoseontheI.E.C.,byap-

pointment.SuchappointmentsmustbeapprovedbytheI.E.C.Sec.3.TheI.P.isempoweredasfollows:(a)TocallameetingoftheI.E.C.wheneverinhisjudg-

mentsuchameetingisnecessary.(b)Todecideallquestionsoflaw,disputeorquestionsin

controversyhoweverarising,allhisdecisionsbeingsubjecttoappeal,includingpolicydecisions,firsttotheI.E.C.andthentheI.C.(NoticeinwritingofappealfromanydecisionoftheI.P.mustbefiledwiththeI.S.T.andI.P.withinthirty(30)daysfromthedateofsuchdecision.)

(c)To establish such departments in the organization orin the I.O., as in his judgment are necessary to protect oradvancetheinterests,ortomeettheneedsoftheI.B.E.W.(d)ToemployInternationalRepresentativeswhoshallbe

reimbursedforactualexpenseswhileawayfromhome,andtoemploysuchassistantsas,inhisjudgment,arenecessarytocarryontheworkoftheorganization,andtodecidethecompensation to be paid, except as provided elsewhere inthisConstitution.Allrepresentativesandassistantsshallworkunderthedi-

rectionoftheI.P.andhehasthepowertodischargethem.(e)Toemployanattorneyorattorneys toactascounsel

andgiveanyotherlegalassistanceashedeemsnecessary.(f)ToauthorizeinwritinganyI.V.P.toauditthebooksand

recordsofanyL.U.inhisdistrictortoengageanaccountantfor thepurpose,wheneverhedeemssuchactionnecessaryfortheprotectionoftheL.U.anditsmembers.(g)TopreferchargesthroughtheI.E.C.againstanymem-

ber who, in his judgment, is violating the Constitution orworking against the welfare of the I.B.E.W.AnymemberagainstwhomchargesarepreferredshallbesonotifiedbytheI.P. inwriting,andsaidmembershallhavetheright toappearbeforetheI.E.C.inhisowndefense.(h)EithertosuspendorrevokethecharterofanyL.U.,or

have theI.S.T. reject thepercapita taxfromanyL.U. thatfailsorrefusestoobservethelawsandrulesoftheI.B.E.W.(i)Totakechargeof,i.e.,imposeatrusteeshipon,theaf-

fairs of any L.U.when in his judgment such is necessaryto protect or advance the interests of itsmembers and the

prior toorduringthecourseof the trusteeshipshallbeas-sumedby,orbecomeanobligationof,theI.B.E.W.withoutthewrittenconsentoftheI.P.(j)Toremoveorsuspendanyofficer, representative,ap-

pointeeoragent,ofaL.U.orSystemCouncilforincompe-tence,orfornonperformanceofduties,orforfailuretocarryouttheprovisionsofthisConstitutionandtherulesherein,orthebylawsandagreementsoftheL.U.orSystemCouncil,orforputtingintoeffectorallowingtobeputintoeffectanypractice,rule,agreement,bylaworpolicynothavingapprov-aloftheI.P.,orforfailuretoobserveorcarryoutinstructionsordecisionsof the I.P.When the I.P. removesor suspendsanyofficer, representative,appointeeoragentofaL.U.orSystemCouncil,thenhecanfillanysuchofficeorpositionbyappointmentofothers.(k)Toappoint,ifhesodecides,arefereewhomayormay

notbeamember,totaketestimonyandreporttohim.(l)Toenterinto,orauthorizeanI.V.P.,representative,or

assistanttoenterinto,agreementswithanynationalorinter-national labororganizationorassociationofemployers,orwithanycompany,corporationorfirmdoinganinterstateorinterprovincialbusinessinelectricalwork,tocovertheentirejurisdictionoftheI.B.E.W.

(m) The I.P. or his representatives shall not enter intoagreements affecting wages, hours and conditions of em-ploymentwherealocalunionagreementcoveringsuchem-ploymentalreadyexists,withoutfirstnotifyingatleastthirty(30)daysinadvanceofsuchagreements,thelocalunionssoconcernedoraffected,inadistrict,andthenonlybyprocur-ingconsentofamajorityofthelocalunionsinthedistrictortheindividuallocalunionaffectedbysuchagreement.(n) To edit and publish the I.B.E.W.’s official monthly

publicationandtoconductitasatechnical,economic,andtradeunionpublication;touseitsobituarysectionformem-bersonly,andathisdiscretiontopublishcommunicationsinaccordancewithpolicyasdefined.(o)Todevelop an appropriate I.B.E.W.HonoraryMem-

bershipCardwhichmaybeissuedtopersonsoutsideoftheregularmembershipwhohavecontributedtothewelfareoftheI.B.E.W.Sec.4.TheI.P.can,inanysituation,delegatethepowers

ofhisofficetoanInternationalRepresentative,VicePresi-dentorAssistant.Sec.5.NothinginthisConstitutionshallbeconstruedto

conflictwithanyoftheprovisionsofthisarticle.

ARTICLE V IMPERATIVE MANDATE

Sec.1.IfatanytimechargesarefiledagainsttheI.P.andsuch are forwarded to the I.S.T.with the signaturesof theL.U.presidentandsecretary,andunder thesealoffive(5)percentoftheL.U.’scomprisingtheI.B.E.W.,theI.S.T.shallimmediately furnish a copyof such charges to the I.P.He

shallanswerthemwithinten(10)days.TheI.S.T.onreceiv-ingtheanswerof theI.P.,shallmailacopyof thechargestogetherwiththeansweroftheI.P.,toeveryL.U.,andshallencloseablankballot,callingforareferendumvoteonthequestion:“ShalltheI.P.beupheld?”TheR.S.ofeachL.U.shallforwardtheresulttotheI.S.T.

withinsixty(60)daysfromthedatetheballotsaremailed.ThevotesshallbepublishedinfullintheI.B.E.W.’sofficialmonthlypublication.TheballotsshallbeenclosedinasealedpackageandentrustedtotheI.S.T.tobedeliveredtothenextI.C.IfamajorityvotenottoupholdtheI.P.,thechargesaretherebyupheld;and theI.E.C.shall thendeclare theofficevacantandelecthissuccessor.

cardnumberanddateofadmission,togetherwiththosesus-pended,expelled,transferred,etc.,andalsotokeepacorrectfinancialaccountbetweeneachL.U.andtheI.B.E.W.

lypublicationeachyeartheannualI.B.E.W.auditbythecer-tifiedpublicaccountantemployedbytheI.E.C.Topublishatleastonceayearacorrectdirectoryinpam-

phletformofallL.U.’swithnamesandaddressesoftheR.S.,F.S.andbusinessmanagerorrepresentativeofeachL.U.Sec. 2. The I.S.T. shall, fifteen (15) days prior to the

month inwhich the I.C.convenes, furnish to the I.E.C.acorrect recordof theconventionvote towhicheachL.U.isentitled.Sec. 3.The I.S.T. and the I.P. are jointly empowered to

businessbycorrespondencewiththeI.S.T.,andeachother,butfive(5)membersmustconcurtomakesuchactionvalid.Sec.3.TheI.E.C.shallbethecommitteeonrulesandcre-

dentialsatallregularorspecialconventionsandshallsubmititsreportassuchimmediatelyaftertheconventionopens.Sec. 4.The I.E.C. shall have the power to try anyL.U.

ARTICLE XI PENSION BENEFIT FUND

Sec.1.Retirement Benefits.An“A”memberwhoretiresfromtheelectrical industryafterDecember31,2006,shallbeentitledtobenefitsinaccordancewiththefollowingrulesastoeligibility:

(a) Normal Pension.An“A”memberof the I.B.E.W. incontinuousgoodstandingwithfive(5)ormoreyearsimme-diatelyprecedinghisapplication,whohasattainedtheageofsixty-five(65)years,shallreceivepensionbenefitscomputedonthebasisoffourdollarsandfiftycents($4.50)permonthforeachfullyearofsuchcontinuous“A”membership.(b)Optional Early Retirement Pension.An“A”member

oftheI.B.E.W.incontinuousgoodstandingwithtwenty(20)ormoreyears immediatelyprecedinghis application,whohasattainedtheageofsixty-two(62)years,mayelecttore-ceivereducedpensionbenefitsaslongashelives,computedonthebasisoffourdollarsandfiftycents($4.50)permonthforeachfullyearofsuchcontinuous“A”membership,re-ducedbysixandtwo-thirdspercent(6⅔%)foreachyearorpartthereofthesaid“A”memberwasundertheageofsixty-five (65) at thedateofhis retirement.Theelectionof thisoptionmustbemadeonaformprescribedbytheI.S.T.andwillbecomeeffectiveon thedatehe isplacedonpension.Theelectionofthisoptionshallbeirrevocable.

(c)Optional Spouse’s Benefit.Each “A”member retiredunderSection1(a),Section1(b)orSection2may,inlieuofthepaymentofpensionsasoutlinedabove,electtoreceivea reduced pension as long as he lives, with the provisionthat afterhisdeathone-half of such reducedpension shallcontinuetobepaidtohisspousethereafteraslongassuchspousesurviveshim.Theamountofsuchreducedpensionpayable under this election shall be actuarially equivalentto thepensionotherwisepayable.Thiselectioniseffectiveonthedatethememberisplacedonpension,exceptintheeventthememberandthemember’sspousearesubsequentlydivorcedorintheeventthemember’sspousesubsequentlypredeceasesthemember,thebenefitpayabletothemembershallberecalculatedandshallbeequaltotheunreducedben-efitwhichwouldhavebeenprovidedunderSec.1(a),1(b)or2,as thecasemaybe.Thisrecalculatedbenefitshallcom-mence themonthofJanuary2002for thosememberswhobecamedivorcedorwhosespousespredeceasedthempriortooronDecember31,2001;andforallothermembers,asofthelastdayofthemonthnextfollowingeitherthedateofthedivorceorthedeathofthespouse.Sec.2.Disability Pension.An“A”memberoftheI.B.E.W.

whoistotallydisabledandhascontinuousgoodstandingoftwenty(20)ormoreyearsimmediatelyprecedinghisappli-cation shall receive disability pensionbenefits, if such ap-plicationisapprovedafterDecember31,2006,computedonthebasisoffourdollarsandfiftycents($4.50)permonthforeachfullyearofsuchcontinuous“A”membership.(a)Benefitswillbepaidcommencingonthefirstdayof

themonth inwhich it has been determined that themem-berbecametotallydisabled,providedthatnoperiodoftotal

disabilityshallbeconsidered tocommencebefore the“A”memberhascompletedtwenty(20)ormoreyearsincontinu-ousgoodstanding.(b) The applicant for disability pension benefits must

maintain his continuous good standing as an “A”memberuntilthedateofapprovalofhisapplicationbytheI.E.C.andshall,intheeventofsuchapproval,receiveafullrefundofI.O.duesfromthedateofcommencementofhis totaldis-ability. The period following the commencement of totaldisabilityshallnotbecountedincomputingtheamountofdisabilitypensionbenefit.Sec. 3. Vesting. An “A” member who has completed

twenty(20)ormoreyearsof“A”membershipincontinuousgoodstandingandwhoceasesbeingengagedintheelectricalindustrypriortotheattainmentofagesixty-five(65)shall,if an application isfiled and approved afterDecember31,2006,obtainavestedrighttopensionbenefits,butnotdis-abilitypensionbenefitsordeathbenefits.Thisvestedrightwill entitle him to receive, commencing at age sixty-five(65),pensionbenefitscomputedonthebasisoffourdollarsandfiftycents($4.50)permonthforeachfullyearofsuchcontinuous“A”membership,lessfourdollarsandfiftycents($4.50)permonthforeachyearorpartthereofthesaid“A”memberwasundertheageofsixty-five(65)atthedatehisapplicationwas received.Theapplicant forvestedpensionrightsmustmaintainhiscontinuousgoodstandingasan“A”memberuntilthedateofapprovalofhisapplicationbytheI.E.C.,andshall,intheeventofsuchapproval,receiveafullrefundofI.O.duesfromthemonthfollowingreceiptofhisapplication.Theperiodfollowingthereceiptofsuchapplica-tionshallnotbecountedincomputingtheamountofvested

pensionrights.Innoeventshallany“A”memberentitledtobenefitsunderthisSection3bepaidamonthlypensionben-efitlessthanhewouldhavereceivedunderthepensionben-efitprovisionsoftheConstitutionpriortoJanuary1,2007.Sec.4.Death Benefits.Uponthedeathofan“A”member,

adeathbenefitshallbepayableasfollows:(a) Benefit Level. Upon the death, after September 10,

2001,ofanonretired“A”memberwhothenhasatleastsix(6)monthscontinuousandactivegoodstanding,thebenefi-ciarytoreceivethedeathbenefitspayableunderthisPara-graphshallbepaidthesumofsixthousandtwohundredfiftydollars($6,250.00)ifthesaid“A”memberdiedfromnatu-ralcauses,orthesumoftwelvethousandfivehundreddol-lars($12,500.00)ifthesaid“A”memberdiedbyaccidentalmeans.However,nodeathbenefitshallbepayableuponthedeathofanonretired“A”memberifsuchmemberwasmorethantwomonthsinarrearsinduespayments,unlessitcanbedemonstratedthatthearrearagewasnotthefaultofthemem-berinwhichcasethedeathbenefitshallbereducedbytheamountofthearrearage.Uponthedeathfromeithernaturalcausesoraccidentalmeansofan“A”memberafterDecem-ber31,2001,whoisretiredunderSection1orSection2,thebeneficiarytoreceivethedeathbenefitsshallbepaidasumcomputedbysubtractingfromsixthousandtwohundredfiftydollars($6,250.00)allpensionbenefitspaidbytheI.B.E.W.PensionBenefitFundtotheretiredmember.However,innoeventshalltheamountofthedeathbenefitdueasaresultofthedeathofan“A”memberretiredunderSection1orSec-tion2belessthanthreethousanddollars($3,000.00),exceptasprovidedinSection4(c).Alldeathbenefitspayableunderthisprovisionarepayablewithoutinterest.

