SUBJ: Highlights from July 8, 1994 JDV Visit to Stratford

As a result of the July 8, 1994 JDV visit to Stratford and recent developments at the site, and as discussed at the July 11th Raymark Team meeting:

Ira will arrange a meeting between the RA and Craig Smith, president of Raytech, to discuss a number of issues which will have a significant impact on the fate of the project, i.e., overall project schedule and goals, RFI/CMS schedule, access to the facility, municipal and residential liability, and potential building demolition. Ira will set up a premeeting between Bob Moody and JDV to make sure we address the key issues in the Craig Smith meeting.

Don Berger will set up a management meeting involving WMD, ESD and DEP to improve coordination between EPA and the State. The meeting will be designed to make sure that all of the senior managers are on the same page and will include Bob Moore and possibly Tim Keeney. The meeting will review the schedule and implications of excavating the Raymark waste at Wooster School, the responsibilities of the state in disposal of the waste at the Raymark facility, and the state role in the negotiations with Raymark.

At the July 11th Raymark Team meeting we also reviewed the commitments John made during his visit to Stratford. The following is a summary of those commitments and follow-up activities which the Raymark Team felt would be needed in order to ensure the commitments are achieved:

1. Agreement that the Raymark waste at the Wooster Jr. High School will be taken back to the Raymark Facility in calendar year 1995.

Commitment: JDV supported the idea of taking the Wooster School waste (12K to 20K cubic yards) back to Raymark in summer of 1995 based on the strong preferences of the State DEP and the Town.

He stated this at the lunch meeting with Tim Keeney, Ed Parker, Mark Barnhart, Elaine O'Keefe, Andrea Boisevain, David Mclntyre, and others. JDV's support was given with the understanding that this will not represent a precedent for other municipal sites, that the state will fund the excavation and shipment ($1.5 million), and that the state and the Town will interact with Raymark on access and potential liability issues.

Follow-up Activities: The Raymark team has recommended we evaluate the impact of this decision by conducting the following analysis:

Develop a complete accounting of the sites considered to be "municipal sites" as soon as possible.

Develop the "mandatory attendance" rationale promoted by the state and town and any other possible rationales for distin­guishing Wooster School from other municipal sites and determine if the resulting rationale is legally and techni­cally defensible. Evaluate the rationale in terms of its potential impact on future removal actions.

- Evaluate the schedule and secondary impacts (e.g., truck traffic) of the proposed excavation and transhipment of the Wooster School waste on other activities at the Raymark facility (building demo, residential transhipment, onsite remedy implementation, etc.). Mike Hill will call the state to obtain a copy of the M&E FS to obtain information on time frames, volumes, and materials handling information.

Develop a recommendation on the form, type and schedule for agreements to be developed among the state, Town and EPA regarding the collective expectations for the management of the "Municipal Sites".

2. Address local concerns on the negative impact of staff turnover.

JDV also said during the lunch meeting that EPA would ensure that any future transitions of Raymark Team personnel would involve complete transfer of information to ensure continuity. Dave Mclntyre believes the local concerns can be addressed by careful management of any transition process. The shift to the USACE may also result in less turnover in the future.

3. EPA will select a remedy for the Raymark Industries site in March of 1995

Commitment: A ROD will be signed in March 1995 which will be the key to resolving the Raymark obligations and initiating efforts to promote the beneficial reuse of the facility.

Follow-up Activities:

To meet this schedule Raymark must deliver the RFI/CMS by August 1, 1994. The most recent information indicates this may not happen. We will ask JDV to address this issue in his proposed meetings with Bob Moody and Craig Smith.

Mike Jasinski will prepare an alternative schedule for the conducting the RIFS and signing the ROD if the project becomes an EPA fund lead RIFS.

4. Residents will not pay for the cleanup or be required to defend themselves from contribution actions

Commitment: John stated at the morning meeting with Congress-woman DeLauro, Tim Keeney and Ed Parker, local officials and representatives, that residents will be held harmless from any third party suits.

Follow-up Activities:

By August 22, 1994, Kathleen will prepare an internal options paper for protecting residents from third party contribution actions and possible "comfort letters" to facilitate access to residential properties.

By August 30, 1994, the Raymark Team will develop options for JDV consideration.

We will ask JDV to express his concerns on the liability issues at the proposed meeting with Craig Smith, and to request from Raymark written assurances on this matter.

5. EPA will develop a position on the Town's Liability sometime between Sept 1, 1994 and Oct 10, 1994

Commitment: John stated during the morning meeting with Congress-woman DeLauro et al that EPA would establish the liability and expectations for the Town's participation in implementing the remedies at municipal sites prior to Oct 10, 1994.

Follow-up Activities:

ORC will review and evaluate the Town's 104 (e) response, determine if a follow-up 104 (e) is needed and issue it if necessary, and solicit rapid turnaround from the Town.

By August 30, 1994, assess and evaluate the action levels and basis of removal activity at municipal sites to establish the extent to which removal funds may be expended at these sites.

By September 22, 1994, assess and evaluate in-kind contributions and what is "fair" using the proposed Superfund Reform Act as a reference point.

6. The shift to the USACE will increase the likelihood of hiring local labor to implement the remedies

Commitment: Local representatives requested during the morning meeting that EPA and DEP use local contractors to the maximum extent possible. DEP and EPA responses were that this would be done.

Follow-up Activity:

None for EPA. The USACE can do this under their subcontracting procedures. Dave Mclntyre told Bob Hunt, USACE, that the issue came up at the July 8th meeting.

7. Final NPL Listing will occur in fall of 1995 coincidental with an RA start at the Raymark Facility.

Commitment: The issue of what is included as part of the NPL site will be resolved coincidental with the request for RA funds.

Follow-up Activities:

Mike Jasinski will set up a meeting with Carl Deloi, Ira Leighton, Dave Mclntyre, Don Berger and the site assessment staff during the week of July 25th to review the potential timing and strategy for preparing the final listing.

Dave Mclntyre will work with Kathleen to amend the existing Action Memo to justify the use of the consistency waiver on the grounds that the residential wastes will be sent to the Raymark facility which will be an NPL site.
