CITY COUNCIL AGENDA Meeting Date: 07/07/2014 TITLE: Main Street/Rodeo Drive Lot Line Adjustment - Mike Ray Responsible Staff: Mike Ray Backup Material: Backup material attached Digital Presentation: Yes Other Resources: Other Non-City Resources: Information DESCRIPTION: On February 18th, 2014 Council approved a lot division for a .42 acre parcel in the southwest corner of Lot 1 of the Re-plat of Lot 1, Block 1 of the Park View Estates Addition. The applicant of the original lot division is now proposing to relocate the newly created parcel to the northwest corner of Lot 1 and has submitted a lot line adjustment request in order to accomplish this. The proposed lot line adjustment will establish a .41 acre parcel and include a 26 ft. wide public access/utility easement adjacent to the east of the parcel which provides vehicular access to the parcel from Rodeo Drive. Lot 1 of the Re-plat of Lot 1, Block 1 of the Park View Estates Addition is currently undeveloped and located within the MB Zone where there is no minimum lot width or minimum lot area requirements for commercial uses. The two reconfigured parcels will meet all zoning requirements for parcels located in the MB Zone. As part of the original Park View Estates Subdivision and the recent Re-plat of Lot 1, Block 1 of the Park View Estates Addition, a condition was contained within the Development Agreements that stated that a Traffic Engineering Study (TES) shall be required prior to the Developer developing any portion of Lot 1 of the Re-plat of Lot 1, Block 1 of the Park View Estates Addition. The agreement further states that the TES shall be in accordance with Idaho Transportation Department standards and that ITD shall review and approve such study before the issuance of any building permit for any portion of Lot 1 of the Re-plat of Lot 1, Block 1 of the Park View Estates Addition. Since the initiation of the TES is the application of a building permit on any portion of Lot 1, the TES will need to be conducted and approved prior to the issuance of any building permits for any portion of Lot 1. The Public Works/Finance Committee reviewed this item on June 23, 2014 and recommended it for approval with the condition that a Traffic Engineering Study be done. STAFF RECOMMENDATION: Approve the lot line adjustment request with the following condition: The applicant shall complete a Traffic Engineering Study prior to the issuance of building permits for the newly relocated .41 acre lot or the remnant of Lot 1 of the re-plat of Lot 1, Block 1 of the Park View Estates Addition. 1.