(b)Beneficiaries.Uponthefailureofanymembertonameanoriginalbeneficiary,ortonameanewbeneficiaryafterthedeathorinabilitytotakeofonepreviouslynamed,thedeathbenefitshallbepayabletothefollowingindividual(s)intheindicatedorderofpriority:1)member’sspouse;2)member’schildren;3)member’sparents; and4)member’sestate.Ev-ery“A”membershallhave the right toname thepersonorpersons, including the member’s estate, who are to be themember’sbeneficiaryorbeneficiariesunderthedeathbenefitprovisionsoftheI.B.E.W.PensionBenefitFund.Everymem-bershallhave theprivilegeofchangingbeneficiaries. If thebeneficiaryentitledtothedeathbenefit(eitherthebeneficiarynamedbythe“A”memberortheindividual(s)intheindicatedorderofprioritystatedabove)cannotbelocatedordoesnotfileaclaimforthedeathbenefitwithinninety(90)daysafterthedateofdeath,thebenefitmaybepaidtoacontingentben-eficiaryorintheindicatedorderofprioritystatedabove.Ifnovalidclaimisfiled,noappropriatebeneficiarycanbelocated,andthememberhasnoestatetowhichthebenefitcanbepaid,thedeathbenefitshallreverttotheI.B.E.W.PensionBenefitFundonthesecondanniversaryofthemember’sdeathandnobenefitwillbepaidsubsequenttothereversion.(c)Set Off of Death Benefit.IftheI.B.E.W.PensionBenefit

Fundhassentpensioncheckspayabletothedeceasedmemberafterthemember’sdeathasaresultofafailuretonotifytheFundofthedeathofthemember,andtherecipientofthosepensioncheckshasnotreturnedthemtotheFund,butretainedthepensionmoney,theFundmaysetofffromthedeathben-efit,andrefusetopaytoanybeneficiary,theamountequaltothetotalamountofthepensionoverpayment.Sec.5.Benefits of “A” members who have retired and/or

died on or before December 31, 1991.Thepensionbenefitsofan“A”memberoftheI.B.E.W.,whohasretiredfromtheelec-tricalindustryandwasplacedonthepensionrollsonorbeforeDecember31,1991,shallbegovernedbytherulesineffectasof thedate theywereplacedon thepension rolls.ThoserulesaresetforthintheI.B.E.W.Constitutionasamendedatthe33rdI.B.E.W.ConventionatToronto,Ontario,September1986.Thedeathbenefitsofan“A”memberoftheI.B.E.W.whohasdiedonorbeforeDecember31,1991,shallbegov-ernedbytherulesineffectasofthedateofhisdeath,exceptthattherulesrelatingtoreversionofthedeathbenefittotheI.B.E.W.PensionBenefitFund,setforthinSection4(b)ofthisArticle,shallapplyinthecaseofdeathbenefitsnotyetpaidonorbeforeDecember31,1991.Sec.6.General Provisions.(a) Continuous Good Standing.Anyperiodofmembership

usedindeterminingeligibilityorincomputingbenefitsshallincludeonlyconsecutiveyearsof “A”membership ingoodstanding in the I.B.E.W., except that years of membershipwhenonpensionordisabilitypensionshallnotbecounted.Anymember that transfers from “A”membership status to“BA”membershipstatusorwhoisdroppedfrommembershipaftersixmonths’delinquencyinduespaymentsorwhohasac-ceptedHonoraryWithdrawalCardstatusshallnotbeconsid-eredingoodstandingforpurposesofdeterminingeligibilityfororincomputingbenefitsunderthisArticle.Inaddition,amembershallnotbeeligibleforpensionapprovalwhilesuchmemberhasanoutstandingL.U.trialboardassessment.Pro-videdfurtherthat,ifamemberwhohasbeengrantedanormalpension,anearlyretirementpension,adisabilitypension,oravestedpensionrightreturnstotheelectricalindustryand“A”

membership,abenefitbasedontheperiodofcontinuous“A”membershipaftersuchreturnshallbeaddedtotheamountofhispreviousnormalpension,earlyretirementpension,disabil-itypension,orvestedpensionright.(b)Waiver.Anymemberwhodesirestowaiveanyportion

ofhispension,eithermonthlyoryearly,maydosobynotify-ingtheI.S.T.Anyportionofthepensionsowaivedwillnotbereturnedtothepensioneratalaterdate.(c) Per Capita Tax of Members on Pension, Disability

Pension or with a Vested Pension Right.Thepercapitataxowedby“A”memberswhoareapprovedfornormal,early,disability or vested pension benefits under this Article isherebywaived.(d)Prohibition of Work. It is a condition for admission

topensionbenefits, includingvestedpension right and thecontinuationthereof,thatthemembershallnotperformanyworkofanykindcomingunder the I.B.E.W.’s jurisdictioneither forcompensationorgratis foranyone,except thatamember may work as an instructor in an I.B.E.W. recog-nizedapprenticeshipprogram,orasanElectricalInspectorforagovernmentalauthoritywhereElectricalInspectorsarenotcoveredbyanapprovedI.B.E.W.collectivebargainingagreement.A retired member shall be permitted to attendL.U.meetings,and,withtheL.U.’sapproval,haveavoiceatsuchmeetings,butshallnothaveavote;provided,thatamemberwhocomesoffpensionandreturnstothetradepriortoaL.U.electionshallnotbepermittedtovoteintheL.U.electionforaperiodofonehundredtwenty(120)daysfol-lowinghisreturntothetrade.HeshallobservehisobligationofmembershipandshowdueobediencetoI.B.E.W.lawsandthebylawsofitsL.U.’s.

(e) Non-Assignment of Benefits. No member, pensioneror beneficiary shall have the right to assign, transfer, sell,mortgage,encumberorpledgeanypensionordeathbenefits,andsuchassignment,transfer,sale,mortgage,encumbranceorpledgeshallbevoidandofnoeffectwhatsoever.Sothatsuch benefits shall not in anyway be subject to any legalprocess, execution, attachment or garnishment or be usedforthepaymentofanyclaimagainstanymember,pensionerorbeneficiary,orbesubjecttothejurisdictionofanybank-ruptcycourtorinsolvencyproceedingsbyoperationoflaworotherwise,theI.E.C.shallhavetherighttopostponeanypaymentunderthisPlantoapensionerorbeneficiary.

(f) Computation of Pension Benefit.Theperiodofcontinu-ousgoodstandingemployedincalculatingamember’spen-sion benefit shall be computed as of his anniversary date,which is thefirstdayof themonth inwhichsuchmemberis initiatedasan“A”memberof the I.B.E.W.or inwhichsuchmembertransfersfrom“BA”membershipstatusto“A”membershipstatusorinwhichsuchmemberreturnsto“A”membershipstatusfromhonorarywithdrawalstatusorfromvestedpensionstatus.Amemberearnsayearofgoodstand-ingbymaintainingmembershipfromoneanniversarydateuptohisnextanniversarydate.

(g) Forfeiture. Members who have been expelled frommembershiporwhohaveresignedfrommembership(otherthanwithanapprovedvestedbenefit),forfeitallrightsinanypensionordeathbenefitspayablefromtheFund.(h)Interpretations, Definitions and Decisions.TheI.E.C.

isherebygranteddiscretionaryauthoritytomakedefinitionsof the termsused in this articleof theConstitution and tomakeinterpretationsoforconstruetheseconstitutionalpro-

visions and itsRules andRegulationswhich shall befinalandbinding.TheI.E.C.isalsogranteddiscretionaryauthor-itytodetermineeligibilityforbenefitsandthedecisionsoftheI.E.C.onallquestionsarisinghereunder,includingcasesofeligibilityfor,andcomputationoftheamountof,benefitsshallbefinalandbinding.NobenefitsareauthorizedotherthanthoseexpresslystatedintheI.B.E.W.ConstitutionandtheRulesandRegulationsoftheI.E.C.

Sec. 7.Members on ParticipatingWithdrawal CardswhohavemaintainedtheircontinuousgoodstandingintheI.B.E.W.andwhomakeapplicationforpensionbenefits,shallbegov-erned and their applications handled in the samemanner asactive members of L.U.’s, except that notice of applicationshallbegiventotheL.U.thatissuedthewithdrawalcardtothemember.MembersonHonoraryWithdrawalCardstatusshallnotbeentitledtoapensionordeathbenefitunderthisArticle.

Sec.8.Anymemberviolatinganyoftheprovisionsofthisar-ticle,oranymemberaidingorabettingamembertodoso,afterinvestigationbytheI.E.C.andbeingfoundguilty,maybeperma-nentlybarredfromeverparticipatinginthesebenefits,andmaybesuspended,expelled,orassessedastheI.E.C.maydecide.

Sec.9.TheproceduresforapplicationsforbenefitsandformakingdeterminationsthereonshallbeasprescribedintheRulesandRegulationsoftheI.E.C.

ARTICLE XII PAYMENTS TO INTERNATIONAL

SECRETARY-TREASURER

Sec. 1.Any L.U. hereinafter organized shall pay to theI.S.T.fivedollars($5.00)foreach“A”memberadmittedasa

chartermember.Thefivedollar($5.00)feeshallbedividedwiththreedollars($3.00)paidtotheGeneralFundandtwodollars($2.00)paidtothePensionBenefitFund.AnyL.U.hereinafterorganizedshallpaytotheI.S.T.one

dollarandfiftycents($1.50)foreach“BA”memberadmit-tedasachartermemberexceptasmaybeotherwisedecidedbytheI.P.EachsuchL.U.shallreceivefreeofcosttheinitialsupplies.ThecharterofnewL.U.’smaybekeptopenfortherecep-

tionofadditionalchartermembersforsixty(60)daysafterpermanentorganization,duringwhichtimeapplicantsshallpaytheamountspaidbytheotherchartermembers.Thechartershallnotagainbeopenedexceptbyconsentof

theI.P.andtheadmissionfeeshallbetheamountapprovedbytheI.P.Sec. 2. L.U.’s already organized shall pay to the I.S.T.

fiftypercent(50%)oftheadmissionfeescollectedfromallnewmembers,butthemaximumfeetotheI.S.T.shallnotbemorethansixtydollars($60.00).Sec. 3. Fifty percent (50%) of all money collected by

L.U.’s frommembersof the I.B.E.W.asdifferences inad-missionfeesshallbesenttotheI.S.T.,butthemaximumfeetotheI.S.T.shallnotbemorethansixtydollars($60.00).Sec.4.L.U.’sshallpaytheI.S.T.onehalfofthetendol-

lar($10.00)reinstatementfeecollectedfrom“A”membersin arrears. “BA”members shall pay a three dollar ($3.00)reinstatementfee,onehalfofwhichshallbesenttotheI.S.T.Allmembers,beforereinstatement,shallpayallarrearagestodateofreinstatement.

Sec.5.EachL.U.shallpaytotheI.S.T.aspercapitataxtheamountssetforthinArticleIX.IfanymemberisinarrearsforduestotheL.U.andlater

payssuchdues, thepercapita tax foreachmonthshallbepaidtotheI.S.T.ShouldamembertakeoutaTravelingCard,hispercapita

taxmustbepaidforthefulllifeofthecardatthetimeitistakenout.ThismustbesenttotheI.S.T.withthenextpercapitapaymentssentafterthecardhasbeenissued.Withdrawalcardmembersshallpaysuchamountsasset

forthinArticleIX.Sec.6.Allpercapitataxcollectedfrommembersshallbe

inthehandsoftheI.S.T.orinthemailonorbeforethetenth(10th)ofthefollowingmonth.Sec.7.AnyL.U.three(3)monthsinarrearsinitspayments

totheI.S.T.maybesuspended,andshallbereinstatedonlyuponpayment of an assessment, in an amount determinedappropriatebyapolicydevelopedbytheI.S.T.,inadditiontomakingitsreportsandremittancesinfulltotheI.S.T.Sec.8.PaymentsduetheI.S.T.shallbeheldinthetreasury

asastandingappropriationanddonotrequireanyvoteoftheL.U.tobesenttotheI.S.T.Sec.9.Asystemofbookkeepingapprovedby the I.S.T.

shallbeusedinallL.U.’sandthebooksandsuppliesshallbefurnishedatcostbytheI.S.T.Sec.10.Anymemberholdinggoodstandingimmediately

priortothefirstofthemonthinwhichthememberentersthemilitaryserviceforthefirsttimeorisrecalledtosuchmili-taryservice,underthelawsoftheUnitedStatesorCanada,

shallbeissuedaMilitaryServiceCardbytheF.S.ofhisL.U.onapplicationbysuchmember.Onedesignatedportionofthecardshallbeforwardedto

theI.S.T.bytheF.S.oftheL.U.withthenextpercapitare-portfiledonbehalfoftheL.U.Thememberreceivingsuchacard,uponbeingreleasedor

dischargedfrommilitaryservice,shallwithinsixty(60)daysthereafterdeposititwiththeF.S.oftheL.U.thatissuedthecardandresumepaymentoflocalunionduesandpercapitatax.Anymemberwhofailstodepositsuchcardandresumepaymentof local uniondues andper capita taxwithin thetimespecifiedaboveshallnolongerbeentitledtotheprivi-legessetforthinthisSection.AllmembersonParticipatingWithdrawalCardswhoenter

militaryserviceshallbecoveredbythisSection,exceptthattheMilitaryServiceCardshallbeissuedtothembytheI.S.T.Anymemberwhoremainsinorreentersmilitaryservice,

withoutbeingrequiredtodoso,shallnotbeentitledtoretaintheMilitaryServiceCard,norshallsuchmemberbeissuedanewoneinsuchcircumstances;provided,however,thatamember servingor reenlisting in theNationalGuardor inthemilitaryReservesmayretaintheMilitaryServiceCardbenefitwhenevercalledtoactiveduty.DuringtheperiodthatanymemberholdsavalidMilitary

ServiceCard,suchmembershallnotberequiredtopayduesorpercapitatax,butshallretainallmembershipprivileges,including,butnotlimitedto,eligibilitytobeacandidateforL.U.officeorforInternationalConventiondelegate.Inaddi-tion,all“A”membersholdingavalidMilitaryServiceCardshall maintain their continuous good standing and entitle-

menttoall“A”members’benefitsprovidedbythePensionBenefitFund.WhenaL.U.provideslocalbenefits,itshalldecidewheth-

eranymemberissuedaMilitaryServiceCardshallcontinuetobecoveredbysuchbenefits.However,theI.B.E.W.shallinnomannerbeheldresponsibleregardingthepaymentornonpaymentoflocalbenefits.

ARTICLE XIII LOCAL UNION CHARTERS

Sec.1.AL.U.maybeorganizedbynotlessthanten(10)electricalworkersoremployeescomingundertheI.B.E.W.’sjurisdiction.TheI.S.T.shallgrantacharterwhenauthorizedbytheI.P.Sec.2.Thetypeofworkandtheterritoryorjurisdiction

coveredbyachartermustbedefinedinapprovedlocalunionbylaws.TheI.P.hastherightandpowertodivideorchangetheterritoryorjurisdictioncoveredbyanyL.U.,ortotakecharge of and direct certain jobs or projects in or passingthroughanyterritory,wheninthejudgmentoftheI.P.suchshouldbedone.Sec.3.The I.P.has the rightand thepower tomergeor

amalgamateL.U.’s inanycommunityorsectionwherethefacts, developments or conditions—in the judgment of theI.P.—warrantsuchaction,alsotodecidethetermsordetailsof anymerger or amalgamationwhen the L.U.’s involvedcannotordonotagree.Sec. 4.When a L.U. does not—in the judgment of the

I.P.—organizeorprotectthejurisdictionorterritoryawardedit,thenitschartermaybesuspendedorrevokedbytheI.P.

and anewL.U. established, or the jurisdictionor territoryawardedtoanotherL.U.orL.U.’s.Sec.5.Whenthereismorethanonebranchofworkersun-

derI.B.E.W.jurisdictionrepresentedinaL.U.,themembersofeachbranchshalldefinetheirownscaleofwages,hoursandworkingconditions.(However, this section shall not apply when different

branches, divisions or classifications come under one (1)blanketagreement.When thesecomeunderone (1)agree-menttheyshallvoteasagroup.)Sec.6.UnitsmaybeestablishedwithinaL.U.byprovi-

sion in theL.U. bylawswhen its jurisdiction coversmorethanone(1)city,townorcommunity,orincludesinitsmem-bership,employeesengagedinseveralofthebranches,divi-sionsorclassificationsoftheelectricalindustry.AunitistoassisttheL.U.ingivingservicetothemember-

shipandshallhavenopowerordutiesnotprovidedintheL.U.bylaws.AllunitofficersandcommitteesshallbeunderthesupervisionoftheL.U.anditsexecutiveboard.Sec. 7. “A” and “BA”membersmay transfer from one

typeofmembership toanother inaccordancewith theby-lawsofaL.U.butmustretainsuchchangedmembershipfornotlessthantwelve(12)consecutivemonths,exceptwhenchangeismadenecessaryonaccountoftransferringtoadif-ferenttypeofwork.Sec.8.TheI.P.isempoweredtoauthorizeL.U.’stocover

such“A”,“BA,”or“A”and“BA”typesofmembershipas,inhisjudgment,theprogressoftheI.B.E.W.demands.TheauthorizedcoverageshallbestatedintheL.U.bylaws.

ARTICLE XIV RAILROAD COUNCIL CHARTERS

Sec. 1. Railroad System Councils shall be formed andcomposedofRailroadL.U.’softheI.B.E.W.,asconditionsrequireandasdecidedbytheI.P.Sec. 2. Each council must be chartered by the I.P. The

I.S.T.shallgrantsuchcharterswhenauthorizedby theI.P.Thetypeofworkandtheterritoryorjurisdictioncoveredbyachartermustbedefined in theapprovedbylaws.TheI.P.hastherightandpowertodivideorchangetheterritoryorjurisdictioncoveredby suchcharterwhen inhis judgmentsuchshouldbedonetoadvancetheinterestsoftheI.B.E.W.onrailroads.

Rules for Railroad Councils

Sec.3.ThemethodofrepresentationinRailroadCouncilsshallbedeterminedbytheL.U.’saffiliatedtherewith.How-ever,eachdelegatetothecouncilshallbeelectedinthesamemannerasaretheofficersoftheL.U.herepresents.Sec. 4. Such councils shall charge a per capita tax for

their support and for proper handling of their business onrailroads,andsuchpercapitataxshallnotbelessthanonedollar($1.00)amonthfromthemembersofRailroadL.U.’s.

Sec.5.Thesecretaryofeachcouncil shall furnish to itsL.U.’sandtotheI.S.T.aquarterlyfinancialreportshowingallreceiptsanddisbursements.Sec.6.Eachcouncilshalladoptbylawsandrulestomeet

theneedsof,ortoprotectandadvancetheinterestsoftheI.B.E.W.onrailroads.Suchbylawsorrulesshallinnowayconflict with this Constitution.Where any doubt appearsthis Constitution shall be supreme. All bylaws, amend-mentsorrules,allagreements,jurisdiction,etc.,ofanyandallkinds,shallbesubmittedinduplicateformtotheI.P.forhisapproval.Sec.7.Nosuchcouncilshallputintoeffect,norshallits

officers,generalchairmanorrepresentativeputintoeffectorallowtobeputintoeffect,anybylaw,amendment,rule,oragreementofanykindwithoutfirstsecuringapprovaloftheI.P.Alltheseshallbenullandvoidwithoutsuchapproval,and the I.P.has thepower tocorrectbylaws,amendments,rulesandagreementstoconformtothisConstitutionandthepoliciesoftheI.B.E.W.Sec.8.Eachcouncilshallcooperateinthemannerdirected

bytheI.P.withsuchorganizationsashemaydecide.Sec.9.WhentheI.P.deemsitnecessarytoprotectorad-

vancetheinterestsofI.B.E.W.membersonrailroads,ortoorganizeorprotecttheirjurisdiction,theI.P.isempoweredtorequiresuchcouncilstoemployafulltimegeneralchairman,orasufficientnumberofassistantgeneralchairmentocoverthejurisdictionorterritoryinvolved.Sec.10.Thegeneralchairmanofeachsuchcouncilshall

beheldresponsibletothecouncilandtotheI.P.forresultsinorganizinghisterritory,forestablishingfriendlyrelations

withrepresentativesoftherailroads,andinprotectingtheju-risdictionoftheI.B.E.W.HeshallattendallmeetingsoftheExecutiveBoardofthecouncil.Itshallbehisresponsibilitytokeepaccuratestatistics—ortoseethatsuchstatisticsarekept—asrequiredbytheI.P.,andtocooperatefullywiththeResearchDepartmentoftheI.B.E.W.Whereacouncilhasmorethanonegeneralchairman,or

representative,oneshallbeelectedtobeinfullcharge.Heshall appoint any additional general chairmen, representa-tivesorassistants,andtheseshallworkdirectlyunderhimandbesubjecttohisauthority.Hemaydischargethematanytime.Whenarepresentativeorassistantisdismissedbythegeneralchairman incharge,heshallnotbe reemployedorpaidbythecouncilinanycapacityduringthetermofofficeofthegeneralchairmaninchargewithouthisconsent.Sec. 11.The officers, general chairmen, and representa-

tivesofsuchcouncilsshallbeguidedandgovernedbythesame rules—where such apply to them—which guide andgovern theofficersandrepresentativesof theL.U.’sof theI.B.E.W.Sec.12.TheI.P.has thepoweratany time toenterany

situationorcontroversyinvolvingacouncil,andhisdecisionshallbeacceptedbysuchcouncilanditsofficers,subjecttoappealtotheI.E.C.andI.C.

ARTICLE XV RULES FOR LOCAL UNIONS

Sec.1.NoL.U.shallmeetmorethantwicemonthlyunlessspecificallycalled.Specialmeetingsmaybecalledonlybythebusinessmanager,railroadgeneralchairman,ortheL.U.ExecutiveBoard.

Sec.2.EachL.U.shalladjournitsmeetingsnotlaterthan11p.m.prevailingtime,andnoothermeetingsshallbeheldon thesamedayornight.Anyaction takenafter thishourshallbenull andvoid.Anyonepresidingover themeetingshallbeheldpersonally liableand subject topenalty fromthe I.P. forpermittingviolationof thisprovision. (WhenaL.U.’smembersareengaged inoperationsofacontinuousnature, and it is impossible or impractical to complywiththeaboveprovision,theI.P.maygrantspecialdispensationinsuchcases.)

Sec.3.AnyL.U. failing toholda regularmeeting foraperiodofonemonthshallforfeititscharter,unlessitshowsgood cause for not doing so. Seven (7)members in goodstandingshallconstituteaquorumprovidedtheL.U.hasamembershipofseventyfive(75)ormore.IftheL.U.haslessthanseventyfive(75)members,thenfive(5)shallconstituteaquorum.

Sec. 4. L.U.’s shall affiliate, or shall not affiliate, withstate,provincial,centralortradescouncilsorbodies,asde-cidedbytheI.P.

Sec. 5. No L.U. shall allow anymemberwho becomesanelectricalemployer,apartnerinanelectricalemployingconcern,ageneralmanager,orothermanagerialposition,toholdofficeintheL.U.orattendanyofitsmeetings,orvoteinanyelectionofaL.U.TheL.U.mayallowsuchamembertocontinuehismembershipintheL.U.,orthemembermayapplytotheF.S.forawithdrawalcard.Itshallrequireama-jorityvoteatameetingtograntsuchcard.ButtheL.U.hastherighttorequiresuchamembertotakeoutawithdrawalcardifitsodecides.

Sec.6.L.U.’sareempoweredtomaketheirownbylawsandrules,buttheseshallinnowayconflictwiththisConsti-tution.Whereanydoubtappears, thisConstitutionshallbesupreme.Allbylaws,amendmentsandrules,allagreements,jurisdiction,etc.,ofanykindornature,shallbesubmittedtotheI.P.forapproval.NoL.U.shallputintoeffectanybylaw,amendment,ruleoragreementofanykindwithoutfirstse-curingsuchapproval.AlltheseshallbenullandvoidwithoutI.P. approval.The I.P. has the right to correct any bylaws,amendments,rulesoragreementstoconformtothisConsti-tutionand thepoliciesof the I.B.E.W.BylawamendmentsshallbesubmittedtotheI.V.P.ofthatdistrict,whowillfor-wardthemtotheI.P.withhisrecommendations.Thenumberofcopiesofagreements,andthemethodoftheirsubmission,shallbedeterminedbytheI.P.ApprovalofL.U.collectivebargainingagreementsbythe

I.P.doesnotmake the International aparty to suchagree-mentsunlesstheI.P.specificallystatesinwritingthattheIn-ternationalisapartytoanysuchagreement.Sec.7.ThisConstitutionandtheruleshereinshallbecon-

sideredapartofallL.U.bylawsandshallbeabsolutelybind-ingoneachandeveryL.U.member.Sec.8.AllL.U.bylawsorrulesinconflictwiththisCon-

stitutionandtheruleshereinarenullandvoid.Sec.9.ExceptwhendecidedotherwisebytheI.P.,agree-

mentsbetweenL.U.’sandemployersmustcontainacondi-tionthattheL.U.ispartoftheI.B.E.W.andthataviolationorannulmentofanagreementwithanyL.U.annulsallagree-mentsentered intowith thesameemployer,corporationorfirmandanyotherL.U.oftheI.B.E.W.

Sec.10.AllL.U.’sshallbecompelledtoliveuptoallap-provedagreementsunlessbrokenorterminatedbytheotherpartyorparties,whichfactshallfirstbeascertainedbytheI.P.NoagreementofanykindornatureshallbeabrogatedwithoutsanctionoftheI.P.Sec. 11. No L.U. shall allow its members to work for

anyemployer indifficultywith itoranyotherL.U.of theI.B.E.W.,ordirectlywiththeI.B.E.W.,providingtheI.P.hasrecognizedsuchdifficulty.Sec. 12. No L.U. shall cause or allow a stoppage of

workinanycontroversyofageneralnaturebeforeobtain-ingconsentoftheI.P.TheI.P.,orhisrepresentative,hasthepoweratanytimetoenteranysituationorcontroversyinvolvingaL.U.oranyofitsmembers,andthedecisionof the I.P., direct or through his representative, shall beacceptedbytheL.U.anditsofficers,subjecttoappealtotheI.E.C.andI.C.Sec.13.NoL.U.’sshallbyanyaction,law,rule,agree-

ment or understanding, refuse to furnish members to, orpreventtheirmembersworkingforoutsideemployerswhohaveworkwithintheirjurisdiction,underthesamework-ingconditionsandwagesthattheL.U.membersworkforlocalemployers,providedthatsuchoutsideemployersrec-ognize the I.B.E.W. as the collectivebargainingagentontheirotherwork.Sec.14.EachL.U.hasthepowertoadopt,orsubscribeto,

anapprenticeshipsystem,trainingprogram,orhelperrules,astheconditionsmayrequire.However,suchshallnotcon-flictwithapplicablestandardsorpoliciesoftheI.B.E.W.ortowhichitisaparty.

Aftersuchanapprenticehasworkedoneyear in the ju-risdictionoftheL.U.,heshallbeadmittedintotheI.B.E.W.throughtheL.U.withoutfurtheractionbytheL.U.Apprentices,helpersandgroundmenmayormaynothave

avoiceandvoteatL.U.meetingsorelectionsas theL.U.decidesandasprovidedintheL.U.bylaws.Noapprentice shall be eligible tohold anyoffice in the

L.U.,exceptthatamemberwhowaspreviouslyeligibletoholdofficeintheL.U.shallremaineligibleifheenteredanapprenticeship program for the purpose of upgrading hisclassification.Sec.15.EachL.U.shallhaveasafetyandhealthcommit-

teewhichshall:investigateandreportseriousaccidentsandfatalities;cooperatewiththeI.O.onsafetyandhealthmat-ters; promote safety and health; and cooperatewith safetyandhealthorganizationsasdeterminedby theL.U.andasdirectedbytheI.O.EachL.U.shallinvestigateandreporttotheI.O.allseriouslosttimeaccidentsandfatalities.Reportsshall be submittedusing theweb-based, electronicversionofForm173I.B.E.W.ReportofOccupationalInjury,IllnessorFatality.Nothinginthissection,orintheactivitiesofthesafetyandhealthcommittee,isintendedtocreateanyrightorobligationenforceablebyindividualmembersoremployeesagainsttheL.U.,theI.B.E.W.ormembersofthecommittee.Sec.16.EachL.U.shallestablishtheamountofitsadmis-

sionfeesubjecttoapprovaloftheI.P.SuchfeesmustbestatedintheL.U.bylaws;andincaseofadispute,thefeesrecordedinthebylawsshallbeconclusiveofthecorrectamount.Sec.17.InnocaseshallaL.U.chargeanymemberofthe

I.B.E.W.anexaminationfee.

Sec.18.NoL.U.shallsendout,orapprovethesendingoutof,financialappealsofanykindwithoutfirsthavingconsentoftheI.P.NoL.U.shallrecognizeorpassuponanyfinancialappeals,etc.,itmayreceivewithoutsuchappealshavingre-ceivedapprovaloftheI.P.Sec.19.WhenevertheI.P.deemsitnecessarytoprotector

advancetheinterestsofaL.U.andtheI.B.E.W.,ortoorga-nizeandprotectitsjurisdiction,theI.P.mayrequiretheL.U.toemployasufficientnumberofrepresentativestocoverthejurisdictionorterritoryinvolved.Sec.20.RailroadL.U.’sshalljoinRailroadSystemFed-

erationsandSystemCouncilswheresuchareformed.Rail-roadL.U.’smustcontributetothesupportofandconformto the laws ofRailroadCouncilswhere such are formed.RailroadL.U.’sshallcooperate in themannerdirectedbytheI.P.Sec.21.L.U.’soutsidetherailroadindustrymayformSys-

temCouncilsforbargainingpurposes,withapprovaloftheI.P.,andshalldosowhendirectedbytheI.P.Whereformed,theL.U.’saffectedorinvolvedshallaffiliate,andremainso,andshallpayforthesupportof,andconformtotheapprovedbylawsof,suchSystemCouncils.The I.S.T. shall grant a charter to such SystemCouncil

whenauthorizedbytheI.P.Thetypeofworkandtheterri-toryorjurisdictioncoveredbythechartermustbedefinedintheapprovedbylaws.EachdelegatetotheSystemCouncilshallbeelectedinthesamemannerasaretheofficersoftheL.U.herepresents.SuchSystemCouncils,andtheirofficersandrepresenta-

tives,shallbesubjecttoandbegovernedbythesamerules

andlaws(wheresuchapplytothem)asappearinthisCon-stitutionforL.U.’s.Sec.22.NoL.U.shallwithdrawfromtheI.B.E.W.ordis-

solveas longasfive (5)members ingood standingobjectthereto.Beforewithdrawal,writtennoticemustbegiventotheI.P.,andallbooks,papers,charters,fundsandallprop-ertyaretobeforwardedtotheI.S.T.Sec. 23. L.U.’s, Railroad Councils or System Councils

whosechartershavebeen revokedor suspended forviola-tion of this Constitution, or for noncompliancewith deci-sionsrenderedbyproperInternationalauthority,shallhavenorightorpowertotakeanyaction,exceptactionsnecessaryto comply with the Constitution or decisions rendered byproperI.B.E.W.authority.Aftersuchactionhasbeentaken,nofurtheractioncanbetakenuntilnoticefromtheI.P.isre-ceivedthattherevocationorsuspensionhasbeenterminated.Sec.24.NoL.U.,oritsofficers,employeesorrepresenta-

tives,isauthorizedtoactonbehalfoftheI.B.E.W.,orshallbe deemed an agent of the I.B.E.W., except upon specificauthorizationgrantedbytheI.P.Sec.25.TheExaminingBoardshallsupervisetheexami-

nation of all applicants formembership to determine theirqualificationsforthetrade,exceptforthoseselectedasap-prenticesunderprovisionsofthecollectivebargainingagree-ment.TheyshallreviewsuchqualificationsofmembersasprovidedinArticleXIXofthisConstitution.TheBoard shallmeet at least quarterly to supervise the

examination of applicantswhen there are applicants to beexamined.TheBoardshallretainallrecordsofexaminationsgivenforatleasttwo(2)years.

Thereportontheresultsofallexaminationsshallbefur-nishedtotheExecutiveBoardandtheL.U.bytheExaminers.

Parliamentary Rules

1.Thechairmanmaysavetimeindecidingcertainques-tionsbyaskingifthereareanyobjections.Iftherearenone,heshalldeclareanactionadopted.2.HeshallnotallowanymemberoftheL.U.tospeakmore

thanonceonthesamesubjectuntilallmembersdesiringthefloorhavespoken,andnotmorethantwice,andnotmorethansevenminutesatanyonetime,exceptthosemakingreports.3.Sectariandiscussionsshallnotbepermittedunderany

circumstances.4.Whenmembersdesirealltalkordebatestoppedanda

votetaken,theymaycallforthepreviousquestion.Whenthisisdoneitshallbeputtoavoteatonceinthisform:“Shallalldebatebeclosedandthemainquestionvotedupon?”Ifthiscarriesbyamajorityvote,thenavoteshallbetakenatonceonthequestionbeforethemeeting.5.Anappealmaybe takenat themeetingonanyruling

ofthechairman,butnotwhenaquestionoflawisinvolved.Whenanappealistakentothemeeting,thechairmanshallstateitinthesewords:“Shallthedecisionofyourchairmanbeupheld?”Themembermakingtheappealshallthenstatehisgroundsand thechairmanshallgive the reason forhisdecision.Thevoteshallthenbetakenwithoutfurtherdebate.6.Aquestioncanbereconsideredonlyatthesamemeet-

ing or at the next regularmeeting. If reconsidered at thesamemeeting,amajorityvoteissufficient.Ifreconsideredatthenextmeeting,atwothirdsvoteisrequired.Amotion

toreconsidermustbemadeandsecondedbytwomemberswhovotedwiththemajority.7.Amotioncanbeamendedonlytwice.8. If a motion has been amended, then the amendment

shallbevoteduponfirst. Ifmorethanoneamendmenthasbeenoffered,thenthevoteshallbefirstontheamendmenttotheamendment;nextontheamendmenttothemotion;andlastontheoriginalmotion.9.Motionstolayonthetable,ortoreadapaperordocu-

ment,ortoadjourn,arenotdebatable.10.Allresolutionsandresignationsmustbesubmittedin

writing.11.All other parliamentary questions not decided in these

rulesshallbedecidedbyRobert’s Rules of Order Newly Revised.

ARTICLE XVI OFFICERS OF LOCAL UNIONS

Sec.1.EachL.U. shallhaveapresident,vicepresident,recordingsecretary,financialsecretary,treasurer,andExecu-tiveBoardofnotmorethanseven(7)norlessthanthree(3)members,providedthatwheredeemednecessaryforbetterrepresentationintheL.U.,theExecutiveBoardmay,withtheconsentoftheI.P.,havemorethanseven(7)membersand,iftheL.U.sodecides,anExaminingBoardofnotmorethanfive(5)norlessthanthree(3)members.ThemembersoftheExaminingBoardareelected,howevertheyarenotconsid-eredlocalunionoperatingofficers.Sec.2.L.U.’srequiringalocalbusinessrepresentativeor

representatives,shallelectone(1)persontobeknownasa

businessmanager.Heshallappointanyandallotherrepre-sentativesorassistants.Theseshallworkdirectlyunderhimandbesubjecttohisauthority.Hemaydischargethematanytime.Whenarepresentativeorassistantisdischargedbythebusinessmanager,heshallnotbereemployedorpaidbytheL.U.inanycapacityduringthetermofofficeofsuchbusi-nessmanagerwithout his consent.However, this does notdisqualify any discharged assistant or representative fromrunningforofficeatthenextelection.ThebusinessmanagershallbetheprincipalofficeroftheL.U.andallotherL.U.officersshallcooperatewiththebusinessmanagerandshallnotworkinconflictwithhim.Sec.3.EachL.U. shall alsohaveapress secretary, reg-

istrarandasmanyinspectorsanddoorforemenastheL.U.presidentdeemsnecessary.Theseshallnotbeconsideredof-ficersandshallbeappointedbythepresident.Theyshallper-formsuchdutiesashedirects.Hemayremoveanyofthemandappointothersatanytime.Sec.4.Nootherlocalofficesshallbecreatedwithoutcon-

sentoftheI.P.Sec. 5. No L.U. shall combine the office of financial

secretary and treasurer unless by special dispensationfromtheI.P.Sec. 6. In each L.U. whose members participate in the

PensionBenefitFund,nomembershallbeeligibletoserveasF.S.unlessheisalsoaparticipantinthePensionBenefitFund,unlessthisrequirementiswaivedbytheI.P.Sec.7.NoL.U.shallallowduestoofficersorappointees

forservicesrendered,buttheL.U.mayfixsuchsalariesforthemasitdecides.

Sec.8.Theofficersshallserve three-or four-year termsastheL.U.bylawsmayprovide,oruntiltheirsuccessorsarequalified.Sec.9.Nominationsforofficersshallbeheldinthemonth

ofMay of election years as provided in the L.U. bylaws.However,theI.P.maygrantspecialdispensationtoholdthenominationsinadifferentmonthwhenheissatisfiedgoodcauseisshown.Wheresuchchangeistocontinue,themonthshallbestatedintheL.U.’sbylaws.Anymembernominatedcanwithdrawhisnameanytimepriortotheelection,eitherbyannouncementatthemeetingoftheL.U.orbynotifyingtheL.U.presidentinwriting.Sec.10.Nomembershallbenominatedforofficeunless

heispresentorsignifieshiswillingnessinwriting,norshallhebeeligibleforanyofficeunlesshehasbeenamemberincontinuousgoodstandingatleasttwo(2)yearsintheL.U.immediately prior to nomination, providing the L.U. hasbeeninexistenceforthislengthoftime.Whenitisimprac-ticableorimpossibleforaL.U.toelectofficerswiththere-quiredstanding,theI.P.maygrantspecialdispensation.Thetwo-yearmembershiprequirementshallnotbeappli-

cabletomembersofL.U.’saffiliatedwithSystemCouncils,who are employed by a single employer andwho transferbetweenL.U.’swithinaSystemCouncil,provided,however,thatanysuchmembermusthavebeenamemberincontinu-ous good standing for two (2) years in at least one of theL.U.’saffiliatedwiththeSystemCouncilinvolved.Sec. 11.TheL.U. shall decide themanner inwhich the

nominations and election shall be held, and such shall bestated in the L.U. bylaws.This shall not conflictwith the

I.B.E.W.Constitution.Thereshallbeonejudgeandasmanytellersasarerequired,andthemethodofselectionshallbestatedintheL.U.bylaws.Nomembershallserveasanelec-tionjudgeortellerunlesshehasbeenamemberincontinu-ousgoodstandingatleasttwoyearsintheL.U.Sec.12.Electionsofofficersshallbeheldinthemonthof

JuneofelectionyearsasprovidedintheL.U.bylaws.How-ever,theI.P.maygrantspecialdispensationtoholdtheelec-tionsinadifferentmonthandtoextendthetimeforconduct-ingtheelectionswhenheissatisfiedgoodcauseisshown.Wheresuchchangeistocontinue,themonthshallbestatedintheL.U.’sbylaws.EachL.U.shallsetadefinitedateandtimefortheelections.Allelectionsshallbedecidedforthecandidatereceivingthe

mostvotes,unlessthelocalunionbylawsprovideotherwise.However,electiontotheL.U.ExecutiveBoardorExamin-

ingBoardshallbedecidedforthecandidatesreceivingthemostvotes.Whereamajorityofthevotescastisrequiredandnocandidatereceivessuchmajority,arunoffelectionwillbeheldbetweenthetwocandidatesreceivingthehighestnum-berofvotes.ThetimeforholdingarunoffelectionshallbestatedintheL.U.bylaws,whereamajorityvoteisrequired.Sec.13.Theinstallationofofficersshalloccuratthefirst

meetingheld inJulyfollowingtheelections.However, theI.P.maygrant special dispensation for adifferent time fortheinstallationofofficerswhenheissatisfiedgoodcauseisshown.Whensuchdispensationisgranted,thetimeshallbestatedintheL.U.’sbylaws.Sec.14.Anyofficer failing todischarge thedutiesofhis

office for two (2) consecutivemeetings, unless satisfactory

excuseisgiveninwriting,shallhavehisofficeorpositionde-claredvacantbytheL.U.president,andtheExecutiveBoardshallthenfillsuchvacancyuntilthenextregularelection.Sec.15.Whenitisdecidedbyproperauthority,andinac-

cordancewiththeselaws,thatanyL.U.officershallbesus-pendedorremovedfromoffice,thentheL.U.presidentshallatoncedeclaresuchofficevacant.Ifthisappliestothepresi-dent,thenthevicepresidentshalldeclarehisofficevacant.Sec.16.Vacanciesoccurring inanyL.U.office,and the

Examining Board, shall be filled by the L.U. ExecutiveBoarduntilthenextregularelection,exceptwhenfilledbytheI.P.Theeligibilityrequirementsforelectiontotheofficeshallapply.Vacanciesinthepositionofpresssecretary,reg-istrar,doorforeman,orinspectorshallbefilledbytheL.U.president.Sec.17.Duringthetemporaryabsenceofanyofficer,the

fice,shalldelivertotheirsuccessorsallbooks,papers,mon-ey and other property in their possession belonging to theI.B.E.W.ortheL.U.andshallnotberelievedfromtheirbondorobligationuntilthishasbeendone.Sec.19.Allofficers, appointeesor employees shall turn

overallbooks,papersandpropertyoftheL.U.intheirpos-sessiontotheI.P.orhisrepresentativeuponhisdemand.

Sec.20.NoofficerofaL.U.,RailroadCouncilorSystemCouncilshallimproperlyuse,orallowanyonetoimproperlyuse,themailinglistofmemberstocommunicatewiththemregardingunionpoliticsorcandidatesforunionoffice.Anyofficerhavingsuchalistshallbeheldpersonallyliableforitsmisuse.

ARTICLE XVII DUTIES OF LOCAL

UNION OFFICERS

President

Sec.1.TheL.U.Presidentshallbeheldresponsibleforthestrictenforcementof thisConstitutionand the ruleshereinandtheL.U.bylaws.Heshallbeheldpersonallyliableandsubject topenaltyby theI.P. for failure toconductorderlymeetingsorfailuretocarryouttheresponsibilitiesanddutiesimposeduponhimherein.Heisempoweredandshalldoasfollows:(a)Presideatallmeetingsof theL.U.andsee thateach

meetingispromptlyadjournednotlaterthan11p.m.prevail-ingtime.Whenhedeemsitnecessarytopreserveorder,heshallappointmemberstoaidhimindoingsoandincarryingouthisrulings.(b)Heshallpromptlyhaveremovedfromthemeetingroom

anyintoxicatedmember,anydisturber,oranyonenotconduct-inghimselfinanorderlyway,oranyonewhodisturbsthehar-monyorpeaceofthemeeting,orwhofailspromptlytoabidebyhisrulingsortheactionofthemeeting.Heshallsuspendfrom attendance at anymeeting anymemberwho commitsanyoftheseoffenses,forthebalanceofsuchmeeting,andhe

shallseetoitthatsuchmembershallnotbeallowedtoreenterthemeetingfortheremainderofthemeeting.Hemayrepeatthesentenceofsuspensionatanysubsequentmeetingatwhichanoffenderpersistsinsuchconduct.(c)Heshalldecideallquestionsoforderaccordingtothe

parliamentaryrulesstatedherein,andhavethedecidingvoteincaseofatie,andseethatallassessmentsarepaidandallpenaltiesenforced.(d)He shall appoint all committees, act as anex-officio

memberofallcommittees,appointalldelegatestocentral,trades,andpoliticalcouncilsorbodies,withwhichtheL.U.isaffiliated.WheretheL.U.hasabusinessmanager,thenheandanyofhisassistantsshallbenamedbythepresidentasdelegates to theBuildingandConstructionTradesCounciland to theMetalTradesCouncil; andhe shall appoint theregistrar as delegate to conferences of bodies on politicaleducationandactivitywithwhichtheL.U.isaffiliated.Thepresidentshallconsultandcooperatewiththebusinessman-ager(wheretheL.U.hasone)onallappointments.(e)Heshallseethatallcommitteesperformthedutiesas-

signedtothemwithinareasonabletime.Heshallpromptlyremove any committeemember not performing his dutiesandappointanother.Heshallseethattheregistrarpromotespoliticaleducation

andactivityasdeterminedbytheL.U.,keepssuchrecordsas are found to be necessary to encourage allmembers toregister and vote, and keeps themembership informed oncandidatesworthyofsupportandpendinglegislationofvitalimportancetothecountry,thecommunity,andthemembersoftheL.U.

(f)Heshalleitherappointanauditingcommitteeofthreemembers, or he or the L.U. ExecutiveBoard, as the L.U.decides, shall employ a public accountant to reconcile thebooksandaccountsoftheL.U.everythreemonths.Heshallinspect thebankbookorbooksof the treasurer tosee thatL.U.moneysturnedovertothetreasurerhavebeenproperlyandpromptlydepositedinthenameoftheL.U.Inaddition,heshallemployacertifiedpublicaccountant

to perform an annual independent audit of the books andaccountsoftheL.U.,inaccordancewithU.S.generallyac-cepted auditing standards or their international equivalent;provided,however,shouldtheL.U.believeitwouldbecostprohibitivetoconductsuchanannualindependentaudit,theL.U.canrequestawaiverfromtheI.S.T.(g)HeshallseethatallfundsoftheL.U.aredepositedin

areputablebankorbanksin thenameof theL.U.,subjecttowithdrawalbychecksignedinthenameoftheL.U.andcountersignedbythepresidentandtreasurer,andseethatnodisbursements aremade except on an order countersignedbytheR.S.andhimselfafteractionoftheL.U.However,noactionoftheL.U.isnecessarytopayregularorstandingbillssuchasrent,salaries,andpaymentsduetheI.S.T.(h)He shall notify inwriting anybank, or all banks, in

whichtheL.U.makesdeposits,thattheL.U.empowerstheI.P.tostopwithdrawalofanyL.U.fundswheninthejudg-mentoftheI.P.suchactionisnecessarytoprotecttheL.U.anditsmembers.Heshallnotifysuchbankorbanksthattheyare tohonor andabideby anynotice from the I.P. to stopwithdrawalsshouldtheoccasionarise.HeshallsendtotheI.S.T.acopyofsuchletterornoticetoanybankorbankstobemadeamatterofrecord.

(i)HeshallseethattheamountofbondsontheL.U.of-ficersandemployeesissufficienttoprotecttheL.U.againstanyloss.Theminimumbondshallbe$5,000,andthebondsaretobemadethroughtheI.O.(j)He shall cooperatewith the businessmanager of the

L.U.,iftheL.U.hasone,andshallnotworkinconflictwithhim.Where the L.U. has no businessmanager, the dutiesnormallyperformedby thebusinessmanager shallbeper-formedbythepresident,whoisthenbothpresident/businessmanager,exceptwheretheL.U.isaffiliatedwithaRailroadSystemCouncilorhasaGeneralChairman.Thepresidentshallkeepaccuratestatistics,orseetoitthatsuchstatisticsasrequiredbytheI.P.arekeptbytheF.S.orpersondesignated,andshallcooperate fullywith theResearchDepartmentoftheI.B.E.W.Heshallperformsuchotherdutiesasareprescribedhere-

in,ormaybeassignedtohimbyhisL.U.whensuchdutiesarenotinconflictwiththisConstitutionandtheserules.

Vice President

Sec.2.Thevicepresidentshallassistthepresidentinthedischargeofhisdutiesandshallfillhisplaceincaseofthepresident’sabsenceandperformsuchotherdutiesasarere-quiredbythisConstitutionandthebylawsoftheL.U.

Recording Secretary

Sec.3.TheR.S.shallkeepcorrectminutesofeachmeetingof theL.U.,answerallcorrespondence inaccordancewithinstructionsgivenhimbytheL.U.orthepresident,makeoutallordersonthetreasurerforthepaymentofauthorizedbills,notifytheI.S.T.ofallchangesinofficersgivingnamesand

addresses,andperformsuchotherdutiesasaredirectedbythepresidentorrequiredbythisConstitutionandthebylawsoftheL.U.

Financial Secretary

Sec.4.TheF.S. shallkeepsuchbooksand records, andissuesuchreceipts,asarerequiredorapprovedbytheI.S.T.Hemay,whennecessary andwhen approvedby theL.U.,employanassistantorassistants.HeshallberesponsibleforallmoneyscollectedbytheL.U.untilsuchfundsareturnedovertothetreasurerordepositedintheL.U.’sbankaccountwithout delay.When he deposits any L.U. funds, he shallfurnishthetreasurerwiththebankrecordofallsuchdepositsnotlaterthanthecloseofthemonth.HeshallmakeknowntotheL.U.thereceiptsreceivedatsuchtimeastheL.U.de-cides.HeshallmailtotheI.S.T.thepercapitareport,andthemoneydue,bythetenth(10th)ofthemonth,unlessspecialarrangementswith the I.S.T. aremade. (TheL.U. shall beresponsibletotheI.S.T.forsuchpayments.)IftheF.S.failstodothisasrequired,theL.U.maybeassessedanamountdeterminedappropriatebyapolicydevelopedbytheI.S.T.Heshallkeepa recordofeachmember, thefullnameandaddress, and notify the I.S.T. of all suspended or expelledmembers.Sec.5.TheF.S.ofeachRailroadL.U.shallalsocollectall

moneysandfeesdueRailroadSystemCouncils,andforwardthesetothecouncilsecretaryonorbeforethetenth(10th)ofthemonth.HeshallmakereportsonofficialtriplicateformsprovidedbytheI.S.T.,sendingonetothecouncilsecretary,onetotheI.S.T.,andkeepingonefortheL.U.records.Heshallalsosendonorbeforethetenth(10th)ofthemonth,a

listgivingthecompletestandingofmembers,showingmem-bersadmitted,thoseleavingwithTravelingCards,suspended,expelledordroppedfromtherolls,andthosenotworking.Sec.6.TheF.S.shallsubmithisbooksandrecordsforin-

spectionorauditwhencalleduponbytheI.P.,theI.S.T.,theL.U.president,orExecutiveBoard.

Treasurer

Sec.7.ThetreasurershallreceivefromtheF.S.allmoneyscollectedorthebankrecordofmoneydepositedintheL.U.’sbankaccountandgiveproperreceiptforthesame.Heshalldeposit allL.U.moneys turnedover to himby theF.S. inabankorbanksdesignatedbytheL.U.inthenameoftheL.U.HeshallmakenodisbursementswithoutsanctionoftheL.U.,exceptforpaymentsofregularorstandingbillssuchasrent,salariesandpaymentstotheI.S.T.whichdonotrequireavoteoftheL.U.anduponanorderorwarrantsignedbythepresidentandtheR.S.HeshallmakeanitemizedstatementtotheL.U.asandwhenrequiredbytheL.U.orthepresident.HeshallsubmithisbooksandrecordsforinspectionorauditwhencalleduponbytheI.P.,theI.S.T.,theL.U.presidentorExecutiveBoard.

Business Manager (WhereaLocalUnionhasone)Sec. 8. The business manager shall be the principal

officer of the L.U. and shall be held responsible to theL.U.andtotheI.P.forresultsinorganizinghisjurisdic-tion, for establishing friendly relations with employers,andforprotectingthejurisdictionoftheI.B.E.W.Itshallbehisresponsibilitytokeepaccuratestatistics,ortoseethat such statistics as required by the I.P. are kept, and

shallcooperatefullywiththeResearchDepartmentoftheI.B.E.W.Thebusinessmanagerorhisdesigneeshallserveasapermanentmemberofthenegotiatingcommitteeandserveasa trusteeonall trustfundsof theL.U.providedfor in the collectivebargaining agreements.He shall at-tendallmeetingsoftheL.U.ExecutiveBoardandhaveavoicebutnovote.Heshallhavesuchauthorityandper-formsuchotherdutiesasareprovidedinthisConstitutionormaybeprovidedforintheL.U.bylaws.

Executive Board

Sec.9.TheL.U.ExecutiveBoardshallmeetbetweenreg-ularmeetingsoftheL.U.ItshallhavethepowertotakeanyactionthattheL.U.cantake,andwhichshouldbetakenpriortothenextregularmeetingoftheL.U.Mattersreferredtotheboardby thebusinessmanager,oranyofhisassistants,orthegeneralchairmanofaRailroadCouncil,shalltakeprece-denceoverallothermattersbeforetheboard.Sec.10.Aquorumoftheboardshallconsistofthemajor-

ityofitsmembers.Sec.11.Theboardshallseethatallmembers,officers,or

otherswhoarenotentitledtoremainintheboardmeetings,shallretireaftertheyhavebeenheardandsubmittedtheirbusi-nesstotheboard.Whenaboardmemberisdirectlyinterestedorinvolvedinanycasebeforetheboard,heshallretire.Noboardmembershallsitinacasewhichaffectshisown

employer,orwhichinvolvesamemberworkingforthesameemployer.Insuchcasetheboardmembershallbedisquali-fiedandthepresidentoftheL.U.shallappointasubstituteorsubstitutes.Ifthepresidentisamemberoftheboardandis

disqualified,thenthevicepresidentshallappointasubstituteorsubstitutes.Ifthevicepresidentisalsodisqualified,thenthesubstituteorsubstitutesshallbenamedbytheremainingboardmembers.ThatportionofthisparagraphwhichreferstoanemployershallnotapplytothoseL.U.’swhereatleastseventyfivepercent(75%)ofthemembershipisintheem-ployofoneemployer.Sec.12.TheExecutiveBoardshallactasthetrialboard,

hearallcharges,andtryallmembers,exceptofficersandrep-resentativesofL.U.’s,RailroadCouncils,andSystemCoun-cils,foranyviolationofthisConstitution,orthebylawsandworkingrulesoftheL.U.(SeeArticleXXV.)Theboardmayreopenandreconsideranycaseorcases

when it feels the facts or circumstances justify doing so,anytimewithinthirty(30)daysfromthedatethedecisionwasrendered,anditshalldosowhendirectedbytheI.V.P.orI.P.Sec.13.Theboardshallsubmitareportofitsactionsand

findings to each regularmeeting of theL.U. for approval,exceptthatnoapprovalordisapprovalistobemadeoractiontakenbytheL.U.,norisanydiscussiontobeallowedwhentheboardreportsonthecasesofmemberschargedwithvio-lationsofthisConstitution,orthebylawsandworkingrulesoftheL.U.Sec.14.TheExecutiveBoardshallcooperate fullywith

otherofficersandtherepresentativesoftheL.U.totheendthattheinterestsoftheL.U.anditsmembersmaybeprop-erlyprotectedandadvanced.TheboardshallperformsuchotherdutiesasareoutlinedinthisConstitutionorasmaybeprovidedforinthebylawsoftheL.U.

ARTICLE XVIII DUES–ASSESSMENTS–FUNDS

Sec. 1. L.U.’s shall collect dues from members eithermonthly or quarterly in advance. The L.U. monthly duesshallbenotlessthanfiftycents($.50)inadditiontoappli-cablepercapitaandassessmentsduetheI.O.Sec.2.Allassessments imposedshallbechargedby the

F.S. against themember as regular dues andmust bepaidwithinthetimerequiredtoprotectthemember’scontinuousgoodstandingandbenefits.Sec.3.NoassessmentshallbeleviedbytheL.U.except

byamajorityvoteof thememberspresent,andnoassess-mentcanbeordereduponthenightofitsintroduction,butmustbelaidoverforatleasttwoweeksforconsideration.Sec.4.Alldisbursementsmustbeonanorderdrawnon

thetreasurersignedbythepresidentandrecordingsecretary.However,noactionoftheL.U.isnecessaryforpaymentofregularorstandingbillssuchasrent,salaries,andpaymentstotheI.S.T.Sec.5.ThefundsandpropertyofaL.U.shallbeusedonly

forsuchpurposesasareapprovedbytheI.P.,orasarespeci-fiedinthisConstitutionandasmaybenecessarytotransact,properlymanageandconductitsbusiness.Sec.6.Thefundsandpropertycannotbedividedamong

themembersindividually,exceptintheformofsuchbenefitsasmaybeprovidedbytheL.U.afterapprovaloftheI.P.Sec.7.Thefundsandpropertyareforthelegitimatepur-

poses of the L.U. while five (5)members remain therein.ShouldaL.U.finallydissolve,itscharter,books,papersandfundsshallatoncebeforwardedtotheI.S.T.

ARTICLE XIX QUALIFICATIONS OF MEMBERS

Sec.1.AnyworkercomingundertheI.B.E.W.’sjurisdic-tion, ofgoodcharacter, not less than sixteen (16)yearsofage,iseligibleformembership,providedhepassesasatis-factoryexaminationwhenrequiredtodosobytheL.U.Sec.2.If,afterbeingadmittedtomembership,it islater

foundupon investigation that amember is not sufficientlyacquaintedwiththebranchortypeofworkonwhichheisengagedtoearnorcommandtheestablishedwages,thenaL.U.can,throughitsExecutiveorExaminingBoardoranes-peciallyappointedcommittee,requiresuchmembertoreverttotheproperapprenticegradeandpayrate,toattendelectri-cal study classes or devote time toward becoming a com-petent,properlyinformedelectricalmechanicoremployee.

ARTICLE XX ADMISSION OF MEMBERS

Sec.1.NoL.U.canadmitanapplicantwhodoesnotresidein,orwhoisnotemployedatthetrade,inthejurisdictionoftheL.U.,unlesstheL.U.isdirectedtoadmithimbytheI.P.No L.U. can admit any applicant who formerly was a

memberoftheI.B.E.W.,orwhowassuspendedorexpelledby,orindebtedtoanyL.U.,withoutconsentoftheI.S.T.andwithoutfirstconsultingthelastL.U.ofwhichtheapplicantwasamemberinregardtohischaracterandrecord.TheI.P.shalldecideanycaseindispute.NoL.U.canadmitanyapplicantformembershipwhoisa

memberofanotherL.U.exceptasatravelerundertheprovi-sionsofArticleXXIII.NopersonmaybeamemberofmorethanoneL.U.atanyonetime.

Sec.2.Eachapplicantformembershipshallfilloutanap-plicationblankfurnishedorapprovedbytheI.S.T.,andan-swerallquestions.TheoriginalapplicationoracopymustbesenttotheI.S.T.Sec. 3. The acceptance of an application for member-

ship,andtheadmissionoftheapplicantintoanyL.U.oftheI.B.E.W., constitutes a contract between the member, theL.U. and the I.B.E.W., and between suchmember and allothermembersoftheI.B.E.W.Sec.4.Eachapplicantadmitted,shall,inthepresenceof

membersoftheI.B.E.W.,repeatandsignthefollowingob-ligation:“I, ,inthepresenceofmembersofthe

InternationalBrotherhoodofElectricalWorkers,promiseandagreetoconformtoandabidebytheConstitutionandlawsoftheI.B.E.W.anditslocalunions.IwillfurtherthepurposesforwhichtheI.B.E.W.isinstituted.Iwillbeartrueallegiancetoitandwillnotsacrificeitsinterestinanymanner.”Sec.5.Theobligationcardsignedbytheapplicantshall

besenttotheI.S.T.TheL.U.shallhaveeachapplicant,exceptasprovidedin

Section10ofthisarticle,taketheobligationbeforearegularmeetingoroutsidetheregularmeetinginthepresenceofthepresidentorthevicepresidentorthebusinessmanagerorthebusinessmanager’sdesignatedrepresentativeortherecord-ingsecretary.Sec.6.Eachapplicantshallpaytheadmissionfeefixedby

aregularmeetingoftheL.U.Thepresidentshallappointacom-mitteetopassandreportupontheapplications,ortheExecutiveBoardmayperformthisfunctionastheL.U.maydecide.Sec.8.Iftheapplicantorapplicantsarereporteduponfa-

vorably,aballotorvotemaybetakenastheL.U.mayde-cide,exceptasprovidedinArticleXV.Ifanapplicant(s)isrejected,hisortheirnamesshallnotagainbeproposedformembershipforsix(6)months,andtheadmissionfeeshallbe returned to the applicant. If an applicant is rejected formembership and the reasons for rejection are found to bewithout justcause, theL.U.shallbedirectedby theI.P. toimmediatelyaccepttheapplicantintomembership.Sec.9.Anycandidatefailingtopresenthimselfforadmission

withinone(1)monthafterhiselectionandnotificationthereof,unlesshegivesgoodandsufficientreasons,forfeitshisadmis-sionfeeandcannotagainbeproposedforsix(6)months.Sec.10.AnyworkeroremployeecomingundertheI.B.E.W.’s

jurisdictionandresidingwherethereisnoL.U.,whocanqual-ify according to thisConstitution,may become amemberbyfillingoutaregularapplicationandsendingittotheL.U.havingjurisdiction;andifaccepted,heshallsigntheobliga-tioncardandsendittotheL.U.TheI.S.T.mayacceptsuchanapplicantdirectlyifhefeels

therearegoodreasonsfordoingso.Sec.11.Inthecaseofanorganizingcampaign,Sections7,

8and9ofthisArticlemaybewaivedbytheI.P.

ARTICLE XXI MEMBERS IN ARREARS

Sec.1.NomemberisentitledtonoticeofthemonthlyorquarterlyduesofhisL.U.,norofarrearages,butmusttakenoticewhenpaymentsaredue.Sec.2.Whenamember’sworkingcardhasexpired,heat

once,withoutnotice,standssuspendedfromallL.U.benefits.Sec.3.AnymemberindebtedtohisL.U.forthreemonths’

dues, or having anypast due indebtedness to the I.B.E.W.forduesorassessments,shallstandsuspended,andtheL.U.mayrefusetoacceptduesfromanymemberwhoisindebtedtoit.Suchmembercannotbereinstateduntilallindebtednesshasbeenpaid,unlesswaivedbytheL.U.However,duescan-notbewaived.(However, when any “BA” member is working under

an agreement requiringmonthly payment of dues, a graceperiodofonly twentyone (21)days—after thefirstof themonthfollowingtheindebtedness—shallbeallowedunlessthegraceperiodisextendedbytheL.U.involved.)Sec. 4. Any member indebted to his L.U. for six (6)

months’fullduesshallbedroppedfrommembershipbytheF.S.andcannotbecomeamemberingoodstandingagainintheI.B.E.W.exceptbyjoiningasanewmember.(However, when any “BA” member is working under

an agreement requiringmonthly payment of dues, a graceperiodofonly twentyone (21)days—after thefirstof themonthfollowingtheindebtedness—shallbeallowedbeforebeingdroppedfrommembership,unlessthegraceperiodisextendedbytheL.U.involved.)Sec.5.AmemberwhohasbeenassessedbyaL.U.trial

previousstandingintheI.B.E.W.,includinganypensionordeathbenefitspayablefromthePensionBenefitFund.

ARTICLE XXII REINSTATEMENT OF

MEMBERS

Sec. 1.Anymember suspended for being in arrears forthree(3)months,butlessthansix(6)months,mayapplyforreinstatement.Sec. 2.Anymember in arrears, if eligible for reinstate-

ment,shallpayhisL.U.allarrearagesandassessments,andreinstatement fees.“A”membersshallpaya reinstatementfeeoftendollars($10.00)and“BA”membersshallpayare-instatementfeeofthreedollars($3.00).HalfofallsuchfeesaretobesenttotheI.S.T.Inaddition,all“A”membersshallpayapensionreinstatementfeeoftwentydollars($20.00),allofwhichshallbeforwardedtotheI.S.T.forthePensionBenefitFund.Reinstatedmembersshallretaintheirformercardnumber.AnyreinstatedapplicantshallbesubjecttothelimitationsimposedbythisConstitution.Sec.3.A reinstatedmember shallnotbeentitled to any

L.U.benefitsuntilsix(6)monthsafterreinstatement.Sec.4.Reinstatedmembers’standingintheI.O.shallbe

thesameasthatofnewmembersexceptasprovidedinSec-tion5ofthisArticle.

Sec.5. Forpensionpurposesonly,an“A”membersus-pendedbecauseofanarrearageinhisdueswhoisreinstatedpursuant to theprovisionsof theConstitution, shall be re-stored to thecontinuousgoodstandingheenjoyedprior tohissuspension.

ARTICLE XXIII TRAVELING CARDS

Sec.1.AnymemberworkinginadifferentL.U.’sjurisdic-tionshallbeadmittedtoitsmeeting,providedthathepres-entshisofficialreceiptforduesshowingheisamemberingoodstandingandheidentifieshimselfastherightfulownerof such receipt, but hewill have no voice or vote at suchmeeting,exceptasrequiredbylaw.AnymembervisitingadifferentL.U.maybeadmittedtoits

meetingattheoptionoftheL.U.,providedthathepresentshisofficialreceiptforduesshowingheisamemberingoodstand-ingandidentifieshimselfastherightfulownerofsuchreceipt,buthewillhavenovoiceorvoteatsuchmeeting.Sec. 2.Anymember desiring to transfer hismembership

mayapplytotheF.S.foraTravelingCardforastatedtimenottoexceedthree(3)months.ThiscardshallbenullandvoidunlessdepositedinsomeL.U.orrenewedbytheL.U.grantingitonorbeforethedateofitsexpiration.Nofractionofamonthshallberecognized,andallcardsmustdatefromthefirstdayofthemonthandexpireonthelastdayofthemonth.Sec. 3. If amember is in continuousgood standing and

notundercharges,theF.S.shallgrantthecardwithoutavoteoftheL.U.uponpaymentofallduesinadvanceforthefulltimeforwhichthecardisgranted.

Sec.4.TheL.U.issuingthecardshallpaytheI.S.T.thepercapitaforthetimethecardholdsgood.TheL.U.shallbeheldliableforanyunpaidpercapita,premiums,assessmentsorotheritemsduetheI.O.andwhichtheF.S.neglectedtocollect.Sec.5.TravelingCardsmaynotbedepositedinanyL.U.

whichdoesnot include the typeofmembership forwhichthecardwas issued,unless themember transfers toa typeofmembership covered by the L.U. In such case he shallbegivencreditforthelastinitiationfeehepaid.NormayaTravelingCardbedepositedinaL.U.byamemberofan-otherL.U.wishingtotransferhismembership,untilandun-lessthatmemberhasbeenacceptedbytheL.U.intowhichhewishestotransfer.EachL.U.shallhavefullautonomytoacceptorrejectallrequestsfortransfers.(ExceptasprovidedinSection10.)Sec.6.Nomembershallworkinthejurisdictionofanother

L.U.untilhisTravelingCardhasbeenaccepted,orhereceivesaworkingcard,exceptbyconsentof theI.P. inspecialcases,andexceptincaseswhereL.U.’sallowtheirmemberstoworkbyagreementorunderstandinginthejurisdictionofeachother.Anymemberviolatingthisprovisionissubjecttoassess-

mentatthediscretionofthatL.U.,buttheassessmentshallnotexceedthewagesearnedbysuchmemberwhilethevio-lationcontinued.However,anymemberviolatingthework-ingrulesofanotherL.U.shallbesubjecttosuchpunishmentasdecidedbytheL.U.Sec. 7.When amember is away and sends dues to his

homeL.U.,theF.S.ofthehomeL.U.shallnotifytheL.U.ofthesamebranchofthetradeinwhosejurisdictionthemem-berislocated,givinghisname,addressandcardnumber.

Sec. 8.Amember not having five (5) years continuousgoodstandingintheI.B.E.W.shallpayanydifferenceinad-missionorinitiationfeetotheL.U.towhichheapplies.NoL.U. shall requireamember topayany suchdifferenceatagreaterratethanonedollar($1.00)adayforeachdayheworks.TheL.U.mayrequirehimtopassitsexamination.Sec.9.Nomemberofthesamebranchoftradewithfive

(5)yearsormorecontinuousgoodstandingshallberequiredtotakeanyexaminationorpayanydifferenceinadmissionfee, except when he changes his classification within thesamebranch, if theL.U.sodecides.(ThisapplieswithinaL.U.orwhentransferringtoanotherL.U.)Nomemberwithfive(5)yearsormorecontinuousgoodstanding—transfer-ringtoadifferentbranchofthetrade—shallberequiredtopayanydifferenceinadmissionfee.However,heshallpassapracticalexaminationiftheL.U.sodecides.Sec.10.NoL.U.shallrefusetoacceptpromptlythecard

ofandreadmitanymemberintohishomeL.U.providedhehasmaintainedhiscontinuousgoodstandingintheI.B.E.W.whileabsentfromtheL.U.TheL.U.whereamemberwasoriginallyadmittedintotheI.B.E.W.shallbeconsideredhishomeL.U.WhereaL.U.oranypartthereofhasbeenamal-gamatedintoanotherL.U.thatL.U.shallbeconsideredthehomeL.U.When themember has changed his classification during

thisabsence,hishomeL.U.isrequiredtoaccepthiscardandchangehisclassificationback to thesameclassificationhehadwhenhelefthishomeL.U.No L.U. shall collect any difference in admission fee

fromamemberwhowasadmittedbytheL.U.andwhohas

maintained his continuous good standing in the I.B.E.W.during his absence from the L.U., except in caseswheretheL.U.permitsachangeofclassificationonhisreturntotheL.U.,andtheL.U.hasestablishedadifferenceinfeesbetweenthetwoclassifications.Sec. 11.Themember’s dues shall begin the first of the

monthafteracceptanceofhiscard.AnyduespaidinadvanceofthisdateshallbereturnedtohimbyhisformerL.U.lessthepercapita.Sec. 12.Anymember leaving the jurisdiction of aL.U.

owingjustdebtstoitshallberequiredtopayuptotherateofnotlessthanonedollar($1.00)foreachdayworkedandshallpayupwithinsix(6)monthsofnoticeorbedroppedfrommembership. The indebtedness shall be collected bytheF.S.oftheL.U.inwhichthememberhasdepositedhiscard.InnocaseshallanewTravelingCardbeissuedtosuchmemberuntilhisindebtednessispaid.Sec.13.AmemberadmittedonaTravelingCardshall

notvoteonquestionsofagreement,troubleorwages,un-til six (6)months after his card has been accepted, norshallhebepermitted tovote in theL.U.electionunlesshehasbeenamemberinthatL.U.sixty(60)dayspriortotheelection.ThissectionshallnotbeapplicabletomembersofL.U.’s

affiliatedwithRailroadCouncils or SystemCouncilswhoareemployedbyasingleemployerandwhotransferbetweenL.U.’swithinthecouncil,provided,however,anysuchmem-bermusthavebeenamemberincontinuousgoodstandinginoneof theL.U.’saffiliatedwithsuchcouncilforsix(6)monthsorsixty(60)daysasspecifiedabove.

ARTICLE XXIV WITHDRAWAL CARDS–

PARTICIPATING AND HONORARY

Sec.1.Anymemberwhobecomesanelectricalemployer,apartnerinanelectricalemployingconcern,ageneralman-ager,oranyothermanagerialposition,orwhoretiresfromhistrade,mayapplytotheF.S.forawithdrawalcard.Itshallrequireamajorityvoteatameetingtograntsuchcard.ButtheL.U.hastherighttorequiresuchamembertotakeoutawithdrawalcardifitsodecides.Sec.2.AnymemberreceivingaParticipatingWithdrawal

Cardanddesiring tomaintainhis standing in the I.B.E.W.shalldeposittheduplicateportionofthewithdrawalcardinthe I.O.andpayhispercapita inadvance to the I.S.T., aswellasanyI.O.assessments,andheshallbeentitledtoallbenefitsoftheI.B.E.W.aslongashecomplieswithitslawsandmaintainshiscontinuousgoodstanding.TheParticipat-ingWithdrawalCardshallnotentitletheholdertoanyL.U.benefitsoradmittancetoanyL.U.meeting.Uponreturningtothetrade,therecipientofthiscardshalldeposititintheL.U. which issued it. No member on ParticipatingWith- drawalCardisentitledtonoticeofanypaymentsduetheI.O.Sec. 3.Anymember not desiring tomaintain his stand-

ingwhoretiresfromthetradeorisunemployed,orinsuchothercasesasmaybedecidedbytheL.U.,maybeissuedanhonorarywithdrawalcardprovidedduesarepaidforthepre-viousmonthorthecurrentmonthiftheapplicationismadeafterthe15thofsuchmonth.Upon returning to the trade, or again becoming em-

ployed, and having complied with this article, he shalldeposithiswithdrawalcardintheL.U.thatissueditand

continuemembershipbypaying thecurrentmonthdues.No new initiation fee is necessary, except that any “A”member shallpay the twodollar ($2.00) feeas requiredinArticleIX.

Sec.4.“BA”membersnotemployedunderthejurisdic-tionof theL.U. for at least amonth canbe shownasonhonorarywithdrawalwithout actual issuance of the card,unless theL.U.bylawsprovideotherwise.Officersof theL.U.arenotentitledtowithdrawalstatuswithoutforfeitureoftheiroffice.

However, a “BA”member, shownasonhonorarywith-drawaloronHonoraryWithdrawalCardnotexceedingtwo(2)months,mayretainhiscontinuousgoodstandingintheL.U.,andeligibilityforlocalunionofficeandasdelegatetothe I.C., by paying dues for themonths of unemploymentbeforebecomingindebtedtohisL.U.forthree(3)months’dueshadhebeenemployed.

Sec.5.Thevalidityofanywithdrawalcardshallbede-pendentuponthegoodconductofthemember.Itcanbean-nulledby anyL.U.orby the I.P. forviolationof the lawsoftheI.B.E.W.,orthebylawsandrulesofanyL.U.,orforworkingwithoremployingnonmembersoftheI.B.E.W.toperformelectricalwork,orforanyactionoftheholderdet-rimentaltotheinterestsoftheI.B.E.W.MembershipintheI.B.E.W.isautomaticallyterminateduponannulmentofanywithdrawalcard.

Amemberonawithdrawalcardmaybesubjecttocharges,trialandappropriatepenaltyinaccordancewithprovisionsofthisConstitution.

ARTICLE XXV MISCONDUCT, OFFENSES

AND PENALTIES

Sec.1.Anymembermaybepenalizedforcommittinganyoneormoreofthefollowingoffenses:(a)ViolationofanyprovisionofthisConstitutionandtherules

herein,orthebylaws,workingagreements,orrulesofaL.U.(b)Havingknowledgeoftheviolationofanyprovisionof

thisConstitution,orthebylawsorrulesofaL.U.,yetfailingtofile charges against the offender or to notify the properofficersoftheL.U.(c)Obtainingmembershipthroughfraudulentmeansorby

misrepresentation,eitheronthepartofthememberhimselforothersinterested.(d)Engaginginactivitiesdesignedtobringaboutawith-

drawalorsecessionfromtheI.B.E.W.ofanyL.U.orofanymemberorgroupofmembers,ortocausedualunionismorschismwithintheI.B.E.W.(e)Engaginginanyactoractswhicharecontrarytothe

member’s responsibility toward the I.B.E.W., or anyof itsL.U.’s,asaninstitution,orwhichinterferewiththeperfor-mancebytheI.B.E.W.oraL.U.withitslegalorcontractualobligations.(f)Workingfor,oronbehalfof,anyemployer,employer

supportedorganization,orotherunion,ortherepresentativesofanyoftheforegoing,whosepositionisadverseordetri-mentaltotheI.B.E.W.(g)WrongingamemberoftheI.B.E.W.byanyactoracts

ormeetingofitsExecutiveBoard,usingabusivelanguage,creatingorparticipatinginanydisturbance,drinkingintoxi-cants,orbeingintoxicated,inoraroundtheofficeorhead-quartersofaL.U.(j)MakingknownthebusinessofaL.U.,directlyorindi-

rectly,toanyemployer,employersupportedorganization,orotherunion,ortotherepresentativesofanyoftheforegoing.(k)Fraudulentlyreceivingormisappropriatinganymon-

eysofaL.U.ortheI.B.E.W.(l)Causingorengaginginunauthorizedworkstoppagesor

tion,properlypreparedassetforthabove,shallnotbeinvio-lationofArticleXVI,Section20.(n)Solicitingadvertisingforyearbooks,programs,etc.,

whenthenameofaL.U.ortheI.B.E.W.,orthenamesorpictures of L.U. or International Officers appear in suchmatterwithoutconsentoftheI.P.Anymember,anyofficerorrepresentativeofanyL.U.,orotherorganizationcomingunder the I.B.E.W.’s jurisdiction, shall be held liable forallowingindividualsoragenciestosolicitsuchadvertisingwithoutconsentoftheI.P.orforinanywayviolatingthisprovision.(o)Failuretoinstallordohisworkinasafe,workmanlike

manner,orleavingworkinaconditionthatmayendangerthelivesorpropertyofothers,orprovingunableorunfitmen-tally,tolearnproperlyhistrade.(p)Causing a stoppage ofwork because of any alleged

grievanceordisputewithouthavingconsentoftheL.U.oritsproperofficers.(q)Workingforanyindividualorcompanydeclaredindif-

ficultywithaL.U.ortheI.B.E.W.,inaccordancewiththisConstitution.(r)Willfullycommittingfraudinconnectionwithobtain-

ingorfurnishingcredentialsfordelegatestotheI.C.orbeingconnectedwithanyfraudinvotingduringtheI.C.

(s)Allowinganotherpersontouse,oralteringinanyman-ner,hismembershipcard,receipt,orotherevidenceofmem-bershipintheI.B.E.W.

Anymemberconvictedofanyoneormoreoftheabovenamedoffensesmaybeassessedorsuspended,orboth,orexpelled.

If an officer or representative of a L.U. is convicted ofanyoneormoreof the abovenamedoffenses, hemayberemovedfromofficeorposition,orassessedorsuspended,orboth,orexpelled.

Ifamember,orofficerorrepresentativeofaL.U.,isas-sessedandfailstopaytheassessment,alawsuitmaybefiledtocollecttheunpaidassessment.

Charges and Trials

Sec.2.Allcharges,exceptagainstofficersandrepresenta-tivesofL.U.’s,shallbeheardandtriedbytheL.U.ExecutiveBoardwhichshallactasthetrialboardinaccordancewithArticleXVII.Amajorityvoteoftheboardshallbesufficientfordecisionandsentence.

(ThissectionshallnotbeconstruedtoconflictwithpoweroftheI.P.ortheI.E.C.totakeactionincertaincasesaspro-videdinArticlesIVandVIII.)

Sec.3.Allchargesagainstamemberormembersmustbepresentedinwriting,signedbythechargingparty,andspec-ify thesectionorsectionsof thisConstitution, thebylaws,rulesorworkingagreementallegedlyviolated.Thechargesmuststate theactoractsconsidered tobe inviolation, in-cludingapproximaterelevantdatesorplaces.

Sec.4.ChargesagainstmembersmustbesubmittedtotheR.S.oftheL.U.inwhosejurisdictiontheallegedactoractstookplacewithin sixty (60) daysof the time the chargingparty first became aware, or reasonably should have beenaware,oftheallegedactoracts.ThechargesshallbereadoutbutnotdiscussedatthenextregularmeetingoftheL.U.followingthefilingof thecharges.TheR.S.shall immedi-atelysendacopyofsuchchargestotheaccusedmemberathis last known address togetherwithwritten notice of thetimeandplaceheshallappearbeforethetrialboard.Sec.5.Thetrialboardshallproceedwiththecasenotlater

thanfortyfive(45)daysfromthedatethechargeswerereadattheL.U.meetingorExecutiveBoardmeeting.Theboardshallgranta reasonabledelay to theaccusedwhen it feelsthefactsorcircumstanceswarrantsuchadelay.Theaccusedshallbegrantedafairandimpartialtrial.Hemust,uponre-quest,beallowedanactiveI.B.E.W.memberingoodstand-ingtorepresenthim.Sec.6.Whenthetrialboardhasreachedadecision,itshall

report itsfindings,andsentence, ifany, to thenextregularmeetingoftheL.U.SuchreportoractionoftheboardshallnotbediscussedoracteduponbytheL.U.TheactionofthetrialboardshallbeconsideredtheactionoftheL.U.,andthereportoftheboardshallconcludethecase,orcases,exceptfortheaccusedhavingtherighttoappealtotheI.V.P.,thentotheI.P., thentotheI.E.C.andthentotheI.C.However,theboardmayreopenandreconsideranycaseorcaseswhenitfeelsthefactsorcircumstancesjustifydoingsoanytimewithinthirty(30)daysfromthedatethedecisionwasren-dered.The board shall reopen any case or caseswhen di-rectedtodosobytheI.V.P.ortheI.P.

Sec.7. If theaccusedwillfully fails to stand trial—orat-temptstoevadetrial—thetrialboardshallproceedtohearanddeterminethecasejustasthoughtheaccusedwerepresent.

Trials of Officers and RepresentativesSec. 8.All charges against an officer, examining board

member, steward or representative of a L.U.must be pre-sentedinwriting,signedbythechargingparty,andspecifythesectionorsectionsofthisConstitution,thebylaws,rulesorworkingagreementviolated.Thechargesmuststate theactoractsconsideredtobeinviolation, includingapprox-imate relevant dates andplaces; andmust bemadewithinsixty (60)daysof the time thechargingpartyfirstbecameaware,orreasonablyshouldhavebeenaware,oftheallegedactoracts.SuchchargesmustbefiledwiththeI.V.P.inwhosedistrict

theL.U.islocatedwheretheallegedactoractstookplace,orasdirectedby the I.P., shouldmore thanonedistrictbeinvolved.(Thissectionshallnotbeconstruedtoconflictwithpower

oftheI.P.ortheI.E.C.totakeactionincertaincasesaspro-videdinArticlesIVandVIII.)Sec.9.TheI.V.P.shallpassuponanddeterminesuchcas-

es,with the accusedhaving the right of appeal to the I.P.,then to the I.E.C., then to the I.C.Any such appeal, to berecognized,mustbemadewithinthirty(30)daysfromthedateofthedecisionappealedfrom.NoappealfromtheI.V.P.shallsuspendoperationofanydecision.Sec.10.TheI.V.P.mayrequirethatallevidence,testimo-

ny,orstatementsbesubmittedtohiminwritingforreview,

thereisnewevidenceortestimony,factsorcircumstances,whichhefeelsaresufficienttojustifysuchbeingdone.

Appeals

Sec.12.Anymemberpenalizedorotherwisedisciplinedby anyL.U. trial boardmay appeal to the I.V.P. any timewithinforty-five(45)daysafterthedateoftheactionoftheL.U.trialboard.AchargingpartymaynotappealaL.U.trialboarddecision.AcopyofanyappealmustbefiledwiththeL.U.Sec.13.Noappealforrevocationofanassessmentshall

be recognizedunless thememberhasfirstpaid theassess-ment,whichhecandounderprotest.Whentheassessmentexceedsfiftydollars($50.00),paymentsofnotlessthanfortydollars($40.00)inmonthlyinstallmentsmustbemadeuntiltheassessmentispaidoruntilafinaldecisionontheappealismade,whicheveroccursfirst.Thefirstmonthlyinstallmentmustbemadewithinfifteen(15)daysfromthedateofthedecisionrenderedandmonthlyinstallmentscontinuedthere-afteror the appealwill notbe considered.AmemberwhohasbeenassessedbyaL.U.trialboard,whoisappealingtheassessment andmaking the requiredmonthly payments inaccordancewiththissection,retainshisgoodstandingstatusuntiltheappealprocessinthisArticlehasbeenexhausted.Sec.14.WhenadecisionhasbeenrenderedbytheI.V.P.it

shallbecomeeffectiveimmediately.

Sec.15.NoappealsfromdecisionsoftheI.V.P.,orfromthe I.P., or from the I.E.C., shall be recognized unless thepartyorpartiesappealinghavecompliedwith thedecisionfromwhichtheyhaveappealed.However,thissectionmaybewaivedbythepartymakingthedecisionifgoodandsuf-ficientreasonsarefurnishedandheisrequestedtodoso.Sec.16.Appeals to the I.P.and to the I.E.C.,and to the

Convention, to be considered,must bemadewithin thirty(30)daysfromthedateofthedecisionappealedfrom.(Ap-pealstotheI.E.C.andtoConventionsmustbefiledwiththeI.S.T.)Ifnoappealismadewithinthirty(30)daysfromthedate that any decision is rendered, such decisions shall beconsideredfinal.Sec. 17.When an appeal is taken above the I.V.P., only

theevidence submitted in theoriginal caseof appeal shallbeconsidered.In caseswhere parties claim they have new and impor-

tantevidenceaffectingacaseinwhichadecisionhasbeenrendered,theymaysubmitthiswithinthirty(30)daystotheauthoritywhorenderedthefirstdecision,witharequestthatthecasebereopened.Suchauthorityshalldecidewhetherthemattersubmittedjustifiesreopeningthecase.

ARTICLE XXVI JURISDICTION

Sec.1.ThecharterissuedthisorganizationbytheAmeri-canFederationofLabor states that itwasgranted“for thepurposeofathoroughorganizationofthetrade.”Theremust be a systematizedknowledgeof the science

of electricity in all of its various applications of electron

transferandelectromagnetism.Thisrequiresathoroughun-derstandingofthemanymeansofproduction,transference,control and utilization of electricity and of the foundationorpreparatorywork tobeperformed. It isquitenecessary,therefore,thatthejurisdictionoftheI.B.E.W.berecognizedasonecovering:(a) The manufacture, assembling, construction, instal-

lation or erection, repair or maintenance of all materials,equipment,apparatusandappliancesrequiredintheproduc-tionofelectricityanditseffects.(b)Theoperation,inspectionandsupervisionofallelectri-

cal equipment, apparatus, appliances, or devices bywhichthe energy known as electricity is generated, utilized andcontrolled.(c) The manufacture, assembling, construction, installa-

tionorerection,repairormaintenanceofallmaterials,equip-ment,apparatusandappliancesrequiredinthetransmissionofdata,voice,sound,videoandotheremergingtechnologies(includingfiberoptics,highspeeddatacable,etc.).Sec. 2. Electricalworkers shall be organized under five

generalbranchesoftheI.B.E.W.,namely:OutsideandUtil-ity Workers; Inside Electrical Workers; CommunicationsWorkers;RailroadElectricalWorkers;andElectricalManu-facturingWorkers.Sec.3.KeepinginmindprogressfortheI.B.E.W.,andthat

allelectricalworkbedonebyitsmembers,itisimpracticaltoclassifyordividejurisdictionofworkineverydetailbetweenthevariousbranchesinthisorganizationtomeetallsituationsin all localities. Therefore, the classifications and divisionsoutlinedbelowarenecessarilyofageneralnature,andL.U.’s

whosejurisdictionwithotherL.U.’softheI.B.E.W.,orwhoseagreementsareharmoniousandconducivetotheprogressoftheI.B.E.W.,shallnotbedisturbed.Butwhenharmonyandprogressdonotprevail,orwhendisputesarise,theI.P.shalldeterminewhatL.U.willdocertainworkorjobs,consistentwiththeprogressandbestinterestsoftheI.B.E.W.inobtain-ingandcontrollingtheworkinquestion.

Outside and Utility Workers

nomessengerorguywire isnecessary for support. Instal-lation,construction,inspection,operation,maintenanceandrepair of all electrical work in isolated plants and withinproperty lines of any given property, and beginning at thesecondarysideofthetransformer,exceptlineworkconsist-ingofpolesandtowers,includingwiresorcablesandotherapparatussupportedtherefromandexceptalloutdoorsub-stationsasdefinedinSec.4hereof.Whenaerialwiresor cablesareused toprovideelectric

currentforbuildingsorstructureswithinthepropertylinesofanygivenproperty,theinsidemen’sjurisdictionshallstartimmediatelyafterthefirstpointofattachmentofsuchaerialwiresorcablestosuchbuildingsorstructures.Renewableelectricalenergysourcessuchassolarphoto-

Communications Workers

Sec. 6. These shall include the following divisions andclassifications:

Sec.7.Railroadelectricalworkersarethoseemployedbyrailroadcompanies,includingwiremen,technicians,fixturemen, armature winders, meter men, electrical inspectors,

stances shall they do any construction or reconstructionworkwherebuilding tradesmechanics aredoingwork inconnectionwithit.AnydisputewillbereferredtotheI.P.fordecision.

Electrical Manufacturing Workers

Sec.8.Theseshall include:Allemployeesofcompaniesengagedinthemanufactureofproducts,components,equip-ment, apparatus,machines,devicesandappliancesused inthe production, transmission, conversion, control, distribu-tion,measurementandutilizationofelectricity.Theyshallhavejurisdictionoverthefollowing:Allworkperformedbysuchemployees in themanufac-

ture,testing,rebuildingandrepairoftheseproductsonthepremisesofthecompany.Sec.9.Allgovernmentworkersmaybeorganizedunder

anyoftheabovegeneralbranchesoftheI.B.E.W.,asstatedinSection2.

ARTICLE XXVII AMENDMENTS TO

THIS CONSTITUTION

Sec.1.ThisConstitutionandtheruleshereincanbeamend-edinthreeways:(a) By referendum, on petition of fifteen (15) L.U.’s of

whichnotwo(2)L.U.’smaybefromthesamestateorprov-ince. Petitionsmay be submitted at any time, however, inConventionyears, allpetitions for referendummustbe re-ceivedprior toMarch1st.Allpetitionsmustbe submittedtotheI.S.T.Proposedamendments,beforebeingsubmittedbytheI.S.T.forvote,musthavetheapprovaloftheI.E.C.AvoteonanyproposaltakenbyreferendumshallbereturnedtotheI.S.T.byeachL.U.voting,withinsixty(60)daysfromthedatesubmitted.Amajorityofthosevotingshallbenec-essarytosustainanyproposal.(L.U.’smaycastthevoteoftheirmembers, if theysodecide.)AfterreceivingfromtheL.U.’sarecordofvotescastfororagainstanyproposal,theI.S.T. shallprepare forpublication in thenext issueof theI.B.E.W.’sofficialmonthlypublicationareportoftheexactvotesforandagainsttheproposedamendment.Amendmentsadopted by referendum shall become effective thirty (30)daysafteradoption.(b)IftheI.E.C.deemsanamendmentisnecessary,itmay

havetheI.S.T.submitthesametotheL.U.’sforvote.(c)Bythemajorityvoterepresentedataregularsessionof

theI.C.,amendmentsadoptedbytheI.C.shallbecomeeffec-tivethirty(30)daysafteradoption.Sec.2.The I.P. shall appoint aLawCommitteeconsist-

ingofeleven(11)delegateselectedtotheI.C.,atleastonefromeachI.V.P.District.TheseshallmeetintheI.O.fifteen

L.U.’sandrecommendationsofInternationalOfficersshallbeconsidered.AllthesemustbesubmittedtotheI.S.T.fortyfive(45)dayspriortotheopeningoftheI.C.The compensation of members of the Law Committee

shallbefiftydollars($50.00)adayandreimbursementforactualexpenses.ThisshallceasethedaytheI.C.opens.Sec.3.IfanysectionofthisConstitutionorpart thereof

shouldbeheldinoperativeorinvalidbyatribunalofcom-petentjurisdiction,theremainderofthisConstitution,ortheapplicationofsaidsectionorpartthereoftopersonsandcir-cumstances,other than those towhich ithasbeenheld in-valid,shallnotbeaffectedthereby.TheI.E.C.shallhavetheauthoritytosuspendtheoperation

ofsuchinvalidsectionorpartthereofintheeventitisdeclaredinoperativeorinvalidbyatribunalofcompetentjurisdiction.Itisfurtherauthorizedinthosecircumstancestosubstituteanappropriateandlegalsectionfortheinvalidorinoperativesec-tion.Thesaidrevisedsectionshallbereportedtothenextsuc-ceedingconventionforitsapprovalordisapproval.The I.E.C. is also empowered to direct the I.S.T. in his

compilation and editing of the new Constitution to makesuchchangesasarenecessarytocorrelatethesubjectmatter.Sec.4.This Constitution was adopted at St. Louis, Mo.,
